Texas Governor Greg Abbott Installs a Floating Barrier Across the Rio Grande

States are forced to do the job that Let's Go Brandon refuses to do.

AUSTIN, Texas -- Gov. Greg Abbott (R-TX) is moving forward with the installation of a $1 million wall of floating buoys on the U.S.-Mexico border despite newly filed legal action that targeted the operation.
Video shared by a Texas Department of Public Safety official this week revealed that construction workers in Eagle Pass, Texas, are in the process of connecting a series of large floating red buoys that look like oversized balls. The state has referred to this new deterrence system as a "marine barrier."
"The State of #Texas is taking historic action under Gov. [Abbott's] Operation Lone Star to secure the border. Installation of the marine barrier began today in #EaglePass. The marine barrier will deter unlawful crossings & human smuggling, & prevent the loss of life due to drownings. #MarineBarrier," Texas DPS spokesman Lt. Chris Olivarez tweeted Monday afternoon.

A river-based business, which serves kayakers, is suing him to stop the building of the barrier. I can understand the business' frustration -- but this is an invasion.

He should sue Biden for damages.

The lawsuit argued that Abbott's use of the Texas Disaster Act was unfounded.
"We will see you in court," Abbott tweeted July 7. "And don't think the Travis Co. Court will be the end of it. This is going to the Supreme Court. Texas has a constitutional right to secure our border."

I'm wouldn't be too optimistic about Texas' chances at SCOTUS.

It really does seem like SCOTUS is dead set on the federal government not enforcing immigration laws, no matter our victories elsewhere over the past two years. That and election integrity.

The word "could" concerns me.

Also, Abbott announced the measure on June 8 and said it would serve as another layer of border security and deter immigrants from crossing in certain areas and funnel people who do cross to other parts of the river where federal and state officials can apprehend them.

The problem is that once they're apprehended, they're simply released again.

My only hesitation in being a complete downer on this score is that the last time this specific question arose was the AZ case, and that was about 10 years ago when both Kennedy and RBG were on the court. There were three separate concurring dissents from Alito, Thomas, and Scalia.

The border is technically the middle of the Rio Grande River. There's some good pictures at the link which shows the placement of the buoys, which quite clearly need to be anchored close to the US river bank. Although it would be possible for a person to climb over them, I believe that the smugglers have been using fast, small flat bottomed boats to zip back and forth across the river, and these barriers will block that traffic.

Even though I agree with what Abbott is doing, I understand the Kayak companies beef. Abbott is putting them out of business with an executive order, and they have no recourse.

Immunities get complicated and Scotus has repeatedly received a lot of flak over its invented qualified immunity std. Arguably, as originally formulated by the Rehnquist Court, it applied to police officers making split second decisions--not to administrative officials having plenty of time and reflection available to follow statutes and protect constitutional rights. Prosecutors and judges also benefit from nearly absolute immunity which is a problem as well.

Government immunity more or less has to be pared back to not cover acts that wantonly try to go around laws and statutes using the ultra vires std. Ironically, the government uses just that to argue that it should not be liable or required to honor any government agent's advice or actions that contradict laws.

It also becomes a problem when the prevailing practice across presidents (D and R) has been catch and release instead of detention at facilities until a court hearing occurs. The Court reasons that absent any sign of Congress giving a shit about this negation of the law, then the administrations will be given discretion to continue to violate the spirit of the law if not the letter of the law.

Essentially, the Court won't be the crusader here to limit fed gov power and historically this has always been the case.

I can handle snow. Snow doesn't come inside your car and ruin the electronics like a flood does. And I intend to be living indoors, not on a park bench. I've been looking at house listings on Zillow in KS, SD, and NE, and anything within about 30 minutes' drive of a good-sized hospital seems overpriced to me. I've been looking at house listings on Zillow in KS, SD, and NE, and anything within about 30 minutes' drive of a good-sized hospital seems overpriced to me. Cedar Rapids is kind of a dump, in my opinion, although it has some nice areas. That part of the state is also rather liberal, probably due to the presence of the University of Iowa in nearby Iowa City and unionized industry in eastern Iowa. I'm in a suburb of Des Moines, and while Des Moines itself is a liberal pesthole, the surrounding area, and western Iowa is more conservative.

I think Abbott is a dark horse to watch for 2024 GOP side if Trump is sidelined for one reason or another. GOPe would probably go along with him as nominee as well.

Abbott can creditably claim Trump's mantle on Build the Wall more than other candidates by using his deportation to blue cities program plus this new barrier. Whether any of that will be done if Abbott was president is another matter.

Not a bad idea, if you plan to keep it long-term. In the winter I hit the carwash anytime the temperature gets above freezing. I've had 12-15 year old cars I drove year-round, that didn't have any rust when I got rid of them. Probably depends on the particular car, how clean you manage to keep it, and luck.
