Sefton: sefton at cutjibnewsletter.com | MSNBC Shrieks at Trump's Promise to End Birthright CitizenshipI'm glad Trump is revisiting this issue, which he brought up but abandoned in his first term. The US is the only developed Western nation that has it. No country in Europe has it. Japan doesn't have it. Most countries in the Americas have it, but the Western Hemisphere is the exception. ... As the Trump campaign laid out over the summer, the proposed executive order he would sign would limit the scope of automatic citizenship to children born here and require at least one parent to prove they are either a U.S. citizen or a permanent resident. In the absence of such evidence, federal agencies would be ordered to deny the newborn from receiving a Social Security number and block the parents from receiving any federal benefits like the Special Supplemental Nutrition Program for Women, Infants and Children, better known as WIC. That baby would also be denied a U.S. passport and any other documentary proof of citizenship. Trump first pushed a similar change back in 2018, but it got put far on the backburner by more cautious staffers. This time around, though, his incoming deputy chief of staff, Stephen Miller, and other hard-liners are preparing to move forward with as many restrictions on immigration as possible. They subscribe to a worldview that has long rejected the notion that America's white Christian heritage can stand while also freely accepting the children of nonwhite migrants or formerly enslaved Black people as equal citizens under the Constitution.LOL. Yes, that's the reason. You nailed it. It has nothing to do with American children being killed by illegal aliens. Seven-year-old Ivory Smith was killed by Venezuelan migrant Joel Enrique Gonzalez Chacin in a late-night drunk driving accident in north Houston just two and a half months after ICE released a hold against him, court documents revealed. Fox 26 Houston reported that court records revealed that Chacin had previously been placed on another ICE hold earlier this year after being arrested for assaulting a family member in June. The felony assault charge against him ended up being dropped to a misdemeanor and, after pleading guilty, Chacin was sentenced to 113 days in jail, which he had already served, and was released that same day. The ICE detainer against him was also lifted that same day for an unknown reason.Of course not. Why should the Regime answer to the peasantry? Authorities confirmed to Fox News Digital that the 41-year-old migrant was intoxicated when he T-boned Christina Smith and her daughter Ivory at 2:45 a.m. Police said that Chacin took photographs of the scene of the crash "instead of helping" and then drove off. The two victims were only a few minutes from home. Smith was severely injured in the wreck but has since been released from the hospital. Chacin was arrested for intoxicated manslaughter and has been put on a new ICE detainer. Ivory was in second grade. According to a statement released by the family, the mother continues to "endure immense physical and emotional pain" from the accident. "No parent should have to suffer the unbearable loss of a child, especially under circumstances that could and should have been prevented," said the family, adding, the incident is a "stark reminder that we need stronger accountability and justice to prevent further suffering for families like ours." "Even more troubling is the fact that this individual was released after being detained earlier this year, only to find themselves back in custody after causing irreparable harm," the family went on. "Why do we have holds in place if they fail to keep dangerous individuals off our streets? ... How can a system allow such leniency, where a person with such a record is given a chance to walk free and re-offend?"Ivory is -- was -- a seven-year-old black girl. But it's all about protecting the White Christian majority from non-white immigrants. MSNBC said so. Comments(Jump to bottom of comments)1

as i recall, the idea of birthright citizenship began with a ruling by a supreme court justice, arthur brenner (spelling? ) in 1968

The idea is to prevent the anchor baby being used to gain entry.
Pregnant people fly here from other countries and then "unexpectantly" go into labor and have a baby that then becomes an American citizen. They then apply for permanent residence based on this relationship. This has been going on for decades. Posted by: El Mariachi at December 12, 2024 02:16 PM (nLFEI) 12

About all these criminal aliens: I'm not all that enthralled about the automatic "deport" line. It has to be conditional.
Yes, deport all illegal aliens. Period. End of story. As to the criminal class that committed a further crime (as in the non- illegal immigration portion), incarcerate and punish first, then deport with prejudice. Let's just not hand out an an "Escape from Justice" Card just because they entered illegally. Posted by: AnonyBotymousDrivel Remembers Babbitt and Perna at December 12, 2024 02:18 PM (aXxgO) 17

Also, the American Indians were granted citizenship by a separate act. If merely being born within the boundaries of the US made you a citizen that would be unnecessary - they would already have been citizens. But, like illegals, the Indians were not under the jurisdiction of the US government, hence, not citizens. Posted by: 18-1 at December 12, 2024 02:18 PM (oZhjI) 20

"It has nothing to do with American children being killed by illegal aliens"
I don't believe for a minute the often repeated claim illegal immigrants commit crimes at a lower rate that citizens.(legal immigrants perhaps true) I have seen no supporting data. Even if there was data, illegals hide their criminals and in many cases will not cooperate with police so it is comparing apple to oranges. And no way are sanctuary cities reporting their illegal crime data correctly. So where did this claim come from? Posted by: Ripley at December 12, 2024 02:30 PM (GUOwU) 95
Isn't this entire "issue" a matter of dicta to a court ruling? Which not only obviously contradicted the plain meaning of the 14th, but directly contradicted the explicit legislative history? (author of amendment, and others I believe, explicitly stated that the amendment would not have the effect that the dicta and subsequent practice directed - i.e. there was no birthright citizenship implied)

