To Presume to Overrule a State Anti-DEI Executive Order, a, Get This, DEI Judge Uses AI to Write An Opinion Filled With Fake Cases

Huh, a DEI hire resorting to AI to do his homework for him. And all to stop the people from ending DEI practices.

Who could have seen this coming.

There is good news: the Appeals Court was so shocked by the complete DEI incompetence on display that they not only reversed him, they kicked him off the case entirely.

The decision is a victory for Republican Mississippi Attorney General Lynn Fitch's office, which had argued that US District Judge Henry Wingate's apparent misuse of generative AI tools had compromised the integrity of the judicial process.

US Circuit Judge Jerry Smith, writing for the three-judge panel, took Wingate to task for a "botch job" that led to a ruling that contained "sloppy edicts" and "several factual assertions nowhere to be found in the record" and got the law wrong.

Really? A DEI judge botching the law and making sloppy mistakes?

And using cheaters' tools instead of writing his paper himself?

First time we're seeing anything like this. "Few such cases," I would say.

This is very harsh: Usually judges protect each other like media hacks protect their fellow guild members.

But this appeals panel is absolutely blasting this complete DEI incompetent.

"The district court -- or perhaps, being charitable, its AI agent -- ignored and manipulated governing law, apparently to satisfy a policy agenda," Smith wrote.

The appeals court laid out detailed instructions for how the new judge should assess the law.

It made clear it does not apply to students, and it said that while states have broad power to regulate their own curricula and publicly funded speech, the new judge will need to balance the state's interests against the individual speech rights of teachers and professors.

Apparently the DEI judge pretended the law said that students would be banned from discussing race under the law, which is a complete fabrication, either created by himself, his DEI clerk, or "hallucinated" by the AI agent he used to do his homework for him.

But... if it was just the AI agent -- did this guy not bother checking the opinion he was going to sign his name to to make sure the cases cited said what the AI said they said, or even existed at all?

Apparently not.

Gee, Judge Wingate, you're right -- DEI really is super-important and leads to excellence.

...

The case before the 5th Circuit concerned a challenge by teachers, professors, students and advocacy groups to a law Republican-led Mississippi enacted last year that bars government-run educational institutions from mandating activities like diversity training or promoting DEI.

The plaintiffs argued the law violated the US Constitution's First and Fourteenth Amendments, and convinced Wingate to issue a temporary restraining order blocking its implementation.

But that order was later found to contain fabricated names and nonexistent legal authorities, prompting scrutiny from Republican Senator Chuck Grassley, the current chairman of the Senate Judiciary Committee.

Wingate in a subsequent letter told Grassley that the errors stemmed from a law clerk's unvetted use of the AI platform Perplexity. Even after the errors in that initial order, Wingate continued to block the law by issuing a preliminary injunction.

Lawyers for Mississippi argued on appeal that even after Wingate replaced the faulty ruling, the AI-related errors cast doubt on the court's core legal reasoning, and they urged the appeals court to reassign the case.

...

But Smith said the case "easily calls for reassignment." He said given the number of errors in Wingate's ruling, the judge might be tempted in future proceedings to want to unjustly find a way "to prove that, even with the correct law and fact, that his initial view should prevail."

This is obviously grounds for impeachment and removal. We'll see if Senate Republicans have the courage and conviction to do the right thing.

I doubt they will.

Update: From Courthouse news, via Ed Morrissey, more spicy quotes from the smackdown:

The panel ordered that the case be assigned to a different judge on remand, finding that Wingate had based his decision "on impoverished legal analysis that barely paid lip-service to the precedents of the Supreme Court or this court, seeming at times purposely to misconstrue the law by manipulating the words of statutes and cases, without regard to their texts' meaning as a whole."

The panel noted factual errors in a temporary restraining order that appeared to be the result of AI hallucinations, including naming plaintiffs and defendants who were not parties to the case, quoting terms that did not actually appear in the act and citing evidence not in the record.

So racist, Appeals Court.

Be better, Appeals Court. #BeBetter.

You're thinking like a fool, because it's a case of do or die.
Out there is a fortune waiting to be had,
If you think I'll let it go, you're mad ...

13 This might be a good test case for impeaching judges at the federal level.

Obvious incompetence and a direct rebuke from the Appeals court while they take him off the case? All while the olds in the Senate are afraid of AI because it can make naked pictures of them?

I guess testing impeachment failure theater may be useful every once in a while on cases where it actually has a halfway decent chance of getting a couple of Democrats agreeing to convict in the Senate.

38 "But... if it was just the AI agent -- did this guy not bother checking the opinion he was going to sign his name to to make sure the cases cited said what the AI said they said, or even existed at all?"

The dirty little secret is the majority of opinions are written by clerks or principal attorneys with little oversight by the judge. The judge might not even "decide" the case so much as ask his clerks to do the research and decide it for him, knowing the clerks will decide the case the way the judge wants.

