Now Sweetdick's Lawyer Is Perjuring Himself, Claiming That All of His Statements About When the Affair Began Were Mere "Speculation" and He Has No Knowledge of Any Kind About the Affair

The hearing is live.

It's frustrating, because the state attorneys (defending Fani and Sweetdick) object to every single question and the judge keeps upholding the objections. Or he keeps telling the anti-Fani lawyer to reframe her questions and establish proper foundation, and she doesn't seem to be able to do so most of the time.

Ashleigh Merchant keeps asking "Did you tell me the affair started in 2019?" or similar questions, and the Fani lawyers object, claiming that she can't ask that question until she's determined that he had any knowledge of the question. And then he lies and says he has no knowledge.

So she can never ask "Why did you tell me about the beginning of the affair if you didn't know?"


These are all lies. Previously he allowed he had information about the affair but could not offer it up because it was learned in lawyer-client communications.

Now that the judge has said that the privilege doesn't apply to many facts, Terrence Bradley is just claiming he doesn't have information at all.

Then why did he previously assert lawyer-client privilege? If he didn't know before, he could have just said "I don't know."

Different society/world. Perjury is a lie under oath. When oaths don't matter, then yeah. This is a totally different matter in the times when oaths were taken seriously.

Theoretically the oath, because of its seriousness, grants credibility to testimony. Since oaths are not today serious, testimony in court under oath has no particular credibility.

Clinton's case at any rate wasn't one where he'd be dragged out of office for being a sexual abuser and molester.

We had to put our dear, sweet, old girl down last month. Still in shock. My wife is pulling multiple extra tutoring sessions and we have to do a ton of travelling for graduations this spring. I am putting down my foot about even considering a replacement until later this summer.

Pretty much. In some ways, civil law systems are more realistic. They believe all witnesses can lie and thus they don't administer oaths. Dossiers compiled by quasi prosecutor/magistrates that include all pertinent information is what the civil law systems rely upon. Not so in common law systems.

But, your best bet on discussing anything with Federale LEOs or in some state LEO's depending on state law is to say nothing without a lawyer. Self defense is one of those border line cases that proves the general rule. To use self defense, you must admit you used force and briefly explain why you did so. If you cannot control your mouth it is better to stay silent.

Martha Stewart went to min sec prison because her discussions with an FBI agent did not match her broker who turned state's evidence and had every reason to lie about whose fault it was.

I think compromised is not quite right - its not that he's a straight shooter but they have some blackmail over him. I think he is part of the organization to get Trump. He has to figure out how to dispose of this case in a way that still leaves the Trump case intact.

Doesn't really work as any decision by the trial judge can be appealed post haste to the Court of Appeals. A previous judge in Fulton disqualified Fani and co from going after Lt. Gov. Burt because of Fani's appearance and contribution to Lt. Gov Burt's general election opponent.

Interlocutory (in the middle of the case before disposition) appeals are rare but in this case, the Court of Appeals will probably hear it as any decision by the judge to allow Fani to go forward could very well be a reversible legal error in failure to apply the appearance of conflict of interest standard in GA law.

Not necessarily Jim. As far as being a witness in a court case, you normally give an affidavit or deposition prior to court usually depending on the type of case. In criminal cases, you have the right to amend your affidavit up to being called to the stand. At that point, any conflict between what you said in the affidavit and what you say on the stand might or might not be perjury depending both state and federal laws which can differ in interpretation.

Affidavits to the government for things like jury service, form 4473, your tax return, etc. require absolute truthiness.

In criminal cases, you have the right to amend your affidavit up to being called to the stand. At that point, any conflict between what you said in the affidavit and what you say on the stand might or might not be perjury depending both state and federal laws which can differ in interpretation.

Affidavits to the government for things like jury service, form 4473, your tax return, etc. require absolute truthiness.

Judges on the hot seat do not work that way. It is always best to allow each side enough rope to hang themselves on and since there is no jury waiting on the ruling--the judge is taking his time as it could affect his legal career going forward.

The snappy rulings on TV rarely happen in real life because trial judges hate to have their rulings overturned by higher courts. Often the higher court sends the case back to them so they have to do their homework all over again.

Dunno about civil procedure laws in California but impeachment of the witness or refreshing the witness memory by introducing their prior statements are used in court in civil cases. Judges are the ones in civil cases that can instigate charges of perjury in testimony (as did the judge in the Clinton case) in this case to the bar of Arkansas with a direction that Clinton be suspended and pay Paula Jones a bunch of money to settle the case.

THIS. Happened in a case I was involved in. To cement her decision, judge said the defendant (who provably perjured himself) was "Very Credible", while the prosecution was "Not believeable". Appeal, from my understanding, is about mis-applied or poorly-applied law resulting in the wrong decision, not the evidence or the judge's "interpretation" of the evidence.

In GA, judges are elected on a non partisan ballot that is held during primaries for statewide candidates (not prezzie primaries) so it is normally a low turnout election anyway with a lot of rolloff where people quit voting before they get to the judicial races. Fulton itself does not have very many competitive races in the primaries but you might be able to see if someone has filed to oppose him.

Technically it is because the judge can determine the 'facts' but whether those 'facts' rise to a conflict of interest or the appearance of a conflict of interest (which is less about whether loverboy or Fani are having it off and more about whether loverboy/Fani have a financial interest in continuing the case).

Trial judges almost universally have stacked case loads and Fulton is no exception. So, having to redo everything means that you are redoing your homework while other cases keep stacking up.

Then there are career aspirations for judges as well. Being overturned on appeal does not look good in a high profile case and being pale, male, and stale does not bode well for federal appointments nowadays. So dunno. Effectively though, an interlocutory appeal on the qualification decision more or less throws any case from summer until probably next year.
