The Very Special Counsel Jack Smith Asks Judge for a Protective Order Against Trump

His fee-fees were hurt! He is a-scared that Trump will literally erase his existence you guys!

Trump posted on Truth Social Friday night the following statement: 'IF YOU GO AFTER ME, I'M COMING AFTER YOU' That was the entire post. One statement in all caps. Smith entered it into evidence Friday night shortly after Trump posted it. This is an indication that Smith's team is actively monitoring Trump's social media posts. They struck gold with what Smith considers a threat to himself, though Trump didn't name any names.

Smith alleges the post is a threat to potential witnesses while Team Trump claims Smith is attacking political speech used by Trump. Trump faces allegations of trying to intimidate witnesses. Defendants are provided with evidence against them (discovery) but they cannot publicize it.

...

Trump had to have known that Smith would pounce on that post. Smith is determined to show that Trump is intimidating potential witnesses in his case against Trump. He is doing everything he can to toss Trump into jail and prevent him from running against Joe Biden in 2024. Democrats are afraid that Biden is such a weak candidate that in order to keep him in office, Trump must be jailed. This is truly uncharted territory in presidential elections.

Biden's weakness has nothing to do with the vendetta against Trump. Trump committed the unforgivable sin. He - an outsider with outsider ideas - got uppity and tried to do things in the government. This is unspeakable, unbearable and intolerable. He must be destroyed on general principles.

He had to be stymied and blocked while he was in office and since he didn't just go nip off and kill himself as was proper, his destruction must continue.

The Dems could have the strongest candidate in history and it wouldn't change this one iota.

56 So what will Trump do? Agree to the protective order and then two hours later say F-U to the judge by making more threats? Or whine about his free speech rights and refuse to agree to the order?

Fuck around and find out - asshole. This looks like a done deal where TFGs only alternative is to shut up and sit down for the foreseeable future.

I suppose it is Trump free speech to threaten a federal judge.

Arrest him and lock him up before and during trial. How is this not considered a threat!

How much more of this are Americans supposed to endure? It is prima facie evidence that the very coup he attempted to arrange is still very much alive in his mind. He is a threat to democracy but even moreso, he is a threat to peace within the nation. We all know MAGA won't go to war with us en bloc, but exhortations such as this will certainly trigger the unhinged and innocent blood will be shed.

Please, Judge Chutkan, put this to an end. Be merciful.

I disagree with Whig that US vs Zucker was just about civil law, not criminal - it was about the difference between the two. If you read the ruling, its plain that civil is meant to be treated different than criminal - and that seems to be the idiot mistake made by the DOJ here.

99 Biden's weakness has nothing to do with the vendetta against Trump.

I think it's both. Yes, the vendetta against Trump is independent of however weak (or strong) the Dum candidate is. Trump must be destroyed for the reasons you mentioned.

But I think the Dums also see Trump as the only credible threat in 2024, and want him taken out of the race. Trump beat the steal in 2016. He showed it could be done. He failed in 2020, true. But the memory of that one victory against the steal still haunts them. Hillary was supposed to be president. They aren't taking any chances in 2024. They want Trump gone.

This is the double danger in what the left did installing Biden in '20 and then imprisoning domestic political opponents. It means every election becomes a life and death event where no one can relent.

Though I will say this is a lesson Trump should have known in '20. The moment he agreed to transition power to Biden...whatever Biden's people promised...he was also agreeing to allow himself to be arrested and likely imprisoned.

Exactly. My point is that many otherwise conservative or at least informed people do not realize how utterly corrupt and compromised the court system is and what despicable state functionaries' judges are. Draining all respect from the judiciary should be a top priority although it seems to be doing a good job on its own. In a sense, I don't think the Left's demonization of conservative justices does not have benefits however unintended. Demonize theirs right back, and in due time everyone will hate the judicial system enough to neuter it. Outside of the secret political police, the corrupt judiciary is a clear and present danger to the American people.

Yea, Trump is a new age “mindfulness” guru. When you cease both worrying about the past and being anxious for the future you exist and become totally aware of the moment.

Trump has transcended human existence and now is in a state of samadhi. He now simultaneously both the most powerful and weakest being on the planet.

Clusterf*cks are distinct from the complications, crises, and catastrophes that mar our personal and professional existences. In "The F-Word", former Oxford English Dictionary editor Jesse Sheidlower defines a clusterfUck as "a bungled or confused undertaking or situation."

Stanford business professor Bob Sutton goes describes clusterf*cks as "those debacles and disasters caused by a deadly brew of illusion, impatience, and incompetence that afflicts too many decision-makers, especially those in powerful, confident, and prestigious groups."

