Governor Abbott: When, in the Course of Human Events....

Governor Abbott writes that the federal government has "broken the compact" under which states agreed to loan power to a central government.

It has, as one person said, a definite "When, in the course of Human Events..." steel to it.

January 24, 2024

The federal government has broken the compact between the United States and the States. The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now. President Biden has refused to enforce those laws and has even violated them. The result is that he has smashed records for illegal immigration.

Despite having been put on notice in a series of letters--one of which I delivered to him by hand--President Biden has ignored Texas's demand that he perform his constitutional duties.

* President Biden has violated his oath to faithfully execute immigration laws enacted by Congress. Instead of prosecuting immigrants for the federal crime of illegal entry, President Biden has sent his lawyers into federal courts to sue Texas for taking action to secure the border.

* President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The effect is to illegally allow their en masse parole into the United States.

* By wasting taxpayer dollars to tear open Texas's border security infrastructure, President Biden has enticed illegal immigrants away from the 28 legal entry points along this State's southern border-- bridges where nobody drowns--and into the dangerous waters of the Rio Grande.

Under President Biden's lawless border policies, more than 6 million illegal immigrants have crossed our southern border in just 3 years. That is more than the population of 33 different States in this country. This illegal refusal to protect the States has inflicted unprecedented harm on the People all across the United
States.

James Madison, Alexander Hamilton, and the other visionaries who wrote the U.S. Constitution foresaw that States should not be left to the mercy of a lawless president who does nothing to stop external threats like cartels smuggling millions of illegal immigrants across the border. That is why the Framers included both Article IV, sec. 4, which promises that the federal government "shall protect each [State] against invasion," and Article I, sec 10, Clause 3, which acknowledges "the States' sovereign interest in protecting their borders." Arizona v. United States, 567 U.S. 387, 419 (2012) (Scalia, J., dissenting).

The failure of the Biden Administration to fulfill the duties imposed by Article IV, sec. 4 has triggered Article I, sec. 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, sec. 10, Clause 3 to invoke Texas's constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border.

I don't know if this invokes new action at all, as he just announces that he's already declared an invasion. He does seem to be threatening that his police and agents will act to defend Texas, and will ignore any federal statute which presumes to tell them they may not defend their own land. Declaring the state's power to defend itself to be supreme to any federal "law" is a big declaration.

Will anything concrete flow from that? I don't know. Maybe this is just saber-rattling.

Sometimes you do need to rattle the saber. Sometimes you even need to draw it out.

Apparently Paxton has said that Texas forces will not permit the feds to enter the park and cut the wire. Remains to be seen if that holds.

I have been saying that for years. The law gives the federal government the right to control legal immigration.

It does not give them the right to allow illegal immigration.

Federal agents, are just that according to the Texas Constitution. They are special agents. They are not law enforcement. They can be arrested by the County Sheriff.

That's almost a certainty at this point. It remains to be seen if Texas will return the favor by arresting Feds for "trespassing" on Texas-owned property.

It is also obviously true.

The People's Rights are most concentrated at the level of our State legislatures. It is those State legislatures which ratify the Constitution, the only permission that the Federal government has to so much as exist. If the Federal government were to be removed, every bit of infrastructure erased, every one of its personnel rendered unto God for judgment, every trace of its laws erased, we would still be organized at our State level, for as long as we chose to do so.

I've been watching Abbott closely for months, and you may recall I have always defended him here, even when others harshly criticized him for not doing much. I say that to back up my belief that I understand his intentions here; the goal he is actually going for.

He is a highly intelligent strategist, an dhas spent the last 3 years setting this up. He knows very well that he (and Texas) does not have the resources to "win" any physical confrontation; BUT he also understands the politics of all this on a national level, which is why his buses have been so successful. I believe is he intentionally trying to provoke the Feds into a heavy handed physical intervention, perhaps even sending the US Army down to the border to take it over. He would do this if he believes the optics of using the Army to assist illegal immigration would be bad enough to finish off Biden's political career.

It was only an injunction and so the lack of specificity was not unusual. But that said, in a case where it seems pretty clear (at least to the dissenters) the plaintiffs would clearly suffer demonstrable harm vis a vis the continued subversion of our immigration system, it's pretty inexcusable. How can you look at the border and deny an injunction where there is already years of material harm and deny it? That requires an explanation and looks like an arrogant, extra constitutional move if you don't. It looks like ACB and Roberts went with the latter and DGAF.

At least on the Republican side the polls are showing that illegal immigration is the number 1 or 2 issue on the minds of most voters. I think Abbott relishes the position of trying to stop illegal immigration while Biden is doing everything he can to not do his job and flood the country.

Abbott has a fairly weak hand when arguing border security under the Constitution so why not highlight the problem is Biden isn't doing his Constitutional duty. Make Biden very publicly own it.

I read an article about what the original rebel yell sounded like along with some oldytime recording of a surviving soldier and it was basically teenage girl screeching. Nothing other than the aforementioned 25 mile easement that the Feds have granted themselves. One of the complications of the Texas Border is that almost all of it (except in park areas like Big Bend) is purely private property. The Eagle Pass property where this confrontation is going on is a City Park, I believe.

I'm not sure that's correct. The actual law requires the government to stop illegals. That was part of what was so heinous about the Senate's "comprehensive" bullshit. It specifically called for a certain number of illegals to be admitted.

At the moment, however, Biden is choosing to ignore the law. Moreover, he's ordered federal forces to specifically violate the law. The Constitution does not permit that. The courts have said that the Constitution permits the administration to do whatever it wants (provided Trump isn't President) but their say-so doesn't make it so. Time to point that out.

In order for it to be parallel, the federal government would have to be violating federal law, ignoring its duties under the Constitution, and interfering in the state's attempts to do the Constitutional duty which the federal government had abandoned.

That's one of the fun facts - ther e is not much Federal Land in Texas, outside of a few national forests, parks, and grrasslands. And the Federal military bases. This is because Texas had title to all of it before they joined the US, and kept it.

That's what screwed up the other Western States, the Feds held title to the land before they became States, and never gave it up.

There have been a lot of cases over the years over border security and the SC has made it pretty clear, as does the Constitution, that the federal government is responsible for border security not the individual states.
