SUPREME COURT STRIKES DOWN AFFIRMATIVE ACTION IN COLLEGE ADMISSIONS CALLING IT A VIOLATION OF THE EQUAL PROTECTION CLAUSE

The decision was 6-3. The breakdown was as you would guess.

The court wrote:


...the Harvard and UNC admissions programs cannot be reconciled with the guarantees of the Equal Protection Clause. Both programs lack sufficiently focused and measurable objectives warranting the use of race, unavoidably employ race in a negative manner, involve racial stereotyping, and lack meaningful end points. We have never permitted admissions programs to work in that way, and we will not do so today.

At the same time, as all parties agree, nothing in this opinion should be construed as prohibiting universities from considering an applicant's discussion of how race affected his or her life, be it through discrimination, inspiration, or otherwise. But, despite the dissent's assertion to the contrary, universities may not simply establish through application essays or other means the regime we hold unlawful today...

A benefit to a student who overcame racial discrimination, for example, must be tied to that student's courage and determination. Or a benefit to a student whose heritage or culture motivated him or her to assume a leadership role or attain a particular goal must be tied to that student's unique ability to contribute to the university. In other words, the student must be treated based on his or her experiences as an individual--not on the basis of race.

Does this mean that affirmative action is done? Oh no. No no no no no. Schools have been abandoning objective tests of academic potential as well as emphasis of a student's grades precisely because they anticipated that this was coming. They are getting rid of all merit-based measures of a student -- so that they can continue affirmative action admissions without leaving a paper trail behind.

Admissions will be based 100% on student essays, or, let's be honest and call them Student Declarations of Grievance and Disadvantage, because that's all they'll be going forward.

And schools like Harvard will continue to rate Asian students as "lacking personality and interest," because they need to find some excuse for denying the admission of academic standouts.

This will be the next series of court battles -- suing schools for Not-So-Stealth continuation of affirmative action policies, and trying to subpoena applications materials and evaluations of students.

Do not be surprised when colleges and universities -- which we're all paying for through massive taxation -- adopt the FBI's policy of simply never recording critical conversations.

You can't disclose what you never bothered to write down in the first place!

The only good news -- it's not a popular issue, even in Democrat dominated California.

Probably not. As the NY Times pointed out Sunday, there's reason to think that while progressives may not be happy to see Affirmative Action go, they aren't likely to make bringing it back a central concern. Because it turns out they already tried to do exactly that in California. In 2020, Prop 16 was intended to bring back affirmative action, overturning a prior proposition which had outlawed it. But despite strong support from all of the usual suspects, the effort failed spectacularly.


The 2020 campaign to restore race-conscious affirmative action in California was close to gospel within the Democratic Party. It drew support from the governor, senators, state legislative leaders and a who's who of business, nonprofit and labor elites, Black, Latino, white and Asian.

The Golden State Warriors, San Francisco Giants and 49ers and Oakland Athletics urged voters to support the referendum, Proposition 16, and remove "systemic barriers." A commercial noted that Kamala Harris, then a U.S. senator, had endorsed the campaign, and the ad also suggested that to oppose it was to side with white supremacy. Supporters raised many millions of dollars for the referendum and outspent opponents by 19 to 1.

"Vote for racial justice!" urged the American Civil Liberties Union of Northern California...

California is a liberal bastion and one of the most diverse states in the country. That year, President Biden swamped Donald Trump by 29 percentage points in California, but Proposition 16 went down, with 57 percent of voters opposing it.

So in a deep blue state, in the year in which BLM was dominating politics, the push to bring back affirmative action got a measly 43% support.

The Times has gone over the results in Los Angeles County, the largest county in the state, and found there was a pretty distinct racial divide on this question. The group least likely to support it were Asians. Despite a county made up of Democrats who overwhelmingly voted for Joe Biden, support for affirmative action just was not strong. Asian and white voters didn't offer majority support and even among Hispanics support was just 55 percent. The only voters who were strongly in favor were black voters. Here's a chart created by the Times which shows the results.

But don't worry -- that's just one track of the progressives' plan of attack.

The other track is just ignoring the ruling, continuing affirmative action admissions, and claiming that they're judging students "holistically," and black students are just so much more holistic than white or Asian students. And you can't prove it because we destroyed all the records so f*** you, bigots.

Some of the better SVPs I worked for wouldn't consider any applicant with a degree from an Ivy. They would add a few others schools in there too.

Generally, they viewed their method as giving the non-priveledged, but more qualified from other unis, a step up.

63 I wish I had had the wisdom at 18 to choose a skill over college: my mom needed plumbing work and found a woman master plumber who had great rates and did excellent work. Her husband was a journeyman plumber who assisted her. The lady said she was working 50-60 hours a week because single women felt safe with her and her husband coming to their homes.

You can read and learn far more on your own than you can in a current college classroom, plus you have the freedom to make up your own mind about issues. These seems like a far better use of one's time, money and intellect than today's colleges and universities.

I think more likely the result of the decision will be Fuck Whitey. The top of the top of the non-diversity pile will continue to get in, and those people are now mostly Asian and Indian. Shaniqua Jackson will continue to get in, no problem. So will rich entitled brats like Hemington Warbucks IV.

So where does that leave normal white kids (and underperforming Asians)? They are fuckeded. In 5 years, it will be 99.99% impossible for any white kid to get into any Ivy, unless Daddy Warbucks buys his way in. Hell, it's already 95% impossible.

White kids: best search your family tree for any hint of any kind of minority whatsoever, and use that as your ethnicity on your application.

