Judge Allows Lawsuit To Proceed Against Biden Administration for "Coercive Censorship," Pressuring Social Media Companies to Censor Stories About Covid-19 and Hunter Biden's Laptop

Other lawsuits have been tossed out. The judge says that this lawsuit, by the states and doctors censored by Biden, is better pleaded.

The Biden administration failed to stop a lawsuit by Louisiana, Missouri and doctors alleging federal coercion of social media companies to censor purported misinformation on COVID-19, elections and the Hunter Biden laptop, with a federal judge greenlighting the suit to move forward.

U.S. District Judge Terry Doughty ruled that unlike previous failed censorship lawsuits against social media companies by their users, the First Amendment and Administrative Procedure Act suit by the states and doctors is much better pleaded.

"Plaintiffs have alleged the full picture: a cohesive and coercive campaign by the Biden Administration and all of the Agency Defendants," from the CDC and FDA to the FBI and Cybersecurity and Infrastructure Security Agency, "to threaten and persuade social media companies to more avidly censor so-called 'misinformation,'" Doughty wrote.

He also cited "alleged various statements from many individuals that contained concrete threats both toward the general viewpoints espoused by plaintiffs, as well as the specific content of the private plaintiffs themselves."

Doughty cited the alleged censorship of the anti-lockdown Great Barrington Declaration and its coauthors, epidemiologists Jay Bhattacharya and Martin Kulldorff, "just after" then-National Institutes of Health Director Francis Collins called for a "quick and devastating ... takedown" of the document.

The only thing I have any optimism about at the federal level is SCOTUS, and that very much has a limited lifespan.

The courts could wreck a lot of havoc over the powers of the administrative state for the next decade.

39 Note that it's been previously rumored that both Marvel and Lucasfilm have taken to a shooting technique they call "scrapbooking," where they film multiple possible endings and multiple plot-exposition scenes which will lead to those possible endings. Then they choose which movie they want to assemble after test screenings.

This is a rumor but it is almost 100% certainly true. It partly explains why they are so damned expensive to make, but it also explains why the films are so disjointed and poorly strung together.

But it makes sense from their point of view. Not only does it make spoilers less likely if nobody even knows what the hell happens, but it makes sense of the multiple rumors coming out of filming.

Directors have said in interviews that they are brought on to film a movie, but then are told that the action sequences are being done by someone else, making things even more disjointed.

Unless you've had a croissant from France or from a very fancy bread shop, you've almost certainly only ever had a shitty simulacrum whose only similarity is the shape.

I don't think Alito or Thomas did, but people like Kennedy seemed to have loved him. Gorsuch hasn't been on the court for very long, so his early years are a bit suspect with the supposed practice of keeping quiet early, and Kavanaugh is the most establishment of the current 5 conservatives. I think there's openness among Kavanaugh and even maybe Barrett to defer heavily to the Chief Justice and all, but the election issue was apparently a giant clusterfuck within the court.

164 There is a huge difference between a welll made, proper croissant and a Safeway Croissant. Its like getting a real Bagel made the old fashioned way, and a sleeve of them from the store. Or a real soft pretzel with kosher salt made right and a package of them from the shelf.

Almost all food is way, way better than we know because we've been getting the crappy mass produced version. Its the difference between home made pizza and Totinos.

I blame food scientists. Companies have been mass producing food for ages and doing a/b testing on their last version to see if their new, cheaper crap is about as good as the old, cheap crap. So in effect, they've been making copies of copies of copies with progressively cheaper ingredients and fillers for decades.

So the food's been getting incrementally poorer while they've been figuring out chemical compounds to make the food more addictive (I know McDonald's uses a chemical to make their burgers taste flame broiled, for example).

But if you compare the copy of a copy of a copy of a copy to the original real deal that's fresh and made from good ingredients, the difference is astonishing.

239 "milky loads" was a phrase that appeared in Sullivan's online dating profile.

240 Is "old Milky Loads" another name for "Andrew Sullivan?" If not, then who is it? If yes, then what does it mean?

It comes from a personals ad Sullivan ran trying to find a boyfriend to ravage his hind end. The details were... very disgusting and graphic. ACE ran it ages ago when Sullivan was ranting and raving about Sarah Palin

241 The only thing I have any optimism about at the federal level is SCOTUS, and that very much has a limited lifespan.

The courts could wreck a lot of havoc over the powers of the administrative state for the next decade.

The dumbest thing Biden did was running the rent control BS after the SCOTUS specifically stated they were outside the lines. I think it was Kavanaugh they punked. Might have been able to get him to be a better "nuanced" justice. Now Alito and Thomas are primed to re-establish the 10th Amendment right down DCs throat, with prejudice. This gas stove BS is just bringing it closer. Pretty soon all the executive branches rulemaking authority is going to get struck down because Congress can't do that. Make those lazy bastards go back to work - or quit passing bullshit bills.

244 " She was frustrated as a single person she had to pay $500 a month with a $5000 deductible for health insurance."

Obamacare saved me a several thousand (not counting the risk I took on). When my $6k deductible insurance went over $1000/month, I dropped it (except for cheap dental). So I had a few years with no payments to make, then got Medicare. Thanks Obama. heh

246 You put the shaped dough in boiling water with baking soda in it and boil for 30 seconds then brush with egg wash and sprinkle your pretzel salt on it and bake.

I did read that you can sort of sub lye out of a recipe with baking soda, yeah. Probably what people do now everywhere.

250 For those who missed it, David French has teamed up with a guy who says that getting the vaxx shot "redeems an abortion in the same way that Jesus' resurrection redeems us". Really. I couldn't make up a blasphemy that stupid.

I do believe that God feels we are all redeemable. But French is certainly putting that belief to the test. Christ has some very specific warnings for people who behave like he does, and they aren't very pleasant.

253 I said last year that WV vs EPA is probably the more important decision, not Dobbs. That was SCOTUS slapping the administrative state, hard.
Posted by: Colorado Alex in Exile

You know, that's thoughful and insightful.

But in this age, the courts and the law are going to be repeatedly subverted.
Decisions upholding the 2nd Amendment have not stopped people in Fed and State govs from doing things to hamper and inhibit firearms sales to private citizens.
Decision to overturn "Roe v. Wade" has not hampered or stopped the same from doing things to circumvent that decision.
I don't think any of this will stop the FBI, CIA, and other parts of FedGov from trying to get media platforms to "censor" viewpoints that they don't agree with or tolerate. Or generally subvert any other Federal Court decisions that they don't like.

As far as I can recall, Sullivan also described himself as a "power bottom."

So now both of us know far too much.

256 "If so, Trump is a sucker. Why on earth would he voluntarily comply with that?"

some think it secures his nomination ... so perhaps he believes it "motivates the base". And I'm not sure what other actions are preferable ... a dawn raid, shoot out with secret service? Or would Trump just have to stay out of New York?
