Judge Orders Trump To Turn Deportation Plane Around and Bring the Illegals Back to America; Trump Pulls the Old "My **dio Is Break*** **, Can You Re***?" Gag

Trump sent a planeload of illegal alien criminals to be held in El Salvador's vibrant and diverse prisons. A federal judge decided he's the Commander in Chief now and ordered the plane to return.

Trump said "whoops, the plane's gone too far, can't call it back now, gee willickers sorry."

And the left is having a nervous breakdown.



Exclusive: How the White House ignored a judge's order to turn back deportation flights

The Trump administration says it ignored a Saturday court order to turn around two planeloads of alleged Venezuelan gang members because the flights were over international waters and therefore the ruling didn't apply, two senior officials tell Axios.

Why it matters: The administration's decision to defy a federal judge's order is exceedingly rare and highly controversial.

"Court order defied. First of many as I've been warning and start of true constitutional crisis," national security attorney Mark S. Zaid, a Trump critic, wrote on X, adding that Trump could ultimately get impeached.

LOL. They thirst for a constitutional crisis like they thirst for racism and "white supremacy."

The White House welcomes that fight. "This is headed to the Supreme Court. And we're going to win," a senior White House official told Axios.

A second administration official said Trump was not defying the judge whose ruling came too late for the planes to change course: "Very important that people understand we are not actively defying court orders."

State of play: Trump's advisers contend U.S. District Judge James Boasberg overstepped his authority by issuing an order that blocked the president from deporting about 250 alleged Tren de Aragua gang members under the Alien Enemies Act of 1789.

The war-time law gives the executive extreme immense power to deport noncitizens without a judicial hearing. But it has been little-used, particularly in peacetime.

"It's the showdown that was always going to happen between the two branches of government," a senior White House official said. "And it seemed that this was pretty clean. You have Venezuelan gang members ... These are bad guys, as the president would say."

...

"There was a discussion about how far the judge's ruling can go under the circumstances and over international waters and, on advice of counsel, we proceeded with deporting these thugs," the senior official said.

"They were already outside of US airspace. We believe the order is not applicable," a second senior administration official told Axios.

More from Fox: Karoline Leavitt blasted the judge for attempting to encroach on the president's sole power to conduct foreign policy.


"The order, which had no lawful basis, was issued after terrorist [Tren de Aragua] aliens had already been removed from U.S. territory," Leavitt said. "The written order and the Administration's actions do not conflict."

"Moreover, as the Supreme Court has repeatedly made clear -- federal courts generally have no jurisdiction over the President's conduct of foreign affairs, his authorities under the Alien Enemies Act, and his core Article II powers to remove foreign alien terrorists from U.S. soil and repel a declared invasion," Leavitt added. "A single judge in a single city cannot direct the movements of an aircraft carrier full of foreign alien terrorists who were physically expelled from U.S. soil."

On Sunday, El Salvador President Nayib Bukele responded to Boasberg's order by joking, "Oopsie... too late," in an X post. He also shared footage of heavily-armed Salvadorean authorities escorting the alleged gang members off the planes, shaving their heads and rounding them up in their prison cells.

A total of 261 illegal aliens were deported from the U.S. to El Salvador yesterday -- 137 of which were through the Alien Enemies Act of 1798, 101 others were Venezuelans removed via Title 8 and another 21 were Salvadoran MS-13 gang members. Two others were MS-13 ringleaders and "special cases" for El Salvador.

A senior Trump administration official confirmed the numbers to Fox News on Sunday, explaining that the migrants' alleged crimes included kidnapping, sexual abuse of a child, aggravated assault, prostitution, robbery and aggravated assault of a police officer.

Nothing came of it.

The judiciary is genuinely, in very real terms, the least powerful branch of government that has the biggest facade of power it can't back up. Everyone seems to recognize this...except the judiciary.

