Eric Swalwell was Nancy Pelosi’s made man, the golden child of San Francisco’s rotten machine politics.Yes the ramifications are indeed national and so Swalwell had to go, lest the Democrats lose more than just a statehouse and control of one state, albeit a massive and important one.
Today he’s roadkill, his name erased from the sign outside his congressional office, vultures feasting on his remains.
Swalwell’s clinical political eradication this week tells you everything about the Democratic Party and how ruthlessly and efficiently they will move to keep to power in the state they have controlled for 15 years and run into the ground.
California, our most populous and richest state, is the engine of their vast patronage system, fueled in part by illegal migration and social services fraud that has ripped tens, perhaps hundreds, of billions of dollars off the taxpayer and recycled it through unions and “grassroots” donations back into the party.
That’s why Dr. Mehmet Oz, Administrator of the Centers for Medicare & Medicaid Services, calls California the “kingdom of fraud” as he confronts massive organized ripoffs of Medicaid, home health services and hospice care... Illegal migration, turbocharged under Joe Biden by his Homeland Security secretary, California hit man Alejandro Mayorkas, also served the machine well, by artificially inflating the state’s census counts and enabling voter fraud.
The census inflation led to extra House seats for California and more electoral votes, and thus more power in presidential elections.
In return, the machine sponsors and protects useful buffoons like Swalwell, who was one of “Pelosi’s boys” from the minute he threw his hat into national politics as a 31-year-old San Francisco councilman with a mischievous grin and a lackluster legal career behind him.
Sadly the cancer of Democrat Leftism has metastasized all over the place, and while California, regardless of its electoral system is most likely a lost cause barring some sea change in the societal/political landscape that might happen (I am not holding my breath), the Democrats have a very deep and dark bench, including the absolutely horrendous Tom Steyer. Meanwhile 3000 miles or so to the east, we have this blonde beast to contend with, who likely has national aspirations for national socialism as this trio of links indicates
https://freebeacon.com/campus/moderate-governor-abigail-spanberger-signs-bill-forcing-virginia-schools-to-consider-restorative-disciplinary-practices-before-suspending-students/ 'Moderate' Governor Abigail Spanberger Signs Bill Forcing Virginia Schools To Consider 'Restorative Disciplinary Practices' Before Suspending Students
Such practices include a 'restorative circle,' a 'centuries-old indigenous practice' in which participants sit in a circle to discuss their actionsThen... She goes Gun Crazy, Quelle Surprise?!
The DOJ’s warning signals potential federal litigation, challenging the constitutionality of the Virginia Democrats’ proposed laws. Pro-Second Amendment critics of the legislation argue the measures could restrict firearms commonly used for lawful purposes, while proponents of gun control, including Spanberger, have attempted to frame the legislation as necessary to address gun violence.Turd and finally...
By signing this compact, Spanberger has agreed to hand Virginia’s 13 electoral votes to whichever presidential ticket wins the national popular vote. Now you can see how crucial it is for the Dems that there isn't even a sliver of an iota of a scintilla of a chance that they lose control of California. But then again, if more states follow VIrginia in handing over their electoral votes to the popular vote winner thus de facto destroying the Electoral College, that's ball game, even if the Golden State should flip Red. Assuming that a GOP candidate even wins the popular vote ever again. On that cheery note... Have a great day!
And lastly, a quick shout-out and a huge thank you for your continued support in hitting our tip jar. It truly is appreciated more than you can know.

Rose alleges that Perry rubbed up on her with her dirty vag.
