Judge: "Geofence" Data, of the Kind Used by Federal Investigators to Mass-Surveil Anyone In the Capital on January 6th, Is Protected by the Fourth Amendment

"Geofence data" refers to data about what phones were in a certain place. I guess the term comes from the idea that you can mark out a virtual "geofence" around the area you want to surveil, then demand that cell phone carriers turn over the phone data for everyone inside that "geofence."

This was used extensively to surveil, harass, and then prosecute J6 political prisoners.

And a judge has just ruled that such data is protected by the Fourth Amendment, and that warrants to grab the data on everyone inside such a "geofence" is unconstitutional.

Notice he's saying that even with a warrant, grabbing all of this data so promiscuously about thousands of people whose names you don't even know and therefore have no actual reason to suspect of any crime is unconstitutional. He's saying you cannot just get a mass-warrant to invade the privacy of everyone in a place.

Just knowing that a crime was committed somewhere inside a large area is not sufficiently particularized information enough to sustain a warrant.

Note that this case is not about the J6 political prisoners, but such a ruling would be extremely helpful to them, if it's upheld on review by the Supreme Court.

The important language there:

Geofence warrants are powerful tools for investigating and deterring crime. The defendants here engaged in a violent robbery--and likely would have gotten away with it, but for this new technology. So I fully recognize that our panel decision today will inevitably hamper legitimate law enforcement interests. But hamstringing the government is the whole point of our Constitution. Our Founders recognized that the government will not always be comprised of publicly-spirited officers--and that even good faith actors can be overcome by the zealous pursuit of legitimate public interests. "If men were angels, no government would be necessary." THE FEDERALIST No. 51, at 349 (J. Cooke ed. 1961). "If angels were to govern men, neither external nor internal controls on government would be necessary." Id. But "experience has taught mankind the necessity of auxiliary precautions." Id. It's because of "human nature" that it's "necessary to control the abuses of government." Id.

The Fifth Circuit says this kind of mass-warrant is illegal, but the 4th Circuit gave its blessing to mass-demanding personal information about thousands at once. And maybe millions of people -- once you bless this kind of warrant, you can make the "geofence" as big as you like. Why not make it the size of an entire city? Or state?

Or country?

With the circuits splitting, it will be up to the Supreme Court to resolve the circuit split.

Which means ACB and John Roberts will once again team up to shred the Constitution.

I think SCOTUS will have to resolve the split first.

Expect John Roberts to try and split the baby - “in normal circumstances it’s unconstitutional, but in extreme circumstances it’s ok”. But then not give any test or guidelines about what “extreme” means. Never mind the contradiction about it being unconstitutional in normal but not extraordinary circumstances.

Dunno, a search enveloping thousands of people and allowing them to be identified and geo located to find the one criminal runs into general warrant territory (which is forbidden by the 4th).

To get around that, the Court would have to push third party doctrine to the max and even there face specificity requirements for warrant validity.

To split the baby, you might get special places exception for sensitive areas that ordinary citizens can avoid being allowed to geofence search but not allowed outside of those circumstances.

My issue with the entire geo fence thingy was there was no warning and no indication that there was a restricted zone around the capitol building. The people assembled there had no idea they were committing a crime just by standing within XX yards of the capitol building inside of some invisible unmarked fence.


That information only came to light after the fact. IMO all of this should have been tossed based on that fact alone.

Jan 6th is an interesting problem. The buildings and grounds are covered by the special places doctrine but primarily not to catch criminals. The special places distinction is to protect the legislature from harm done by those intent on carrying firearms, etc. to shoot up the place or bomb it like the PR terrorists did in the 50's or some splinter Weatherman Underground did in the 80's.

In that context, a geofence warrant would give protection of the legislature from contraband being used to harm them but simply indicate presence, legal or not, in that location. Then there is the reliability issue of geofencing.

I recently listened to a lecture that had a side discussion on how the "robber barons" like the Rockefellers, Carnegies and the Harrimans all were boosters of Americans and America under the later development of "the American System", but in part they were being subsidized for their support, right up until they weren't
But it was a system that sought to combine state and private as a single system, as opposed to the Jeffersonian ideal with a weak government and decentralized power focusing on Agriculture and manufacture as far as it could find a market.

He is so disingenuous in politics I doubt he could do it with a clear conscience. So, even though I eschew "judging people's faith", I have no trust that he actually is the Christian that he says he is.

At one time, I was not too much of a Christian. I started reading the Bible and talking to Christians, partly in a way to manipulate them from their own book, if nothing else.

So I know how that works.

Killer turned out to be a handyman she had hired to do some renovations.

Scotus specifically can make the ruling apply only to the cases at hand and not to other past cases.

Has to do with US v. Leon that allows searches, even erroneous ones, to be made if they were done in good faith. Geofencing allowed by judges and approved by appellate courts in the past would qualify.
