Judge Delays Trump's Florida Documents Trial to Investigate the FBI's Mishandling of Evidence; Georgia Court Agrees to Hear Trump's Appeal to Disqualify Fani Willis

This isn't even about the FBI falsifying the evidence by photographing documents inside of "CLASSIFIED" folders that they brought to the crime scene and put the documents in.

This is about Jack Smith's own misrepresenations to the court about his sloppy evidence handling.

Judge Aileen Cannon's decision to indefinitely delay former President Trump's trial stems from significant pretrial litigation issues, including a crucial admission by Special Counsel Jack Smith that may reshape the prosecution's standing. In a recent filing, Smith disclosed that the documents from Mar-a-Lago might not have been maintained in their original order, contradicting earlier representations to the court.

I confess, I have no idea why the ordering of the documents is important, but apparently it is. Anyone know why this is important?

This revelation came as part of the Special Counsel's response to a co-defendant's request for a delay to prepare his defense, asserting that the state of discovery provided was inadequate. Smith's admission acknowledges that some boxes of documents had been accessed and their contents possibly rearranged, which he claims still does not affect the integrity of the evidence. However, this could provide a substantial basis for Trump's defense team to argue evidence tampering.

Moreover, Smith admitted that the replacement of classified documents with placeholders was not initially disclosed accurately to the court, which could lead to significant legal repercussions for the prosecution. Judge Cannon now faces the task of deciding how to address these admissions, including the potential sanctioning of the Special Counsel and further delays in the trial proceedings.

Meanwhile, in the matter of MSD (Mobile Snizz Dispensary) Fani Willis:

The cowardly, biased chickenshit political operator posing as a judge did not disqualify her; he gave her a choice to recuse herself, or fire Sweetdick. She chose the latter.

Trump says she should have been disqualified outright. He's right.

The Georgia Court of Appeals has agreed to consider Trump's appeal. This is an "interlocutory" appeal, which is harder to get. Usually appeals are heard after a trial is completed. An interlocutory appeal is a request to hear an appeal while a trial is still underway.

The decision by the intermediate appeals court to take up the case is likely to cause a delay, further reducing the possibility of the case reaching trial before the November general election. This is particularly significant as Trump is expected to be the Republican nominee for president.

Trump's lead attorney in Georgia, Steve Sadow, has expressed that the former president looks forward to presenting arguments to the appeals court as to why the case should be dismissed and why Willis "should be disqualified for her misconduct in this unjustified, unwarranted political persecution." A spokesperson for Willis declined to comment on the Court of Appeals decision to take up the matter.

29 "I confess, I have no idea why the ordering of the documents is important, but apparently it is. Anyone know why this is important?"

There are a few things going on here. The classified markings in the photo aren't folders, but cover sheets.

First - Now that Smith has confessed to not keeping the documents in their original order, he has also implicitly confessed to not maintaining a proper chain of custody. What order were they in originally? Who changed the order? Why? Under what authority? Where were those changes documented?

Second, and more importantly - Since the chain of custody is suspect (read as: blazingly dishonest, as acknowledged by Smith himself), the entire thing is suspect. Jack Smith can no longer demonstrate that the documents under the planted cover sheets were themselves classified. It is now (from a legal perspective) entirely possible that the FBI planted S and TS cover sheets on blank printer paper and took photographs to 'prove' Trump knowingly kept crypto in his house.

This is - as Joe Biden would say - a big fucking deal.

Ace: Generally documents must be collected, maintained, and produced "in the ordinary course of business." That means they should stay in the same order as they were found. The purpose is to avoid dirty scumbags like Jack Smith rearranging or reordering them to prejudice the other party's case.

That said, this is generally not a big deal. But here, not only did dirty scumbag Jack Smith rearrange the documents to prejudice Trump, he outright lied about it to the judge. I think that's what got the judge (rightly) pissed off.

