CNN Moves Superstar Jim Acosta to a Hot New Time Slot More Worthy of His Towering Stature
BREAKING: JURY FINDS CNN LIABLE

Having a show at midnight is a high-status thing, right?


CNN is apparently plotting to exile star anchor Jim Acosta -- a longtime antagonist of President-elect Donald Trump -- to the "Siberia of television news" in a bid to "throw a bone" to the incoming commander-in-chief, according to a former colleague.

The network's boss, Mark Thompson, this week called in Acosta to propose shifting his show, "CNN Newsroom with Jim Acosta," from 10 a.m. to the graveyard midnight slot, ex-CNN senior media reporter Oliver Darcy reported in his Status News newsletter.

"The move would effectively exile Acosta to the Siberia of television news," Darcy wrote.

It's like the hospice of television. CNN will just try to "make Jim comfortable" as he prepares for his departure.


Acosta was caught "off guard," Darcy said -- with the anchor later using his airtime for some self-promotion to send a message to Trump to go easier on journalists.

"He had no reason to believe that his current show would be on the chopping block. In fact, his ratings have historically been some of the network's strongest," Darcy pointed out.

LOL, sure.

The spin is that this move is necessary so that... Wolf Blitzer can be moved to mornings.

That makes no sense. Blitzer is on in the afternoon. Why do they have to move Acosta's ten p.m. show to move Blitzer from 5pm to 8am?

Acosta was told his possible move was to accommodate moving veteran anchor Wolf Blitzer from primetime evenings to a morning show -- and nothing to do with his ratings or editorial style, Darcy said.

"They want to get rid of Acosta to throw a bone to Trump," an unnamed media executive told the newsletter.

"Midnight is not a serious offer when his ratings are among the best on the network."

UPDATE: The Jury reached a verdict -- CNN is liable for defamation.

They are now Convicted Defamers. I think that's what we say now, right?

Even better -- They requested a calculator for determining damages.

You'll have so much winning you'll be tired of winning.

Update: The jury awarded five million in compensatory (that is, real) damages. But it's the punitive damages where the big money can come in.

JUST NOW: A jury has found CNN liable for defamation against Zachary Young for lying about his efforts to rescue people from Afghanistan. The jury has awarded Zachary Young $5 million in compensatory damages. The jury will next decide how much CNN must pay in punitive damages.

I think that there's probably some limit to how much a jury can award in punitive damages, limited by compensatory damages. Maybe 10-to-1? So the five million in real damages may point to a much-smaller-than-we'd-hope punitive damages award.

Punitive damages are damages intended to punish the wrongdoer, not compensate the victim.

Already settled law. Brief rehash of earlier comment in other thread. Scotus in the 30's, Coleman v. Miller upheld Congress setting time limits on amendments (the 27th had no limit as it was part of the original Bill of Rights package of amendments). Congress did so regarding the ERA putting a seven year limit, then extending it for several years. A federal judge in Idaho ruled that states could actually de ratify amendments and that actually happened with the ERA in several states. It was on its way to Scotus but time ran out for the ERA ratification and thus the case became moot.

Biden can sign as a witness to certification of an amendment but no actual power to recognize. Even the National Archives lacks that power btw to overcome specific congressional legislation on time limits and said just that in 2021. So, it will require a new amendment altogether.

It could be Florida law that the judge is required to tell the jury. The trial occurred under Florida state's laws regarding defamation. Federal court rulings also apply in how the jury and the state of Florida must address these cases---e.g. clear and convincing std of evidence, public figure doctrine, and so on.

Oberlin College was involved in a legal fracas with its insurance company which demanded Oberlin settle with the bakery or lose insurance coverage. Oberlin refused and the insurance companies then claimed they would not pay damages and so on.

Oberlin and its insurers ended up settling out of court this year.

Dunno, we have some attorneys here with litigation experience but I am too lazy to look up Florida code. Only applicable federal constitutional requirements under BMW v. Gore is taht the awarded punitive damages have to be proportional to the actual damages awarded in the case. 500-1 ratio of punitive to actual damages was regarded as violating due process protections.

US Supreme Court said nope, can't hammer them so wildly out of proportion. So on a 5 million award, about as high as will legally stand is 50 million in punitives.

Treble damages is a pretty ingrained concept. And a lot of courts are unhappy when punitive damages get much larger than that. Going for a lot more than that might grab a headline, but wil probably get easily reduced on appeal.

The bad news for CNN, all those appeals will be in Florida State courts. Then they get their shot at a writ of cert to Scotus after Florida Supreme Court decides.

They'll probably settle because CNN itself is becoming a drag on WB/Discovery and important earnings/risk assessment issues in corporate reports. I think Comcast is spinning off MSNBC in part because of legal liabilities and risk assessment along with declining revenues.

Courts aren't ruling on defamation for the defendants like they were in the 70's-00's. Several big decisions like Oberlin, multiple settlements like the Covington decisions, and so on.

Treble damages is a pretty ingrained concept. And a lot of courts are unhappy when punitive damages get much larger than that. Going for a lot more than that might grab a headline, but wil probably get easily reduced on appeal.

And since, Lively has tried to remove the director from any ownership of the film (the MeToo stuff is a subset of that fight).

I think he's great as Deadpool, but they have a very varied cast around him for him to play off of in different ways. He's the same wisecracking asshole, but is in scenes with characters with 8-10 very different, strong personalities to keep things fresh DESPITE Reynolds' unchanging, otherwise abrasive personality.

That is probably why CNN went to trial rather than settle. Risk to them in damages is relatively minimal in financial terms. Reputational hit though is probably greater and it will continue if they try to appeal it by keeping it in the news.

FWIW, Florida law follows US courts caselaw in defining public figure, evidence std., etc.

There has always been a concept of excessive punishment via punitive damages grossly exceeding actual damages. BMW v. Gore simply marked the outer limits of this. Guy is found by a jury to suffer 4K in damages but they award him $4 million in punitive damages. Alabama Sup. Ct. agreed and reduced damages to $2 million. Scotus told Alabama that was still too excessive.

Punitive damages are used in the case of 'don't do it again' as a ways of public punishment of a company or individual and it induces settlements by defendants that might have deep enough pockets to simply win by dragging out legal proceedings. Same as pleading guilty to a charge gives a definite sentence rather than risking a judge/jury giving a higher one. Both, though, can be abused in practice and it was an issue in common law torts long ago before the US became a nation. Same with common law criminal punishment--death sentences were often awarded that were never actually carried out via means like benefit of clergy and other such devices.

There is a rationale behind such rulings--basic fairness.

Want an explanation, see upthread for the court case. Basically, Scotus gave the power to Congress for setting time limits (also the means of ratification--convention or legislature). The 27th, was adopted because Congress had not yet got around to adding time limits to ratification which they rectified shortly afterwards. 27th was in the original Bill of Rights along with one other proposal, "The original First Amendment stated a formula for determining the size of the House of Representatives based on the population of the United States in 1789" from US Constitution Center. It never received the necessary state ratifications unlike the 27th did. Technically still live according to that precedent.
