Texas Gov. Abbott Signs Law Making Illegal Entry from Mexico a State Crime
Shame you'll be siding with California in the Hollywood-craved civil war.Texas Governor Greg Abbott signed a bill making Texas the first state in the union to give law enforcement officers the authority to arrest migrants who illegally enter the state. The measure, SB 4, was signed into law on Monday during a ceremony at the base of the border wall in Brownsville, Texas. The bill is part of a package of measures designed to decrease the flow of migrants entering the state from Mexico. The Texas Legislature passed the bills during two special sessions this fall. ... Senate Bill 4 from Special Session #4 makes illegal entry into Texas from a foreign country a criminal offense. The law is the latest attempt by the state to crack down on migrants illegally entering the state between ports of entry. By creating the offense of illegal reentry, offenders can be penalized with sentences of up to 20 years in prison. It also provides the mechanism to order an offender to return to the foreign nation from which they entered or attempted to enter this state. The law provides civil immunity and indemnification for local and state government officials, employees, and contractors for lawsuits resulting from enforcing these provisions.This is an interesting legal problem. Biden will sue Texas, claiming that Texas has no right to make its own law in this area, because the federal government has a special, constitutionally-granted power to make law affecting the border and a state cannot contradict the laws set forth by the federal government. But... does this state law contradict the federal law? There is a federal law against illegally entering the country -- Biden is just ignoring that law. Now, maybe state law has to yield to federal law, but state law doesn't have to yield to a president's mere policy of ignoring a federal law on the books. But I think this law might fall, because the Texas law is different than the federal law. The federal law begins as a misdemeanor for first offense, then becomes a felony with the second offense. The Texas law is a major felony on the first offense. I'm afraid that Biden will argue that this law is superseded by federal law and it will be struck down. However, as a back-up, Texas can pass a law criminalizing illegal entry that substantially tracks with the federal law. Then Biden cannot argue that Texas is attempting to supersede superior federal law. Then, Texas will have the power to enforce the law that the Biden Administration has chosen not to enforce. And what will a court say then? That a president's lawless decision to ignore the standing law of the US also trumps state law? I don't think so. Maybe they'll get lucky and get a Hawaiian judge to agree to such a rule, but an the Fifth Circuit apcourt won't bless that.
The law is similar to a current federal statute under Title 8 of the United States Code 1325, which makes illegal entry into the United States a misdemeanor offense for a first-time offender and a felony for a second offense. Under the current administration, the federal statute is not pursued to any significant degree. Also similar to proceedings carried out under federal law, migrants may agree to return to their home country as part of sentencing agreements. The process in federal courts is known as Stipulated Deportation, where a previously deported migrant waives his right to a separate immigration hearing and agrees to removal as part of the sentencing process.

If, in the interim, this dissuades a few hundred people from crossing the border, it did more than 99.9% of politicans have been doing.
If you can't make laws to stop immigrants, do what you can do PR wise, through trying to pass harsh laws, to scare the shit out of ther immigrants. We can't deport all 40 million who Biden let in, but if you make them scared and uncomfortable, hopefully some will self deport, until there's an easier way yo get rid of them all (which we won't be able to do because of their anchor babies)

At what point does a law that is seldom or never enforced cease to be a law at all?
All the federal government has to do is enforce their own laws and many of the problems we see in this country would disappear.
The fact that they do NOT enforce them--or only under very selective circumstances--makes it fairly clear that some laws are simply not laws at all. They should be removed from the books entirely. Or enforced to the hilt wherever and whenever they may apply.

It is much more about *knowing* violations. If an employer uses e-verify and the guy checks out (e.g., his stolen identity is complete enough), why should the business be punished for that? Mandatory e-verify with a fixed timeline for resolving the problem is much better, with punishments on a sliding scale according to the scope of the issue - something like a baseline penalty of the entire cost of the person's labor (pay and benefits, if any), plus 10%. If you have two offenses, it's plus 20%. Etc. After a point, then get into massive flat-rate penalties and criminal prosecution.