Also, the American Indians were granted citizenship by a separate act. If merely being born within the boundaries of the US made you a citizen that would be unnecessary - they would already have been citizens.>
The Indian Citizenship Act of 1924 shows the best way out of this situation. I believe an EO by itself will be tossed out immediately by the first Fed Court that hears it, and probably not be rescued by the SCOTUS because this is outside the scope of what EO's are supposed to do. However, the Indian Citizenship Act shows that there is precedent for Citizenship matters to be dealt with legislatively, without needing to amend the Constitution. Congress is the body that needs to act here, in order to do this constitutionally. Remember that anything done by an EO can be undone by any future President. Congressional legislation, not so much. I am not in favor of us jailing illegal immigrants here. We should make it a condition of trade and any aid we give that their native country will incarcerate them for the length of their sentence from our court in one of their jails.
Or if we really need to be 'nice' we could pay their native country the daily costs for incareration so long as that country proves they still have the thug in custody. The way it's SUPPOSED to work is, if a child is born to 2 non American legal residents, the child is granted citizenship, however, must return to the parents country of legal citizenship.
Then, when the child turns 18, they're welcome to come back as a US citizen and work to get their family members brought in legally. What's going on now is a mockery of the rule of law. Posted by: Sponge - F*ck Cancer at December 12, 2024 02:38 PM (Zz0t1) 123

Tom Servo, hope you're wrong, and think you are (technically). There is no law or explicit court ruling creating birthright citizenship - right? The constitutional amendment that is cited plainly does not cover illegals having kids here, and the authors of the amendment left no doubt that was *not* the intent.
It's just notes to a ruling (by a dissenter from the ruling, I think?), nothing more. There is not the slightest chance any legislative solution will ever happen. But unless the whole system is a farce (well ... when it comes to the judiciary, sadly this is often the case), no legislation is indicated or required. Wong Kim Ark explicitly blessed the idea of birthright citizenship? Thought it was just a (baseless) idea in dicta to that ruling.
And legal aliens definitely are "subject to jurisdiction" of the US, as they have entered a system of law and regulation controlling and limiting their presence etc. So I would think that legal aliens are obviously a separate category. Legal aliens often have a path to citizenship - it's a legal path, requiring time, money, compliance with laws, etc. That removes any doubt they are in a separate category from somebody whose mother happens to be in the US when birth occurs. After an hour of frustrating nothing burgers, he saw the writing on the wall and walked out. “I walked out because it was worthless,” Bergen began. “It was the biggest amateur hour presentation I’ve ever seen about anything, ok? In his latest effort to entrench Democrat control, despite Americans making their views clear, Schumer tried to ensure a Democratic majority on the National Labor Relations Board for the first two years of Trump’s presidency.
Ultimately, however, Schumer’s efforts failed after Sens. Kyrsten Sinema (I-AZ) and Joe Manchin (I-WV) voted ‘no’ on a procedural vote that would have cleared the way for Lauren McFerran’s nomination. Posted by: SMOD at December 12, 2024 02:49 PM (RHGPo) 171

146 Wong Kim Ark explicitly blessed the idea of birthright citizenship? Thought it was just a (baseless) idea in dicta to that ruling."
Brief synopsis - Wong Kim Ark was born in California to two Chinese nationals who were resident aliens. Wong Kim Ark as a young man took a trip abroad, and was then denied re-entry to the US under the Chinese Exclusion Act, and the fact that neither parent had been a citizen. His case for reentry made it to the Supreme Court, and the Court ruled that due to Birthright Citizenship he was a full citizen of the US and could not be denied entry. That ruling has never been challenged in 126 years, and is treated as dogma by all US Courts. Posted by: Tom Servo at December 12, 2024 02:51 PM (wyMQY) 179

Back to how I think this situation should be addressed - in 1924, the Court had no problem with Congress completely rewriting the Citizenship treatment of Indians under the 14th amendment in a massive piece of legislation. The Court has said that when Congress passes a bill, and it is signed by the President, this represents the authority of 2 branches of government working together, and they are very hesitant to overturn something of that nature.

I loved the black friend in the Queens Gambit.
Not only did I guess she was going to decide to become a lawyer but when she was asked what she was going to do I without missing a beat chorused along with her - "change the world". And would you believe none of that shit was in the book - I think her friend became a maid (?). But that's apparently too lowly for the Left so instead she had to be written as a proto Moochelle despite it not being true to a damn thing. Actually chess was invented by a sassy black woman. Posted by: Christopher R Taylor at December 12, 2024 03:04 PM (RsS92) I disagree on two points. 1) The NKJV doesn't rely solely on the same source texts as the KJV. There are definite differences in the locations of texts, and other additions and subtractions. 2) I think there are a lot of people here in the Horde who could do a good job on a language update, using a relatively recent, non-woke dictionary, the original Noah Webster dictionary, and other sources to ensure clarity. If so, I'd recommend having multiple teams, each responsible for one part, or integrating the useful amendments into the core document, then reviewing and reviewing the work of other teams. This would be a refining process, similar to the work done to create the KJV Bible. Posted by: Hour of the Wolf - Remember Vic and VNN! at December 12, 2024 03:09 PM (VNX3d) 278

Most of the Civil War and Antebellum amendments were unnecessary. The entire idea that people were not citizens or subject to the Constitution due to the color of their skin is both insidious and antithetical to the text. All those amendments did was provide a means to subvert the Constitution and Bill of Rights.

Posted by: Sponge That's one of the things that really bothers me about Spellcheck. I was once Christmas shopping for my WWII veteran father-in-law, and found a book I thought he'd like which were the memoirs of a German panzer commander. On the title page it said "Translated form the German by..". At this point I shut the book and put it back on the shelf. I knew my FIL would not countenance that kind of thing in a published work. But there was no red sqiggle under that "form," so some lazy kid working in the printing house never caught the error. I don't do withous Spellcheck entirely, since it does catch things that the human eye might otherwise miss, but I always make sure to print out the doc and do a proofread of the hard copy as well.
