Hunter Biden's "Business" Partner Says a $3 Million Payment From China Was a Gift -- a "Thank You" -- and that "Loans" Granted to Hunter Were Never Repaid, Making Them Also Disguised Gifts (and Unreported Income)

Money you get via a loan is not income and isn't declared on taxes, because you're supposed to repay it. Thus it's a zero-gain transaction. You get the loan, but then you repay the loan (almost always with interest) and hence you have no net income on the transaction.

If you repay the loan, that is.

If you never repay it, it is income. You're supposed to declare, retroactively, the income gained through a loan which is later forgiven or written off.

Update: Joe Mannix corrects me. The giver of the fake loan could also declare it as a gift and pay taxes on it himself.

I doubt very much that the Chinese Communist government alerted the US government that they had given a "gift" (a bribe, of course) to Hunter Biden and then paid the taxes on the transaction.

And, is is probably the case with Hunter Biden -- if you call gifts and outright "bribes" "loans" just so you don't have to pay taxes on them or acknowledge payments coming to you from foreign governments, then that's both tax evasion and a Foreign Agent Registration Act violation.

And that's what Hunter Biden's "business" partner Rob Walker says was going on with "loans" from "business" partners.

These are all very, very thinly disguised bribes. He's a fucking criminal and so is his rapist/molester father.

And Merrick Garland is meanwhile throwing pro-life protesters in jail.

For months, congressional Republicans have suggested that when Hunter Biden received millions of dollars from places like Ukraine and Romania, an $80,000 diamond from China and a luxury car underwritten from Kazakhstan he was simply trading on his powerful family name and not really conducting meaningful business. But Democrats have scoffed, painting these facts as part of a conspiracy theory.
But now GOP House investigators have found a powerful ally for their narrative: former Hunter Biden pal and business partner Rob Walker, who told the FBI in a newly released interview report that Hunter Biden often got something for essentially nothing.
In an FBI FD-302 interview report dated Nov. 23, 2021, Walker recounted to agents how Hunter Biden borrowed $90,000 from him and never repaid it and detailed another instance in 2017 in which one of their joint business ventures got a whopping $3 million payment from the Chinese energy firm CEFC essentially as a gift.
"The $3 million amount was more of a "thank you" from CEFC. They talked of putting together a larger group and discussed acquiring office space," Walker is quoted as telling agents in the report.

He got paid $3 million from China for merely talking about starting a business and opening an office.

I don't know when this bribe was paid. But that's important, because the alleged "Trump-appointed" "prosecutor" David Weiss allowed the statute of limitations on his 2014 and 2015 tax evasion crimes to run, almost certainly because the money that was undeclared in those years came from the Chinese government and involved his father.

Walker's account to the FBI adds to a mountain of evidence that Hunter Biden was often given loans that he never repaid or gifts from foreign interests (even a Democrat donor) simply because of his last name when his father was vice president and while contemplating a run for the presidency.
The list includes a 3-carat diamond from CEFC's founder, $142,300 from a Kazakhstan businessman to buy a luxury Porsche, the $3 million Chinese payment and more than $2 million in payments later converted to loans that came from a Democratic-donating lawyer from Hollywood who helped Hunter Biden pay off many of his delinquent IRS tax debts.

Even salary payments from Burisma Holdings in Ukraine were structured to look like loans for Hunter Biden, which IRS agents believed were designed to evade tax payments.
"[Hunter Biden] directed to have a portion of his Burisma income paid back to himself personally as 'loans', even though Devon Archer had deducted these payments on the Rosemont Seneca Bohai tax return," former IRS Agent-turned-whistleblower Ziegler wrote in his first affidavit to House Ways and Means. "[Hunter] had essentially loaned himself his own income from Burisma, failing to report this income from Burisma on his 2014 tax returns and failing to pay the taxes on this income."

This is unambiguously tax evasion, and also clear evidence of attempting to hide the income. Money laundering, in other words. And a violation of FARA.

House Oversight Committee Chairman James Comer told the "Just the News, No Noise" television show that there is a clear pattern in the evidence his investigators have gathered: a loan to Hunter Biden really meant it was a gift.
"You know, there's a term called a forgivable loan. And that is more than likely what these things were," Comer said. "You know, you give stuff as a gift or a loan so you don't have to report it on your taxes. This is another example of the Biden family and their organized criminal activity trying to avoid paying taxes. The Biden's are tax cheats.