Posted by: mpfs at August 07, 2023 02:14 PM (jFvbr)

271 t is more than Roberts as a problem. The court could have easily decided in Plessy not to allow de jure segregation but that would have been unpopular. Brown was popular in the sense that a majority of Americans wanted the Plessy dissent to have become law. You also see the retreat by Chief Justice Salmon Chase in ex parte McCardle, the switch in time that saved nine by Chief Justice Hughes and Owen Roberts, etc. etc.

Lawyers, by and large are not hero types but system stability types because otherwise when the rule of law is absent, being able to argue is not superior to the barrel of a gun.

Posted by: whig at August 07, 2023 02:01 PM (bk5GW)

It's far worse than that. Most lawyers are huge statists - they believe the right law can solve any problem and "change the world". Most lawyers (all lawyers on the left) don't really like the Constitution much. I've heard attorneys I know talk about the First Amendment like it's a curse. Forget about the 2nd Amendment.

And, these same people are fine with SCOTUS making up laws like Roe v. Wade b/c in a leftist attorneys mind, if a "really smart" lawyer comes up with something, it must be right.

The best thing about Ramaswamy is he knows how to pitch on camera to libs the appeal of conservative ideas, and make them make sense to people who are usually driven by emotion.

For example, he never uses the euphemism "Affirmative Action", he calls it "race based quotas". He doesn't concede the moral high ground to the left for their amoral policies or theories. All of the GOP should learn this trick but don't.

And the left can't use the race card against him, so the lazy debators who have no other tools in their debate toolkit (aka Don Lemon, chick on the Breakfast Club) just end up floundering.

Shows how far leftist thinking infiltrated republicans - even back then. What Nixon did was hardly terrible. Clinton, Obama, and now Biden have done far, far worse.

People think of "watergate" as some terrible crime. It was a silly prank at worst. The left has managed to indoctrinate people to think it was a terrible crime - the same way the left convinces everyone that the german party in control during WWII was "conservative" or "right wing" when they were avowed socialists.

In any other state Pataki would have been a liberal democrat. He only won election b/c the first Cuomo was running for a, I believe, 5th term and people were sick of him. Pataki got reelected by bribing the big state employee unions and giving away the store to them in exchange for them to basically sit out the election (they would obviously never endorse or campaign for a republican).

Because Pataki was really a democrat - it would have been pretty hard for him to do anything to strengthen the GOP in NY.

Lincoln once argued when someone pointed out to him that his actions were outside of the Constitution during the Civil War. Lincoln replied, basically, that if the other side is violating the whole point of the document (to create a more Perfect Union) then he should be given latitude to prevent the opposition from hiding behind constitutional guarantees. In essence, Lincoln was a tyrant but judged that preferable than letting the South win.

In fairness to buckley, I think what is considered American conservatism has changed dramatically since Buckley started National Review. It has also changed dramatically since Ronald Reagan. I think that is b/c of talk radio and the internet. conservatives likely used to believe they were in such a minority that the best "conservatism" could do was slow down the left. After Rush Limbaugh and the internet, suddenly we see that we are a pretty large minority and that we can appeal to the low info voters. So, we are pushing for more than just slowing the left down. This is something the GOP still does not understand. But the left does, which is why they are now actively trying to censor us and no longer pretend to like the First Amendment.

Posted by: Darrell Harris at August 07, 2023 02:36 PM (/iWhV)

that's an impossible question. In every era, there were things that were good and things that were bad. If we go back to the 1950's there's segregation, etc. If we go back further, there were open borders at earlier times - and it made sense during those times. There was always good and bad. The idea is to keep or reinstate the good and get rid of the bad.

As a realist, we are never going back to the society mores of the 1950s (putting aside segregation and race issues for a moment). and I'm not asking for that.

I don't think American conservatism is at all concerned with "going back" to some bygone era, so much as it wants to bring back things that actually worked and made sense and get rid of things that are bad or unconstitutional.

1788-1808. Madison's acquiescence to the war of 1812 was disgraceful. His crabbed idea of what the president should do was in hindsight damaging. Jefferson, at least, was a hypocrite and did the Louisiana Purchase despite his claims about a limited role of the presidency. Jefferson preferred to hide his influence in the shadows via private letters--Madison was more honest and virtuous to his beliefs but his beliefs were not what we would consider successful as an executive. Even Adams was a bit more like Jefferson than Madison in office.

that is the "conservatism" of "conservative inc.", not the conservatism of actual voters and those of us on sites like this. The Trump presidency fully exposed conservative inc. for what it was/is - which is as you say, defeatism on social issues and doing the bidding of corporate interests on economic issues.