Police in Australia are investigating after Ruby Rose accused Katy Perry of sexual assault. Victoria Police confirmed the investigation in a statement shared with USA TODAY on April 15, days after Rose claimed the singer sexually assaulted her almost two decades ago. A representative for Perry has denied the "reckless" allegations. "Melbourne Sexual Offences and Child Abuse Investigation Team (SOCIT) detectives are investigating [an alleged] historical sexual assault that occurred in Melbourne in 2010," Victoria Police said in a statement. "Police have been told the incident occurred at a licensed premises in Melbourne's CBD," or the Australian city's central business district, home to bars, nightclubs and more. "As the investigation remains ongoing, it would be inappropriate to comment further at this stage," the statement concluded. ... "I was only in my early 20s. I'm now 40. It has taken almost 2 decades to say this publicly," she wrote. "Though I am so grateful to have made it long enough to find my voice, it just shows how much of an impact trauma and sexual assault takes. Thank you for seeing me." The "Batwoman" actress also said she planned to go to the police "to see if any of my experiences can be investigated." She later posted, "I did it." "The allegations being circulated on social media by Ruby Rose about Katy Perry are not only categorically false, they are dangerous reckless lies," the statement said. "Ms. Rose has a well-documented history of making serious public allegations on social media against various individuals, claims that have repeatedly been denied by those named."
Berkeley campus radicals demand the removal of Trump "by any means necessary."
You have probably been enraged by the phenomenon of young thugs-- usually black, Muslim, or immigrant, or all three -- engaging in acts of harassment and intimidation against random law-abiding citizens and then posting videos of these crimes on to social media, where they get plaudits and clicks for this psychopathic behavior. The latest "trend" is to touch white strangers' hair without permission. So funny! There was one especially noisome criminal called "Johnny Somali" who made money as a Harassment Entrepreneur. I guess he got bored of upsetting white people and took his social terrorism act... to South Korea. Whoops. Low-IQ gonna Low-IQ.
A left-wing activist group at the University of California, Berkeley recently staged a protest opposing the war in Iran, declaring that "Trump must go now by any means necessary." The demonstration, held on April 7, was advertised on social media as an "Emergency Protest" against the administration's military actions in Iran, along with purported "fascist ethnic cleansing" in the Middle East and United States and issues related to immigration. The group appeared to call for a military mutiny in the post, writing, "The American joint chiefs, officers and soldiers must disobey Trump's illegal orders to commit war crimes against the Iranian people!" Campus Reform was present at the protest and captured exclusive video. The organizing group, known as By Any Means Necessary (BAMN), describes itself as a "Coalition to Defend Affirmative Action, Integration and Immigration Rights and Fight for Equality By Any Means Necessary." The organization has committed itself to "defeating Donald Trump and his fascist movement by any means necessary."
During the protest, demonstrators displayed signs with messages such as "Stop Trump's fascist police state By Any Means Necessary," while a number of participants delivered speeches criticizing the president and federal immigration authorities. "Trump is a fascist, the whole Trump regime is a fascist, ICE is a fascist," said one speaker who identified himself only as Ryan, adding that activists should continue demonstrations "over and over again until Trump is out," UC Berkeley student Frances Cramer, who observed the protest, told Campus Reform that the slogan raised concerns. "I immediately thought the sign called for violence or demonstrated ill intent," Cramer said.
Legal YouTuber "Legal Mindset" was so annoyed by this anti-civilizational activist's antics that he set up a "Somali Conviction Team" to give evidence and encouragement to South Korean prosecutors. I imagine one of his tasks was to reassure prosecutors that no, no one in the west is going to be outraged at South Korea jailing a foreigner, we're all sick to death of these morlocks too. He does a victory lap in this video, which begins with the Low-IQ Somali guaranteeing he will not spend a single night in Korean prison. Unfortunately, the Korean judge got cold feet and did not imprison him for the three years of prison labor the prosecutors sought. But six months, 20 days of prison labor -- probably the first day of work he's done in his life -- will fix his wagon a bit. Speaking of foreign terrorists who need to be imprisoned: The Democrat Party is executing a full-court press to normalize and mainstream the openly pro-terrorist, "The US deserved 9/11" Islamis Hasan Piker:
US internet 'troll' Johnny Somali sentenced to South Korea labor prison for public nuisance -- months after comparing himself to Otto Warmbier
A controversial American YouTuber was sentenced to half a year in a South Korean labor prison for his nuisance behavior, including posting a video of himself crudely dancing on a statue honoring World War II sex slaves. Ramsey Khalid Ismael, a self-proclaimed internet "troll" known as Johnny Somali online, was tossed into the specialized prison on Wednesday, the Korea Herald reported. Ismael, 25, had provoked citizens in South Korea by singing the North Korean national anthem, spilled noodles inside a convenience store, got into several heated arguments with strangers, and degraded the solemn "Statue of Peace," all stunts he shared on YouTube. "I am the Otto Warmbier of South Korea. A political prisoner wrongfully and falsely accused and made into a scapegoat by a tyrannical government. The truth will come to light soon," Ismael wrote on X in January, referencing college student Otto Warmbier, who became a North Korean prisoner in 2016 before he was released in a vegetative state and later died. Ismael was indicted by the Seoul Western District Court in November on charges of obstruction of business and violations of minor public order laws.
