Elon Musk: Target Should Expect Class-Action Suits from Shareholders Whose Money They've Burned Away For the Sake of Advancing the Corporate Officers' Personal Divisive Leftwing Politics

The corporate officers of a company have a fiduciary duty to the shareholders, not "the stakeholders" in all of society, and given that Target's leadership has absolutely crushed the value of the shareholders' shares, they might just sue.

Charlie Kirk
@charliekirk11

BREAKING: JP Morgan just downgraded Target's stock, after its longest losing streak in 23 years citing "too many concerns rising'.

Happy Pride Month Target!!

Elon Musk
@elonmusk

Won't be long before there are class-action lawsuits by shareholders against the company and board of directors for destruction of shareholder value

Tranheuser-Busch might expect a shareholder suit as well.

Bud Light has lost its place as America's number one beer. It's replaced there by Modelo, which is also a Tranheuser-Busch beer, but, if I understand this right, the US side of the concession is "controlled" by another company.

It's still a loss.

Bud Light sales suffered their worst week ever, falling 25.7% -- endangering its status as the world's No. 1 beer brand, according to the latest data provided to The Post on Tuesday.

...

The precipitous drop has narrowed the gap in sales between Bud Light and nearest rival Modelo Especial, which saw its sales surge 9.2% for the week ending May 20, according to Bump Williams Consulting and NielsonIQ data.

"While Bud Light loses week after week, Modelo Especial gains week after week and now Modelo outsells Bud Light on a national basis across all trade channels combined," Bump Williams, who runs the consulting firm, told The Post.

"If this continues Modelo will surpass Bud Light for the year," he added

Anheuser-Busch InBev owns both brands, but it does not control Modelo in the US, where it is owned by New York-based conglomerate Constellation Brands.

As mentioned earlier, supermarkets and package good stores will make decisions about how much shelf space to give to Tranheuser-Busch products based on the summer numbers, and once that shelf space is gone, it's likely to remain gone.

Bud Light needs to come up with a cogent strategy to win back customers in the next few months, a former executive warned, or its market share losses could become permanent.

...

A president of sales and distribution at Budweiser's U.S. parent Anheuser-Busch until his departure in April 2022, he told the Daily Mail that rivals like Coor's Lite and Yuengling could then remain a more prominent fixture in stores following this "reset".
"Those brands will have a better likelihood to succeed long term because they have more shelf space, they have more inventory, they have more back-stock, and they have more availability for consumers," he said.

...

Frericks warned Anheuser-Busch has only limited time left in which to come up with a plan that can draw a line under the controversy.

"It needs to make a statement about who their customers are and who they're going to serve now, and try and regain those customers now in June and July, because by August, September, it's too late," the former sales exec said.

Frericks had previously warned in late April about the risks companies take when sacrificing their apolitical stance in the marketplace to support environmental, social and governance issues that may lose them more customers than they gain.

That might be why Tranhesuer is offering rebates to give away its beer for free, or for $2.99 per case. They want to artificially boost demand just to keep the valuable shelf space in markets. Maybe it's worth it to them to spend millions and millions just to keep all those precious feet of shelf space.

Meanwhile, Nike likes Disney's woke war against the people of Florida.

Nike's top executive praised Disney CEO Bob Iger for his handling of the Mouse House's ongoing war with Florida Gov. Ron DeSantis -- just weeks after the apparel giant came under fire for its marketing partnership with transgender social media influencer Dylan Mulvaney.

"I think Bob's doing a great job at this," Nike CEO John Donahoe said of Iger on Monday.

Days before Mulvaney began promoting Bud Light to her millions of followers on TikTok and Instagram, she also posted images of her wearing Nike sports bras.

The Nike partnership also sparked boycott calls.

But Donahoe told CNBC that Nike will adhere to its track record of promoting racial and social justice causes.

When asked by CNBC if he was worried that DeSantis would come after other "woke" corporations such as Nike if the Republican governor manages to get elected president next year, Donahoe said companies should "stand up for your values."

They are permanent. It's too late now. The time to deal with this was in the first week or two. It's dragged on too long. The habits have changed. The pall of customer contempt and corporate impotence has now settled over the brand. The things they could have done right out of the gate - apologize, publicly fire people, hold customer-appreciation events, etc. - probably won't work now. If they come out and do those things, the attitude will likely be, "you're a day late and a buck short. You made your positions and your opinions of me known, and you're only backtracking now that you're in free-fall. Call me up two months ago."

39 It's interesing that Modelo, a Mexican beer, is the biggest beneficiary so far of Bud Light's faceplant. But they're relatively inexpensive, and it's a decent tasting beer in that segment. I suspect that a lot of Hispanic buyers have gravitated there easily, and a lot of new Anglo beer drinkers are trying it and saying "hey that's better than my old stuff was!"

Once consumers switch brand loyalties they generally don't go back.

Then she does behind the bar and says "I'm so sorry, Bob. I just heard about it. Let me get you a drink on me."

And then she slides him a Bud Light and the whole bar cracks up laughing and starts throwing wadded up napkins and stuff at him.

