Elon Musk: Target Should Expect Class-Action Suits from Shareholders Whose Money They've Burned Away For the Sake of Advancing the Corporate Officers' Personal Divisive Leftwing Politics

The corporate officers of a company have a fiduciary duty to the shareholders, not "the stakeholders" in all of society, and given that Target's leadership has absolutely crushed the value of the shareholders' shares, they might just sue.

Tranheuser-Busch might expect a shareholder suit as well.

Bud Light has lost its place as America's number one beer. It's replaced there by Modelo, which is also a Tranheuser-Busch beer, but, if I understand this right, the US side of the concession is "controlled" by another company.

It's still a loss.

Bud Light sales suffered their worst week ever, falling 25.7% -- endangering its status as the world's No. 1 beer brand, according to the latest data provided to The Post on Tuesday.

The precipitous drop has narrowed the gap in sales between Bud Light and nearest rival Modelo Especial, which saw its sales surge 9.2% for the week ending May 20, according to Bump Williams Consulting and NielsonIQ data.

"While Bud Light loses week after week, Modelo Especial gains week after week and now Modelo outsells Bud Light on a national basis across all trade channels combined," Bump Williams, who runs the consulting firm, told The Post.

"If this continues Modelo will surpass Bud Light for the year," he added

Anheuser-Busch InBev owns both brands, but it does not control Modelo in the US, where it is owned by New York-based conglomerate Constellation Brands.

As mentioned earlier, supermarkets and package good stores will make decisions about how much shelf space to give to Tranheuser-Busch products based on the summer numbers, and once that shelf space is gone, it's likely to remain gone.

"Those brands will have a better likelihood to succeed long term because they have more shelf space, they have more inventory, they have more back-stock, and they have more availability for consumers," he said.

Frericks warned Anheuser-Busch has only limited time left in which to come up with a plan that can draw a line under the controversy.

"It needs to make a statement about who their customers are and who they're going to serve now, and try and regain those customers now in June and July, because by August, September, it's too late," the former sales exec said.

Frericks had previously warned in late April about the risks companies take when sacrificing their apolitical stance in the marketplace to support environmental, social and governance issues that may lose them more customers than they gain.

That might be why Tranhesuer is offering rebates to give away its beer for free, or for $2.99 per case. They want to artificially boost demand just to keep the valuable shelf space in markets. Maybe it's worth it to them to spend millions and millions just to keep all those precious feet of shelf space.

Meanwhile, Nike likes Disney's woke war against the people of Florida.


Nike's top executive praised Disney CEO Bob Iger for his handling of the Mouse House's ongoing war with Florida Gov. Ron DeSantis -- just weeks after the apparel giant came under fire for its marketing partnership with transgender social media influencer Dylan Mulvaney.

"I think Bob's doing a great job at this," Nike CEO John Donahoe said of Iger on Monday.

Days before Mulvaney began promoting Bud Light to her millions of followers on TikTok and Instagram, she also posted images of her wearing Nike sports bras.

The Nike partnership also sparked boycott calls.

But Donahoe told CNBC that Nike will adhere to its track record of promoting racial and social justice causes.

When asked by CNBC if he was worried that DeSantis would come after other "woke" corporations such as Nike if the Republican governor manages to get elected president next year, Donahoe said companies should "stand up for your values."

They are permanent. It's too late now. The time to deal with this was in the first week or two. It's dragged on too long. The habits have changed. The pall of customer contempt and corporate impotence has now settled over the brand. The things they could have done right out of the gate - apologize, publicly fire people, hold customer-appreciation events, etc. - probably won't work now. If they come out and do those things, the attitude will likely be, "you're a day late and a buck short. You made your positions and your opinions of me known, and you're only backtracking now that you're in free-fall. Call me up two months ago."

It's also probably a bit of financial jiggery-pokery. They aren't discounting, they're rebating. They can book the sale and write off the reduction later, making their sales - and cashflows - look healthier than they are. The books are probably a mess right now and they want the cash flow and sales figures - even if they have to write it all off later.

39 It's interesing that Modelo, a Mexican beer, is the biggest beneficiary so far of Bud Light's faceplant. But they're relatively inexpensive, and it's a decent tasting beer in that segment. I suspect that a lot of Hispanic buyers have gravitated there easily, and a lot of new Anglo beer drinkers are trying it and saying "hey that's better than my old stuff was!"

Once consumers switch brand loyalties they generally don't go back.

