73 Btw, some folks conflate omnibus versus continuing resolutions. They are not the same. Omnibus simply means folding spending bills into a large package. But it sets new permanent discretionary spending levels (aside from entitlements) for agencies.

Continuing resolution means that the last spending bill levels (passed by Dems during Biden's first term) approved for an agency continue and that includes projected increases in spending.

Since 2011, we have been running the House and Senate under Continuing Resolutions for the most part instead of regular budgetary order. For the most part, that meant Democratic spending levels continued into Republican Congresses.

this makes me wince. They always said the same thing about Obama - "he's a constitutional lawyer". What does that mean to these people?

I'm a litigation attorney. I have represented a lot of law enforcement and state agency employees. So, I have seen a lot of Section 1983 litigation over constitutional issues like excessive force, false arrest, malicious prosecution, first amendment issues, due process, etc. I've even worked on some 2nd amendment issues.

I've briefed and argued those issues for over 25 years at every level of court except SCOTUS (I've had a couple of opponents try to get certiori, but it didn't happen). I've never referred to myself as a "constitutional lawyer", but I think I probably have as much right to that title as any other attorney and certainly more so than Obama ever did.

What do these people think that term means? At a law school it just means a professor who teaches a con law subject.

I just fell like that term has no real meaning.

Gaetz claimed to Bannon that McCarthy was behind all of the turmoil as he thought he would be able to return as speaker (his supporters even floated the weird co-speaker idea). Apparently McCarthy was the only one to reject adopting Johnson by unanimous consent after he won the last round of voting during the conference for GOP lawmakers.

Johnson then demanded a roll call vote where members had to declare themselves and whaddaya know, the opposition magically vanished with a few members voting present or absent but no negative votes.

All the folks supporting McCarthy really hate the idea of a conservative Congress and their conservatism is to process not policy.

I think there is a huge difference between realizing you can't pursue a hard-right agenda because you don't have the votes and actively shitting on the actual conservative members of your caucus. MNW, you do know that motion to vacate the chair was unchanged from one individual making a privileged motion by Pelosi. The rule itself requiring only one vote was in the House Rules since Speaker Cannon over one hundred years ago. If all other speakers could live with that rule until Pelosi, then McCarthy and you btw should have no beef about it. It is a conservative rule in that it makes the leader responsive to their own party rather than the opposition.

Places with no such rules like Texas often have a RINO speaker and a few assorted RINO creeps that made deals with the Dems to stay in that office.

If you have a party system, you have to have leadership accountable to the rank and file which is Parliamentary 101.

The mechanics of the Senate prevent it from working.

Majority leader is just that, the leader of the majority (same with minority). There's no floor vote for the president of the Senate because that's constitutionally the VP, and they don't have any real power in the Senate anyway.

All Mitch needs to do to retain his power is get a majority of Republican senators to vote for him behind closed doors, and that's easy to do since he controls so much election money.

McCarthy was a fool. I think this whole thing has more to do with changing attitudes within the GOP and the GOP base than people realize. The GOPe wants to go back to the pre-Trump era when they lied to us, played failure theater, etc. and helped the left further its agenda. Some (unfortunately too few) GOP house members don't want to go along with that anymore and the base definitely doesn't want to go along with that anymore. Which gave Gaetz the gonads to take his shot. McCarthy and much of the caucus thought they could beat back this revolt and either reinstall McCarthy or someone just like McCarthy and they couldn't.

I think this, in hindsight decades from now, will be seen as a turning point.

McCarthy objected to a unanimous consent request in conference to adopting Johnson as the GOP nominee for speaker by acclamation. Instead three hours were wasted and Johnson wisely demanded a non-secret roll call vote in conference. No GOP member went on record at conference against Johnson with all those votes for members not running for Speaker magically disappearing.

The mechanics of the Senate prevent it from working.

Majority leader is just that, the leader of the majority (same with minority). There's no floor vote for the president of the Senate because that's constitutionally the VP, and they don't have any real power in the Senate anyway.

All Mitch needs to do to retain his power is get a majority of Republican senators to vote for him behind closed doors, and that's easy to do since he controls so much election money.

Trump is trying to set it up so that he has allies in congress if he gets another shot as president. I can't imagine Trump knew or really liked McCarthy. And I realized that when Trump endorsed McCarthy.

I don't expect Trump to be perfect on everything or right on everything. that would be silly.

Plenty of folks in the bottom 40% swear up and down they pay Federal taxes. Because of FICA. That's not going away.

Ironically, Social Security is the easier fix. Basically the retirement age will be raised from 67-70 for full retirement and partial at 65. Same old as the Reagan fix was in the 80's. Medicare is the one that is a real mess. To keep it going as it is, a combination of things is going to be required such as maybe doubling the Medicare tax, more limits on coverage, and encouraging people to stay on private insurance longer. EOL treatment guidelines will continue to get stricter aka death panels as to justifiable care.

Medicaid is something else that is going to burst the budget but strictly speaking is not a retirement program.

1. FICA is already a tax and it is 15.4%. That's what self employed people pay.

2. That 40% really don't because they get the "earned income" credit which is a rebate of their half (7.7%) of the FICA tax.

Watched part of the Speaker voice vote today, and noticed something: The Republican members usually (like 90%) voted for "Mike Johnson", whereas the Dems only used "Hakeem Jeffries" about 20% of the time. I guess they're a little sensitive about the Muslim name. Which is funny, because we now have co-religionists controlling the House; both Jeffries and Johnson are Baptists.