"The defendant repeatedly committed crimes against unspecified members of the public to generate profit via YouTube and distributed the content in disregard of Korean law," the court said during the trial, noting prosecutors sought a three-year prison sentence, according to the outlet. The trial, originally scheduled for March 2025, had been delayed after prosecutors added additional charges alleging Ismael shared AI-generated sexual content of him with a deepfake with a female YouTuber, the outlet reported. Ismael was deemed a flight risk and was detained immediately after his sentencing. Ismael faces 20 days of detention, is barred from working at institutions that serve minors and people with disabilities for five years, and will have to be registered as a sex offender for the same time. ... Ismael, who currently boasts a whopping 5,220 YouTube subscribers, had become notorious on the South Korean streets for his offensive stunts, including repeatedly shouting racial slurs. ... Ismael continued his romp around the Korean capital, getting into several more heated arguments and making sexually abusive and racist comments at unsuspecting passers-by. One interaction occurred inside a convenience store when Ismael and another man got into a shouting match over Israel before the two were kicked out by a store employee, but not before the streamer shouted, "Free Palestine."

Christopher Rufo reports at City Journal:
Last month, we received a report from a whistleblower who claimed that illegal aliens were staying in San Francisco's homeless shelters. Following up on the tip, we visited numerous publicly funded shelters in San Francisco, and spoke to employees and residents about their policies, sometimes through a translator. We discovered not only that the shelters were housing illegal immigrants but also that they were apparently housing a population of male-to-female "transgender" illegal aliens, who had hoped to obtain "gender-affirming care." And, to our shock, state and local governments apparently are providing it. St. Vincent De Paul's MSC-South facility is San Francisco's largest homeless shelter, and, in 2024, signed a $66 million service contract with the city. After we arrived at the front entrance, an employee wearing a do-rag and a light green polo shirt showed us around and confirmed that illegal aliens were living there. "You got a few people here from El Salvador. . . . You got a few people here from Venezuela. You got a few people here from a little bit of everywhere," he said. As a rule, he suggested, management instructed employees to refuse cooperation with federal immigration authorities. "When the ICE thing was going around, we all had a meeting, and they told us, 'We ain't letting them in.'" Among the shelter's residents was a group of Hondurans who identified as transgender. During our visit to MSC-South, whose executive director did not respond to a request for comment, we spoke with two Honduran men, "Lyca" and "Alondra," who identified as transgender women. Both indicated that the local government gave them shelter and food. Lyca, who wore long hair and red lipstick, was candid about this arrangement. He confirmed that he was an illegal immigrant and that the shelter doesn't ask questions about immigration status. "Tengo Medi-Cal," he said, referring to the state health-care program, which, under Governor Gavin Newsom, began providing "full scope" coverage to illegal aliens, which includes transgender procedures, or "gender affirming care." He said he was receiving cross-sex hormone therapy--and bore the physical signs of having done so. Alondra, a muscular man in a camouflage shirt and dyed hair tied behind his head, said he had been in the United States after claiming asylum. According to the translator, the city government had offered to pay first and second month's rent on private apartments for him and Lyca. But neither accepted the offer--in Lyca's case, because he might not be able to pay for the apartment after the second month. At the Embarcadero SAFE Navigation Center, a city-funded shelter on the eastern waterfront that did not respond to our comment request, we heard similar stories. "Jacqueline"--a self-identified "trans woman" from Mexico living at the shelter who claimed to be a lawful U.S. resident--indicated that there were illegal aliens living in the shelter. Wearing rouge on his cheeks and a low-cut red shirt, Jacqueline flaunted his large chest. He said that he had gotten transgender hormone treatments, and confirmed that he had received breast implants from the state Medi-Cal program. Though Jacqueline claimed to be a legal resident, he suggested that the state also provides implants to illegal immigrants. "Even though you're undocumented," he said, "you can get them."See the link for video interviews with these Cultural Enrichment Agents.

