Biden Junta Considering Forcing Illegal Aliens to Remain in Texas

Trump's policy: Remain in Mexico

The Biden administration is considering forcing migrants who cross into the United States illegally to remain in Texas while they wait out their asylum screening.
Administration officials cite the proposed plan as a way to curb the flow of illegal immigrants at the southern border, The Los Angeles Times reported, citing three U.S. officials not authorized to discuss the matter.
The plan would force migrants to remain in Texas, or possibly other border states by tracking their location through GPS monitoring devices, such as ankle bracelets, the officials told the Times.
The migrants would undergo an asylum screening to determine whether they can remain in the U.S. Officials have discussed working with local groups to provide housing for the migrants.

"Texas has bused over 35,000 migrants to self-declared sanctuary cities," [Governor Abbot] wrote Tuesday on X, the platform formerly known as Twitter. "Over 11,300 to D.C., over 13,300 to NYC, over 6,700 to Chicago, over 2,600 to Philadelphia, over 1,000 to Denver, over 480 to LA.

This must be illegal and unconstitutional. If it's not, then the first Republican to take office enforces the opposite policy: All illegals must reside in blue states and cities.

It's incredible that this is even being considered -- and apparently he thinks he can use his Tyrant Prerogative to impose this illegal mandate without any congressional authorization whatsoever.

Maybe Texas should hire Biden's crackhead bagman get as a "consultant" for $83,333 per month.

Then maybe Biden will afford Texas special favors.

Let's say they make a new rule: "All apprehended aliens must remain within 50 miles of the port of entry or other location where they were apprehended until they appear before an immigration judge" or something like that.

Judges do that all the time in criminal cases where someone is out on bail.

Of course, we all know what is REALLY going on here. But I think a court would uphold that.

I'm just saying that a rule of that sort could likely be drafted without congressional input, and would likely be upheld by the courts.

If a Republican tried that it would not work though, obviously. Judges would read deeper in to the "intent" of the law, as they did constantly with Trump. "Well, when you were campaigning you called Mexicans rapists, so CLEARLY this law meant [x,y,z] and is unconstitutional"

Why not? Think about it -- procedurally speaking, aliens are apprehended by Border Patrol at the border.

Border Patrol (a quasi law enforcement agency) brings these people to processing facilities, where they are processed then let go on their own recognizance, with a court summons in their hand telling them they have to show up to court in front of an immigration judge.

This is exact analogous to someone being arrested for a crime.

It doesn't take an act of congress to decide on bail restrictions, the judge does that. They have to follow certain guidelines, and I don't know what the USC says about this, but I suspect it is purposely vague.

So the immigration courts set the guidelines to what I suggested ("50 miles of where you were caught" or whatever)

Then with the Chevron deference, article III really don't have much to say about it.

Probably some.

The correct thing for Liberty Safe to have done is to demand a subpoena. There is no cause for a warrant, since the company is a third party. When the cops need something from a third party during an investigation, that is what a subpoena is for. Liberty Safe should have demanded one, but didn't bother. I can even get that, sort of. A subpoena *will* be produced, and all you'll do is get a reputation for being "not a team player" and the revenuers will come make your life hell. It would still have been the right play, and the play they should have made.

The bigger issue by far is that they have a back door. What they're selling is not a security product.

Abbott is exactly like Clinton: he will wet his finger and hold it in the air to get a sense of where the political winds are blowing. He is much more concerned about looking good on Fox News than he is doing the actual work of governing.

Take his calls for special sessions. He will call special sessions, because the Legislature meets once every two years, but will do nothing to offer leadership to the Legislature. He makes no effort to call Reps and Sens to get his preferred bills through the process. That’s a big gripe from a lot of the Legislators in Austin.

I've worked with and known a lot of illegals from Mexico & Central America. Mostly good guys.

But yeah, their plan is to work in the US for 10-15 years, maybe get paperwork if possible (marrying a gringa is always a good move), live as cheaply as possible, send back as much money as possible to their parents, then after 10-15 years, retire back home and live a pretty upper middle class lifestyle on the money their parents squirrelled away for them.

Which like -- I get it. I do. They're not bad people, they are responding to the incentives in front of them.

That said, we have to do what is best for us. Which is ... not this.

They already do.

That "money sent back home for the family" is going to the cartels. The passage must be paid for, and it's done on credit. Get El Norte and send the cash home to pay off the cartels who cut you the loan. If you don't, they'll kill your family.

Once they're paid off, of course, it becomes what they say it's for - sending home to help out those left behind and get saved otherwise for those who - like in Harry's example - plan to go back home some day.

This is one of the reasons small-money remittances (under $30,000) should be taxed at punitive rates.

This is true, but there is a world of difference in terms of how expensive it is to defeat the lock, and whether defeating the lock is worth it.

With something like Liberty Safe, which has a built-in backdoor, defeating the lock is trivial. If they have to call in a safecracker and pay him to defeat the lock, it is less trivial. As things get increasingly non-trivial, they get increasingly less worth doing.

A good mechanical lock that has to be cracked without convenient workarounds is something they have to work and spend money to defeat. That is a bit of sand in the gears, and sand in the gears is a good thing by any measure. Maximize your access to sand.

Good point The local online parents group which is a very energized and diverse group already know I'm running and I was part of the group long before I decided to run so hopefully that will help. Of course the Democrats are squawking about "The want to ban books" (No, they don't) for the conservative candidates for BOE. I cannot wait to see what they'll bring up at our debate, "So you're a pastor. How will that affect your work on the committee?" My response will probably be, Are you going to ask the Democrat candidates?" and "Shall we have a requirement about people who are people of faith not serving?" or something along those lines.

That's slightly different and still the subject of a lot of litigation. The compromise they've reached so far - and it's terrible precedent that SCOTUS needs to overturn as promptly as possible - is to make you key in the password. That's an action, not speech in the narrow interpretation. It's absurd and wrong.

That is also just about encryption and data. There is no analogue for that in the physical realm of locks.
