Rep. Stefanik Files Legal Complaint Against Merchan, Alleging His Selection to Judge Three Separate Trump Trials Was Obviously Rigged

There are hundreds and hundreds of criminal judges in Manhattan.

The odds that the same hardcore partisan and corrupt judge gets assigned all three?

Zero point zero percent.

"Hand-picked judge," Jonathan Turley calls him.

Elise Stefanik files complaint against Juan Merchan alleging assignment over Trump case wasn't "random"

MXM Exclusive

Quick Hit:

New York Rep. and House Republican Conference Chair Elise Stefanik has filed a misconduct complaint against New York Judge Juan Merchan, alleging that his assignment to oversee Donald Trump's Manhattan hush money trial and other cases involving Trump's allies is not random. Stefanik's complaint calls for an investigation into whether the required random selection process was followed.

Key Details:

Stefanik's complaint alleges potential misconduct related to the repeated assignment of Justice Merchan, a Democrat Party donor, to criminal cases related to Trump and his allies.

Justice Merchan presides over the criminal case against Trump brought by Manhattan District Attorney Alvin Bragg, the criminal trial against the Trump Organization, and the upcoming criminal trial of Steve Bannon.

Stefanik argues that the probability of three specific criminal cases being assigned to the same justice is infinitesimally small, suggesting that the selection process may not have been random.

Diving Deeper:

Stefanik's complaint, filed with the inspector general of the New York State Unified Court System, calls for an investigation into whether the required random selection process was followed in assigning Justice Merchan to these cases. She notes that there were at least two dozen sitting justices eligible to oversee the cases, yet Merchan, an acting justice, was selected for all three related to Trump and his allies.

Meanwhile: the impact of this fake trial on the election?

Also zero point zero percent.

9 After all the testimony in Trump's hush money case, the effect on the public has been zero. Voters simply just don't care that much. They are far more tuned into news about inflation, immigration, etc. than Trump's trials.

Unsurprisingly, Trump small lead over Biden is holding.

===
I am back in the courtroom for the instructions.

...This judge has stated that he wants to stay close to the standard instructions. The problem is that this case is anything but standard. We will be looking for some of the outstanding issues, particularly on the standard of proof for key elements like "unlawful means." ...

...Yesterday was chilling as the judge allowed the prosecutors to engage in what some of us view as highly improper arguments. That included effectively testifying on facts not in the record. Merchan's view of "argument" was considerably broader for the prosecution than the defense. For the prosecutors making objections, the strike zone seemed like it stretched from dugout to dugout. For the defense, it seemed the size of a postage stamp...

47 >> I don't think any of this shit stands on appeal...but that's not the point...their primary mission has been accomplished.

Has it? Their primary mission was to tie Trump up and smear him with all sorts of bullshit legal cases to bring down his popularity and hamper his campaigning.

They certainly have hampered his campaign schedule but I see zero evidence these trials are making him less popular. Just the opposite. Trump continues to climb in the polls including in the traditional swing states and even states like Virginia.

Aside from the hard left the one thing most Americans agree on is basic fairness. Even people who don't particularly like Trump can see this is corrupt and hurting not just Trump but the country.

Posted by: Joe Mannix (Not a cop!)
======
Depends on the statute but ultimately the appellate courts can make the call. Merchan's behavior during the trials also can be scrutinized plus jury instructions as well as evidence rulings.

Most common grounds for a granted appeal is bad jury instructions given to the jury. Depending on NY case law, it is possible that his refusal to require the jury to find all the elements of an alleged offense unanimously might be the key.

Scotus already requires a unanimous jury on all elements of the criminal charge (US v. Gaudin) in federal charges and the recent Ramos v. Louisiana case that now requires unanimous verdicts in state courts probably applies that reasoning to NY cases as well regardless of NY law.

And now Trump's going to expose all that was done - illegally and prejudicially - and the world will finally understand the cesspool of US Federal government and ancillary States."

Trump is the singular entity that can turn over the moneychangers in the temple and make history. That the Uniparty is so bound and determined to see Trump destroyed is all the evidence you really need to understand our failed State. And now Trump might have the popular backing to eviscerate it.

Yeah, I'd say that was existential. Maybe DeNiro stumbled upon that without realizing it... on account of the TDS worms eating his brain.

129 Trump has to stay in the courthouse during jury deliberation. I hope they take their time.

If he's convicted on 34 felony charges and doesn't do any time, that might be a world record. His accomplice Cohen only got convicted on eight and did three years.

He won't serve a day in prison. Merchan already put in writing in gag orders that he is taking into account that Trump is a candidate for US POTUS. I like Merchan but he is admitting he is giving Trump more leeway.

Merchan needs to treat him like anyone else. He would not be interfering in the campaign. He is holding him accountable.

He's not "stuck in a room." But he can't leave the building. He just now gave a press conference, once again complaining about how unfair the trial is.

They have a conference/war room of sorts they can retreat to. It's only a press conference because the dickheads want it to be. Even on MSNBC, they read his idiotic complaints. Free BS time for him.

I agree. If Trump was treated like anyone else this trial never would have happened.

Merchan oversaw other proceedings directly tied to Trump.

Those cases included the tax-fraud trial against the Trump Organization and proceedings against the former company CFO Allen Weisselberg. Merchan also will preside over the case against Steve Bannon over allegations that the far-right Trump strategist cheated thousands who donated to build sections of a US-Mexico border wall, scheduled for trial in September.

271 Depends on the statute but ultimately the appellate courts can make the call.

Posted by: whig

Exactly. Merchan did some really dodgy things at the end of the trial, and in his jury instructions. He has really opened himself up for either having this all over turned and/or getting seriously reprimanded by a Superior Court in New York State.

No, seriously, there is actual data that cannot be discussed or researched any farther:

"We looked at the gender of current new Tesla owners, including Tesla Model S and Tesla Model X. Overall, Tesla owners skew 74% male... Tesla owners appear to be well-off.

The median home value for a new Model X owner was much higher at $641,882. Model Y owners came in at $562,823... 70% of all current Tesla owners have no children at home.. The ethnicity of Tesla owners skews toward white in 2024, at 81%. "

Gas prices are down $1.40 from their peak after Russia’s war, but they’re still too high.
My Administration is releasing 1 million barrels of gasoline from the Northeast Gasoline Supply Reserve ahead of July 4th, which will lower prices at the pump when folks need it the most.

352 Most common grounds for a granted appeal is bad jury instructions given to the jury.

Posted by: whig

I am going to disagree in a small fashion here, only because I know folks in the NYS judicial system. The most common appeal that is heard and is successful is not following lower court 'procedures'...this decision is usually "remanded back" to the lower court to fix, or if it can't be fixed, the case gets dismissed. There is, apparently, a whole rule book these idiots must follow in the lower courts and its written down and sworn to by judges, elected or not, state or federal...they follow the rules or expect to have their cases appealed and remanded back for fixing.

I suspect that is going to be the case here...
