Supreme Court May Rule on the "Overcriminalization" of January 6 Political Prosecutions

Good news, if it actually happens.

Two Jan. 6 defendants are asking the Supreme Court to correct what they argue is "prosecutorial overcharging" before their cases go to trial.

Edward Lang and Garrett Miller, who allegedly both entered the Capitol on Jan. 6, are asking the Supreme Court to dismiss an obstruction charge against them before their trials, alleging prosecutors broadened an unrelated statute to "over-penalize" those who participated in the riots, according to their petitions. If the Supreme Court takes the case, it could have broad implications for hundreds of other Jan. 6 defendants indicted under the statute.

The law under consideration is Section 1512(c)(2), which carries a maximum 20 year prison sentence for anyone who "obstructs, influences, or impedes any official proceeding." Though the statute was passed to fight evidence tampering, government prosecutors have reasoned that Lang and Miller, along with many other Jan. 6 defendants, obstructed an official proceeding by attempting to disrupt Congress from certifying the election results.

In an amicus brief filed Aug. 30, three other defendants with pending cases before the U.S. District Court for the District of Columbia asked the Supreme Court to hear the case to prevent "a cascade of errors and misconceptions in the application of the law and undeserved harm to the defendants and the public perception of the courts."

Over 200 defendants have been charged under the statue, according to the brief.

"A short walk from the building in which this Court sits, 'a revolution is underway, with ambitious federal prosecutors reworking the penal code to make it do work never intended to be done, work that threatens to chill, and does chill, ordinary Americans in their First Amendment rights to assemble, to petition for the redress of grievances and to speak out on matters of public concern," Lang's petition begins, calling the application of Section 1512(c)(2) "overcriminalization of otherwise criminal conduct."

Many, many "protests" of the left disrupt government functions, usually deliberately.

If this law is actually intended to be used against protesters "taking over" federal spaces and expose them to sentences of 20 years -- why isn't ever deployed against the many insurrections of the far left?

++++
This is one of the goals of protesting, period. Civil disobedience disrupts government function. That is one of the points of the entire exercise. To say, "you have the right to speech and association and assembly, but only if no official function is disrupted in any way," then you've canceled the First Amendment.

What is "disruption?" Marches and protests can block streets. That can disrupt a commuter on his way to his government job. Is that "disruption?" Protesters may demand that government officials do something. Is that "solicitation of violation of oath" like they claim in Georgia?

All of these fig leaves behind which they're trying to hide all have the same implication: you have no freedom of speech or association or assembly. If you think you do, we'll find some "law" that claims that it's totally different this time, for some reason.

38 As with the Courts fighting these Gov of NM, this is all well and good (especially if it frees these political prisoners) but is moot if there's no actual punishment for those beaking the law.

Okay so the supreme court says it's illegal, but the prosecutors, doj and judges will just continue to do it, because there's no disincentive for them not to.

Unless those breaking the laws of the constitution are personally punished for committing these crimes, ruling on these things are just a slight stumble for them

I think they can't. We'll see if they try it, but I don't think it can work. Enough "brave" Democrats will back McCarthy to clear the logjam, and in exchange he'll probably drop his "impeachment inquiry" posturing by hiding behind a newfound enthusiasm for certain interpretations of House protocol that claim that a floor vote is required prior to preliminary inquiries. The shields are already in place. McCarthy is secure.

For example, when antifa shuts down highways, presumably at least once or twice a juror or lawyer or someone was unable to make it to court and a court proceeding had to be delayed, no?

And more to the point, when hundreds of pink haired weirdos insurrected the capitol during Kavanaugh's hearing and impeded that, I don't recall anyone going to jail for 20 years.

This is absolute silliness.

Barring a prison break, by outside mobs with pitchforks, most J6 prisoners will *never* see freedom. I said this at about month three. They are being tortured and it's been years now.

If you had tortured men for years would you ever let them go free? Would you take that risk to your own life? Because every single one of these people would be justified in taking their time once freed, and exacting the ultimate judgement upon their captors, and upon their jailers. And their captors and jailers know it, so won't risk freeing them. Ever.

The prisoners would also be justified, IMO, in hating all of us forever too. Because all we did was pray and mumble "support".

I'd be like "man, fuck you" to literally everyone for the rest of my life it it were me. Except maybe Jim Hoft and a couple others.

Not so sure about that. Criminal laws are to be strictly construed is a maxim and first amendment rights in political speech trump statutory law and require any statute thus affecting it must be a) narrowly tailored so as to indicate what is legal and what is not for the average citizen.

The first is indicated in the Enron trials of Skilling and the later case of Conrad Black over the 'honest services' provision. Jeffrey Skilling and Conrad Black had their honest services convictions thrown out as even Justice Ginsberg agreed that the law was bent by a vengeful prosecutor named Andrew Weissman in Skilling's case into a club for prosecutors well beyond the statute's meaning.

Neither though involved the first amendment and the fact that the US did not prosecute similarly situated individuals make it difficult to understand the equal application of the law other than viewpoint discrimination, let alone the broad interpretation of it by prosecutors

Can it be stanched at this point? We're not really in a legitimacy crisis at this point, we're well beyond it. If SCOTUS both accepts this case *and* rules correctly, do you have any expectation of actual or meaningful improvement in the operational conditions and goals of federal law enforcement?

I don't. The well is poisoned. These institutions can't be fixed with a knuckle-rapping from SCOTUS. They have to be torn down brick by perfidious brick and totally replaced. A single appropriate SCOTUS ruling isn't going to carry much weight, I don't think. I may well be wrong, but it's so toxic at this point that I doubt it.