Which is why I don't give a rat's a** about the GOP or other presidential candidates besides Trump. In my opinion, if elected Desantis will revert back to being a "national review" "conservative".

that's an impossible question.

Conservatism, in a sense, has always been a beautiful loser philosophy and not one of government. Burke himself lost his seat in Parliament as a consequence and never was paid much attention to by the Brits even now. Ditto for the Physiocrats who failed to conserve the French monarchy and so on.

Effectively, a ruling philosophy more or less has to take the one valuable thing that Rousseau says as a benchmark. A nation that is flourishing has most of its inhabitants seeing life is getting better and that is demonstrated by a nation's gaining wealth (not specific individuals), peace, and an increasing organic population (not immigration).

I've seen far too many state-level GOP "conservatives" get elected to the federal gov't and become establishment conservatives overnight. It has happened almost to every single conservative darling that has come along. Rubio was going to be the next Ronald Reagan. Cruz was. W Bush was. and on . . .

Mostly true.

523 I thought DeSantis' best point was that Trump is running in 2024 on a platform to do everything he said he would do in 2016. Lol. Plus he sure can pick' em, can't he? You know, all those people who kept him from doing everything. But I'm sure he'll pick better people this time. Amirite?

524 I ain't for "conserving" shit. I'm for looking for the good things, figuring out how to cultivate them on a larger scale, and building anew. I don't want what was. I want the better version that can yet be.

And that better version looks nothing like the garbage being pushed today.

527 Ironically, I choose 1984 (ironic because of the book title) as the go back year.

But in 1984 conservatives were busy trying to conserve the 1950s and in the 1950s conservatives were trying to conserve the 1920s.

But... why? Why get mad at *us?*

If a lot of people who voted for your shitheel Party over and over again through years and years of betrayal after betrayal finally start walking away, isn't that on *them?* Shouldn't you be mad them?

That is part of the problem with conservatism--it conserves the victories of the left like a ratchet and never tries to reverse it. Chesterton and his gate analogy is a weak argument for keeping the status quo going because we don't know what will happen if we get rid of a tradition. By implication, this would mean conserving Roe v. Wade for example because the new gate lasted for decades.

532 @492 whig-doesn't matter what we call/label ourselves. We both stand for the same thing and what I described is what happened. 533 Yeah, it was a joy. In 1986, only had an interest rate of *11.75 with 20% down on a house. Thank heaven for refinancing three times over several years. The worse music/song ever: Funky Town released around 1980...kill me.

*Down from +/- 18% earlier 80s.

The only thing peak about American in the 1980s movies - there were some wonders in those years - some music.

534 "That is a wonderful staw-man argument you have built. "

You don't k ow what a straw man argument is, do you. Is that something you read on the internet?

DeSantis has a record of things he's done. It convenient y'all would like to memory home that stuff and turn him onto Darth Vader, secret liberal. Then call his wife names, yeah that's convincing. But the facts aren't on your side. Trump has a record too, including COVID and all the stuff he's says he's going to do. Again. It's the same list. No thanks. The guy wins the primary I'll vote for him. But it's a wasted vote.

535 I'm dating peak America right about 1962 when we lost Marilyn to dope. That spared us from watching her succumb to the ravages of time. But that's selfish. She was just so ravishing to lose.

And so many others since then. More than all the wars and murders. But schools are consumed by Wokeism instead of teaching our kids how to stay alive.

It does matter a bit, pragmatically it doesn't in the short run but having a political philosophy about how humans behave in society and setting up a system to govern them accordingly is important.

President Trump and his gaggle of crackpot lawyers asked me to reject electoral votes and chaos would have ensued. To keep faith with the oath that I made to the American people and to Almighty God, I did my duty that day.

Please tell me that sanctimonious bullshit isn't real. No one who's serious about running for office could be so stupid that they'd twat out that drivel...

Of course, I know better.

The one thing that really pisses me off about the GOPe is that they will get downright vicious in the primaries, they'll willingly stuff a real conservative or right wing populist into a vat of acid, not to win but just to be sure that the populist won't come out ahead. Then when it comes time for the general election, they turn into poodles wearing pink ribbons and let the Donk commie step all over them.

This is why you had the Class of 94', the TeaParty and MAGA which was opposed and taken down by the GOP establishment. Conservatives never wrestled control of the party away from the establishment.........and here we are.