As many have pointed out, this brave moral voice kept absolutely stumm when Iran was killing 30-45,000 of its own people. But now he finds his voice.
And weirdly, he speaks with a vague Italian/Spanish accent, despite being an American citizen. Is he one of those weak men who put on the accent of whatever city or country they're currently standing in? Trump sure thinks he's weak:
Cynical PubliusThe pope was anti-Trump before becoming pope -- and then covered that up.
@CynicalPublius Well it looks like the Pope’s interference in American politics is still top of the news cycle, so I want to repeat something. The Democrat/Media Complex deliberately set this up so faithful Catholics would be forced to choose: Trump or your faith? That’s a false dichotomy. The Pope is speaking on politics, offering his opinion only and he is not speaking ex cathedra. You are not obligated to agree with the Pope in these matters where he speaks as an ordinary human. If you are a Catholic, you can still support Trump, and disagree with what the Pope is saying about the Iran War and American politics, and still remain true to your Catholic faith. Please do not fall for the either/or con job.

Here's video of the Boats and Ho's cruise this allegedly married "Christian" man took. More information about Rapewell's Cooze Cruise:
Regarding the woman who just accused Rapewell of drugging and raping her at the Montrose Hotel in July, 2018: FEC records confirm that Rapewell's campaign paid $360 for expenses at the Montrose Hotel in July, 2018. You can say that just because she is telling the truth about having been at that hotel on that date with Rapewell doesn't mean she was raped. Well, I'm going to apply the Rapewell standard. Remember, he personally convicted Brett Kavanaugh of rape when the accuser couldn't even remember what year the alleged rape took place in.
Sources tell us that in early September 2022, two of Swalwell's pals jetted by private plane from Las Vegas to the French Riviera town where they chartered the 200-foot Arience yacht and called Swalwell to come join them. We're told the now-former congressman arrived by commercial flight and joined them by tender on the stunning luxury craft. We're told there were some four or five men on the boat, including Swalwell, and a group of beautiful young women. One of the men is believed to be the entrepreneur Nik Richie. According to our source, one of the women, a Brit believed to be in her late teens, appeared to be romantically involved with one of the men in the group. But the five or six other women, a mix of Brits and Americans who were a little older (apparently in their 20s), seemed otherwise unacquainted both with the group and with each other. "The people on the boat were told to keep it hush-hush about Swalwell being on the trip," said a source familiar with the weeklong excursion around the French Riviera. "They were told everything stays on the boat." The former Bay Area representative had been in Congress nine years by the time of the getaway. "It didn't seem like a politician," said a source familiar with the antics aboard. "More like president of a frat house." We're told some of the women seemed to be shipped back to shore, never to return, while others arrived to "replace them."
The billionaire Democrat donor is not only done with Rapewell, but he says he's done with the entire Democrat Party as well, citing "broken trust." He had been allowing Rapewell to live there, given that Rapewell is running in California and is required to be a resident but has no home except for the DC Infidelity Pad he shares with Ruben Gallego. The ex-donor of course booted the couch-surfing farting spy-banging rapist out.