I wrote about it before, but in the late 80s I was dating a black girl and in all the same classes and more extracurricular (were both in band together). I made better grades and applied to multiple schools, and got some partial academic scholarships.

there's reason to think that while progressives may not be happy to see Affirmative Action go, they aren't likely to make bringing it back a central concern. Because it turns out they already tried to do exactly that in California. In 2020, Prop 16 was intended to bring back affirmative action, overturning a prior proposition which had outlawed it. But despite strong support from all of the usual suspects, the effort failed spectacularly.

You're letting the parents off way too easily in all this. The vast majority of those inner city school kids are three grades behind in the first grade and raised practically feral.

They're also constantly moving from apartment to apartment because someone went to jail and auntie has to take care of the kids or someone went on a drug bender and grandma has to take care of the kids. Or even worse, someone pulls them out of school for weeks at a time because the younger kids need a babysitter.

Teachers in good schools only have to deal with one or two troublemakers in class. Teachers in inner city schools would be happy to have one or two kids that weren't troublemakers.

The next push should be pointing out how universities are selling most admissions to foreign students (who generally pay full price) and that their filling their rolls with them at the detriment to US students.

Congress needs to get on top of both things, removing funding to any university that's discriminating against "the wrong" races, and those laundering tax payer money to foreign students.

They lost the fight over Prop 209, which (sort of) banned affirmative action, passed a law that was supposed to negate 209 (but was vetoed by Jerry Brown, of all people), tried to pass another proposition repealing 209 in 2020 but it got curb-stomped at the polls.

Funny thing, the father of Prop 209 is Ward Connerly, a black man who was a UC Regent at the time. It's the pasty white Donk commie cocksuckers who fight tooth and nail for AA.

The ruling will force states which according to the constitution have the right to determine their congressional districts to create majority minority districts based on a population breakdown, not where minorities actually live. This will force absurd geographic districts.

the trend has been brutal for elite prep schools they are really struggling to get their students into even T50 colleges. forget about ivies!

these people have money and have been very pissed off. so the response from the families (from my sense of what people do around here) has been to aim for good public universities (usually in the south, nowadays!) and getting a great scholarship. the girls seem to do better with T20 and Ivy placement (even if they're White lol). but the guys are hosed.

I don't even honestly care if this helps because I think that employers are already wise to the fact that you're getting a fantastic prospect from Alabama or U of F or Texas now. you are usually getting the top students (in reality) from northeastern prep schools!

I have mixed feelings. On the one hand, you cannot or should be able to force a university to adopt or abandon standards that it does not wish to adopt or abandon.

But discrimination based solely on race is anti-Constitutional if said college writes down on paper that that is what it bases its admissions policy on. How they treat students of different backgrounds once admitted is a whole other story.

But, for every college that values skin color over merit, let a thousand others blossom that value merit.

Sure, and Kavanaugh and ACB didn't fall in line with Thomas when he wanted SCOTUS to drop the NC election case out of muteness. Thomas often wants to go further than the rest of the "Republican" jurists. He wanted to go further here than Kavanaugh and ACB were comfortable with, so they sided with Roberts enough to let him do his own thing which still provided enough for Thomas to sign off on it with a concurrence.

I can recognize that. But they are state institutions, and we already have tighter strictures on state institutions.

For example, we tell a teacher that she does not have freedom of speech when she is on the job. She "represents" the Power and Authority of the State. So, she's not allowed to engage in behaviors the State can't.

And the local school board is not allowed to intervene and loosen up those restrictions.

The admissions department called me to do an emergency late interview for a black girl who clearly wasn't qualified. She got in (but turned Harvard down because she got a free ride somewhere else). The hidden crime of affirmative action is that these universities pull in students, even intelligent ones who are unprepared for the expectations of the university because of the failures of the government school system. These men and women fail, or change their major to useless 'studies' degrees and gain a load of bitterness. It is quite likely that if these same people were at a second tier university aligned with their test scores they could get a good education and become a success. In the current system these universities bring in underqualified students of their own and these in turn fail out or plump up the phony majors in those schools.

Yes, he did have an unusually good talent for taking law school exams. That requires being able to say what both sides of an argument are and spotting the legal questions involved. It does not require* actually answering the question.

*Except in Dershowitz's Criminal Law class. On Dersh's exams, you actually had to take a position and there was a right answer and a wrong answer. The politically-correct answer based on the feelz was usually the wrong answer.

Thus "blackness" is a thing created by whites (who created "whiteness" for them).

But the thing that is true about it is that Europeans did create the abstraction called "white". That's on my group.

There have already been people grifting on race and ethnicity in Academia - Ward Churchill, Elizabeth Warren. Any weapon can be turned both ways.

512 All the f*%king drama but look back decades in government.

For example, State Police in certain states, IIRC PA was one, the White male "average" lower/middle income were already placed low for employment. The bottom-line, White had virtually no chance at such employment unless from a "connected" family. (Like getting into a military academy, etc.)

In the Federal government a decade + ago, certain executive branch agencies suddenly rated certain positions at PhD & some Masters degree levels. Never had that been the case in the past - it was completely unnecessary - but positions at GS-12 & above level positions for "connected" Whites were desired. Few lower/middle income background Whites were able to get jobs even with outstanding college transcripts & decent non-criminal backgrounds & health. Now the feds open decent positions - good grades & pay - to high school graduates and applicants from non-profits, often without prior work experience, but they meet certain EEO qualifications. And most military veterans, particularly non-officer, are still screwed for federal employment regardless race. (Resented by the unions, average employees, managers alike.)
