Supreme Court Lifts Stay on Enforcement of Texas Law Criminalizing Illegal Border-Crossing

The Texas law makes violation of the country's immigration laws a felony, and authorizes Texas state personnel to arrest border-jumpers and sentence them to jail.

The law had been stayed -- blocked from taking effect -- as a lawsuit challenging it works its way through the courts.

The Supreme Court had issued a stay, but now, by a 6-3 majority, cancels that stay and allows the law to be enforced.

Note the case has not been decided yet. This is about whether the law will be blocked from operating or allowed to operate before the case is decided.

There's a tangly history here: the lower court, presided over by a Hawaiian judge, ruled the law unconstitutional, but then the Fifth Circuit Court of Appeals overruled that judge. Biden appealed to the Supreme Court.

Texas can finally begin to enforce its new state law against illegal immigration -- but not after a head-spinning 24 hours. Late yesterday, CBS News reported that the Supreme Court allowed a stay on enforcement of SB4 to lapse. Within an hour, the court then reinstated its stay, only more broadly -- a signal that the court might look disfavorably on Texas' arguments.

But just like that, a 6-3 court lifted its stay, this time for good ... we think. Maybe!

Actually, this lifts a stay on another stay. The Fifth Circuit accepted an appeal of a lower-court ruling that rejected the law as an unconstitutional infringement of the Supremacy Clause. They then stayed their own ruling while the Biden administration appealed to the Supreme Court, which extended the stay while it considered the emergency request to vacate the stay. Yesterday, that temporary stay expired, only to have Justice Samuel Alito issue a new stay ... on the stay.

The Hill only quotes the shitlibs who dissented. They claim that enforcing our immigration laws will cause "confusion."

The three liberal justices chastised the majority's decision to put the law into effect.

"Today, the Court invites further chaos and crisis in immigration enforcement," wrote Justice Sonia Sotomayor, joined by Justice Ketanji Brown Jackson.

Justice Elena Kagan dissented separately.

In defending the law, Texas argued the state has a constitutional right to defend itself and the Biden administration was unwilling or unable to defend the border.

"Plaintiffs urge the Court to rush straight to the merits of their claims," the state responded in court papers. "But these cases do not belong in federal court at all--even apart from the fact that no state court has yet had an opportunity to construe any provision of S.B.4."

The border crossing in NM is difficult, because it is mountainous and there is not much near the NM- Mexico border.
Arizona is more desert and HOT, most of the year. People literally die out in the desert trying to trek in.
The word I have heard is that Tucson is over-run with illegals, and it is now quite a dangerous place to walk around in (down town).
And California is going to become Mexifornia soon. I think it will actually be comical when the white progressive liberals wake up to find that they are in a minority and the new "Californians" want to run the state their way.

Yup. My assessment was that the number of people bused in by Texas and then Florida wouldn't be enough to cause any meaningful problems at their destinations.

And that is true. What I didn't understand at all, however, was that it didn't need to. It did two other things that were tremendously important:
1. It was very public, and forced coverage of the problem
2. It allowed the blue city mayors to gang up on Abbott and blame the lunch lady while exposing the catastrophic problems that the open border was causing their cities. They didn't blame the real villain - the FedGov - at that time, but they were able to blame the lunch lady while airing their grievances.

That's just wrong. I do work with the NYC government and I can tell you it has had a profound effect on the city. The budget cuts and pain is rippling throughout every government agency including the police, fire, schools, sanitation and more and people are angry.

The very far left mayor of Chicago is now blaming Biden for the illegals and the residents who are losing things like recreation centers for their kids to house illegals are equally angry.

But the busing didn't do that. It was a fairly small number of people. The systems into which they were dumped run on thin capacity margins, but there weren't enough people to cause the breakdown the major cities are now seeing. It was a few thousand people at its height.

The *real* influx came from the Administration, the NGOs and the invaders' own two feet. The buses were a rounding error on the total. It wasn't a meaningful contributor.

But it sure did give the mayors latitude to start talking about the problem, and forced the problem into media coverage it otherwise would not have received. It's a win, just not in the way I was expecting because I was too caught up in the numbers, and the fact that those numbers weren't big enough to matter.

At a certain point boots on the ground are more important than laws from DC. All of this is essentially an agreement, a desire to act within specific political limits so as to avoid things spiraling out of control and throwing the entire country into discord. The progressive left seems to have forgotten that fact. SCOTUS rulings fall into the same bucket.

Once you invalidate the agreement on political norms, which the Obama faction in DC essentially is doing, the ability of the left to do anything pretty much ends. Red states can say you have no jurisdiction on these items, and if they want to be really mean, they will arrest federal employees, try them in sympathetic state courts and throw them in jail - with no bond pre-trial. Just a matter of will.

Our side needs leaders who are willing to fight more than any single policy. It needs people who we elect to stand up and represent us and say "enough"!

Generally stays or injunctions are put in place because allowing the action to stand could cause harm. SCOTUS obviously doesn't feel there's any harm in letting Texas arrest and jail illegals for now.

Just got here - so quit hoping that the SCOTUS is going to bail us all out. They have always been built to do exactly what they are doing - split this baby and thus require Americans to fight it out in the end. They are "the useless branch of government" - they always will be.

In that Gov. Abbott *HAS* issued the Legal Proclamation that this IS "an Invasion", then the force of this in the U.S. Constitution DOES give the State a higher and more immediate power, than the distant Seat of the Federal Government.

Further, there is NOTHING in Art.1 Sec.10., that gives the U.S. Government ANY Powers, to Un-Decree the Governor's Decree of Invasion.

Should the U.S. Government send in Agents or Forces to override the Governor's Orders, it shall be THAT Federal Government which is the Party acting outside the boundaries of it's own Constitution and Laws.

But, that won't surprise anyone here....