Then the logo "Bud Light: We know you are disappointed. We are too. Come back".

The only other thing DeSantis has done in the corporate space is around ESG and doing business with finance companies that ice out energy producers.

I'd guess there are direct payments to stores for placement and shelf space too. That's one of the dirty secrets of the grocery store business. Billions of dollars annually in payola for end of aisle shelves with better signage, eye level placement, extra space for new flavors or varieties, etc. Bud Light has hemorrhaged so much market share that AB couldn't subsidize things for very long though.

You've just described brand preference generally. People have brand preferences because they don't want to think about every little purchase. Toothpaste is toothpaste, buy Crest 'cause it's easy and you always have.

But if you *make* people think about that choice by pissing them off, they will choose something else. That choice will become a habit. Then your goose is cooked. This has been going on long enough for new habits to have been established. It's a brand disaster of the highest order.

86 I am skeptical about the possibility of lawsuits. Plaintiff's lawyers are part of the Dem coalition; they are unlikely to neck other Dems for being Dems. Big firms have been culturally coopted by the left politically (which we see in all kinds of ways - e.g., partners being asked to leave for representing clients with the wrong politics or for just having the wrong politics themselves, Trump being unable to secure well-heeled representation). And while the situation at big firms is acute, what's true of them is true of the profession more generally in terms of being coopted. Lawyers as a class have moved further to the left.

Do you live in a city? Have you lived there for a long time? If so you might not realize that, until recently, there hasn't been much in the way of beer selection outside of cities.

That's not a sleight, just that I could understand not realizing how many people probably drink Bud/Coors/whatever if so. Bud is cheap and available and a known quantity. Always has been. Folks in pool halls, at concerts, at juke joints, etc. order it because of that.

Add in the 40oz malt beverage crowd and the Dos Equis XXX or whatever bunch (and ball games and golf courses and bowling alleys etc), and it's probably just a simple numbers game.

Not to mention they made moves to get into those markets in some way, so the numbers were weighted towards them.

Zero real financial stake but they represent the people with everything to lose... and if they lose everything for a little tranny social justice grooming that is a small price for Blackrock to suffer - nothing.
Posted by: Itinerant Alley Butcher at June 07, 2023 04:28 PM (jFrE2)

They do not. BlackRock only recently set up a program for institutions to determine how those shares were voted(one option of which is to delegate it to BlackRock). Index shares are still broadly not voted and not without electing to delegate it to a manger. As of September the % of index assets managed by Blackrock that are using one of their voting option is about 12%, and not all of that is being delegated to Blackrock. Blackrock isn't voting shares without permission. Though it could be your 401k manager giving permission.

If index fund shares were being voted we'd start seeing way higher voting rates, it's still the case you can shake up a company with a few % of shares.

115 Biden's hatchet man at the SEC, and the commissioners themselves, along with SEC Staff have been trying to slowly undermine investors by writing DEI and factors like ESG into their regulations. There are several issues with this. First, investment advisors have a fiduciary responsibility to ensure the clients objectives are met. But they've now given them an out to include factors like DEI, which have zero to do with profitability, as a factor in their decisions. That's created some gray areas, which I believe overstep the SEC's statutory authority, quite directly. That will be challenged in court, you can count on it. Congress is further investigating as they've never ceded any of that authority to the SEC. The same goes for corporate level actions. The SEC is slowly allowing factors such as these in the corporate level decisions, even though they may negatively impact corporate profitability, which they do not have the statutory authority to do. Indeed the shareholder lawsuits are going to be glorious, and costly because the government will be fighting them all the way. This is manipulation of the securities market through regulatory fiats.

That’s actually insulting . Only way to get back is something they won’t do. And that is to have a commercial that confirms there are only two genders . Could be funny . Could be serious. But it has to have that message. Usually don’t like to say something is impossible but that is an impossible scenario.

There is more - beer has a shelf life. Unsold beer has to be taken back by the distributer. That has a cost - the time, the trucks, disposal, etc. Better to give away what's on the shelf now than risk having to take it back.

Who here hasn't drunk a five year old can of beer and thought...yeah, that could have been better. Beer is perishable - unsold beer costs a lot more money than you think. Giving it away might be a very attractive option.

True, but this particular topic - the Reedy Creek disaster - is something with no upside to be had by talking about it, much less the way he talks about it. He keeps openly stating that the District was a subsidiary operated by the corporation, which is a big no-no and has the potential to expose Disney to massive liabilities in the form of the municipal bonds that it turns out a corporation - not a government entity - was issuing.

It's breath-taking how badly he's doing on this topic.

GM's run GT Corvettes competitively at Le Mans for decades now.

InBev owns Modelo outside of the United States. Any US-brewed and US-distributed Modelo is Constellation Brands, as InBev had to sell the rights to domestic brewing and distribution to Constellation when it bought AB, for antitrust reasons (it would have resulted in a Mexican beer monopoly for InBev). If you manage to buy Mexico-brewed Modelo in the US, then it was brewed by InBev and they got paid for it, but that should be rare.