111 85 You can pre-pardon someone, see Gerald Ford for an example.

You are quite literally obtuse and ignorant. Ford's pardon of Nixon was never constitutionally challenged because a) it involved a specific individual that perhaps might be charged with many crimes and b) lack of standing to do so because the prosecutions were speculative. If you want to educated about Watergate, you might read about Nixon's appearance before one of the Watergate Grand juries post presidency where he discusses the matters and his decisionmaking.

On Carter's pardon, it was for many individuals being accused of one specific act, avoidance of the draft and was both for individuals charged in the past and to prevent specific individuals from being charged in the future. Thus, specificity in the charge but applied broadly. Civil War had similar pardons.

It's my understanding that they have, and that they are progressing towards trying some kind of floor vote. It's also apparently the truth that these bills do have significant cuts.

It's also true that the Senate will simply refuse to vote on the bills or go into conference on them, staging the groundwork for a government shutdown that can "only" be avoided by the House buckling and passing a must pass CR last minute.

148 I don't. The well is poisoned. These institutions can't be fixed with a knuckle-rapping from SCOTUS. They have to be torn down brick by perfidious brick and totally replaced. Posted by: Joe Mannix (Not a cop!) at September 14, 2023 12:25 PM (t0OGg)

Yeah, basically. Supreme Court only continues to have some power because the rest of the power structure allows it. Lots of nickel and dime rulings get handed down, but as far as I can tell, there was only one ruling this court made that actually made any real difference.

Otherwise, all they ever CAN do is swat down the administration when it oversteps its bounds, and all of that ends up taking years, and most people have no clue where anything really gets settled.

So it's not a completely useless institution, but we're getting close.

I don't think so. EVs were barely a thing back then, and the market destruction caused by the program needed about a decade to work through.

I think it was exactly what it presented itself as: a way to use taxpayer money to bail out automakers and increase systemic debt in a grossly inefficient way that sacrificed the low end of the used car market (and those usually poor and young people who depend upon it) on an altar of corruption to score cheap political points during election season with no care whatsoever for broader consequences or the abject insanity of committing vast sums of money to willfully destroy functional - and unencumbered - capital assets that are also vital tools for the purpose of pushing a new generation of debt-encumbered assets for the benefit of a small portion of the population at the expense of everyone - an expense borne most severely by those least able to afford it.

During the first week of arrests when the majority of charges were filed, Michael R. Sherwin, acting U.S. attorney for the District, said his office ultimately chose to not pursue rioting charges and instead focused on counts involving assault, property damage or burglary, where prosecutors felt the evidence was clear.

"I did not authorize any of those individuals to be charged with rioting. I think that’s a very gray area, a very dangerous area that bleeds into protesting, and what is First Amendment [protected] and what is not," Sherwin said in a June 5 statement to The Washington Post. "But what we did charge and will continue to charge is any and all acts of violence, physical aggression and property damage - such conduct will never be condoned or accepted in the District."

Meh. Most of the writers and actors aren't exactly wealthy, and the core issues around residuals and likeness rights are not nothing.

The problem is that they want the dreamy days of Network TV when a sitcom writer could support a family on the residuals from a hit show. Well, we don't have three networks now. We have a thousand. A hit show now gets a fraction of what MASH got.

The streaming part is window dressing to the issue that there's simply too much content getting too few viewers, and they're getting paid pretty appropriately for that.

284 Conservatives and Maga types putting their hopes on the Supreme Court are in for the terrible disappointment. The Supreme Court screws things up more often than not. And they are incredibly slow to act. Consider that it took them 50 years to undo their screwup of Roe v. Wade. And they never did get around to undoing their Dred Scott screwup. This is a weak and fickle institution, unworthy of anyone’s confidence.

Want a better bang for your buck: put Maga types in prosecutorial positions, and let the prosecutions of the left for their political viewpoint commence, full force. Then, you might see a change. Not till then.

The people who were really good at accumulating money under the systems in place when we rammed seven trillion dollars through wound up with a lot of cash. Sometimes those people buy stock.

What I can't fathom is how the Fed can sell off its' balance sheet when the prices of those instruments should be way under water due to current rates. The short term stuff has mostly rolled off, but how do you Quantitatively Tighten the 1-2% yielding long term stuff?

That's the irritating part. People aren't buying stock. People didn't turn away from the tech market or any other market. Some hedge fund algorithm was triggered and it made a trade triggering other hedge fund algorithms to make trades, and the market shifts based on those robots.

And the news will dutifully report "stock market traders shied away from tech stocks today..."

I'm sure SCOTUS has reviewed what constitutes an unbiased jury, but it is high time that us reviewed again.

365 I think the difference if they had to answer is that left wing protestors - like the ones who held Senator Jeff Flake hostage while screaming at him in an elevator in the Senate Office building during the Kavanaugh nomination committee proceedings used moral suasion rather than force - this is proven by the fact that after this episode Flake postponed the committee vote. (This was set up for him by his good friend Senator Chris Koons of Delaware).

The January 6 people in the Capital building - even though they didn't get near any actual elected office holders - were planning on tearing them limb from limb in the telling of the regime.

Naturally, the real guiding principle is Stalin's "who, whom?" Their guys are good/freedom fighters/brave speakers of truth to power while ours are evil/terrorists/low class types.

The J6 folks are screwed unless they get a Republican who pardons them. Even then it would have to be someone like Trump, because the Nikki Haley's of the world are way too icked out over rioting maga people than they are by the steam pile of corrupt theft that was the 2020 election.