What I think happened is the judge was already skeptical of the case and Smith's dirty scumbaggery. I think this latest move to postpone the case is her way of saying "I've had enough of this bullshit."

59 I think the issue with the "evidence order" is that if it's handled improperly, its obvious that it can foul everything up.

Say you have a stapled pack of papers that were SECRET in a box, and a sheet on top of it saying "the following papers are declassified 12DEC2019", unattached (no paperclip/etc).

The FBI raids, empties the box, and "misplaces" the cover sheet (conveniently) or just puts it in the bottom of the stack, not attached to the original documents. But they put one of those "SECRET" coversheet and package it into a folder. Take 100 photos and leak them to the press.

Have they "tampered" with the evidence. Hell yes. Have they influenced the media/jury with the photos of how things were not? Hell Yes.

60 Since the home invasion, where FBI kicked out Trump's lawyer and tried to disable security cameras, (and iirc collect any tapes Trump may have still retained) ... there is no evidence that FBI did not add all sorts of documents, as well as placing spy cams all over Trump's residence.

---
Recall, additional boxes were sent later, after the delivery of the initial boxes packed while Trump was leaving the WH?
Those 1st set of boxes likely had the contents cataloged and indexed.

The reason why this is important is, it'll show that Smith took classified docs from the second set-- that Trump et al. had no idea were sent-- and "accidentally" put them into the boxes from the 1st set.

But, there is more: Read the letter and discovery requests filed by Trump's team yesterday.
1) There are serious, serious chain-of-custody issues with the boxes seized.
2) there are massive errors from the "filter" team. As I posited yesterday, it's likely, now almost certainly, that they had no training or experience in handling or identifying classified info.

Note well: Jack has fought tooth and nail to keep Trump from seeing the docs seized. And even harder to keep Trump from knowing who all is involved in the investigation.
His whole case hinges on no one looking under those rocks.

The ATF (through deputized local LEOs) literally got the wrong guy in South Carolina, and the only reason he's not still in jail is because his public defender said "Hol' up, wait a minute!" at his arraignment.

Reminds me of a meme where Jesus is preaching before a crowd “love thy neighbor and take care of the poor and homeless”. Someone asks “But Jesus, can’t we just pay Caesar and have him do that for us?”

Next panel, Jesus says “OK, let me start over from the beginning. Let me know where I lost you.”

Posted by: Diogenes

Happens more than it should. There are two types of defense lawyers--one is there to get the best plea they can obtain for you, the other is a bulldog type that wants to win at trial and pulls no stops to do that.

Unfortunately, almost every public defender is quite literally snowed under with a variety of criminals as clients and has a very scant budget and time to actually defend someone who is innocent. Occasionally, an idealistic type will fight like hell for the relatively rare innocent client but most treat them the same as their other clients that are hardened criminals.

The really good trial lawyers that want to win are expensive and run 10-20k for a run of the mill representation before a grand jury. Trial cost usually starts at about 50k up to the sky especially if defense expert witnesses are required. The other type of paid attorney is there to negotiate the best deal with his buddies in the prosecuting office that they socialize with after hours.

Imagine you're a defendant fighting to stay out of max prison - your lawyer finally gets the entire discovery box of evidence and it's not even consistent with how it has been represented in writing to both you and court at the beginning of the trial...who has been rifling thru it, taking things out, maybe, writing things in? Has anyone changed anything? How would you know without a complete investigation? Why would people be doing that? And why are you just now learning it happened only because you dug around and found out...?

You'd be pretty sure you aren't getting a fair trial at that point - and Judge Cannon obviously has concerns that you as well...

I don't think he will. In fact, if the Deep State allows him to win, he won't.

Why, you ask? Well, my opinion is that these fortunate breaks that are happening during the various Trump prosecutions are actually a bad thing, because I believe that even though Teh Donald sees and remarks on the utter corruption and the traitors trying to imprison him, he might actually be thinking, "hey, the system works! It's taking time, but I'm being vindicated and my enemies are showing their asses!"