It is easy to tell by the packaging. If "Constellation Brands" is on the label, it isn't InBev. If it was brewed in the United States, it isn't InBev.

227 It's You-jen in French and You-gen-ee-o in Italian.

||Prince Eugene of Savoy
Prince Eugene Francis of Savoy-Carignano,[1] (18 October 1663 – 21 April 1736) better known as Prince Eugene, was a field marshal in the army of the Holy Roman Empire and of the Austrian Habsburg dynasty during the 17th and 18th centuries. He was one of the most successful military commanders of his time, and rose to the highest offices of state at the Imperial court in Vienna.

Born in Paris, Eugene was brought up in the court of King Louis XIV of France. Based on the custom that the youngest sons of noble families were destined for the priesthood, the Prince was initially prepared for a clerical career, but by the age of 19, he had determined on a military career. Based on his poor physique and bearing, and perhaps due to a scandal involving his mother Olympe, he was rejected by Louis for service in the French army. Eugene moved to Austria and transferred his loyalty to the Holy Roman Empire.||

That aura has evaporated and now the people you suckered in with your fun and light campaign know how much the current corporate leaders hate them.

I just can't see people coming back after that. Maybe if you make it consistently the cheapest brand of lite beer o the market, after years, you might become a solid seller.

This bothers me a lot about Cadillac. They are making some really hot, luxurious cars, but they seem to have no style or design sense at all any longer. Cadillacs used to look badass and striking, beautiful and distinctive. You knew it was a very special car just by looking at its amazing presence.

They lost that mid 80s and have failed ever since. They went from the number one premier luxury car on earth to "is that a caddy?"

320 wiki on Modelo/Constellation:
In 2013, Constellation acquired Grupo Modelo's US beer business from Anheuser-Busch InBev. The transaction included full ownership of Crown Imports LLC which provided Constellation with complete, independent control of all aspects of the US commercial business; a brewery in Mexico; exclusive perpetual brand license in the US to import, market and sell Corona and the Modelo brands and the freedom to develop brand extensions and innovations for the US market. Constellation had formerly imported Corona and other Modelo brands to the United States and acquired the US rights to those brands as a part of an anti-trust settlement permitting Modelo's acquisition by Anheuser-Busch InBev.

356 >>Hmmm.. not familiar with that.. the tuna, not Australia.

Years ago the tuna industry was in trouble in Australia and it was big bucks because of the Japanese trade. So they made huge pens in the middle of the ocean and raise tuna in them.

Saw a video of the "tuna cowboys" who dive in the pens to get the sharks out. Crazy dangerous job but the Japanese love their tuna and they will pay for it.

358 Disney and Nike will be rewarded for their diligence by future customers when hate is finally eradicated, after you are all dead and buried. The right side of history is the side that wins, and whose values shine into the future. The wrong side holds values that will be passed by and forgotten.

Here's my proposed ad-

(Scene - riverside, young and middle aged fit men and women dressed for outdoors but also sexy)

Chad-"Hi, I like my beer like I like my women, full bodied, refreshing, and authentic. No artificial ingredients, like fake boobs or a fake tranny vag. Next time you're at the store, pass up those gay rainbow supporting brands and try a cold refreshing Bud Light. Share a few with your real lady friends, who knows, you may get lucky!"

Nice young lady comes up to Chad, gets close and puts hand on his chest.

Lady-"I like a man who knows what he wants in his woman, and in his beer!"

Chad-"So try some Bud Light, and have good child-making sex with your lady. Bud Light, get back to basics!"

If the they/them/their idiots at Butt Lite and Targhey had any brains they would come out and say, look. We hear you. We respect ALL opinions. That's why we won't be taking a stand on any issue or selling anything other than regular clothes and beer. We're sorry to have offended our customers. They won't. And they will die, good.

Posted by: Minnfidel at June 07, 2023 05:52 PM (Ml6sx)

379 They are permanent.

29 Nike is like Disney in that they are so big and world wide it will be hard to significantly damage them. That’s why I look at my boycotts as a personal stand not dependent on whether it’s successful in doing any damage.
==
I think this is now a whole new world. And NIKE's China exposure in this world is a bit more serious. Disney could save themselves - but apparently won't. This is different. Markets lost now won't be regained. Lose too much, you're done.

A buff dude gets off a hard day's work down at the Mexican Weather Girl factory, and cracks open an ice cold bud light.

*zoom in on frosty can*

*Pshhhhh*

Then he wakes up in a bathtub full of ice, with his dick missing. At first he's super pissed off, but then he reads some books about Queer Theory and finds out his dick was donated to a needy genderfluid BIPOC girl by Anheuser-Busch. So he chills out, and he thanks them for their commitment to equality while he rides on a Clydesdale with Jake Gyllenhaal.

Fin.

384 Who decided Nike's 'values' should be Left-wing?
Nike was founded by 2 Republicans FFS.
The truth is that Donahoe is using company money to support his own politics. Not the politics of his workers, or the Vietnamese children stitching his shit shoes together in their tiger cages.
The best thing Republicans could do if they get back into the presidency is get money out of politics. It would knee-cap the Democrats.