If Abbot were to do what you're describing - and I would like to see it, don't get me wrong - then there would probably be an actual military response by *our* military to prevent it. Getting other countries involved - which deportation necessarily does - becomes an international crisis immediately if it is not done by the "legitimate" authority.
What Abbot and DeSantis are doing is trying to square the circle by shifting them to the places where the power structure demands their presence.

I booked everything online and they said to be there exactly on time - not earlier not later.
When I got there the building was full of people sitting/standing around (guess COVID is really over?) and was directed into a line.
They gave me a bunch more forms (of course) including a note that if I was an illegal they'd take WHATEVER paper work I had.
An hour later I finally got to take to a human being who informed me I was missing a piece of ID they wanted.

Why not? Set aside political will and consider the logistics. It's doable. This is what internment camps are for, with attached express-lane courts.
When an illegal engages with the government, he's arrested. Once arrested, he's given the choice to be repatriated or claim asylum. If he claims asylum, he's sent to the internment camp to await adjudication. If his claim is approved, he's handed his papers and sent back to where he was found. If not, he's deported. If they have kids born here, he can take them back home with him or they can go into an orphanage - parent's choice.
The number of people who will "self-deport" under such a scheme would be staggering. At least half of the illegals would be back in Latin America within a year, either voluntarily or through the process.

When an illegal engages with the government, he's arrested. Once arrested, he's given the choice to be repatriated or claim asylum. If he claims asylum, he's sent to the internment camp to await adjudication. If his claim is approved, he's handed his papers and sent back to where he was found. If not, he's deported. If they have kids born here, he can take them back home with him or they can go into an orphanage - parent's choice.
The number of people who will "self-deport" under such a scheme would be staggering. At least half of the illegals would be back in Latin America within a year, either voluntarily or through the process.

Why not? Set aside political will and consider the logistics. It's doable. This is what internment camps are for, with attached express-lane courts.
When an illegal engages with the government, he's arrested. Once arrested, he's given the choice to be repatriated or claim asylum. If he claims asylum, he's sent to the internment camp to await adjudication. If his claim is approved, he's handed his papers and sent back to where he was found. If not, he's deported. If they have kids born here, he can take them back home with him or they can go into an orphanage - parent's choice.
The number of people who will "self-deport" under such a scheme would be staggering. At least half of the illegals would be back in Latin America within a year, either voluntarily or through the process.

Related to previous thread- I’m now down to 194 from 355. Have run three 5 Ks, last one averaging 11 min miles. Strong, 17” biceps, doing resistance training, dips, pull-ups,, sit-ups, push ups. Near 10% body fat, even have abs. I can walk, sleep, tie shoes, etc. no more gout, snoring, constant foot pain, breathlessness

The problem with the Ray Rice thing was, his suspension met NFL's guidelines. It was a p.r. problem that they had, not one of not knowing how bad it was.
It was proven beyond any reasonable doubt, the NFL had the video from the elevator almost immediately after the incident. So they only reversed course because they were too gutless to deal with the fact their policy was bullshit, and pretended they didn't know how bad it was. They did.
And then subsequently violated their own policy by suspending him for... what, the whole season? And then it became quite clear, Rice was expendable, because he was basically washed up by then anyway.
Stalwart moral leadership there, Mr. Goodell.

There is definitly precedent for Texas law being enforced at the border. Back in the early 60's, I took a little sojourn across the border to Juarez. I played turista for two days, and then bought a bottle of tequila as a souvenir to return to PA - this was when Mexican restaurants were a novelty in the mid Atlantic. But I digress... As I returned across the border into El Paso, I had to pay Texas an import tax-I think it was 20 cents- on the booze.
IOW, Texas law (an import duty) was enforced at the border. If I didn't pay it, I couldn't enter the US.
Let's see if this is brought up in all the legal wrangling about to ensue.