Lefty billionaire Stephen Cloobeck dramatically cut ties with Eric Swalwell and revealed he has kicked him out of his mansion -- hours before the congressman dropped his run for California governor. "I am no longer supporting Eric," Cloobeck told The Post in an exclusive interview. "F--ing tell everyone I'm a libertarian. F-- you, Democrat Party. I'm a libertarian now." The ugly breakup between the timeshare mogul and Bay Area congressman -- who pulled out of the governor's race late Sunday -- marks yet another stunning point in Swalwell's cratering political career. ... Cloobeck spent more than $1 million supporting Swalwell's candidacy, and the embattled congressman filmed a denial video Friday from inside the billionaire's palatial Beverly Hills mansion. ... He added that he would need to talk with his attorney to see if he can claw back the $1 million he gave an independent committee supporting Swalwell.Oh, Rapewell's in debt just as he becomes unemployable? Looks like you're finally going to see that Eric Swalwell Gay Porn you've been dreading these many years. ... Cloobeck had harsh words for fellow billionaire Tom Steyer, saying the progressive hedge funder-turned-environmentalist and candidate for governor -- who has dropped nearly $100 million on the race -- was "spending all this money on bulls--." "I've met most of the players, and I will continue to," Cloobeck said.
Just weeks ago, Cloobeck called Swalwell his "little brother" in an interview with Politico, and he scoffed in a previous interview with The Post when asked about rumors that Swalwell may have acted inappropriately with female staff and interns. Cloobeck, who said he has been a Democrat for "almost 40-year plus," is now unsure where the allegations will ultimately lead, but he said the controversy was enough to make him walk away. "I don't know where these facts are going to end up -- you hear or read all this stuff," he said. ... On top of letting the deeply-in-debt congressman frequently stay at his 9,700-square-foot mansion, Cloobeck gave the maximum $39,200 to Swalwell's campaign and gifted the congressman a $31,000 trip to France in 2024.
Party affiliation, however, will clearly not be the attribute Cloobeck prioritizes most. "I'm going to change my Godd-- party affiliation, because I cannot stand this Democratic Party at all," he said. "I am done. Finito."

The most corrupt, fascist administration in American history.
They should all be in prison, or dangling from a rope.Biden's DOJ also sought to exclude Christians from the juries in these cases, asking questions which would reveal their religious affiliation without actually asking about it (which presumably would result in a mistrial).
The Department of Justice under former President Joe Biden "withheld evidence" and approved "aggressive arrest tactics" when targeting pro-life defendants -- and then slapped them with longer prison sentences than pro-abortion ones, according to an explosive internal review released Tuesday. The DOJ revealed the stunning abuses in a nearly 900-page report after examining more than 700,000 records related to the Biden administration's prosecutions under the Freedom of Access to Clinic Entrances (FACE) Act. The 1994 law was passed to protect access to houses of worship, religious institutions, abortion clinics and pregnancy resource centers. But the Biden DOJ was found to have engaged multiple times in "biased enforcement" of it -- while also collaborating with and even seeking to fund pro-abortion groups, according to the DOJ Office of Legal Policy report. Former Attorney General Merrick Garland set up a national task force to pursue cases against pro-lifers the month after the Supreme Court overturned Roe v. Wade in June 2022. Emails show the task force, led by civil division trial attorney Sanjay Patel, worked closely with Planned Parenthood Federation of America, Feminist Majority Foundation and the National Abortion Federation (NAF) Security Team to initiate investigations and "monitor" pro-life activists -- sometimes for years -- before requesting arrest warrants and filing charges. In a Nov. 17, 2021, email, before the task force was launched, Patel had already praised NAF's security director, Michelle Davidson, to colleagues as an "MVP" at "bringing incidents to my attention, often in real-time, which usually result in an investigation/prosecution." The task force director was not nearly as chummy with defense counsel for one of the first pro-lifers indicted for illegally blocking access to an abortion clinic after the Dobbs decision, writing in a Feb. 22, 2023, email that he didn't "keep the kind of records" the lawyer requested about the total number of "prosecutions for vandalisms of pregnancy centers." That was false, the Trump DOJ review found, since he had already forwarded "substantially identical information" to NAF.
Another case, US v. Zastrow, saw Biden DOJ prosecutors seeking "an indirect way to get some more info about religion without directly asking it," leading to a handful of Christian jurors being flagged "for peremptory and for-cause strikes from the jury pool because of their faith," according to draft voir dire documents and the subsequent review. Other draft documents from the Biden-era prosecutors referred to Christian pro-lifers as "culty" -- before swapping out a less offensive term so as to appeal to the Catholic magistrate judge who they griped had taken up the case. "Unfortunately, we ended up with a very Catholic magistrate on duty this week and he was very particular about the bond conditions and not infringing on their first amendment rights," Assistant US Attorney Frances Lee Carlson wrote in a March 10, 2023, email.Remember when pro-abortion demonstrates harassed the son of a pro-life demonstrator?
