Georgia Judge Throws Cornell West and Green Party Candidate Jill Stein Off the Ballot

Democrat-aligned judges will not permit any non-Regime-approved leftist candidates to run.

He also disqualified two other leftwing candidates, based on Democrat demands that he do so.

A Georgia judge ruled on Monday that four independent and third-party candidates, including Robert F. Kennedy Jr. and Cornel West, are ineligible to appear on the state's presidential ballot. The final decision now rests with Georgia Secretary of State Brad Raffensperger.

Key Details:

Judicial Ruling: Administrative Law Judge Michael Malihi ruled that Robert F. Kennedy Jr., Cornel West, Green Party's Jill Stein, and Claudia De la Cruz from the Party for Socialism and Liberation are not qualified to appear on Georgia's presidential ballot.

Legal Challenges: The Democratic Party challenged the eligibility of these candidates, citing concerns over siphoning votes from Vice President Kamala Harris in a crucial swing state.

Next Steps: Georgia Secretary of State Brad Raffensperger must decide on the matter before September 17, when military and overseas ballots are mailed out.

Diving Deeper:

In Georgia, Administrative Law Judge Michael Malihi declared on Monday that four independent and third-party candidates, including Robert F. Kennedy Jr. and Cornel West, are ineligible to appear on Georgia's 2024 presidential ballot. This decision follows a series of legal challenges brought by the state Democratic Party, which argued that these candidates might divert votes from Vice President Kamala Harris, the Democratic nominee, in a state where President Joe Biden won by a slim margin in 2020.

The ruling also affects Green Party candidate Jill Stein and Claudia De la Cruz from the Party for Socialism and Liberation. Judge Malihi's decision hinges on a technical interpretation of Georgia election law. He pointed out that, according to a 2017 amendment, petitions for independent candidates must be filed by the presidential electors rather than the candidates themselves. This interpretation was contested by the candidates' legal teams, who argued it was an incorrect reading of the law, especially since the Georgia Secretary of State's office had initially accepted their petitions without objection.

This is Kamala Harris charting her "New Way Forward."

Huh, looks a lot like the old ways.

Will Obama's lawyers also get to work unsealing divorce filings?

If they needed 1.7 million fraudulent ballots in 2020 (which they did, according to the GA board of elections), and if they can't replicate that, then third party candidates aren't material to the consideration.

Trump's team needs to lean hard into "the Democrats REALLY don't want the people to have choices". They rigged the primaries so Joe wouldn't face opposition, then they replaced him with someone whose gotten 0 votes, then they fight hammer-and-tongs to prevent anyone else from getting on ballots. Pennsylvania is the key to the election. Harris wins it, it's a hard way for Trump to get to 270. Trump wins it, and Harris has an equally hard way to get to 270 EV's.

I wasn't talking averages, but just how the narrative is shaping up. Kamala up by 7 nationally would probably mean something like a 10 point win in places like PA.

She can't be up 7 nationally but only up by 1 or 2 in state polls showing her ahead right now. It's literally not possible.

Unless CA votes a whole lot, but then the national polling is really disconnected from how American presidential elections work.

191 Joe Biden may be forgotten, but at least he'll be amusing Russians next year:

The Russian television channel TNT has begun production on a comedy series about U.S. President Joe Biden that is set to premiere next year, the network announced Tuesday.

The show, called “Goodbye,” revolves around the American leader traveling to Russia “incognito” to find out “why his sanctions aren’t working against Russians,” TNT said in a press release.

During the visit, Biden loses his passport and finds himself trapped in Russia. He is then forced to live in a Soviet-era apartment block and work as an English teacher to save money so that he can buy a new passport for his return home.

“Meanwhile, CIA agents whisk away Russian pensioner Ivanovich, who looks just like Biden, to the United States,” TNT said.

This mirrors the plot of one of the most popular Soviet comedies: "Ivan Vasilevich Changes His Profession", where a Russian experimenter creates a time machine, and sends his obnoxious apartment manager back to the court of Ivan the Terrible, and brings Ivan the Terrible to modern-day Moscow. (The apartment manager and Ivan the Terrible were played by the same actor.)

The one pattern over the past few years that aggregates of polls have shown consistently is that they underestimate, very specifically, Trump's support by something like 2-3%.

Not necessarily where the Democrat will be, but specifically where Trump's numbers will be.

And, remember, that's a curated aggregate of the "best" pollsters, not every one of them.

Also, aggregates of polls are generally bullshit.

Posted by: TheJamesMadison, reminiscing about lost times with Orson Welles at August 27, 2024 01:45 PM (GBKbO)

203 There are very few "easy lay up elections." We live in a hyper-polarized country.

Also, the Democrats always poll well in August (look at 2004-2020 polling in August) and there is response bias because of the switch/convention. And of course there's the fact that Trump has over-performed the (final) national and MI/PA/WI polling both in 2016 and 2020.

205 No, I don't see a contradiction. Convention is supposed to show the Party and candidate at their best. Kamala has no platform, does no interviews and gets less appealing the more you hear from her. We don't really know the effect of the Kennedy endorsement. It may not be much, but there are definitely voters going for Trump that weren't before. That video I linked tries to get a handle on who those Kennedy voters are.

