The Ninth Circuit (Circus) Rules That Local Politicians Do Not Have the Right to Block Presidents From Deporting Illegals

The bad news: the Ninth Circuit just got round to ruling on this 2019 case.

That's how they'll block Trump's deportations: Local communists will assert the right to overrule the elected president, and leftwing courts will take five years to tell them they don't have that power.

The federal government has the authority to deport foreign nationals in the U.S. illegally over the objection of local authorities, a panel of three judges on the Ninth Circuit Court of Appeals unanimously ruled.

The 29-page ruling was written by Judge Daniel Bress, with judges Michael Hawkins and Richard Clinton concurring.

At issue is an April 2019 executive order issued by King County Executive Dow Constantine, which directed county officials to prohibit fixed base operators on a county airfield near Seattle from servicing U.S. Immigration and Customs Enforcement charter flights used to deport illegal foreign nationals.

Constantine's order prohibited King County International Airport from supporting "the transportation and deportation of immigration detainees in the custody of Immigration and Customs Enforcement, either traveling within or arriving or departing the United States or its territories."

The airport is located next to a major ICE-Seattle base of operations.

The Trump administration at the time sued, arguing Constantine's order violated the Supremacy Clause's intergovernmental immunity doctrine and a World War II-era Instrument of Transfer agreement allowing the federal government to use the airport in King County.

A district court agreed, ruling in favor of the federal government. King County next appealed to the Ninth Circuit.

The Ninth Circuit panel affirmed the district court's summary judgment that the order violated the Supremacy Clause and the Instrument of Transfer agreement.

With King County, as a so-called "sanctuary county," Constantine argues its region "has acted decisively to become more inclusive, removing barriers to affordable housing, transit, health, economic opportunity and promoting strong childhood development for everyone." The county has also set its "region apart as a leader in protecting the rights of all people in our communities, and continues to not tolerate discrimination, harassment, expressions of hate, or any behavior intended to promote fear, intimidation, or isolation," he says.

Constantine's argument was ideological, according to the order, stating federal "deportations raise deeply troubling human rights concerns which are inconsistent with the values of King County, including separations of families, increases of racial disproportionality in policing, deportations of people into unsafe situations in other countries, and constitutional concerns of due process."

"I don't like this policy and I voted against the man implementing it" is not a constitutional argument, jerkoff.

8 I seem to recall that such strategies of the court work the opposite way, as well. For example, just forgive those student loans using the lower court until the higher courts says you can't....then just ignore that ruling and tailor your give away around the wording and promise more of the same.

It was under Obama. Arizona passed a law that was word for word identical to federal law and was going to allow law enforcement to ask for proof of legal status during encounters such as traffic stops, but Obama's DOJ came in and said only feds have power to enforce, meaning not enforce, immigration law.

There was an apartment developer in Houston named Harold Farb that built and maintained very nice properties that were top notch places to live. He died the same year Katrina destroyed New Orleans. Thousands of those impacted by that storm ended up in apartments in Houston that were Farb properties that were being sold off. All of those properties are now crime ridden shit holes sitting among or next to nice neighborhoods. People who can be baling out to the 'burbs being built in adjacent counties.

That brave woman was arguably the beginning of what we're witnessing now.

The SCOTUS wrote a new law, and the pervs insisted she marry them. Her specifically. They drove through multiple counties that would have signed off on their fake marriage to get to her in particular.

And she knew that she did not have the authority to re-write the paperwork. It was not her job. But the pervs and the feds didn't care. They attacked her relentlessly for obeying the law.

Germany doesn't have a deployable brigade of Infantry they can send anywhere. They also don't have enough aircraft to patrol their own sky, we do that for them. Great Britain is even worse off than Germany when it comes to military they can send over seas.

Man, I need to up my photography game. Had a fantastic shot of the crescent moon through some trees with Venus above. Moon getting low enough to be yellowish crescent, with earth shine quite visible for the rest of it.

And I can't hold the camera still enough to get a good shot with long exposures and all that.

It has been that way for most of modern times. The US Army in WWII had less than 20% of their entire strength as front line combatants. For every front line trigger puller there were 4 people in the rear supporting that fighting soldier.

The poor bloody infantry does the dying. By the end of Normandy the Brits had lots of arty and tankers but their infantry components were so drawn down and replacements were nil and the units could barely function.

A favorite fun fact was that the US Tank Force in WWII had 1400 KIA....out of the 450K total, yet the Sherman is supposed to be the worst tank ever. Well some get knocked out, but the crew usually survives to get a new tank.

Early on in the SMO, Russia had to reorganize their units to have more and larger infantry per unit. You can't root out peeps in basements and trenches with anything else.

Mrs. Cop was watching Jesse Waters on Fox last night. Apparently when Trudeau was whining about Canada being adversely impacted by tariffs, Donald Trump told him that Canada could join the USA and become the 51st state.

Then someone pointed out that would shift the balance of power towards Democrats (since a lot of Canada is Lefty), Trump then said that Canada would have to divided into a Conservative half and Liberal half "to keep it fair." LOL.

Suddenly, the Canadian government is making noises about keeping migrants on their side of the border. It's almost as if tariffs can be used as a diplomatic cudgel ... but it can't be that, since Trump is a big dummy and a BadOrangeMan.
