Sefton: sefton at cutjibnewsletter.com | LOL: Don LeMon Hires as His Crisis Communications Flack Allison Gollust, the Woman Who Was Having the Affair With Jeff Zucker and Got the Ancien Regime Made AncientRe: The "conservative news alternative" Fox News, lol: Is that true? I dunno. According to Megyn Kelly, Tucker Carlson isn't officially fired yet. They're working out the settlement. What I hear Fox is that Fox is refusing to pay him a settlement for firing him, becaue they claim he quit. They are willing to pay him, though. They are attempting to tell him that he has to continue taking his salary -- but remain off the air for the final two years of his contract. They are claiming that they still have him under contract and that he can't go out and do his own show as long as they keep paying him. They want to pay him not to compete with them. According to a Fox insider -- not my source, but relayed through one person and then another -- Tucker Carlson wanted to rebut the 60 Minutes Ray Epps "story," which directly called Tucker Carlson a conspiracy theorist and inciter of violence. A Fox executive producer told him he was not allowed to do that. That's what caused Carlson to quit. Now, an interesting wrinkle, per this source, is that Tucker's contract specifically forbade Fox News from interfering with his show, which they obviously violated, putting them in breach of contract by doing what his contract says they can't do. Supposedly, this non-interference clause would make them possibly liable to both lose Tucker Carlson and get a most of his remaining salary. But again, Fox is arguing that he just has to sit on the sidelines to get his money, paid to Not Be On TV. I wish I could get that deal! I'd be great at Not Being On TV! I have a virtually spotless record of Not Being On TV! Even when I was on TV, they bumped me to show a tank stuck in the mud! Obviously my part of that reporting is very sketchy, relying on a friend of a friend of a friend stuff. Only take my claims as fodder for conversation. Incidentally, I don't know if it's anywhere near true that a single breach means you get the full contract payment. But I don't know. Carlson may have invoked that clause and this Fox executive, we know, still forbade him doing his show as he wanted, telling him, effectively, that she was voiding his contract on her authority. Maybe that would entitle someone to a payout of the terms of the contract. Comments(Jump to bottom of comments)1

++++ If this is true, I smell a lawsuit followed by an out-of-court settlement. If he had a non-interference clause and he can prove they interfered - Epps, Jan 20, the vax, whatever - then they're in breach (unless the non-interference clause is weak and offers no real protections). I suspect there will be a settlement if this is the case. Fox will balk, Tucker will sue, they will settle for 75% or 80% of the contract value, nobody admits guilt, the terms are private, and Fox provides the seed money for Carlson's next venture. In the blue hellhole where I currently reside, the rule is that a contract breach has to be "material" to excuse the other side's non-performance. Arguably, Fox honchos interfering with Carlson's show could be big enough to call the whole thing off, but that's likely going to be something for the lawyers to hash out.

What is a "leaked" court document? Civil court proceedings are public. All documents filed or entered in the case are available publicly, and usually via on-line services. Unless the defamation case was under seal -- which is highly unlikely and would raise red flags if it were -- then court documents can't be "leaked." Anyone can access them. SO many rumors out there about what's really going on. We probably won't know for a while, sadly. But the theories are fun.
One head scratching theory is the Murdoch kids want to sell Fox, so they want him out so another liberal will be willing to buy it. But dramatically firing their top show runner is causing people to unsubscribe from fox nation en masse and is tanking their stock price. You don't sell after you've tanked your new channel's max price. Unless they just don't care about the money and politics is more important. Posted by: LizLem at April 26, 2023 12:20 PM (+mkOR) 65

Re contract violation on interference, it would be under NY law and a lot of recent agreements have a mandatory arbitration clause.
But, essentially, the money Fox is offering is chump change for the remaining years compared with Tucker's ability to move to streaming platforms and monetize his brand. Rupert and Lachlan must be gutting the organization prior to selling it--only problem is that they are picking the worst possible time to dump a cable network. Supposedly, this non-interference clause would make them possibly liable to both lose Tucker Carlson and get a most of his remaining salary. But again, Fox is arguing that he just has to sit on the sidelines to get his money, paid to Not Be On TV.