Patel also prodded his team following a Planned Parenthood referral to pursue what looked "like a good felony FACE matter" involving pro-life activist Mark Houck, per an Oct. 18, 2021, email on the day that he shoved an employee for the abortion advocacy group who harassed his son. ... Houck, a Catholic father of seven, was arrested in September 2022 by 16 armed FBI agents -- some of whom were carrying long guns -- at his home in rural Pennsylvania and charged with two FACE Act-related counts. The US Attorney's Office for the Eastern District of Pennsylvania had declined to pursue a summons in order to allow him to self-surrender, but the public backlash caused Patel to place blame on the FBI.Sharp as a tack, not racist at all:

This isn't confirmed or announced yet, but Cavernous Nostrils herself says she's "uncomfortable" about what the Alliance Defending Freedom is saying about case they're working.
Ben Shapiro might also be suing. She recently defamed him as well. (Well, she has probably defamed him a dozen times, I just remember in the past few days she dropped another one and I thought, "That's actionable, I sure hope he sues.") Cavernous Nostrils herself showed this video, which she says is an "internal video" from ADF (though it appears to be a public Q&A, but then again, Cavernous is a low-IQ lunatic who doesn't know anything.) In the video, a person she identifies as being part of the ADF says that she was on a phone call with a "large organization you would know very well... it has to do with Candace Owens, which might give you an idea about what we're talking about." And she talks about the question of whether to sue or not sue when someone defames you.Posted by: Disinformation Expert Ace at 12:10 PM | Comments (328) | Trackbacks (Suck)

Referring to an impeachment reversal, Dershowitz admitted, “It's never been done. I don't see any reason why it couldn't be done. Impeachment is a quasi-judicial procedure, whether you have to go back to Congress and ask them to expunge it or go to the courts.”Referring to the new exposure of the key source for the accusations, who met with top Democrat Adam Schiff before filing his complaint, Dershowitz added, “But I have to tell you one thing, history will expunge it already based on your work, because what you've done is you've created so much doubt about the credibility of the main accuser that it's hard for anybody to sit back now and say that was a just, a just impeachment, but I don't know that there's going to be any remedy. Maybe we should try to create one.”And from the exceptionally all-too tolerant American people, we go to the exceptionally stupid people of Spain:
Spain’s Socialist Workers’ Party has authorized plans to grant amnesty to 500,000 illegal migrants in the country, authorities said. Pedro Sanchez, Spain’s prime minister and general secretary of the Socialist Workers’ Party, said in an April 14 statement shared on X that the Council of Ministers would approve a move to grant amnesty to migrants. . . The move will provide amnesty to 500,000 illegal migrants and allow them to be formally integrated into the Spanish workforce, according to the BBC. The government will offer migrants a one-year renewable residence permit. Migrants seeking amnesty must apply between April 16 and the end of June. They must also prove they have been living in Spain for five months and have no criminal record, the outlet reported.PS: Joey Sponge-Brain Shits-Pants thinks all those colored dudes look alike: At least Barack was "clean and articulate, that's a storybook, man!"

- China's leading flash memory producer, YTMC, is constructing two new factories in addition to the one already in progress. (Tom's Hardware)
Each factory will produce 100,000 wafers per month - equal to 50% of the company's current production - once it reaches full capacity, but that will take a while. The first of the new facilities will come online this year but will take another year to reach 50% of planned capacity.
In an interesting twist, half the capacity of the first of these factories will be assigned to DRAM rather than NAND, which is what YTMC normally produces.
It won't be enough to fill the current shortage but every bit helps.

