Now Sweetdick's Lawyer Is Perjuring Himself, Claiming That All of His Statements About When the Affair Began Were Mere "Speculation" and He Has No Knowledge of Any Kind About the Affair

The hearing is live.

It's frustrating, because the state attorneys (defending Fani and Sweetdick) object to every single question and the judge keeps upholding the objections. Or he keeps telling the anti-Fani lawyer to reframe her questions and establish proper foundation, and she doesn't seem to be able to do so most of the time.

Ashleigh Merchant keeps asking "Did you tell me the affair started in 2019?" or similar questions, and the Fani lawyers object, claiming that she can't ask that question until she's determined that he had any knowledge of the question. And then he lies and says he has no knowledge.

So she can never ask "Why did you tell me about the beginning of the affair if you didn't know?"

These are all lies. Previously he allowed he had information about the affair but could not offer it up because it was learned in lawyer-client communications.

Now that the judge has said that the privilege doesn't apply to many facts, Terrence Bradley is just claiming he doesn't have information at all.

Then why did he previously assert lawyer-client privilege? If he didn't know before, he could have just said "I don't know."

Techno Fog
@Techno_Fog

Witness Terrence Bradley:

Did Nathan Wade tell you they had sex at Fani Willis's office before she was DA?

"I don't recall"

This is testilying. This is perjury.

But it's working, in the sense that he just refuses to give any information up. All questions are either answered by "Lawyer-Client Privilege," "I have no personal knowledge," or "I don't know" or "I don't remember."

6 Second time posting this only to get willowed. I shan't be willowed again!

A bit of fun:

Wife and I wanted to get the kids a puppy for Christmas but it didn't work out. We held off (which was great because we had some unexpected expenses) but lately I'd been thinking our house could use a little something.

I didn't exactly pray on it but certainly put it out there.

Welp, saint of a woman from our church posted that her dog had puppies that were now available. For free.

We snatched one up. Eight weeks old. He's a ton of fun. Now if you'll excuse me, I need a nap.

There may have been other alliances before WW1, but the Brits and French (along with 6 other nations) ganged up to beat down the Chinese during the Boxer rebellion. I don't know if that speaks more to the universal colonial and anti-Chinese attitudes of the West at the time, or the incredibly stupid decision by Chinese forces to threaten the foreign district housing all the Great Powers of the time. Probably a good time to embrace the power of "and".

Different society/world. Perjury is a lie under oath. When oaths don't matter, then yeah. This is a totally different matter in the times when oaths were taken seriously.

Theoretically the oath, because of its seriousness, grants credibility to testimony. Since oaths are not today serious, testimony in court under oath has no particular credibility.

Clinton's case at any rate wasn't one where he'd be dragged out of office for being a sexual abuser and molester.

Pretty much. In some ways, civil law systems are more realistic. They believe all witnesses can lie and thus they don't administer oaths. Dossiers compiled by quasi prosecutor/magistrates that include all pertinent information is what the civil law systems rely upon. Not so in common law systems.

But, your best bet on discussing anything with Federale LEOs or in some state LEO's depending on state law is to say nothing without a lawyer. Self defense is one of those border line cases that proves the general rule. To use self defense, you must admit you used force and briefly explain why you did so. If you cannot control your mouth it is better to stay silent.

Martha Stewart went to min sec prison because her discussions with an FBI agent did not match her broker who turned state's evidence and had every reason to lie about whose fault it was.

Posted by: The Central Scrutinizer
========
Not necessarily. If you gave a previous statement and then claim on the stand that you cannot recall, the side interrogating the witness has the right to 'refresh' the memory of the witness and at worst can impeach their credibility with are you lying now or were you lying then.

Courtroom dynamics vary depending on whether it is a bench only trial/hearing or whether a jury is involved.

Doesn't really work as any decision by the trial judge can be appealed post haste to the Court of Appeals. A previous judge in Fulton disqualified Fani and co from going after Lt. Gov. Burt because of Fani's appearance and contribution to Lt. Gov Burt's general election opponent.

Interlocutory (in the middle of the case before disposition) appeals are rare but in this case, the Court of Appeals will probably hear it as any decision by the judge to allow Fani to go forward could very well be a reversible legal error in failure to apply the appearance of conflict of interest standard in GA law.

Not necessarily Jim. As far as being a witness in a court case, you normally give an affidavit or deposition prior to court usually depending on the type of case. In criminal cases, you have the right to amend your affidavit up to being called to the stand. At that point, any conflict between what you said in the affidavit and what you say on the stand might or might not be perjury depending both state and federal laws which can differ in interpretation.

Affidavits to the government for things like jury service, form 4473, your tax return, etc. require absolute truthiness.

This is rough. Bradley clearly doesn't want to say a word. The judge is making sure this is by the book as far as what the defendant's attorney is trying to manage. Bradley looks awful no matter how you slice it.

High-tech lynching. I see a white, blonde woman all over a black man and it is upsetting. Shades of the South.

What an absolutely terrible judge -- why is he even allowing this? It's irrelevant to whether Willis has a conflict that adversely affects TFG. If she were to lie about liking dogs or cats more, what difference does that make?

The judge has allowed far too much irrelevant questioning throughout. He should have told the parties to focus on the conflict standard. This has delayed the proceedings and allowed the defense to harm a dedicated public servant—and the public interest.