Trump's biggest fault is that he still believes in a nation of laws. I don't see how the prosecutorial collapse is going to change his attitude. Therefore, I think he simply will not have the desire to slice like a fucking hammer.

But what do I know? I'm just an asshole commenter on a Smart Military Blog.

I have maintained that is exactly what happened since the day of the raid. The fib came loaded down with classified garbage documents to plant in Trumps house. Remember those boxes they received from the archives had not been inventoried by Trump or his lawyers by the day of the raid. They could have put in anything they wanted to in those boxes.

And I expect this latest admission by jack smith is cover for that very thing. If they were to take the inventory sheets from the archives and compare them to what the fib said was there it would be totally different.

Trump's biggest issue by far is not going to be any belief in the "system" - you have to remember he was trying to be a normal president AND was concerned with being reelected.

His biggest problem is going to be the next Four Year Scandal(s) op(s) they are going to throw at him. J6 was going to be one but after he "lost" they ran it anyway just with slight differences in reporting. That's why antifa was there and organized. They were going to riot and people were going to get killed and they were going to take over Trump's second term with putting Orange Hitler on trial for sending storm troopers to a peaceful protest.

So whatever they have planned next is going to be fucking bad. They need a new Russia and a new J6 and if he is allowed to win, they will have one.

142 As I pointed out yesterday, the whole point of planting and staging all the S and TS sheets--with the impression that those were as original-- was to sweat the valet under the klieg lamps to take a plea.
And get the linchpin allocation that he did commit every element of the crime as alleged. As they did in GA.
And, more importantly, he would agree to testify.

Which was to then be boot-strapped to "prove" Trump also committed the same crime.
Where the valet agreement to testify gets that "admission " in, a loophole around the usual prohibition of admission of guilt of co-conspirators.

143 >>>I confess, I have no idea why the ordering of the documents is important, but apparently it is. Anyone know why this is important?

My guess is that they wanted the "X BOXES OF CLASSIFIED DOCUMENTS, OMG11!!" hook to give to the press, whereas reality was probably 1 box or a few documents already declassified and biden-reclassified, the remainder being mementos and unclassified POTUS tchotchkes.

--------
I might be wrong [probably, given my post-Lockdown memory!] but I thought it was because the papers were randomly put singly in unrelated boxes. So no rhyme nor reason to their placement, that you'd think a criminal would do so he could find them later; and similarly spread over the most number of boxes instead of collated somehow in a few easy to find and hide boxes doesn't sound too likely.

Didn't one or more of the revealed illegal White House to Archivist emails go ape about them being all over the place too??

148 I've been mentioning the story of a wealthy blue town near mine that wants to massively increase taxes to pay for inflation and bloated school system.

The tax increase lost, finally. They had a first "town meeting" style vote where about a thousand people voted, narrowly, for it. Then it had to get through the general ballot and there it lost by a healthy margin. Note more people voted in a local election by a factor of 3 then any local election this town has ever had.

At the same time the woman that had championed torpedoing the tax increase lost narrowly in running for a local office

I take a couple of things from this...even in blue states people don't want blue policies. But...they don't vote normally. Even when you can get them to the polls they don't really pay attention - why would you vote against the tax increase and then for the local official that wants to raise taxes?

What's really bizarre to me is how Palin got chosen. Maybe they knew they were going to lose to Captain Historic First and she wasn't quite ready regardless? I knew she was green the first time I saw her interviewed (before she was chosen) so no doubt they knew too.

I think they wildly underestimated her though. Like they didn't expect her to make one of the absolute all time great political speeches, which she did at the RNC. But it's one thing I can't really figure out.

Trump’s lawyers have offered various legitimate reasons why the FBI’s poor handling of the evidence has fatally compromised the case. For one thing, they’d intended to show that everything in the boxes had been packed in sequential date order, proving the documents were undisturbed from when the National Archives staff originally packed them for Trump to take with him...
But now the documents are all mixed up, not even in the same bankers’ boxes in which they began. Nobody knows anymore.