You can imagine what they mean by "work." AWFULs are jealous, envious, spiteful, status-craving, crab-in-a-bucket-tugging, tall-poppy-cutting lunatics:
There were at least 20 people at the warehouse when the fires began, authorities said, but no one has been reported injured. ,,, The first state charge carries the special circumstance of the damage from the arson reaching more than $10.1 million, Anderson said. That charge carries a penalty of 10 years to life. An initial estimate found the paper products inside the warehouse to be worth $500 million, with the building itself worth $150 million.
...
Essayli said that in a phone call, Abdulkarim allegedly "compared himself to Luigi Mangione."

SCOTUS WireIf you recall, Boasberg issued a (lawless) TRO blocking Trump from deporting criminal illegal Venezuelans to the CECOT prison in El Salvador. But Boasberg mis-drafted his order because the planes were already on their way. The TRO was then moot.
@scotus_wire 2h 🚨 In a 2-1 vote, a D.C. Circuit panel has issued an extraordinary writ of mandamus, ordering Judge Boasberg to terminate his criminal contempt probe into the Trump administration's transfer of alleged Tren de Aragua members to El Salvador.
This made Boasberg angry so, on his own initiative and by his own "authority," Boasberg has been conducting a Star Chamber criminal investigation into Trump and his staffers.
Even worse, the Supreme Court later ruled that Boasberg had no authority to issue this order in any case. But the power-mad authoritarian continued his "investigations" into whether his order -- now ruled conclusively to have been lawless and void from the onset -- was "violated" by Trump anyway. The order has been ruled illegal - but Boasberg insists on seeking criminal charges against people for violating his officially-illegal order anyway. He's taking the position: "I don't care if the order was illegal, Trump should have obeyed it anyway, and he should be punished for not Respeccing My Authoritah!" By a vote of 2-1, an Appeals Court just ordered him to terminate these lawless proceedings.
More from the decision, via Powerline:
A federal appeals court on Tuesday ordered an end to U.S. District Judge James Boasberg's criminal contempt inquiry into Trump administration officials over last year's deportations of Venezuelans to El Salvador, delivering a second major rebuke to Boasberg and foreclosing further pursuit of the case. In a 2-1 decision, a three-judge panel of the U.S. Court of Appeals for the D.C. Circuit granted a writ of mandamus and directed that the contempt proceedings be "terminated," finding Boasberg, an appointee of former President Barack Obama, had committed a "clear abuse of discretion" by continuing to press forward A writ of mandamus is a rare and extraordinary order from a higher court directing a lower court or government official to stop exceeding their authority. The panel that wrote the 122-page decision included Judges Neomi Rao and Justin Walker, both appointed by President Donald Trump, in the majority, and Judge J. Michelle Childs, appointed by former President Joe Biden, in dissent. The Washington Examiner contacted the Justice Department for comment. "The district court proposes to probe high-level Executive Branch deliberations about matters of national security and diplomacy," the majority wrote. "These proceedings are a clear abuse of discretion, as the district court's order said nothing about transferring custody of the plaintiffs and therefore lacks the clarity to support criminal contempt based on the transfer of custody." The order comes nearly one year after Boasberg found probable cause to hold the government in criminal contempt, accusing officials of failing to comply with his March directive to halt deportation flights carrying Venezuelan nationals to El Salvador, where many were sent to a maximum-security prison. The deported Venezuelans were illegal immigrants who were suspected of being members of Tren de Aragua, a violent transnational gang. Boasberg had sought to determine whether officials, including then-Homeland Security Secretary Kristi Noem, willfully violated that order and had moved toward referring the matter for criminal prosecution while continuing to gather evidence through hearings and testimony.
The Supreme Court ultimately overturned the underlying order from Boasberg that had blocked Trump from using the Alien Enemies Act to deport illegal immigrants suspected of gang membership. Boasberg, however, continued investigating whether the Trump administration had violated the order.