Judges on the hot seat do not work that way. It is always best to allow each side enough rope to hang themselves on and since there is no jury waiting on the ruling--the judge is taking his time as it could affect his legal career going forward.

The snappy rulings on TV rarely happen in real life because trial judges hate to have their rulings overturned by higher courts. Often the higher court sends the case back to them so they have to do their homework all over again.

Dunno about civil procedure laws in California but impeachment of the witness or refreshing the witness memory by introducing their prior statements are used in court in civil cases. Judges are the ones in civil cases that can instigate charges of perjury in testimony (as did the judge in the Clinton case) in this case to the bar of Arkansas with a direction that Clinton be suspended and pay Paula Jones a bunch of money to settle the case.

THIS. Happened in a case I was involved in. To cement her decision, judge said the defendant (who provably perjured himself) was "Very Credible", while the prosecution was "Not believeable". Appeal, from my understanding, is about mis-applied or poorly-applied law resulting in the wrong decision, not the evidence or the judge's "interpretation" of the evidence.

= in a remarkable display of political fervor, early Christians, covered themselves with pitch, erected crosses, climbed up on those crosses, nailed their feet and hands to said cross, then set themselves on fire. 🔥 it's a thing.

Agreed.
Once the allegation was made, it was on Fannie to prove it wasn't true. That there was no relationship at all.
Not, "we had sex but it wasn't the reason we pushed the case."
Does. Not. Matter.
There can be no relationship.
They have 100% proved there was a relationship.
The relationship itself is the impropriety. It's full-stop, do not pass "go" at that instance. No excuse after that saves the prosecution.

Because a defendant is guaranteed the right to a unbiased prosecution without even the hint of impropriety. Fucking the hired gun and paying him near a million isn't a "hint" it's a mountian.

The judge is fucked: He rules in favor of his local bosses and he gets trashed on appeal. He rules against them and his career is over.

257 It's worth noting that the National Bar Association is a private association of and for black Lawyers.

I have no idea who or how in the NBA would give him advice on anything. What bar associations normally do is put together CLE programs and conferences, sell insurance, and hold meetings where they pass resolutions that mean nothing.

It is NOT the American Bar Association (which itself is a leftist private organization that only represents a small proportion, maybe 15-20% of lawyers, but purports to speak for the whole profession). The two powers that the ABA has that give it more weight than it deserves is that it accredits law schools and it makes recommendations on people nominated for the federal bench.

He can rule in favor of his bosses, maintain his credibility and value to the Party, possibly be overturned on appeal and possibly disrobed one way or another, and will be taken care of by the Party in the unusual way like book deals and department chairs.

309 LOL.

LAPD academy graduating class includes DACA residents. Per federal law, DACA residents cannot possess firearms.

So is LAPD going to field them without weapons? Unlikely. LAPD will most likely illegally provide firearms to "dreamers." It's also possible this information will get public scrutiny and they'll place the "dreamers" in desk jobs.

319 I don't know if this is subject to immediate appeal.

My guess is "no" because otherwise the judge would rule correctly-- he's also in on the fraud to prosecute Trump and an immediate appeal that is guaranteed to go against him scuttles that.
Posted by: People's Hippo Voice
=========
Yes it can be appealed before a trial as to the disqualification decision. Technically it is because the judge can determine the 'facts' but whether those 'facts' rise to a conflict of interest or the appearance of a conflict of interest (which is less about whether loverboy or Fani are having it off and more about whether loverboy/Fani have a financial interest in continuing the case).

320 I watched a trial recently where a witness on cross was being shown her earlier texts where they said, "I wish so-and-so would get a pair and do such-and such"

The lawyer asked, get a pair of what?

The witness, who had been trying to present as all righteous and spiritual and pristine, said, I don't recall.

The whole courtroom fell out, including the bailiff. The witness looked like an idiot.

They would have done better to say, yeah, I was referring to testicles. Wish I hadn't said that -- it was crude but I was angry.

Holy shit, they're really around the bend.
--
Worse.
The "crime" he committed is he did not illegally pay the settlement from campaign funds.
And since he did not illegally pay it from his campaign, it wasn't included in his campaign expenditures.
And that was election fraud on the people of New York who deserved to know that Trump's attorney--without any knowledge by Trump--paid Stormy.
Election fraud on the people of New York--multiple felonies for not committing a campaign finance violation.

330 Right but I still ask is there any real consequence to being overturned, such that one might say judges hate it? They don't lose pay. They can hardly be fired. They can't get demoted.
Posted by: blaster
========
Trial judges almost universally have stacked case loads and Fulton is no exception. So, having to redo everything means that you are redoing your homework while other cases keep stacking up.

Then there are career aspirations for judges as well. Being overturned on appeal does not look good in a high profile case and being pale, male, and stale does not bode well for federal appointments nowadays. So dunno. Effectively though, an interlocutory appeal on the qualification decision more or less throws any case from summer until probably next year.

338 She's involved because she's a model of government, like Kamala & Leticia, etc., who take the too male, too pale, to task because all other White people have had their time. The Black male lawyers get involved because some of Trump's people are POC and also the alleged 'voting rights' issues in Georgia & other swing states will be built upon for the November presidential election.

It's sad; such issues shouldn't drag race into the mix. But for now, maybe half of the other White people are enjoying the show, believing they're winning. Wait until that worm turns & they're feeling it on their own.
