Is Cultural Power Moving To The States?

The Deep StateTM has conspired with the progressive movement to shift the focus of our federal government from its traditional function (wasting our money and doing a half-assed job of running the country), to a radical reimagining of America.

Trans lunacy, insane racial favoritism, abortion-on-demand until (or maybe including) birth, open borders, demonization of traditional America, destruction of our God-given, natural right to self defense, and that's just the short list.

But there is pushback, and it isn't coming from our feckless, corrupt, amoral leaders in Washington. It is coming from the states...those wonderful laboratories of liberty that have come to realize that the federal government is not our friend. Not all of them of course...California leads the way to our new and glorious Socialist Peoples Democratic States of America, followed by the usual suspects of Oregon and Illinois and New York and New Jersey and Massachusetts and...

But there are states that are disgusted by what is happening in the halls of federal power, and they are taking the 10th Amendment very, very, seriously!

And because the states now have control over abortion law, the hysteria on the national stage may be losing its power, and perhaps losing it's influence over elections. I'm not holding my breath, but this is a very good thing.

14 I think before Illinois turned Socialist, most of the counties (particularly below I-80) would secede. Champaign, East St.Louis and the other very few blue counties would have to decide how to go, but staying blue would not be viable.

I agree with this as an aspiration…. But at the moment and for the foreseeable future I’m afraid that what happens in DC very much matters. That huge and powerful administrative state is burrowed in like a stubborn tick. States should really start pushing the 10th amendment aggressively…. But we also need a Trump and then a Vance in DC to work things on that end (like firing millions of federal workers)

58 Today is the big pride parade downtown Seattle. This whole month has been fairly subdued in comparison to years past. Even in my super gay neighborhood, there's only a small handful of flags, and the majority of those are up all year.

We don't really disagree. It will make the cheat easier, but I believe still nigh impossible given the givens. What I meant was that the emperor's nudity is now on full display, and it will be difficult to convince most people to buy into what are now the obvious lies of the left. Dems are not interested in state power, they want the whole kahuna, but they have so beclowned themselves that it will be a long time, if ever, before they recover.

I think Jill can get to "Joe needs to go" but can't get past "and Kamala takes over." Jill may be trying to positions things so Joe gets officially nominated in August, then drops out, and The Party then picks whoever they want to take over (not Kamala). Nevada they would probably ignore, the Dems are close to writing that state off. But they can't win without WI.

However, Hawaiian judge can't do squat. It is a state law.

We will see, I'm probably 50/50 on whether or not Biden stays in our not. But if he does drop, I think it has to be Harris they run.

Congress never passed a law saying that the NMFS was allowed to charge companies for its "regulatory" services - that was something that NMFS decided to do on its own. (After all, it's easier to extract money from private companies than ask for an appropriation from Congress.)

NMFS can charge whatever it wants, and there is no appealing that.

I refuse to pay for Peacock in order to see what I used to for free. They’ll greatly diminish their audience…. The NFL did the same thing; they put one playoff game last winter on Peacock.

I've read the book and seen the movie. The movie wasn't as bad as I expected, at least until the last hour. The Chevron Precedent had said that NOT ONLY did Federal Agencies have the right to interpret Congressional Statutes any way that they saw fit, but ALSO that as a citizen, you had NO RIGHT to challenge them in any Federal Court for doing so, even if it was a horrible interpretation!

So the ruling this week doesn't change any actual interpretations of anything, but it DOES allow you to finally go to a Court and sue and get a Judge to decide if the Agency's interpretation was rational and in keeping with the actual law. We have not had that right for 40 years.

That is not quite accurate. Chevron carved out a deference to agencies regarding how the agency carried out its mission. In theory, not in actuality, it meant that agency interpretations of its own authorizing statutes would be presumptively correct. Not all agency actions that were clearly beyond the authorizing statutes were allowed but it was a situation where it created unpredictable actions by the courts where some agency idiocies like the EPA declaring carbon dioxide as a pollutant to be allowed.

Scotus has been chipping away at Chevron for about a decade and ironically most of the Chevron deference dealt with agency authorizing statutes written before Chevron when the administrative state was not a big political issue. Took Reagan to do that.

The Chevron issue was mainly related to power grabs by an agency that were inconsistent with its actual authorizing statutes. It treated agency interpretative rules as presumptively correct (subject to rebuttal) when challenged in court whereas the actual APA (administrative practices act) text required no such judicial deferral to agency interpretations of statutes and guidance legislation.

The whole Chevron decision actually dealt with a Reagan era rule allowing the EPA to treat an entire plant as a stationary source for pollutants (Clean Air Act) rather than each individual component of something like a refinery complex.

Not that big of a deal but Chevron essentially allowed district judges to abrogate disfavored citizen and interest group complaints in favor of agencies which is distinctly opposite of what the APA's intent was. The APA was passed in 1946 to rectify the reckless attitude of FDR era agencies to literally invent the justification on the spot and ignore courts and citizens.

On Friday, the WSJ ran an excerpt in their "Notables and Quotables" section of a Monday NYT story (with three authors - why can't just one person write a story nowadays?) all about the cheap fakes designed to make Biden look old, confused. The absence of pessimism does not equal optimism. It's just reality.

There were two things Dems didn't count on - first, Joe was much much worse than they thought he could be - apparently they had all started to believe their own bullshit, a fatal error. Also, Trump was much, much better than they thought he'd be. I wouldn't say it was great, but it was a sold performance; not a home run, but a good triple (to use a baseball metaphor) Most of all, Trump looked calm and in command, unrattled by any of Biden's mad rambling. The contrast was Yuuuuuuge!

Hard to skip leg day when three hour soccer practices five days a week.

True story: My daughter went to high school with some hot guy who made it as NY fashion model. I found an issue of a magazine of male NY fashion models while working late one night. He was in it. But the really interesting thing is in the 'stats' of height and weight there was a certain crazy consistency. I later figured it out. Two and one half pounds of weight for every inch of height. I am within seven pounds of that. Those seven pounds will not give it up.

I call it my 'Buddha Belly'. Everything else is good. Why the hell did seven pounds of fat park there?

I haven't read "American Prometheus", but Richard Rhodes' two books on the Bomb ("The Making of the Atomic Bomb" and "Dark Sun: The Making of the Hydrogen Bomb") present a rich portrait of Oppenheimer; they are well worth reading.
