Well, for one thing, Congress has no power to compel him to appear. He's at the top of an independent, co-equal branch of government. For another, Congress is limited in what it can investigate. The power of Congress to investigate isn't in the Constitution; it's one of those powers deemed to exist by the "necessary and proper" clause. But it's a dependent power -- Congress only has this power to the extent it is necessary to carry out one of its explicit powers. Congress has the power of oversight over some executive departments. Congress has the power to approve or disapprove of some nominees. And Congress has the power to legislate. Which of those three powers would Congress be advancing by subjecting Supreme Court Justices to badgering, insulting questioning? They do not have the power of oversight over the Supreme Court, and no one is being nominated and approved to the court. Finally, they do not have the power to pass legislation affecting the Supreme Court -- it's a co-equal branch of government and therefore makes its own rules. So Roberts was quite right to re-assert the Court as a co-equal branch that simply does not answer to partisan Democrat Senators who have been trying to get rid of Clarence Thomas for, what is today, Wednesday? Let's see, this Wednesday is the 3rd, last Wednesday was the 26th... Ah yes, partisan Democrat Senators have been trying to get rid of Clarence Thomas for thirty five f'n' years now.
Two Republican Senators tore into their Democrat colleagues Tuesday, accusing them of threatening to cut $10 million in funding for Supreme Court security unless SCOTUS does what they want. Senators Ted Cruz (R-Texas) and Josh Hawley (R-Mo.) made the explosive accusations during yesterday's Democrat-led "Supreme Court Ethics Reform" hearing. "The Left is willing to threaten the lives of the justices," said Cruz. "This is disgraceful." The fiery hearing was held amid a weeks-long media campaign accusing conservative justices of ethics violations and conflicts of interest. When Barr came in as AG and many were hopeful (even me, to some degree, because I'm an idiot who never learns) that Things were finally happening, I laid out why I thought that Things were *not* happening even though I thought Barr wasn't too big a monster himself. Barr was, by my reckoning, a Company Man. He wasn't out to destroy Trump, but he would do nothing to impugn the integrity of the Company. There would be no deep inquiries into the DoJ, there would be no punishments, there would be no acknowledgement of how corrupt the DoJ was. Nobody would be fired, nobody would be prosecuted. The investigations would wind down and they would pretend it never happened, except for when they *had* to publicly defend the institution. Barr's first loyalty was to the Company and so it also is with the SCOTUS, and this should surprise no one. They are Company Men, and they will close ranks against interlopers. Somebody wrote that phrase out for Schumer (It's from Hosea 8:7) because I don't think he's sitting on his bed at night pouring over Hebrew Scriptures to hurl at Republican chief justices or Congressppeople.
That being said, I think Republicans in Congress of a conservative religious bent should get up in Congress everyday and quote things from the Hebrew scriptures back at him, and reference what he said from Hosea. What about this juicy quote reported by the NYT, of all places:
"Harlan Crow is a deeply honorable, decent, and patriotic person," said Jonah Goldberg, the editor in chief of The Dispatch, on Twitter. And this from the Dispatch: "(Disclosure: Harlan Crow is a minority investor in The Dispatch and a friend of the founders.)" By "minority investor," they probably mean that Jonah and his pals have more than 50% of the equity while not putting a dime of their own money in it. Harlan is the sucker, er, benefactor who pays the bills. Clever weasel phrase, though, it really downplays his contribution while (probably) not technically being a lie.
