Judge Delays Trump's Florida Documents Trial to Investigate the FBI's Mishandling of Evidence; Georgia Court Agrees to Hear Trump's Appeal to Disqualify Fani Willis

This isn't even about the FBI falsifying the evidence by photographing documents inside of "CLASSIFIED" folders that they brought to the crime scene and put the documents in.

This is about Jack Smith's own misrepresenations to the court about his sloppy evidence handling.

Judge Aileen Cannon's decision to indefinitely delay former President Trump's trial stems from significant pretrial litigation issues, including a crucial admission by Special Counsel Jack Smith that may reshape the prosecution's standing. In a recent filing, Smith disclosed that the documents from Mar-a-Lago might not have been maintained in their original order, contradicting earlier representations to the court.

I confess, I have no idea why the ordering of the documents is important, but apparently it is. Anyone know why this is important?


This revelation came as part of the Special Counsel's response to a co-defendant's request for a delay to prepare his defense, asserting that the state of discovery provided was inadequate. Smith's admission acknowledges that some boxes of documents had been accessed and their contents possibly rearranged, which he claims still does not affect the integrity of the evidence. However, this could provide a substantial basis for Trump's defense team to argue evidence tampering.

Moreover, Smith admitted that the replacement of classified documents with placeholders was not initially disclosed accurately to the court, which could lead to significant legal repercussions for the prosecution. Judge Cannon now faces the task of deciding how to address these admissions, including the potential sanctioning of the Special Counsel and further delays in the trial proceedings.

Meanwhile, in the matter of MSD (Mobile Snizz Dispensary) Fani Willis:

The cowardly, biased chickenshit political operator posing as a judge did not disqualify her; he gave her a choice to recuse herself, or fire Sweetdick. She chose the latter.

Trump says she should have been disqualified outright. He's right.

The Georgia Court of Appeals has agreed to consider Trump's appeal. This is an "interlocutory" appeal, which is harder to get. Usually appeals are heard after a trial is completed. An interlocutory appeal is a request to hear an appeal while a trial is still underway.

The decision by the intermediate appeals court to take up the case is likely to cause a delay, further reducing the possibility of the case reaching trial before the November general election. This is particularly significant as Trump is expected to be the Republican nominee for president.

Trump's lead attorney in Georgia, Steve Sadow, has expressed that the former president looks forward to presenting arguments to the appeals court as to why the case should be dismissed and why Willis "should be disqualified for her misconduct in this unjustified, unwarranted political persecution." A spokesperson for Willis declined to comment on the Court of Appeals decision to take up the matter.

There are a few things going on here. The classified markings in the photo aren't folders, but cover sheets.

First - Now that Smith has confessed to not keeping the documents in their original order, he has also implicitly confessed to not maintaining a proper chain of custody. What order were they in originally? Who changed the order? Why? Under what authority? Where were those changes documented?

Second, and more importantly - Since the chain of custody is suspect (read as: blazingly dishonest, as acknowledged by Smith himself), the entire thing is suspect. Jack Smith can no longer demonstrate that the documents under the planted cover sheets were themselves classified. It is now (from a legal perspective) entirely possible that the FBI planted S and TS cover sheets on blank printer paper and took photographs to 'prove' Trump knowingly kept crypto in his house.

This is - as Joe Biden would say - a big fucking deal.

Ace: Generally documents must be collected, maintained, and produced "in the ordinary course of business." That means they should stay in the same order as they were found. The purpose is to avoid dirty scumbags like Jack Smith rearranging or reordering them to prejudice the other party's case.

That said, this is generally not a big deal. But here, not only did dirty scumbag Jack Smith rearrange the documents to prejudice Trump, he outright lied about it to the judge. I think that's what got the judge (rightly) pissed off.

What I think happened is the judge was already skeptical of the case and Smith's dirty scumbaggery. I think this latest move to postpone the case is her way of saying "I've had enough of this bullshit."

59 I think the issue with the "evidence order" is that if it's handled improperly, its obvious that it can foul everything up.

Say you have a stapled pack of papers that were SECRET in a box, and a sheet on top of it saying "the following papers are declassified 12DEC2019", unattached (no paperclip/etc).

