BREAKING: Obama Judge Blocks Trump Administration's Freeze on Federal Funding

In a sweeping decision, a federal judge has blocked the Trump administration from freezing any federal funding, dealing a significant legal blow to the White House's efforts to withhold funds that are suspected of waste, fraud, and abuse of taxpayer money.

Chief Judge John J. McConnell Jr. of the U.S. District Court for the District of Rhode Island issued the ruling, reinforcing a temporary restraining order (TRO) previously placed on the administration.

The court found that the government had continued to freeze funds despite prior legal orders, prompting the judge to mandate immediate compliance.

The ruling states that "all orders and judgments of courts must be complied with promptly" and warns that ignoring the order risks contempt charges. The Trump administration had attempted to justify the broad funding freeze as an effort to root out fraud, but the court ruled that such an expansive pause exceeded lawful authority and violated the TRO.

Judge McConnell's order requires the Trump administration to:

- Immediately restore all frozen funding during the pendency of the TRO.

- Cease any federal funding pause under the directive until a ruling on a preliminary injunction is made.

- Take all necessary steps to ensure the TRO is fully implemented without delay.

- Adhere to the TRO's plain text, preventing any funding pauses linked to the Office of Management and Budget's (OMB) directives or the President's 2025 executive orders.

- Resume funding of institutes and agencies affected, including programs funded under the Inflation Reduction Act and the Infrastructure Improvement and Jobs Act.

This decision follows a legal challenge from 22 Democratic-leaning states and the District of Columbia, which sued the Trump administration over its broad suspension of federal disbursements.

The lawsuit, filed in late January, argued that the administration was improperly halting funds that had been duly appropriated by Congress.

Last month, Judge McConnell issued a temporary restraining order prohibiting the administration from withholding funds while the lawsuit proceeded.

The decision marks a critical setback for President Trump's broader efforts to reshape government spending policies, particularly regarding states and programs that conflict with his administration's agenda.

Legal experts suggest that the Trump administration's only remaining option is to seek mandamus relief, an extraordinary legal measure to overrule the district court's decision. The Trump administration has not yet announced its next legal steps.

Random federal judges in blue state backwaters have no authority to unilaterally dictate who the President may talk to or what data he can access. John Roberts and SCOTUS have two options here: they can bring these inferior malcontents to heel, or they can get used to the President simply ignoring these inferior courts or Congress eliminating them entirely.

Congress created these inferior courts so the Supreme Court wouldn't have to deal with every federal case by itself. But if these rogue inferior judges are going to routinely issue lawless decisions that the Supreme Court has to deal with anyway, Congress would be well within its rights to just eliminate them.

Roberts and SCOTUS can immediately put these lawless judges in their place, or Roberts can watch his caseload go up 1000x and his court's precious perceived legitimacy crater overnight.

The age of tolerating this nonsense is over.

It's also just how the body politic operates. The US Constitution set up a system where the Body Politic, through a series of horizontal and vertical arrangements, exerts power over the government.

The take a piece of that government and remove its feedback from the people, the make it apolitical and unyielding to any amount of pressure from the Body Politic, is deeply, terribly unAmerican.

Even the judiciary gets appointed by more directly political branches, preserving the fact that it's base existence is political in nature.

SCOTUS controls its own docket and the cases it hears. Other than a few types of cases, the only way a case gets to be heard by SCOTUS is if SCOTUS agrees to hear it. The vast majority of requests to be heard -- called certiorari -- are summarily denied.

So I don't think the threat of an increased docket is gonna move the needle much for Roberts.

Yet in the “opinion” produced in a secret ex parte hearing there is no legal basis for the ruling. That’s because one does not exist. The judicial branch cannot dictate policy to the executive branch. If SCOTUS can’t find the balls to slam this shut, it should not only be ignored, it should eliminate their own raison d’etre for existing.

55 The judiciary and the bureaucracy are similar in that both have operated beyond scrutiny. Neither are created by the Constitution directly. Gone are the days of a judge having some pride and not wanting to be overturned on appeal. There being no penalty for being overturned ... they don't care and are simply doing the bidding of their ideological masters. The same can be said for the bureaucracy. Both groups are inferior and should be brought to heel.

There comes a time when the point is conceded. If judges have infinite review, then we are not ruled by ourselves, we are ruled by them. This cannot work that way.

It's over. We have about 20 months to get done what needed to get done before the Democrats take back either the House or the Senate (as is historically consistent) before the administration has to stave off endless investigations and impeachment hearings all over again. The judical process will get drawn out for months, and when this particular case is resolved, the Democrats will just do the same thing all over again with a different judge/issue.

iPhone? All browsers use Safari under the hood and it is bad about releasing memory. You'll need to explicitly kill the browser and restart it. Should be good for a bit and then you'll have to do it again.

Android? Probably the same basic issue but with Chrome.

He has. The administration briefs are well written examples of how the law allows what Trump has done. The plaintiffs briefs are hysterical nonsense by comparison with all sorts of idiocies like ex parte decision, ignoring standing, etc. and yet the Democrat judges are ignoring the law and the Constitution in their overreach.

I think a lot of this is that their families and associates were getting grift too and they are literally putting a noose around their own necks.

Unlike the president, federal judges don't have to be impeached to be tried for criminal actions and conspiracy from their actions in office.

So Marshall went back in time to argue that the Judiciary Act of 1789 could not grant Scotus the power to hear writs of mandamus directly but only appeals of them. Marbury relied upon that for his claim and thus Marbury's claim was filed in the wrong court.

The evil genius of Marbury was that Marshall pointed out Jefferson's undeniably illegal acts, claimed the power to declare laws unconstitutional, but left no way for Jefferson to retaliate. Marshall did not order Jefferson to do anything which made it impossible for Jefferson to retaliate or make political capital from the decision.

Little more complicated than that. It is apparent that Roberts tried to wrest control over the opinion and make it much more watered down (keeping Roe but diluting it which is basically a stupid move). Warren Burger used to do that as Chief Justice until eventually he lost control over his own court with both liberals and conservatives on the court sick of his meddling with opinions.

I think a core of four justices (including Kavanaugh as its left most member) are not enamored of Roberts on the right and the three on the left are merely opportunists seeking to pick off him and Amy Coney Barrett from time to time.

Clarence Thomas and Alito have good reason to dislike Roberts intensely for what he has done on the court.

The entire judiciary's power stems from a court ruling, not the Constitution.

And that's for a reason: the judiciary is the furthest branch from the people. Madison didn't want the judiciary to be the most powerful. He wanted Congress to be the most powerful.

It's why spending bills are supposed to original from the House (the chamber closest to the people), not the judiciary. The power to dictate spending is the largest power.

But, Madison not being a fan of direct democracy, built in a whole host of other mechanisms to redistribute power in the Virginia Plan.

She's doing good. Feeling better and went to work today. We've got a meeting with the oncologist Wednesday to see if we can just forgo the last chemo get get into radiation. It'll have been a month since the last one, so we don't see much point.