Highly unlikely. A sufficiently "material" breach of a contract could entitle you to full payment, but those are very rare in long-term contracts like this. These type of entertainment contracts are very complicated, probably run a 100 pages, and specifically delineate exactly what's a breach and what isn't, and what the remedies for that breach are. Also: I would be shocked if the contract doesn't include substantial oversight and review and approval by the network of Tucker's show's content. That would be standard. No network is gonna allow its host to praise Hitler or run segments on how cannibalism is a great idea. Posted by: Elric Blade at April 26, 2023 12:25 PM (iFTx/) 121

From an HR perspective, it sounds like we have the employment lawyers on both sides combing over the contract. Per the rumors, Fox originally said they fired for cause so don’t have to pay, which would be true except they then lose control of what Tucker does. Oops! Take 2, he quit! We don’t have to pay but he is bound by his terms (prob non disparagement clause, etc) because it’s voluntary. Out of extreme benevolence, we will pay and it has nothing to do with covering any weakness with unreasonableness in our non-compete. Trust us!
Other side- wait a minute, I see I am not being harmed financially now, but this could harm my earning potential in the future. That is, in fact, unreasonable. Also, your over zealous exec violated the terms of this agreement, so we do have a club in which we can proverbially whack you over the head with, you don’t hold all the cards, Fox. Posted by: Lady in Black --- So this is a really stupid chain of inference. Michel Foucault told all the revolutionaries that words don't mean things, that they are only a means to manipulate you and assign power. So, you may think you are just using words, but Foucault has convinced them (oddly enough through words he wrote) that words are a form of aggression against them if they don't like their implications. Thus they escalate the "aggression" they interpret to another word "violence" to basically get you back at your own game. Because then as the victim of violence, they have power over you. And words can only apportion power. How that doesn't mean that Foucault was just fucking with them all in his books is beyond me. Posted by: Axeman at April 26, 2023 12:35 PM (krQz2) 210

You know, as our 'every story is about Trump v Desantis' thing is entering it's... adolescence, something that has always bugged me.
What seems odd to me about the visceral reaction a lot of people have to Trump is that it reminds me a lot of the visceral reaction a lot of people had to Palin. Note: I am not defending either Trump or Palin here. What I am trying to do is describe a phenomena I have observed. 1) Do not like Trump/Palin. 2) Come up with reasons AFTER that to continue and support not liking Trump/Palin. I could get into gender or class or whatever it is that causes the reaction, but I am just observing what I have seen. I have never quite gotten it. On the other hand, I have never quite gotten the love the individuals engender, either. Posted by: Aetius451AD Johnson Work Laptop at April 26, 2023 12:37 PM (zZu0s) 235

FEMA replaced HHS as the Lead Federal Agency, with no warning or preparation
What Zimmerman is saying here is that, in the PanCAP-A org chart, where the NSC is in charge of policy and the HHS is in charge of almost everything else – actually, FEMA is in charge of everything else. This means that, in effect, starting on March 18, 2020, the HHS –which comprises the CDC, NIAID, NIH and other public-health-related agencies – had NO OFFICIAL LEADERSHIP ROLE in pandemic response – not in determining policy and not in implementing policy. This is a staggering piece of information, considering that all pandemic preparedness plans, as Zimmerman notes, placed the Health and Human Services Agency (HHS) at the helm of pandemic response. He's worked well with women for years, and many who know them refute even the much milder charges being made at this time. Because Willowed, and because funding is an issue, I brought this forward:
Part of the problem is expecting revenue from Youtube vids. As far as I am concerned, they are freely provided by their authors, who simply want to share some knowledge or entertainment out of the kindness of their hearts. I have never given Dime One to any Youtuber, and I either block the ads, scroll over, or quit the video if those don't work. But here is an idea for a payment system I could support. Call it "PayAnon". You buy a prepaid Visa card from a store that sells such things. It has a number, right? PayAnon is simply an encrypted comms link, through which you transmit the card number and donation amount to the recipient. Recipient makes the draw, and sends back through the link, "got it, bro. Thanks". Would work for making donations here, too. Using pre-paid cards would limit your risk. Posted by: Alberta Oil Peon at April 26, 2023 12:45 PM (tkR6S) 306

Trump is super frustrating. He has good instincts at times and get there is a fight going on which puts him above 95% of the GOP. Unfortunately he surrounds himself with the absolute worst personnel and has a tendency to shoot allies due to his thin skin. All in all I'd prefer him as kingmaker, not candidate. Having said that, his new drop about firing govt employees made it move.

Same with Ronna etc. Trump is trying to make peace with the GOPe because he is essentially a deal maker and has picked the inside track to win. DeSantis appeals to a different type which is more ideological--e.g. trans wars, choosing a target and freezing it like Disney, etc. Appealing to the upper class that feels they can support him without embarrassment to others unlike Trump or Palin for example. Very smart and disciplined with a tight knit political operation in Fla. But, whether he can create a broader coalition and whether his six weeks abortion law and trans focus hurts him with college educated women is anyone's guess right now. They have a plan and stick to it to climb the greasy pole of politics. Remember how Kavanaugh had detailed accounts of what he did every day--that sort of discipline can serve one well in almost never making a mistake. But, that type often comes off as cold---aka the often quoted and seldom seen movie Elections created a stereotype Tracey Flick as example. That does not make DeSantis a bad candidate--but it does limit the personal (not policy) appeal of such to minorities and lower class voters.
