Daniel Penny lacked the intent to kill, or even the willful disregard of the risks. He was protecting people who said they were "terrified" by this deranged drugged-up lifelong criminal thug. But will the jury see that? Or will they just convict "The White Man"? Meanwhile, another perp effed around and found out on the subway that Alvin Bragg has turned into a hunting ground for sociopaths and psychotics. Of course, the "I can't breathe" line that all of the criminals and thugs have memorized. I betcha he can just walk around punching people, if George Soros' prosecutor has anything to say about it. One of the most overlooked facts in this case is that even the prosecution -- IIRC -- admitted this junkie skell was still alive and breathing when the cops and paramedics arrived. He didn't die in Penny's hold.
I also think there's almost no dispute that Neely would still be alive if the cops or paras helped him. But they refused. Read that again. They. Refused. These are professional medical personnel, and they refused help. I can't blame them. They saw a disgusting junkie skell and wanted no part of that. They worried he was diseased, or would puke on them, or whatever. They just said "nah." How can Penny possibly be convicted of any kind of homicide when the alleged victim was still fucking alive when the paramedics arrived, and would still be fucking alive if the paras did their jobs? I think the biggest problem the Defense has here (putting aside the jury pool) is that the video shows that Penny held the choke hold after Neely was clearly unconscious.
In other words, if he had released Neely 53 seconds earlier, I'd say Penny was 100% in the right here. But I do think a reasonable jury could find that at some point in those 53 seconds it went from self defense to assault, and find him guilty of Manslaughter. I do feel very bad for Penny though. I think he had good intentions and it feels unfair that a jury unpassionately judges him based on his actions during a highly stressful situation. But that is how our legal system works. I also feel bad for Neely. Clearly the guy should have been in a mental hospital for the past 10+ years and not roaming the streets terrorizing people. I watched the Alexander Rakitin video. Good for the nebbish guy beating up the bully. But I saw at least three big no-noes in the video:
1. You never sit in the seat that Rakitin did unless the subway is empty. If you sit there, you are sitting practically on top of the seat that 90 degrees to your left. There's no way you're not gonna make physical contact with a guy sitting in that seat, which is where the bully was. 2. Rakitin actually engages the skell with conversation and logic. He keeps at it, as the skell gets more and more agitated. You do that only if you're planning for a fight. If you don't want to fight, you ignore the guy and just stare at the floor. 3. Strike first, strike hard, no mercy. Admittedly this is much harder to do in today's world of Soros prosecutors. I randomly started watching a fun little Netflix show called, "Delicious in Dungeon." It's an anime that starts off with a D&D style party with a thief, knight, mage, etc and they're in a battle with a dragon. They lose spectacularly, mostly because they're hungry and tired, and their mage manages to magic most of the party out, but most of their gear and treasure stays in the dungeon.
One member of their party is trapped in the belly of the dragon, slowly being digested. The remaining members of the party want to rescue her, but they can't afford to mount a rescue party. So one of their party members comes up with the radical idea of eating some of what they kill to save money, eat well, and save themselves from having to carry so much weight. I've watched several episodes. The party has fun D&D dungeon adventures, killing monsters, and making delicious meals from them. It's clever writing and very enjoyable. Of course the reason there are so many white people on the jury is to make them think "Well it would look really bad if we vote 'not guilty', so we better convict". An all black jury might not have so much sympathy for the "victim".

If I was on the Penny jury, I would vote to acquit for four reasons:
1. The prosecution deserves to lose this case. They could have just stuck to the facts, but they indicted all of white society. Innocent! 2. I'm reluctant to imprison a man who has served his country honorably in uniform. I'm willing to color outside the lines, just a little, in such a case. 3. The jury should send a clear message that public disorder is the main problem. So what if Penny killed Neely? It wouldn't have happened if Neely wasn't on the street to begin with. 4. When you can see the actual "chokehold" ... he wasn't choking him. Unfortunately, the lunatic started struggling and the 2 people assisting Penny blocked the view of the camera for the crucial 30 or 40 seconds, but (unless he had switched his choke hand) his head was still on the wrong side when you can see Penny again.

On one hand we have a medical examiner who has decided what killed a man without examining the corpse as opposed to the opinion of the examiner who did. I know which opinion I'd accept. As for the NYC subways and the people of NY, lets nuke them from orbit. Its the only way to be sure.