45 For what it's worth, The discounting is to save on double handling (what they need to take back from the retail stores back to the wholesaler), also what it would cost to dispose of as trash especially at this scale isn't free.
The can buy shelf space if they need to, brands like this normally don't need to or they wouldn't want to pay to expand if they weren't moving units... they might consider it this fall to see if they can recover by the next reset.

Corporate governance is going to be a huge topic over the next 5 to 10 years. In particular - what to do about institutional / index fund shareholders that don't give a shit about money as much as they care about political / social control. There's not a great solution. But setting the plaintiff's bar loose on these assholes would help I think.

Is a disingenuous question. DeSantis can't go after very many organizations. Disney was uniquely vulnerable to Florida government actions, but most other businesses are not. The only other thing DeSantis has done in the corporate space is around ESG and doing business with finance companies that ice out energy producers.

There is no particular corporate risk in Florida, and this was a stupid question. Donahue knows that because he is probably *much* smarter than some MSM newstalker, so he took the opportunity to brush off an irrelevant question with a soundbite.

I'd guess there are direct payments to stores for placement and shelf space too. That's one of the dirty secrets of the grocery store business. Do you live in a city? Have you lived there for a long time? If so you might not realize that, until recently, there hasn't been much in the way of beer selection outside of cities.

That's not a sleight, just that I could understand not realizing how many people probably drink Bud/Coors/whatever if so. Bud is cheap and available and a known quantity. Always has been. Folks in pool halls, at concerts, at juke joints, etc. order it because of that.

Add in the 40oz malt beverage crowd and the Dos Equis XXX or whatever bunch (and ball games and golf courses and bowling alleys etc), and it's probably just a simple numbers game.

Not to mention they made moves to get into those markets in some way, so the numbers were weighted towards them.

They do not. BlackRock only recently set up a program for institutions to determine how those shares were voted(one option of which is to delegate it to BlackRock). Index shares are still broadly not voted and not without electing to delegate it to a manger. As of September the % of index assets managed by Blackrock that are using one of their voting option is about 12%, and not all of that is being delegated to Blackrock. Blackrock isn't voting shares without permission. Though it could be your 401k manager giving permission.

If index fund shares were being voted we'd start seeing way higher voting rates, it's still the case you can shake up a company with a few % of shares.

It's like AAA business in the old Yellow Pages. Most people really did dial the first couple of listings and never made it down the alphabet.

InBev owns Modelo outside of the United States. Any US-brewed and US-distributed Modelo is Constellation Brands, as InBev had to sell the rights to domestic brewing and distribution to Constellation when it bought AB, for antitrust reasons (it would have resulted in a Mexican beer monopoly for InBev). If you manage to buy Mexico-brewed Modelo in the US, then it was brewed by InBev and they got paid for it, but that should be rare.

It is easy to tell by the packaging. If "Constellation Brands" is on the label, it isn't InBev. If it was brewed in the United States, it isn't InBev.

It certainly is in the Lehigh Valley area. Scads of local breweries popping up over the last ten years or so. All pretty damn good. All getting their stuff into local restaurants, even big chains. It's impressive. And it's all fascinating stuff, by really good brewers, not just fifty different fruit-based variations on "juicy cloudy hazy 420x High-PA" that every other damn microbrewer has been obsessed with.

Just bought some snow crab at 9.99 per pound while King Crab was north of 24.99 per pound. Dungeness only appears in my area a few times a year and is overpriced but delicious when occasionally reasonable.

With properly prepared drawn butter the difference between crabs is hardly noticeable.

Years ago the tuna industry was in trouble in Australia and it was big bucks because of the Japanese trade. So they made huge pens in the middle of the ocean and raise tuna in them.

Saw a video of the "tuna cowboys" who dive in the pens to get the sharks out. Crazy dangerous job but the Japanese love their tuna and they will pay for it.

368 Catfish is amazing if its fried right. Nasty otherwise. Halibut is terrific, and so was the original Tilapia we got at first from New Zealand was good but the Chinese stuff is bad. I tried Swordfish once at McGrath's but it had a really weird acidic aftertaste

379 They are permanent. It's too late now. The time to deal with this was in the first week or two. It's dragged on too long. The habits have changed. The pall of customer contempt and corporate impotence has now settled over the brand. The things they could have done right out of the gate - apologize, publicly fire people, hold customer-appreciation events, etc. - probably won't work now. If they come out and do those things, the attitude will likely be, "you're a day late and a buck short. You made your positions and your opinions of me known, and you're only backtracking now that you're in free-fall. Call me up two months ago."
