Senate Bill 4 from Special Session #4 makes illegal entry into Texas from a foreign country a criminal offense. The law is the latest attempt by the state to crack down on migrants illegally entering the state between ports of entry. By creating the offense of illegal reentry, offenders can be penalized with sentences of up to 20 years in prison. It also provides the mechanism to order an offender to return to the foreign nation from which they entered or attempted to enter this state. The law provides civil immunity and indemnification for local and state government officials, employees, and contractors for lawsuits resulting from enforcing these provisions.This is an interesting legal problem. Biden will sue Texas, claiming that Texas has no right to make its own law in this area, because the federal government has a special, constitutionally-granted power to make law affecting the border and a state cannot contradict the laws set forth by the federal government. But... does this state law contradict the federal law? There is a federal law against illegally entering the country -- Biden is just ignoring that law. Now, maybe state law has to yield to federal law, but state law doesn't have to yield to a president's mere policy of ignoring a federal law on the books. But I think this law might fall, because the Texas law is different than the federal law. The federal law begins as a misdemeanor for first offense, then becomes a felony with the second offense. The Texas law is a major felony on the first offense. I'm afraid that Biden will argue that this law is superseded by federal law and it will be struck down. However, as a back-up, Texas can pass a law criminalizing illegal entry that substantially tracks with the federal law. Then Biden cannot argue that Texas is attempting to supersede superior federal law. Then, Texas will have the power to enforce the law that the Biden Administration has chosen not to enforce. And what will a court say then? That a president's lawless decision to ignore the standing law of the US also trumps state law? I don't think so. Even if Abbot knows it'll fail, he's playing the game Democrats play. Create a law, and make the opposing party fight it and defend their stances.
Even if Biden wins, it'll force his administration to go on the record that they don't believe in securing the border. If, in the interim, this dissuades a few hundred people from crossing the border, it did more than 99.9% of politicans have been doing. All the federal government has to do is enforce their own laws and many of the problems we see in this country would disappear. The fact that they do NOT enforce them--or only under very selective circumstances--makes it fairly clear that some laws are simply not laws at all. They should be removed from the books entirely. It is much more about *knowing* violations. If an employer uses e-verify and the guy checks out (e.g., his stolen identity is complete enough), why should the business be punished for that? Mandatory e-verify with a fixed timeline for resolving the problem is much better, with punishments on a sliding scale according to the scope of the issue - something like a baseline penalty of the entire cost of the person's labor (pay and benefits, if any), plus 10%. If you have two offenses, it's plus 20%. Etc. After a point, then get into massive flat-rate penalties and criminal prosecution. Why not? Set aside political will and consider the logistics. It's doable. This is what internment camps are for, with attached express-lane courts. When an illegal engages with the government, he's arrested. Once arrested, he's given the choice to be repatriated or claim asylum. If he claims asylum, he's sent to the internment camp to await adjudication. If his claim is approved, he's handed his papers and sent back to where he was found. If not, he's deported. If they have kids born here, he can take them back home with him or they can go into an orphanage - parent's choice. The number of people who will "self-deport" under such a scheme would be staggering. At least half of the illegals would be back in Latin America within a year, either voluntarily or through the process. On the whole federal vs state law, if say state police came across an operation that was counterfeiting US dollars, they certainly have the right to arrest these people. Even if that is a specific federal law that is in question.

So they only reversed course because they were too gutless to deal with the fact their policy was bullshit, and pretended they didn't know how bad it was. They did. And then subsequently violated their own policy by suspending him for... what, the whole season? There is definitly precedent for Texas law being enforced at the border. Back in the early 60's, I took a little sojourn across the border to Juarez. I played turista for two days, and then bought a bottle of tequila as a souvenir to return to PA - this was when Mexican restaurants were a novelty in the mid Atlantic. But I digress... As I returned across the border into El Paso, I had to pay Texas an import tax-I think it was 20 cents- on the booze.