All it's going to take is Trump announcing that Marbury v Madison is an unconstitutional and illegitimate encroachment on executive and legislative authority by the judiciary, and it all comes crashing down. I'm shocked that it seems like so few realize it.

41 The thing is, the judge's ruling has a sort of weak basis, which I'll get into in a moment. But ordering the plane turned back is stretching their legal authority a bit beyond the pale.

What was this legal basis? Well President Trump activated a very old law regarding deporting enemy combattants, basically it allows the president to throw people out of the country who are members of a nation at war with the USA. OK, but El Salvador is not at war with the USA, so the judge said "you cannot use this statute to deport these scumbags because you have not designated the nation at war."

Now, as far as that goes, its true: The US is not at war with anyone right now. Except... terrorists have for about 25 years been at war with terrorists, who are designated a distinct entity found in any nation. So there is some legal obscurity here. It should be interesting to see how this plays out.

Just like Trump negating pardons because Biden wasn't even PRESENT for a lot of them and the autopen was used. This will go to court and could be really interesting.

Of course they are. There are actually measures such as writs of mandamus (basically an order to a judge by a higher court to stop doing shit or do their frigging job) among other tools that appellate courts can use.

Administrations can refuse to apply a decision by a judge to others that are not specifically named as parties, ignore rulings like this judge's that exceed the jurisdiction of the court, forum shopping (probably why those creeps at Guantanamo were sent to Louisiana), 5th Circuit is a no nonsense circuit and that establishes precedents other district judges are supposed to honor. Same reason Mr. Columbia takeover was sent there--habeas corpus must be filed in the jurisdiction you are being held (not in lefty friendly SD NY). And so on.

For fun, read up on Ex Parte Merryman where a general managing a stockade told Chief Justice Taney that he only responded to orders from the President, not judges. Taney had the common sense to not push the issue to Scotus (he was issuing the habeas order as a circuit judge hearing the case).

Being at war is not a requirement of the Alien Act.

There's an "or" in there that allows the president to merely declare an invasion.

Which he's done.

The Act was signed when we weren't even at war. There were high tensions with France that could have turned into a war, but they never did. Still, Adams had French nationals ejected under the law.

There's a clock on how long we're going to tolerate this judicial bullshit. Either rein in your children or I'll declare that federal courts, having demonstrated that they cannot act in an unbiased fashion, may not rule on matters facing the United States and you can try to get me removed via impeachment. I think we both know that won't work and then all your importance will be gone forever.

There are a lot of really dirty judges around, and I am wondering how far a wave of impeachment will go if it starts.

The judiciary is not going to win a fight with the executive over executive powers, especially not this executive.

For their own self-preservation, SCOTUS needs to shut these things down.

Trump is going to do it all anyway. SCOTUS can retain judicial supremacy in some degree, or he can watch Trump declare Marbury v Madison unconstitutional and SCOTUS can't do anything about it.

The Executive's duty to obey the courts depends entirely on the voting public's good will towards the courts.

Nixon gave up the tapes because the polling told him he needed to (because the public were being manipulated by the WaPo), not because he absolutely had to.

You have to understand where the authority for these rulings comes from.

The Fed Court runs under Federal Court Rules, which are WRITTEN by the Supreme Court, under authority delegated to it by Congress, to write such rules. There is actually no where in Law where this authority is given to the Courts, EXCEPT through these rules, and Court precedents.

This power is given unto Judges, by the Supreme Court itself.... oh and these rules were updated JUST LAST YEAR... thus by Roberts himself.

In order for these Judges to be reigned in, the Supreme Court itself has to RULE it was wrong...

Marshall had the genius to order the Jefferson administration to do 'nothing' because the Judiciary Act of 1789 unconstitutionally extended judicial power for Scotus to issue writs of mandamus to Sec. of State Madison to pay Marbury for the rest of his supposed term in office. By the way, less known, is that this decision defined when a person became the officeholder by addressing the appointments clause.

