Supreme Court May Rule on the "Overcriminalization" of January 6 Political Prosecutions

Good news, if it actually happens.


Two Jan. 6 defendants are asking the Supreme Court to correct what they argue is "prosecutorial overcharging" before their cases go to trial.

Edward Lang and Garrett Miller, who allegedly both entered the Capitol on Jan. 6, are asking the Supreme Court to dismiss an obstruction charge against them before their trials, alleging prosecutors broadened an unrelated statute to "over-penalize" those who participated in the riots, according to their petitions. If the Supreme Court takes the case, it could have broad implications for hundreds of other Jan. 6 defendants indicted under the statute.

The law under consideration is Section 1512(c)(2), which carries a maximum 20 year prison sentence for anyone who "obstructs, influences, or impedes any official proceeding." Though the statute was passed to fight evidence tampering, government prosecutors have reasoned that Lang and Miller, along with many other Jan. 6 defendants, obstructed an official proceeding by attempting to disrupt Congress from certifying the election results.

In an amicus brief filed Aug. 30, three other defendants with pending cases before the U.S. District Court for the District of Columbia asked the Supreme Court to hear the case to prevent "a cascade of errors and misconceptions in the application of the law and undeserved harm to the defendants and the public perception of the courts."

Over 200 defendants have been charged under the statue, according to the brief.

"A short walk from the building in which this Court sits, 'a revolution is underway, with ambitious federal prosecutors reworking the penal code to make it do work never intended to be done, work that threatens to chill, and does chill, ordinary Americans in their First Amendment rights to assemble, to petition for the redress of grievances and to speak out on matters of public concern," Lang's petition begins, calling the application of Section 1512(c)(2) "overcriminalization of otherwise criminal conduct."

Many, many "protests" of the left disrupt government functions, usually deliberately.

If this law is actually intended to be used against protesters "taking over" federal spaces and expose them to sentences of 20 years -- why isn't ever deployed against the many insurrections of the far left?

This is one of the goals of protesting, period. Civil disobedience disrupts government function. That is one of the points of the entire exercise. To say, "you have the right to speech and association and assembly, but only if no official function is disrupted in any way," then you've canceled the First Amendment.

What is "disruption?" Marches and protests can block streets. That can disrupt a commuter on his way to his government job. Is that "disruption?" Protesters may demand that government officials do something. Is that "solicitation of violation of oath" like they claim in Georgia?

All of these fig leaves behind which they're trying to hide all have the same implication: you have no freedom of speech or association or assembly. If you think you do, we'll find some "law" that claims that it's totally different this time, for some reason.

Okay so the supreme court says it's illegal, but the prosecutors, doj and judges will just continue to do it, because there's no disincentive for them not to.

Unless those breaking the laws of the constitution are personally punished for committing these crimes, ruling on these things are just a slight stumble for them

I think they can't. We'll see if they try it, but I don't think it can work. Enough "brave" Democrats will back McCarthy to clear the logjam, and in exchange he'll probably drop his "impeachment inquiry" posturing by hiding behind a newfound enthusiasm for certain interpretations of House protocol that claim that a floor vote is required prior to preliminary inquiries. The shields are already in place. McCarthy is secure.

The first is indicated in the Enron trials of Skilling and the later case of Conrad Black over the 'honest services' provision. Jeffrey Skilling and Conrad Black had their honest services convictions thrown out as even Justice Ginsberg agreed that the law was bent by a vengeful prosecutor named Andrew Weissman in Skilling's case into a club for prosecutors well beyond the statute's meaning.

Neither though involved the first amendment and the fact that the US did not prosecute similarly situated individuals make it difficult to understand the equal application of the law other than viewpoint discrimination, let alone the broad interpretation of it by prosecutors

I don't. The well is poisoned. These institutions can't be fixed with a knuckle-rapping from SCOTUS. They have to be torn down brick by perfidious brick and totally replaced. Ford's pardon of Nixon was never constitutionally challenged because a) it involved a specific individual that perhaps might be charged with many crimes and b) lack of standing to do so because the prosecutions were speculative. If you want to educated about Watergate, you might read about Nixon's appearance before one of the Watergate Grand juries post presidency where he discusses the matters and his decisionmaking.

On Carter's pardon, it was for many individuals being accused of one specific act, avoidance of the draft and was both for individuals charged in the past and to prevent specific individuals from being charged in the future. Thus, specificity in the charge but applied broadly. Civil War had similar pardons.

I haven't been following this very closely, but as I understand it, most people plead guilty in a plea deal.

So there's not much you can do there. There's nothing to petition SCOTUS about. They admitted to a crime.

And the plaintiffs in this case haven't been convicted of anything yet.

I'd say SCOTUS would be justified in punting the case by saying it's not ripe. If they want to.

They could also hear it. If they want to.

Yeah, basically. Supreme Court only continues to have some power because the rest of the power structure allows it. Lots of nickel and dime rulings get handed down, but as far as I can tell, there was only one ruling this court made that actually made any real difference.

Otherwise, all they ever CAN do is swat down the administration when it oversteps its bounds, and all of that ends up taking years, and most people have no clue where anything really gets settled.

So it's not a completely useless institution, but we're getting close.

I don't think so. EVs were barely a thing back then, and the market destruction caused by the program needed about a decade to work through.

The people who were really good at accumulating money under the systems in place when we rammed seven trillion dollars through wound up with a lot of cash. Sometimes those people buy stock.

What I can't fathom is how the Fed can sell off its' balance sheet when the prices of those instruments should be way under water due to current rates. The short term stuff has mostly rolled off, but how do you Quantitatively Tighten the 1-2% yielding long term stuff?

That's the irritating part. People aren't buying stock. People didn't turn away from the tech market or any other market. Some hedge fund algorithm was triggered and it made a trade triggering other hedge fund algorithms to make trades, and the market shifts based on those robots.

That he's not focusing on the other political prisoners is clearly due in part to that fact, and I suspect he's being advised by lawyers telling him to keep his mouth shut about them, while they're trying to defend him.

374 I don't think the SCOTUS is going to touch this case. It's not usually their purview to correct prosecutorial misconduct or an overzealous application of the law. Or uneven application of that zeal.

The J6 folks are screwed unless they get a Republican who pardons them. Even then it would have to be someone like Trump, because the Nikki Haley's of the world are way too icked out over rioting maga people than they are by the steam pile of corrupt theft that was the 2020 election.