The FBI raids, empties the box, and "misplaces" the cover sheet (conveniently) or just puts it in the bottom of the stack, not attached to the original documents. But they put one of those "SECRET" coversheet and package it into a folder. Take 100 photos and leak them to the press.

Have they "tampered" with the evidence. Hell yes. Have they influenced the media/jury with the photos of how things were not? Hell Yes.

Recall, additional boxes were sent later, after the delivery of the initial boxes packed while Trump was leaving the WH?
Those 1st set of boxes likely had the contents cataloged and indexed.

The reason why this is important is, it'll show that Smith took classified docs from the second set-- that Trump et al. had no idea were sent-- and "accidentally" put them into the boxes from the 1st set.

But, there is more: Read the letter and discovery requests filed by Trump's team yesterday.
1) There are serious, serious chain-of-custody issues with the boxes seized.
2) there are massive errors from the "filter" team. As I posited yesterday, it's likely, now almost certainly, that they had no training or experience in handling or identifying classified info.

Note well: Jack has fought tooth and nail to keep Trump from seeing the docs seized. And even harder to keep Trump from knowing who all is involved in the investigation.
His whole case hinges on no one looking under those rocks.

Happens more than it should. There are two types of defense lawyers--one is there to get the best plea they can obtain for you, the other is a bulldog type that wants to win at trial and pulls no stops to do that.

Unfortunately, almost every public defender is quite literally snowed under with a variety of criminals as clients and has a very scant budget and time to actually defend someone who is innocent. Occasionally, an idealistic type will fight like hell for the relatively rare innocent client but most treat them the same as their other clients that are hardened criminals.

The really good trial lawyers that want to win are expensive and run 10-20k for a run of the mill representation before a grand jury. Trial cost usually starts at about 50k up to the sky especially if defense expert witnesses are required. The other type of paid attorney is there to negotiate the best deal with his buddies in the prosecuting office that they socialize with after hours.

From what I have read they did not know they were coming and asked the SS to store them. Thats when the Mar a Lago people that are also charged had them moved.

I have maintained that is exactly what happened since the day of the raid. The fib came loaded down with classified garbage documents to plant in Trumps house. Remember those boxes they received from the archives had not been inventoried by Trump or his lawyers by the day of the raid. They could have put in anything they wanted to in those boxes.


And I expect this latest admission by jack smith is cover for that very thing. If they were to take the inventory sheets from the archives and compare them to what the fib said was there it would be totally different.

The tax increase lost, finally. They had a first "town meeting" style vote where about a thousand people voted, narrowly, for it. Then it had to get through the general ballot and there it lost by a healthy margin. Note more people voted in a local election by a factor of 3 then any local election this town has ever had.

At the same time the woman that had championed torpedoing the tax increase lost narrowly in running for a local office

I take a couple of things from this...even in blue states people don't want blue policies. But...they don't vote normally. Even when you can get them to the polls they don't really pay attention - why would you vote against the tax increase and then for the local official that wants to raise taxes?

The room that was locked and not accessed by anyone per prior agreement.

So the pretext of the raid wasn't just that Trump had the docs, but that he was also refusing to return them.
Note well, that is how they laughably claim Pence and Biden stealing classified docs is different, because they "cooperated" in n the return.

The last several years that I taught, I noticed a sharp decline in reasoning, writing, and ability to being able to apply knowledge in various fields to the question at hand even among the 'top' students.

Just in the last twenty years, there has been a remarkable decline and I blame smartphones and reliance on search engines as well as our educational system.

If the documents were all in chronological order, it could show that they hadn't been reviewed yet, so Trump wasn't aware of them and greedily hanging on to documents...he just hadn't gotten around to that set yet.

And without those cover pages, they won't look super secret, and Trump wouldn't know if they were crazy secret level or just random stuff.

Also seems obvious they leaked that photo...remember you're not supposed to influence elections.

Literally their entire case is that Trump had the documents in his possession. When they break chain of custody and admit that they messed with the documents, they can no longer prove what documents were there in the first place, and their entire case is gone.