Remember, Hunter Biden's "Sugar Brother" Kevin Morris "loaned" him $2 million to pay off his delinquent taxes.

I have not heard of Hunter Biden making any loan repayments yet.

It's another gift, and it's yet another round of tax evasion and money laundering.

That's option 1.

Option 2 is that the person who gave you the loan declares it as a gift and pays the taxes on it.

Either way, the taxes must be paid. The gift tax is so high that it usually makes more sense to declare it as income, even if you need a gift to pay the income tax.

But I wonder how many of these "gifts" had the gift tax filed and paid (or deferred out to the estate, up to the limits) by the benefactor.

Yup. And if you do that and the IRS finds out - unlikely, if you and the other person both trust each other - then you're penalized as the giver.

This can cut both ways - making a loan on very long terms to *avoid* the gift tax. If you've ever given someone a down payment, you've been through this. Lenders to do not accept down payment "gifts" that are actually loans, and have lots of endorsement paperwork required by both parties that explicitly describe it as *not* a loan, but a gift. It is also handed over to the IRS and so the giver had damn well better declare it and pay the tax or deduct it from his estate.

The IRS is ruthless about the gift tax because it is so stupendously huge.

Gifts come out of the "lifetime exclusion" pool, which is the same pool as is used for the death tax. As soon as a gift exceeds the annual exclusion $17k (this year), it is subject to the gift tax.

When you give a gift, you can give it tax-free up to the exclusion (which is $12.92 million this year) - but it reduces the size of the exclusion. If you give someone a million dollars and defer the taxation, it reduces the tax exemption for your estate - when the time comes - to $11.92 million. You pre-spent some of the exclusion.

If you don't want to reduce the exempt value of your estate - or you have already given away enough to exhaust the exemption - you have to pay the gift tax. The bottom tax rate (gifts up to $10k over the annual exclusion) is a whopping 18%. The top tax rate (gifts $1 million or more over the annual exclusion) is 40%.

Avoiding the gift tax is a big deal, and creates a lot of fraud for obvious reasons. It amounts to staggering sums, either today or when you die.

Where the IRS might care is if I "give" someone $10k and they then "give" me $12k the following year. That would be $2k interest on a loan that I would have to report as income.

The Gift/Estate tax is US person to US person. If we still had a legal system, none of this would have any applicability to Hunter since it was a Chinese Company and it was not a gift.

I got one of those once. Said I owed them thousands of dollars because they misunderstood a stock transaction. Shortfall, penalties, interest.

The letter had one date. It was postmarked the next day. Three days in transit. Response due within 10 days of the letter date. In effect, the IRS gave me six calendar days to respond. I went to my tax guy and we filed an amended return that did show an error on my part - but in the wrong direction. I had overpaid my taxes by a couple of hundred dollars that the IRS had to return to me.

The IRS acknowledged my response and said they'd get back to me within 90 days. They gave me six days to respond and took 90 days to acknowledge their own error.

This, Secretary Yellen, is why people hate the IRS.

That's the Gov't for you. I have a close family member that once worked for a company, not realizing they were selling knockoff stuff. She was approached by agents who questioned her (becuase her work there was almost at the statute of limitiations). She found out she had a court appearance THE NEXT DAY. They wanted to get her so bad they set things up hoping she would not show to court. When she did, the charges were sealed pending arrests of others. In the end, she spent no time in jail and was on probation for a few years.

It will probably need to be higher than that, but I disagree with "all consumer goods." It should apply to all *new* goods and services purchased by the end user.

Buy a brand new house? Subject to the tax. Buy a used house? Not subject to the tax. Buy a brand new washing machine? Subject to the tax. Buy a used washing machine? Not subject to the tax. So on and so on for everything. This has the purpose of avoiding double-taxation and exemption rules (it''s simple and fair) and has a side effect of encouraging longer-lasting durable goods, since resale will be a real factor to consider and new big-ticket goods have to be worth it to justify paying the tax (e.g., they have to have adequate quality).

Before the early 90s before internet filing was everywhere I had them come after me for something like $60. Granted that's $20,000 or so in today's money, but it was at a time when I was scraping and barely surviving, and they contacted me at work to discuss it. It took multiple phone calls, days, hours on the phone, and agents to resolve. I'm certain it costed taxpayers well over $1500 to get that $60 from a 22 or so year old.

And everyone has either had this happen to them, or knows someone one step away who had it happen to them.

