Trump Files Motion to Toss Manhattan Conviction, Citing Presidential Immunity
This is not a winning motion. In the Manhattan case, he's accused -- falsely -- of mis-categorizing payments to Stormy Barn-Vagina as a private citizen, before he was president. This is a delaying maneuver only.
But there will be a delay. Alvin Bragg has agreed that the motion should be argued before sentencing, which had been scheduled for July 11. The hearing will probably be scheduled in a couple of weeks, and last a couple of days. (A hearing on a motion doesn't take a long time like a trial often does.) Then the decision will be quickly written by leftwing operative Judge Merchan. Trump does then have the right to appeal his ruling, but I don't think that Bragg will agree to delay the sentencing through the appeals process. I just don't see this delaying things more than a month. He won't be able to push this past the election or anything. In better news, Professor William Jacobsen says that the DC case against Trump has "mostly gone away" due to the immunity ruling-- the hearings and appeals will delay it until after the election, and Tanya Chutkan will not get her big chance to convict Trump before the election.Comments

I think having to brief the motion, having it heard by the judge, and then the judge issuing a decision will delay this by more than a month. Especially since this week is a major holiday and then we're heading into the meat of summer. But I agree it won't get them past the election.
However: this could give the judge an off-ramp to sit on this for longer, hoping the whole thing fades from memory. This whole trial has blown up in the Democraps' faces. If they were smart they'd be looking for an off ramp. But I think Trump is their White Whale, and they are mad with rage and revenge. They can't let it go. For hate's sake they will spit their last breath at Trump.

They were federal charges. Sure they occurred at the state level, but if the feds are the ones charging you they're state charges.

Sounds legit to me. I'd say this is a delay tactic, at worst. Merchan will certainly rule against it, but then they can appeal it to the Circuit Court of Appeals, and when they deny it, they can appeal it to SCOTUS. It may do nothing but delay things, but then the bump Trump gets from the court sentencing him will be that much closer to the election.

At first blush, it also seemed to me like merely a delaying (i.e., not a winning) tactic.
However, the crime he is falsely accused of committing is alleged to have been committed while he was president. A reasonable arg is that on those dates & times he was attending to official presidential business with zero connection to the actions alleged. I think that's a serious arg. If immunity doesn't protect a president in such cases, prosecutors will be able to easily convict former presidents of somehow mysteriously violating laws even though they were clearly attending to official presidential duties unrelated to the crimes alleged.
So, it might be winning arg after all.

I think you are selling the grounds short. The Trump defense moved to preclude certain evidence on the grounds of immunity, including some of the Trump's comments after taking office. Merchan said he would rule as they came in -- but ended up not excluding anything.
The Immunity opinion says evidence of "Official conduct" cannot be used to prove criminal actions even if alleged to be private conduct. So the issue is whether some of the evidence allowed in after Trump took office violated that bar on using "official conduct" covered by immunity as evidence to prove private conduct.

Except that's not *all* SCOTUS ruled yesterday. They only said, yes official acts of the President assume presumptive immunity. But they didn't rule out that "unofficial" acts could still fall under some form of immunity. They also went on, at length, about things that put undo distraction on performing the duties of the President.
Trump signing checks for Trump Inc. in the White House certainly aren't "official acts" of the President, but he has more important shit to do than be checking to see what accounting code is on the check in case some douchebag in the NY AG office decides to claim that code constitutes a felony they need to prosecute.
And, again, this case is SUCH horseshit that any exposure people get to the details of it helps

Similar to analysis of confessions outside the Miranda rule. Courts have to do the analysis first and establish the record for upper courts as a check on their homework.

In Cohen's plea agreement he pled guilty, and got immunity, for illegal campaign finance violations.
These illegal violations were the payments to Stormey Daniels, which the Federal government says are not campaign finance violations at all - but they were written into the pela agreement as if they were illegal.
Now, given that chain of absurdities, do you think a little 'ol thing like the Supreme court saying Trump can't be charged with crimes as part of his official duties matters? Pish posh. They will find a way to ignore anything and everything to get a conviction. Just lie they have already ignored facts, logic, campaign finance law, the statute of limitations, etc.

He's not arguing the payments were what he was immune to nor that the ledger payments are immune acts.
What Trump is saying is, that the DA was allowed to put in front of the jury testimony and evidence of other acts of Trump which ARE official acts.
They point out that they filed motions that sought the exclusion of these official act; that if the President is immune for those acts, they must be excluded as prejudicial to the jury.
Of course, we know the judge gave no shits about letting prejudicial evidence in and that the jury was going to convict.
Except: Justice Roberts specifically called out Chuncken for her bullshit of not even holding an evidentiary hearing on official acts. And that's a broadside aimed at Merchen as well.
So, Trump may very well get a new trial on that point alone.

And Merchan would have rejected it, no doubt. Because he didn't even make it a hurdle that Bragg had to demonstrate that Trump was involved at all in order to charge him with "34 FELONIES!!!"
So, a stronger justification for this the case of Trump's lack of involvement doesn't seem like it would make a dent because Bragg didn't need to show any of it.

Courts don't want to get into that much but arguably the NY State trial was conducted just as badly as the noted Sam Shepard murder trial in Cleveland which Scotus overturned due to pretrial publicity, no sequestration of the jury, no consideration of change of venue, and an obvious biased judge (Merchan's personal donation against judicial rules to Biden and his daughter serving as a major Dem fundraiser).

Junior has a fair number of friend in the neighborhood. There's one we don't hear much about (let's call him Trampoline since his parents have one in the backyard). The only time I've heard about this kid is when Junior got to play on the trampoline for the first time and two other times. The first was an accusation that Junior changes the lock codes on the back door of Trampoline's house. The second time was today.
I get a panicked call over the walkie talkie from Junior that Trampoline is coming over and is going to lie about Junior. The kid wheels up, rings on the doorbell, I answer.
"What did Junior do?"
"He kicked me hard in the leg. Like, really hard."
This kid is very small. A pipsqueak. And he just bolted over from his house on a bike and shows no bruising or signs of being hurt.
Later, "Junior, don't play with that kid. He's an asshole" (paraphrase). Junior later tells Trampoline to not play with him because Trampoline lies. One of Jr.'s other friends is there and back Jr. up.
Just...kid drama.

Justice Roberts explicitly said this cannot be allowed as it would chill a president's conduct in his official capacity so it sounds like Trump actually has a very strong case for a mistrial here. Merchan did exactly what the SC decision listed as an example of what would not be allowed.
