The giver of the fake loan could also declare it as a gift and pay taxes on it himself. I doubt very much that the Chinese Communist government alerted the US government that they had given a "gift" (a bribe, of course) to Hunter Biden and then paid the taxes on the transaction. And, is is probably the case with Hunter Biden -- if you call gifts and outright "bribes" "loans" just so you don't have to pay taxes on them or acknowledge payments coming to you from foreign governments, then that's both tax evasion and a Foreign Agent Registration Act violation. However, if you never repay it, it is income. You're supposed to declare, retroactively, the income gained through a loan which is later forgiven or written off.
++++ That's option 1. Option 2 is that the person who gave you the loan declares it as a gift and pays the taxes on it. Either way, the taxes must be paid. The gift tax is so high that it usually makes more sense to declare it as income, even if you need a gift to pay the income tax. But I wonder how many of these "gifts" had the gift tax filed and paid (or deferred out to the estate, up to the limits) by the benefactor. In an FBI FD-302 interview report dated Nov. 23, 2021, Walker recounted to agents how Hunter Biden borrowed $90,000 from him and never repaid it and detailed another instance in 2017 in which one of their joint business ventures got a whopping $3 million payment from the Chinese energy firm CEFC essentially as a gift.

For us plebes, a loan made, to be considered a loan and not a gift, must have a realistic interest rate and be paid back.
I know, I made a large loan to someone once (which I regret, even though there was collateral). I didn't want the IRS coming after me. In the Hunter case, we ALL know these "loans" were never meant to be repaid, and were therefore gifts or compensation hidden as loans. ++++ Yup. And if you do that and the IRS finds out - unlikely, if you and the other person both trust each other - then you're penalized as the giver. This can cut both ways - making a loan on very long terms to *avoid* the gift tax. If you've ever given someone a down payment, you've been through this. Lenders to do not accept down payment "gifts" that are actually loans, and have lots of endorsement paperwork required by both parties that explicitly describe it as *not* a loan, but a gift. It is also handed over to the IRS and so the giver had damn well better declare it and pay the tax or deduct it from his estate. After reporting $300k per year in 2015 and 2016, Joe reported earning $11 million in 2017. Supposedly from book deals. Hopefully they are looking into those book deals. Just how big is the gift tax? Well, it's enormous.
Gifts come out of the "lifetime exclusion" pool, which is the same pool as is used for the death tax. As soon as a gift exceeds the annual exclusion $17k (this year), it is subject to the gift tax. When you give a gift, you can give it tax-free up to the exclusion (which is $12.92 million this year) - but it reduces the size of the exclusion. If you give someone a million dollars and defer the taxation, it reduces the tax exemption for your estate - when the time comes - to $11.92 million. You pre-spent some of the exclusion. If you don't want to reduce the exempt value of your estate - or you have already given away enough to exhaust the exemption - you have to pay the gift tax. Federal Gift/Estate Tax (current amounts): You can gift up to $15,000 per person per year with no paperwork required to be filed . Gifts to a person above $15,000 per year require filing an IRS Form 709. The amount over $15,000 reduces the lifetime total estate exemption for the giver. Tax is not due on the amount over 15k until the remaining exemption goes negative. The exemption is currently $12 million.
Where the IRS might care is if I "give" someone $10k and they then "give" me $12k the following year. That would be $2k interest on a loan that I would have to report as income. The Gift/Estate tax is US person to US person. If we still had a legal system, none of this would have any applicability to Hunter since it was a Chinese Company and it was not a gift. Granted that's $20,000 or so in today's money, but it was at a time when I was scraping and barely surviving, and they contacted me at work to discuss it. It took multiple phone calls, days, hours on the phone, and agents to resolve. I'm certain it costed taxpayers well over $1500 to get that $60 from a 22 or so year old. The Currency Transaction Report dates back to the Bank Secrecy Act of 1970. It was $10k then, and it is still $10k now. Inflation-adjusted it, it should be around $80k today. At the same time - 1970 - the FDIC limit was was $20k and so the reporting requirement was 50% of the FDIC limit. With today's $250k FDIC limit, the reporting limit should be $125k. First off, the exemption level would have to astronomically high, otherwise the upper middle class would lose their shit when they got taxed on "unrealized gains" based on the increased value of their homes. Then you have the problem that its NOT income, so I don't know how we fit that in to the 16th amendment. Then you have the practical problem with how do you structure this tax? Year over year growth on something like stock value? What happens if it goes up year 1, drops year 2, goes back up year 3, etc? Elon Musk et al. are selling their stocks to cover the taxes on shares every other year until they have no more equity in the company? The worst one is a so called wealth tax. So, they can tax you ever year on the equity in your house, retirement accounts and any other major asset that has equity.
I was pretty pissed when they stopped allowing income averaging. You have a fabulous year and sell a whole lot of houses and the next year everything crashes and they don;t give you any of that tax money back. So, the LA governor's race.
If I remember correctly, it's an open primary where if someone wins a clear majority it ends up acting as the next governor's race, and if someone makes 50.1% in the open primary they win the race, and that's what happened yesterday. Looking through the polls and comparing them to the end result, the polls had Landry winning a plurality of no more than 40% with an RCP average of 38.7%. He won 51.6%. Wilson's average was 24% and his final result was 25.9%. Those polls were off...by a lot, and they were done right before the election. The terms they used and the attitudes about truth, fact, verification, peer review and credentialism was a slap in the face when I thought about 2020 to today. Falsification of hypothesis is a huge issue in the scientific process. The attitude I kept getting was that falsification is only useful in debunking non-approved thought, as if peer review and credentials is armor against anything in the view of the current replication crises developing in all areas of science research.
