I think having to brief the motion, having it heard by the judge, and then the judge issuing a decision will delay this by more than a month. Especially since this week is a major holiday and then we're heading into the meat of summer. But I agree it won't get them past the election. However: this could give the judge an off-ramp to sit on this for longer, hoping the whole thing fades from memory. This whole trial has blown up in the Democraps' faces. If they were smart they'd be looking for an off ramp. But I think Trump is their White Whale, and they are mad with rage and revenge. They can't let it go. While a agree that the conviction should be vacated, Bragg and Merchan should both be facing charges for misconduct/malfeasance and Cohen and Daniels for perjury, I don't see how entries into the ledgers of his company have anything to do with official Presidential actions. Especially when part of the defense was thst the payments to Cohen had nothing to do with the campaign, much less running the country.

- When the charges came about because the sitting POTUS / White House declared publicly that they are going to do everything in the government's power to make sure he never holds office again... They were federal charges. Sure they occurred at the state level, but if the feds are the ones charging you they're state charges. Not that any of it matter anyway. I think I remember reading somewhere in the USSC Immunity decision that answering a criminal charge with an immunity appeal requires that the immunity appeal process must be adjudicated before the trial can proceed. All the way up the US Supreme Court if necessary.

At first blush, it also seemed to me like merely a delaying (i.e., not a winning) tactic. However, the crime he is falsely accused of committing is alleged to have been committed while he was president. A reasonable arg is that on those dates & times he was attending to official presidential business with zero connection to the actions alleged. I think that's a serious arg. If immunity doesn't protect a president in such cases, prosecutors will be able to easily convict former presidents of somehow mysteriously violating laws even though they were clearly attending to official presidential duties unrelated to the crimes alleged. @shipwreckedcrew I think you are selling the grounds short. The Trump defense moved to preclude certain evidence on the grounds of immunity, including some of the Trump's comments after taking office. Merchan said he would rule as they came in -- but ended up not excluding anything. The Immunity opinion says evidence of "Official conduct" cannot be used to prove criminal actions even if alleged to be private conduct. So the issue is whether some of the evidence allowed in after Trump took office violated that bar on using "official conduct" covered by immunity as evidence to prove private conduct. The letter Trump's lawyers sent makes a pretty solid argument.
He's not arguing the payments were what he was immune to nor that the ledger payments are immune acts. What Trump is saying is, that the DA was allowed to put in front of the jury testimony and evidence of other acts of Trump which ARE official acts. They point out that they filed motions that sought the exclusion of these official act; that if the President is immune for those acts, they must be excluded as prejudicial to the jury. Of course, we know the judge gave no shits about letting prejudicial evidence in and that the jury was going to convict. Except: Justice Roberts specifically called out Chuncken for her bullshit of not even holding an evidentiary hearing on official acts. And that's a broadside aimed at Merchen as well. "The President has more important things on his agenda than to oversee ledger entries to his personal lawyer" is an argument that 1) doesn't require immunity and 2) could have been made *without* the SCOTUS ruling.
And Merchan would have rejected it, no doubt. Because he didn't even make it a hurdle that Bragg had to demonstrate that Trump was involved at all in order to charge him with "34 FELONIES!!!" So, a stronger justification for this the case of Trump's lack of involvement doesn't seem like it would make a dent because Bragg didn't need to show any of it. I just got back so don't know if anyone has brought this up but the immunity claim is not about the payments to Stormy but about the witnesses. Supposedly information was given to the jury that he was immunized against. This should not have been part of the prosecution.

IMHO the weakest part Bragg's case is Judge Merchan's Chinese menu jury instructions to pick any three predicate uncharged felonies without requiring unanimous vote is now clearly unconstitutional in light of the Erlanger case (dealt with predicate felonies for ACCAP enhanced sentencing) and past precedents such as Sullivan v. La that applied jury unanimity on charges for sentencing.

Junior has a fair number of friend in the neighborhood. There's one we don't hear much about (let's call him Trampoline since his parents have one in the backyard). "Judge Merchan, over Trump’s lawyers’ objections, allowed the prosecution to introduce evidence of Trump’s official acts to support a guilty verdict with respect to private acts." Justice Roberts explicitly said this cannot be allowed as it would chill a president's conduct in his official capacity so it sounds like Trump actually has a very strong case for a mistrial here.