239 I think there is also a huge timing issue Smith is/was trying to hide.
It seems the Archivist didn't start threatening until after the delivery of the second set of boxes.
And it surprised the Trump team cause they were like. "WTF? We're working on an agreement to sort these."

Why?
Because they knew they planted classified docs in them.
And the raid was based on those planted docs.
And they couldn't dare let Trump's team look at any of the boxes before the raid.
Which planted docs then were "accidentally" intermingled with the docs in the 1st set of boxes.

Posted by: People's Hippo Voice at May 08, 2024 12:55 PM (g9W3m)

240 From what I read, the issue was brought to attention because the disordering meant they had documents not classified labeled as classified in the inventory etc.

242 I do defense paralegal work in the military. If I was on Trump's team, I would be furious over the mishandling of the documents.

The order is relevant because the government is saying, "This is what we found, and this is how we found them." The order is important because of the material misrepresentation to the court about the preservation of evidence.

"Is my client guilty?"

"This is what we found."

"Is it? Is it really?"

"Well, I mean, it might be a little out of order."

"How did they get out of order? Were you careless or did you deliberately arrange the documents for your own purposes?"

[profuse sweating ensues]

"During the course of the operation, did you introduce any classified materials into the files?"

"No! I would never!"

"How can we be so sure considering you have already lied to this court?"

And: Can we appreciate the fact that as the government claims Trump mishandled classified materials, their own people failed to properly account for the materials, used them to stage publicity photos, and then made false official statements about how they conducted their investigation upon which everything rests?

IF Trump is allowed to 'win' by the Deep State, it is for one of three reasons:

1. The entire US economy is about to collapse and they want to pin the blame on Trump and the GOP.

2. They faced no penalties for blatantly disobeying and stonewalling him the last time around, so why not just do it again?

3. The shitstorm from installing Trump will be so severe and so deadly that the public will beg for the Dems / military / UN to come in and give Trump the full Ceaucescu.

That's my prediction and I am sticking to it. YMMV.

308 Its important for two reasons:

If the documents were all in chronological order, it could show that they hadn't been reviewed yet, so Trump wasn't aware of them and greedily hanging on to documents...he just hadn't gotten around to that set yet.

And without those cover pages, they won't look super secret, and Trump wouldn't know if they were crazy secret level or just random stuff.

Also seems obvious they leaked that photo...remember you're not supposed to influence elections.

334 Here is the problem:

"But now defense attorneys claim, and the special counsel concedes, that some placeholders do not match the relevant document. “Following defense counsel’s review of the physical boxes…and the documents produced in classified discovery, defense counsel has learned that the cross-reference provided by the Special Counsel’s Office does not contain accurate information,” attorneys representing Trump’s co-defendant Waltine Nauta wrote in a May 1 motion."

335 The order isn't necessarily important, but the fact that they already lied about the order indicates that they broke their chain of custody, and can no longer be trusted as to what documents were there in the first place.

Literally their entire case is that Trump had the documents in his possession. When they break chain of custody and admit that they messed with the documents, they can no longer prove what documents were there in the first place, and their entire case is gone.

Think of the Dreyfus Affair in France: doctored letters, forged documents created by the French Secret service to convict an innocent man of offering military secrets to Germany. It's the same playbook. Here they just placed documents into classified folders to create the "crime" and try to convict a man of offering secrets to the Russians.

They really think we are stupid.

Posted by: jcelephant at May 08, 2024 02:07 PM (rhP7v)

338 Well we can all rest assured that there can only be 2-4 FBI suspects in this manipulation of evidence "investigation".

"Only" the top of the food chain within the FBI are the ones who are "possibly" rearranging, adding, subtracting etc..etc..etc. classified material (of which every POTUS has laying around).

Thankfully none of the rank and file FBI agents are involved in this. They can't be according to the average Joe................Right?