More than a year ago, the President invoked the Alien Enemies Act against members of Tren de Aragua, a Venezuelan criminal gang and foreign terrorist organization, and ordered that they be detained and removed from the United States. In a series of fast-moving events on March 15, 2025, the government placed a group of alleged gang members, including plaintiffs in this case, on planes to El Salvador. After the planes took off and left the country, the district court ordered the government not to remove the plaintiffs from the United States. The Supreme Court vacated the district court's order because it was premised on a legal error and the plaintiffs' suit was brought in the wrong court.I think that last part might be about these criminal illegals filing in friendly liberal district courts while ignoring the Immigration Courts that actually have jurisdiction over their cases. They did this again and again and the Supreme Court kept telling them that they had no original (first-dibs) jurisdiction in these cases, but could only enter the cases after an appeal.
Eric Schmidt comments:
Nonetheless, the district court threatened to hold government officials in criminal contempt unless they complied with the now-vacated order by, for instance, taking back custody of the plaintiffs. We issued a writ of mandamus vacating the court's first contempt order. Undeterred, the district court is proceeding with criminal contempt for the government's decision to transfer the plaintiffs to the custody of El Salvador. To cooperate, the government identified then-Secretary of Homeland Security Kristi Noem as the official responsible for the transfer decision. The district court previously said this was the only information it required to make a referral for prosecution. But the district court has now expanded its inquest and ordered hearings to extract more information from government counsel about exactly what happened last March. The government petitions for mandamus. The widening gyre of the district court's investigation again calls for the extraordinary remedy of mandamus to halt the judicial "impairment of another branch in the performance of its constitutional duties." Cheney v. U.S. Dist. Ct. for D.C.,542 U.S. 367, 390 (2004) (cleaned up). The district court proposes to probe high-level Executive Branch deliberations about matters of national security and diplomacy. These proceedings are a clear abuse of discretion, as the district court's order said nothing about transferring custody of the plaintiffs and therefore lacks the clarity to support criminal contempt based on the transfer of custody. Moreover, the government has already provided the name of the responsible official, so further judicial investigation is unnecessary and therefore improper. In these circumstances, mandamus is appropriate to prevent the district court from assuming an antagonistic jurisdiction that encroaches on the autonomy of the Executive Branch.
So, he mis-drafted his order but now wants to put people in jail for not having obeyed the order I meant to give, but did not in fact give because I am a sloppy partisan incompetent.
Senator Eric Schmitt
@SenEricSchmitt 4h "The pursuit of this improper investigation is a clear abuse of discretion." Judge Boasberg just got slapped down...again. The walls are closing in on his crusade to jail Trump officials for DEPORTING Venezualan terrorists. It's clear: time to impeach Rogue Judge Boasberg. 🧵 To review: last March, Judge Boasberg forced himself onto the "turn the planes around" case--just a few days after trying to foment a constitutional crisis at a Judicial Conference meeting. He has spent the past year trying to jail prosecutors and cabinet Secretaries. Today, the D.C. Circuit issued an opinion, once again, in the appeal on Boasberg's attempt (extrajurisdictionally) to hold officials in contempt. The Court found Boasberg's "inquest" was both wrong on the law and a violation of our Separation of Powers. Let's break it down.
The core holding is simple. Criminal contempt requires a court order that is "clear and specific." The D.C. Circuit held this TRO was not. Why? Because the written order barred "removing" class members, but said nothing about transferring custody once the planes were already outside the United States. The district court tried to transform an order about "removal" into an order about continued U.S. custody in El Salvador. The D.C. Circuit said no: criminal liability cannot rest on what a judge later says he meant. It has to rest on what the order actually said at the time.
Judge Boasberg was mad he didn't get his way by halting the deportation of TDA terrorists. He got shut down: "In our constitutional system of government, criminal liability cannot turn on the unstated intentions (or post hoc assertions) of a district court judge." The district court told the government it would issue a written order "so you don't have to race to write it down." The written order then superseded the oral remarks--and that written order did not bar what the district court later claimed it barred. This is bigger than one case. If this contempt theory had survived, any politically charged district judge could issue a rushed, muddy order, then later reinterpret it to threaten executive officials with prosecution. The D.C. Circuit put a needed stop to that. Today's ruling is a win for due process, for separation of powers, and for the proposition that judges must follow the law too. No vague order.
No post-hoc rewrite.
No judicial fishing expedition.
No contempt. Time to move forward with impeachment.
