Sefton: sefton at cutjibnewsletter.com | Judge Merchan Violates the Constitution Again, Instructs Jury That They Don't Need to be Unanimous About Which Mystery Crime Constitutes the Legal Predicate for the Trump ProsecutionHey, hit Trump with a gag order about mentioning this in his appeal. His appeal might endanger Merchan and his Democrat whore daughter. The prosecution wants a Choose Your Own Adventure style verdict -- jurors can pick from three offered predicate crimes. And they don't even have to agree on which of the three possibilities they're convicting Trump under; five jurors can pick Possible Predicate #1, four can pick Possible Predicate #2, two can pick Possible Predicate #3, and one can even make up his own predicate. As long as they all say that some predicate is present, they can convict. This is against the law. The Supreme Court has ruled that juries must be unanimous about all elements of a crime to convict.udge Juan Merchan ruled that the jury does not need to unanimously agree on the specific 'predicate' crime Donald Trump committed to convict him of felony-level falsification of business records. Legal experts, including Greta Van Susteren, have pointed to a Supreme Court case that contradicts this ruling. Key Details: Judge's Ruling: Judge Juan Merchan ruled that for a felony conviction, the jury need not unanimously agree on which specific crime Trump intended to cover up by falsifying business records. Legal Precedent: Legal analyst Greta Van Susteren highlighted a Supreme Court case, Richardson v. United States, which emphasizes the need for jury unanimity on underlying offenses. Defense Argument: Trump's defense argued for unanimity on the 'predicate' crime, but the prosecution maintained that the law does not require such agreement. Diving Deeper: In a significant ruling, Judge Juan Merchan determined that the jury in Donald Trump's hush money trial does not need to unanimously agree on the specific 'predicate' crime Trump allegedly committed to secure a conviction for felony-level falsification of business records. This decision plays a crucial role in the prosecution's strategy to elevate the charges against Trump. According to the ruling, while the jury must unanimously agree that Trump falsified business documents to commit or conceal another crime, they do not need to concur on what that specific crime was. This ruling sparked controversy and drew criticism from legal experts, including Greta Van Susteren, who cited the Supreme Court case Richardson v. United States. In that 1999 case, the Court ruled that jurors must unanimously agree on the specific underlying offenses in a Continuing Criminal Enterprise (CCE) prosecution. The prosecution initially presented four possible predicate crimes, one of which was dismissed by the judge. The remaining possibilities include a tax crime and violations of state or federal election law. Trump's defense, led by lawyer Emil Bove, argued that unanimity on the predicate crime is essential for a felony conviction. However, prosecutor Matthew Colangelo contended that the law does not mandate such agreement. "The importance of the case is not a basis for deviating from the standard application of the law," Colangelo stated. "There's no reason to rewrite the law for this case." The Democrats have decided to abandon longstanding Supreme Court rulings to Save Democracy.

Judge Merchan Violates the Constitution Again, Instructs Jury That They Don't Need to be Unanimous About Which Mystery Crime Constitutes the Legal Predicate for the Trump Prosecution
++++ Forgive me for asking a possibly stupid question, but I find this confusing. If we pretend that law is a thing and that the Constitution is a thing (join me in fantasy land), is this Unconstitutional? Isn't it the *prosecution's* job to lay out the predicate, the crimes, the reason for the allegation that the defendant committed the crime, and the evidence supporting that allegation? Why is the Jury being called upon to determine a predicate at all? If they can't state it simply, the prosecution failed. Posted by: Joe Mannix (Not a cop!) at May 28, 2024 03:32 PM (d04cU) 26

Correct me if I'm wrong, but the true nature of this is: they can decide which misdemeanor that has expired due to the statute of limitations can be transformed magically into a felony, and they don't have to all agree on which felony, as long as they find him guilty of one.

Democrats and Merchan threw out the law long ago, agreeing the persecution didn't even have to specify a crime to convict Trump.

Hell, the judge--in any other case--berating a witness or the defense in front of the jury is grounds for mistrial. Well, Germany is having its “Let’s Go Brandon” moment.
Some Germans took a 1990’s French electronic dance music hit and changed the chorus to: “Foreigners Out! Foreigners Out! Germany For Germans! Foreigners Out!” A group of trendy German hipsters was filmed singing this chorus on the island of Sylt, and the scheisse then hit the fan. All the people in the video have been doxxed and fired from their jobs, and the head of the Bundestag is demanding that they be imprisoned for 3-5 years for singing that chorus (a number of people noted that some “migrants” convicted of gangraping German teenagers received lesser sentences than that). The German government has banned the playing of the French song, and has announced that it can’t be played at Oktoberfest. In response, the French song is now the #1 most purchased song on ITunes in Germany, and there are now numerous videos of people singing the song with the forbidden chorus (no faces shown, of course). Posted by: Common Tater at May 28, 2024 03:47 PM (PpROq) ++++ Because it doesn't matter anymore. Institutional trust is already gone. Republican government is already gone. The consent of the governed is already gone. The United States of America is already gone. It's an empty suit. It looks largely the same (outside of the urban shitholes, anyway), but it no longer properly exists. So they're blowing up what's left of the legal system? Okay. What are the negative consequences of that? It's not like anyone trusted it anyway, at least not after ever *encountering* it personally. We're in the pure will-to-power stage now. They're going to rule until they can't anymore (when the loot runs out and there's an "accident" that causes either revolution (unlikely) or a breakup (more likely)). None of this destruction matters anymore, because the basis for it to matter no longer exists. Posted by: Joe Mannix (Not a cop!) at May 28, 2024 03:52 PM (d04cU) 175

USA Today: Democrats to nominate Joe Biden in virtual session to ensure he's on Ohio ballot. The Democratic National Committee will hold a virtual roll call ahead of its Aug. 19 convention in Chicago and before Ohio's Aug. 7 deadline to certify the ballot, party officials said Tuesday.
The pandemic online nominating roll call was quick, so why not do it again so everyone can focus on other things? Hat tip to the Governor of Ohio, Mike DeWine (R) for trying to do the right thing. Too many young asshat R's these days... DeWine was smart enough to realize the danger of not taking action. There's no way Biden/Harris wouldn't be on the ballot, but if it took a court fight or pre-convention meeting to do it, the damage to Republicans in Ohio could send the state to the Democrat's side. So he "wants" to fix what they broke, and look like a hero doing it. What a hero...🙄 IMO Dems should have gotten out in front of this. I was waiting on the hack squat machine yesterday. Good lord this woman was doing everything but working out on it. She was stretching her calves, holding onto the machine to stretch her quads, playing on her phone, etc. When she finally gets on the machine, she takes a full minute to get her feet planted in just the right spot. Then, she's facing toward the back rest in a football center's position, then she does this weird good morning lift that's like 90% back and 10% legs. Then she was back to stretching and goofing around on her phone. I ended up doing three sets of 15 goblet squats with a full 2.5 minute rest in between sets before she was done with the hack squat machine. Posted by: bonhomme at May 28, 2024 04:18 PM (Odg76) 331

This business of "requiring unanimity about the predicate" is true, but far too into the weeds.
I go back to the VIth Amendment, plain text: "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and TO BE INFORMED OF THE NATURE AND CAUSE OF THE ACCUSATION." If the charge isn't specified ahead of time, you can't mount a defense. No due process. A sham of a mockery of a sham. Posted by: Zek at May 28, 2024 05:31 PM (5FPX4) 402