Try the FDIC limit and the reporting limit for cash withdrawals.

The Currency Transaction Report dates back to the Bank Secrecy Act of 1970. It was $10k then, and it is still $10k now. Inflation-adjusted it, it should be around $80k today.

At the same time - 1970 - the FDIC limit was was $20k and so the reporting requirement was 50% of the FDIC limit. With today's $250k FDIC limit, the reporting limit should be $125k.

So it *should* be at least 8x and potentially as much as around 12x higher than the $10k it has been since 1970.

You can gift someone up to $13,000,000 in your lifetime / death (including from your estate) without triggering taxes. This changed fairly recently, the number used to be much lower (the so-called "death tax")

But any annual gift above $17,000 (IIRC) to an individual triggers an IRS reporting requirement.

In my state, sales tax is paid on a schedule based on MSRP and depreciation. So a $50K MSRP new car that's 6 years old will be taxed at a value of $18,736 or whatever. Doesn't matter if you paid $1 or $50K for it. The sales tax is on $18,736.

Then so be it. If people want to piss money down Hunter Biden - or any other crackhead - it's their money and up to them. In this case, of course, it's actual bribery and racketeering which are already illegal - but setting that aside, it's just one fool giving money to a buddy and there is no reason that should be taxed.

If someone is stupid enough to lend that person money and eats the loss after the borrower dies, well, that's a risk the lender should have managed. He could - and should - have demanded escrow or collateral.

They already do that. My house value was reassessed last year, and they almost doubled the value, which doubled our yearly taxes. We could never afford to buy our house now at the price they say it's worth, but have no choice to pay almost 10k in yearly taxes on unrealized value.

Most of them have highly-structured dodges in place to avoid all those taxes. Most of the money from the estate tax comes from families with large asset bases - farmers come immediately to mind. Yeah, it does hit some of the bastards you're describing, but most of them have lots of shields in place.

I don't see how it works, to be honest.

First off, the exemption level would have to astronomically high, otherwise the upper middle class would lose their shit when they got taxed on "unrealized gains" based on the increased value of their homes.

Then you have the problem that its NOT income, so I don't know how we fit that in to the 16th amendment.

Then you have the practical problem with how do you structure this tax? Year over year growth on something like stock value? What happens if it goes up year 1, drops year 2, goes back up year 3, etc? Elon Musk et al. are selling their stocks to cover the taxes on shares every other year until they have no more equity in the company? Not to mention selling all of those shares will sink the stock price.

I was pretty pissed when they stopped allowing income averaging. You have a fabulous year and sell a whole lot of houses and the next year everything crashes and they don;t give you any of that tax money back. When the housing market crashed, my FAFSA contribution for my son's college was more money than I made that year.

Two different things. That's the property tax assessor and there are ways to keep those kinds of excesses in check but most places don't have them.

An "unrealized gain" tax is a new tax on paper gains that is owed to the IRS. It could be real estate, stocks, etc.

Those polls were off...by a lot, and they were done right before the election.

But let's keep trusting polls 14 months out from a presidential election like they mean anything.

a) not exactly small family farmers
and
b) should be savvy enough to hire a lawyer to put the land in a trust, then there's no triggering event when someone dies.

but that is the problem with this tax structure in the first place -- it's trivially easy to get around it assuming you shell out a few grand for a lawyer.

Which is why I want to see it *all* scrapped. No income taxes at all. No capital gains taxes. No estate taxes. No gift taxes.

All federal revenue is raised with tariffs and a 10% consumption tax (sales tax) on new goods and serviced purchased by the end user. No exemptions, no exceptions, no other form of taxes. Prebate it at the poverty line if you want to make it somewhat progressive.

Opiates are not bad in and of themselves. There is almost zero risk of addiction IF they are used properly for acute pain. They are also far milder on your system than many over the counter meds that mess up your liver. The junkies wrecked it for people with legit pain.

I don't discuss covid issues because of what I have lost because of it - and its impact on my life is less than quite a few others - but I recently started relistening to a podcast that wrapped up in 2017 that was archaeologists debunking Art Bell level theories about ancient technologies and the like.
The terms they used and the attitudes about truth, fact, verification, peer review and credentialism was a slap in the face when I thought about 2020 to today.
Falsification of hypothesis is a huge issue in the scientific process. The attitude I kept getting was that falsification is only useful in debunking non-approved thought, as if peer review and credentials is armor against anything in the view of the current replication crises developing in all areas of science research.