Same thing at big law firms. I graduated law school and was researching and writing memos and legal briefs on multi-billion dollar cases. The partners rarely if ever read the cases I cited to see if I was correct.

I couldn't believe it then. I still don't now.

And I'm not trying to make a joke:
These cartel judges are just making up what they want the law to say and then cite to the thinnest of authority to justify it.

E.g. someone walking by the White House has standing to stop any renovations.
Some golfers who like the way the course is now, have standing to block any and all landscaping.
Illegally entering the country and giving birth gives your child citizenship.

It's an institutional problem in the federal courts that aging judges, many of whom are no longer capable of doing their jobs, are placed on "senior status" so they can technically remain judges on the payroll while doing little if any work.

Corrupt clerks in the filing office will feed these judges only the kinds of cases they want -- or rather, what their law clerks want.

Kerman Mayor Maria Pacheco is accused of following a Fresno hairstylist for about 25 minutes and confronting him because she believed he was an immigration agent, according to complaints filed.
Eric Bridges' attorney said the complaints were submitted Monday to the Fresno Police Department and the Fresno County district attorney’s Public Integrity Unit. They ask authorities to investigate allegations including stalking and false imprisonment. No criminal charges or investigative findings have been announced.
Bridges said the encounter began Oct. 14 near Kearney Park, outside Fresno, when an orange vehicle began following him. He alleged the driver photographed his white Mercedes, blocked him in and continued following him into Fresno, eventually confronting him outside his sister’s home.

========

The problem with impeachment is the same problem with how Democrats now vote as a block on appointments in the Senate.

It's just far too partisan.

Impeachment is just a partisan question among others, what benefits my side and degrades the other side?

So, you have to find something to convince 14 Democrats (and the recalcitrant GOPers like Mitch, Murkowski, Tillis, Cassidy, and Cornyn) to vote for conviction beyond "this judge is bad at their job". And, no, "this just a partisan hack who's overstepping his bounds and trying to destroy the constitutional order" isn't enough either, because it's all about cui bono.

And we barely impeached judges before this. Like...8 total? In American history?

The real solution is actually to amend the Judicial Acts to impose punishments and limitations in statute. That would just require 60 votes instead of 67. So, slightly less impossible.

146 You can absolutely be assured this was written by clerks. A 79 year old judge isn’t applying AI in this manner. But it is also his responsibility to review, edit and approve whatever the clerks produce.

There are several things becoming more prevalent in the judiciary. The vast number of clerks graduating from law school are not just completely left wing, they are ignorant, unqualified and not at all well schooled in the law. They don’t write these decisions from a textual understanding or material recitation of the law. They are not formulaic or structured in their thought process, at least not in a traditional legal sense. They are written with an extreme bias in mind which is completely disconnected from actual case law. So you have unqualified, left wing and legally ignorant using AI to reach a predetermined conclusion irrespective of case law, which by the way most of their professors have told them is biased and should be subverted.

This is why your current judiciary, and in the very near future is such a danger to the country. You no longer have lawyers or judges in the traditional sense of the law. You have left wing ideologues projecting their counter factual bias.

Isn't there some way to sideline the guy short of impeachment? Put him in charge of the suggestion box or send him to hear night traffic court in some remote outpost where they don't have cars ?

========

I believe the rulebook for the judiciary does give the chief jurist in the circuit authority to limit cases heard by individual judges given bad behavior.

Considering the guy's on senior status, I think the move would effectively force retirement.

But, if we want impeachment to mean...anything ever, especially against judges. Well, you have to start somewhere.

169 I’ve been doing a little research on the Voyager probes and their relation to “nearby” stars. For the most part the AI summary provided by Google has been helpful, providing both sources and math.

I did get a “fun” response last night. Why will Voyager 2 take longer to reach Sirius than Ross 248, when Sirius is closer to us?

Voyager 2 will take longer to reach Sirius because it is approximately 4.3 light-years away, compared to just 1.7 light-years from Ross 248. This greater distance means it will take about 296,000 years to pass near Sirius, while it will reach Ross 248 in about 40,000 years.

Sirius is not 4.3 light years away; it is double that. Ross 248 is not 1.7 light years away—more like ten. But all of those numbers appear in various web sites such as NASA’s. The AI just put them together into a sentence that answered my question without regard to what the numbers meant. (The 1.7 light years for Ross 248 is how far Voyager 2 will be from Ross 248 at its nearest point.)

(The reason Voyager 2 will “reach” Ross 248 first is that it is more appropriate to say that Ross 248 will reach Voyager 2 first. Both

Nope there is nothing that can be done other than impeachment. I mean this guy got overrruled hard, but it doesn't even go down on his permanent record - he does not have one. He has a lifetime appointment. Impeachment is the only possible sanction. He won't lose a paycheck or even get leave with pay.