Posted by: Notsothoreau at August 27, 2024 01:46 PM (dDSBl)

206 Elections have been queered for decades. Even in the 1960s it was a given that any Republican nationally had to be up a million votes or so just to break even. We tend to think things stay static, and they don't.

It was a given that Philly, Chicago, and Detroit elections were hopelessly corrupt, but over time the whole state of California with a boatload of EC votes was flipped. Colorado.

Controlling a few key precincts in large cities, can flip a state. Flip a few key states - and Bob's Yer Uncle. I think 2000 was a good illustration of how far the wankery goes. There is an ebb and flow to politics, and much like economic cycles, the "experts" are determined to negate electoral politics to usher in one party rule. They can't "wait" any longer. Remember the "Office of the Prezzy Elect" business? And "He needs to take office Now! We can't wait till January" etc.

That's another thing about polls that you imply:

The margin of error. It's not 3% (or whatever) overall. It's 3% per data point.

A poll showing 45-45? It could be 42-48, or 48-42.

The margin for error on these things is actually quite large. What you end up just getting, at best, is a herding effect where people trying to do it right all kind of end up coalescing around similar numbers (why aggregates seem accurate but are still actually bullshit because if you average two statistics, it increases the MOE).

231 I spoke with a quant I know about the polls. Solid smart math guy who people rely on for their livelihoods. The guy barely ever misses and when he does it’s by a horseshoe. He was showing me, mathematically, what complete bullshit the current polls are and how they are statistically unsound. He was also comparing their past projections and how they move as we get closer to the election. One of his conclusions was the margin of error was more like 20% not less than 10. For any poll he showed me, and some were worse. His conclusion was they are completely tanking for Kamala. Why? Draw your own conclusions…

The problem with polling is you cant force someone to participate or answer honestly.

The other is the raw results are then run through a modeling that no one agrees on. And always seems to favor Democrats.

They always mysteriously swing towards Republicans in the final days.

All that being said, I miss the flawed polls showing Biden getting slaughtered by Trump.

269 It was actually some pretty interesting stuff. He was showing how a small statistical analysis in a poll is related to other factors that are largely not considered, but are very relevant to a correct outcome. He was also showing how that small statistical analysis could be corrupted simply by bias in the core measurements, and that by deliberately not correlating to other factors, like say, turnout models, voter approval on key issues, even weather on Election Day the poll could usually immediately be disproven. He was also showing me some new analysis he was doing that looked at percentage of mail in ballots, and even harvesting that in many cases were actually responsible for more than 100% turnout in some places, which is obviously impossible.

Georgia went for Dubya by 16 points.

States don’t stay static politically.

California voted for Reagan by 16 in 1984. Vermont was one of only 2 states to vote against FDR in 1936. Today it elects Bernie as its senator.
West Virginia was once a solid blue state. Now it’s one of the most red. Things are always changing.

349 This decision follows a series of legal challenges brought by the state Democratic Party, which argued that these candidates might divert votes from Vice President Kamala Harris, the Democratic nominee, in a state where President Joe Biden won by a slim margin in 2020.

Um, so? That's the chance you take when you have multiple party ballots. You can't just complain they'll cost you votes, so they shouldn't be allowed to run.

I'm QUITE SURE, much like the illegal alien problem, if they were syphoning from Trump, you'd be A-OK with them running.

Democrats suck. They want one party rule, period. They're willing to destroy this country to do it.

350 This is why--despite "unskew the polls" being one of the biggest cons we fell for-- I still won't trust the polls.

This 'fortification process' for the polls works for elections, too, and keeps the results in line.

Posted by: Doo-Dah, Doo-Dah at August 27, 2024 02:18 PM (f7l8l)

353 I'll never understand how Georgia became a swing state and Florida became a solid red one.

There are two main reasons. One is that Georgia has become much less white since 2004 (when as you say Bush won it easily). In the 2000 Census, it was 63% non-Hispanic white, now it is 50%. Florida had a similar shift, though, which brings me to the second point.

The black population of Georgia is about 30% whereas in Florida it is 15%. So the non-white vote in Georgia is much more Democratic (because a greater portion are black) as compared to Florida. A large number of black people from northern cities have moved to greater Atlanta, for example. So this is a big part of the reason that the GOP has done much better in Miami-Dade as compared to Fulton County.

As a result, a small drop in the white share voting GOP in Georgia (e.g., winning 68% instead of 71%) will now sink a Republican, whereas in 2004 it just meant the candidate wins by less.

And while I am not a Trump-basher, he didn't exactly help us win the Georgia senate seats in 2020/21 or 2022.

354 Because in Dhimmieland democracy means limiting choices to those that Dhimmies approve of, no others are allowed. Just like in the USSR.

355 If you are getting a $150,000 20% down payment assistance from the state, you are buying a $750,000 home and borrowing another $600,000 from a lender. To get that kind of money you have to be making roughly $200,000, as an illegal.