Marbury was not used a basis to overturn congressional laws again until Dred Scott.

I try to point a key concurrence in Sawyer v. Youngstown Sheet and Tube. Justice Jackson created the three part test for presidential actions where a President acts on their own constitutional authority and Congress has authorized those actions by law, then courts must defer to those branches on questions like war, invasions, national security, etc. far more than even prosecutions.

See Curtiss Wright Export v. US for Sutherland's opinion that the president is the SOLE organ for national defense/diplomacy. FDR was acting on the basis of the Neutrality Act but Sutherland opined was not really necessary except to criminal charge Curtiss Wright. The exports could be banned directly by FDR simply on constitutional powers alone.

Not really. Marbury was more about taunting the Jefferson administration for its admittedly unlawful actions. Marshall's opinion though was cleverly crafted so that Marbury literally had no court with jurisdiction to hear his writ of mandamus case.

Marshall court until his death never overturned another law of Congress. State laws due to the Supremacy clause, yes but no federal laws. Marshall also accepted humiliation in the case of Stuart v. Laird where the Judiciary Act of 1801 overturned the creation of judges in the Judiciary Act of 1800 (Marbury was part of those jobs). Marshall ruled that it was constitutional for the Court to roll back existing courts by deauthorizing them after they were established.

Basically, the Convention itself was divided over judicial review so they kicked the can. But, if you read a pre Marshall decision, Hylton v. US. They held the law constitutional but clearly indicated that if it wasn't, they could declare that too.

Yup. It's not uncommon for judges to shoot their mouths off at hearings -- many judges are dumber than dicks -- and then later think "wtf did I just say?"

I suspect this toady is looking for an exit ramp and will back down at the 4 pm hearing. Oh sure, he'll talk tough but in the end he'll back down. Not necessary, get the CR passed to fund remainder of the year then you can file recission bills (or one giant recission bill) where House and Senate pass a resolution of recission (no filibuster in the Senate btw) that removes all identified DOGE cuts at once. Think that is the game plan here. Cannot pass a recission bill until the spending bill is passed from my memory of it. This was passed by the Gingrich Congress after the Line Item Veto act was declared unconstitutional. This recission resolution avoids the presentment clause difficulties. Clinton signed it.

Not really much action on that via federal caselaw on pardons because no one has abused it like the Biden junta did. But, two instances are Carter's mass pardon of Vietnam draft evaders which address one specific crime (similar to Washington's general pardon of the Whisky Rebellion types). Another is the Nixon pardon by Gerald Ford which addressed a range of potential uncharged crimes committed by one man during his presidency. Unfortunately, I think Hunter's falls more on the Nixon precedent (one would have difficulty challenging it (of course there is the autopen issue and competence of the president), but notice he is not pardoned nor can he be for state crimes nor future crimes committed after the pardon date.

Isn't Trump setting up the argument that the pardons aren't valid because someone in effect forged Biden's signature without his knowledge? And why would someone have to prove "harm", why can't the DoJ just start prosecutions, by accepting pardons, they've already declared their guilt. I can see Scotus doing something like they did in Fletcher v. Peck. Basically during the Yazoo Land Fraud, the GA legislature and governor were bribed by land speculators to sell GA lands to them far below market price. New GA government after elections repudiated the whole deal and revoked the grants. Some people bought land from the speculators before that happened and sought to keep their land. Scotus baldly stated that even if the legislature was corrupt; the contract remained in effect and the purchasers got to keep their lands. Bad decision in my estimation but Scotus will often accept injustice or law breaking if opening that up allows for all kinds of challenges to every official act of the Biden administration.

And why would someone have to prove "harm", why can't the DoJ just start prosecutions, by accepting pardons, they've already declared their guilt. US for example in the 1930's regarding the Neutrality Act granting FDR powers to cut off arms sales to warring countries. Similar in that the Alien Enemies Act grants similar power for a President to thwart invasions.
