Jacob Chansley's Former Attorney: I Repatedly Asked Federal Prosecutors for Video of My Client and They Repeatedly Told Me They Had None

An attorney for the so-called "QAnon Shaman" Jacob Chansley asked federal prosecutors repeatedly for all videos showing his client inside the Capitol on Jan. 6, yet told The Daily Wire he never received the bombshell -- and potentially exculpatory -- footage aired Monday night by Tucker Carlson.

Albert Watkins, whose client Jacob Chansley pleaded guilty to felony charges in connection with the Capitol riot and was sentenced to 41 months in prison, said Department of Justice prosecutors were legally bound to turn over the footage. Clips shown on Carlson's Fox News Channel program show Chansley walking freely and peaceably through the building, often accompanied by multiple police officers.

"We did not receive that video footage," Watkins said. "We asked for it, and not just once or twice. Whether we asked for it or not is irrelevant because the government had an absolute, non-compromisible duty to disclose that video and they did not do so."

"And all the while, they were actively representing to the court and the American people that Jake was a leader, leading the charge into the Capitol," he said. "They did not disclose that footage because it ran contrary to their rote narrative."

Watkins, an attorney for nearly 40 years, told The Daily Wire he was stunned to see the footage, which he could have used to defend Chansley.

"I've never seen anything so vile as what I'm seeing right now," he said. "It's a departure from a pretty high standard they've maintained for a long time. Anyone who needs to have belief in the integrity of our justice system, whether they're a left-wing New England academic or a raging right-winger, needs to say that this is really wrong and f--ing it up for everyone."

Watkins said anger now being focused on Carlson for locating and airing the footage should be directed at prosecutors who appeared to violate rules established in the landmark Supreme Court case U.S. v Brady, which cemented that prosecutors must turn over relevant information to defense attorneys, particularly exculpatory evidence.

"Looking at the news, half of it is getting mad at Tucker," Watkins said. "What the f-- does Tucker have to do with any of this? Except that he was smart enough to get it in our faces."

"It's appalling," he continued. "Whether you're right-leaning, you like Tucker Carlson, you hate Tucker Carlson, is irrelevant. This is about putting a dagger in the heart of our justice system. And the person holding the dagger and thrusting it with all its might is our Department of Justice. This required collaboration from the top of the Justice Department right down to the Assistant U.S. Attorney lying to me, a fellow officer of the court, knowing I had a duty to put my client in the best position I could based on the evidence."

Chansley in September of 2021 pleaded guilty to unlawfully obstructing an official proceeding. Watkins no longer represents him.

Kimberly Paschall, the assistant U.S. attorney for the District of Columbia who Watkins said lied, did not immediately return a request for comment. A spokesman for her boss, U.S. Attorney for the District of Columbia Matthew Graves, declined to comment even though Chansley's case is not ongoing.

Federal Judge Royce Lamberth, who presided over the case, should sanction the federal prosecutors, Watkins said.

"This is as egregious a violation of the trust as I have seen, with the exception of hiding DNA evidence in a murder case," he said. "If I'm a federal judge and find out that indeed I was played a fool, I was duped by an assistant U.S. attorney that lied to me repeatedly while Mr. Watkins was yelling that no one was more peaceful than Jacob, and I'm making rulings based on what the government is saying, I'd be one pissed off federal judge."

Yeah, that's the way it should be. But ol' Royce Lamberth will make some excuses for the prosecutors.

There was cellphone or GoPro footage of that online THAT DAY. There were so many vloggers roaming around recording that every bit of footage the govt had should've been available online somewhere at one time or another. I remember watching Buffalo Guy walking around and being aghast that he was actually in "the people's chamber" and walking around.

Even without that video, the shaman was accused of nothing more than trespassing or "parading" in a public space. He was never accused of anything violent. And yet Watkins stood by with his thumbs up hi ass as his client was locked in solitary for months like some kind of movie super-villain. Then Watkins recommended the shaman plead guilty to bullshit crimes and got almost 4 years in prison.

Watkins was in on the scam from the beginning. Whether he did or did not have the video is irrelevant.

Given that lawyers write the laws, I am certain there is no law actually punishing lawyers for doing this kind of thing. They might get disbarred for being bad people, but there are no legal repercussions.

And everything leading up to it. His defense counsel appears to have assisted with railroading him but even that wouldn't have been enough.

Arrest, solitary confinement, abuse - all of the shit that led up to the plea - was a form of torture to break him down and get him to sign. Then they threw the book at him for his "crimes."

Just because he wasn't beaten up or broken on a wheel doesn't mean he wasn't tortured until they extracted a forced confession.

He says the prosecutors were dragging their feet on turning over the footage (to the tune of months in solitary confinement as a pressure tactic), but Watkins was also was pressuring Chansley, telling him he already had over $1 million in legal fees when he had only made 5 filings in the case. And that Watkins did not demand the footage be turned over before making a plea deal.

I guess we will see what the details are, but it is pretty clear they all worked together to jail dissidents --- both sides of the system.

Most people do not realize that the local courtroom set of defense lawyers and prosecutors are actually on quite friendly terms because they have to deal with each other long after your case has come and gone. Many defense attorneys for those who cannot afford to pay much if any are there to negotiate your plea--not to contest your guilt at trial.

If innocent, you want lawyers used to trying high profile cases in the news and that are not part of the local courtroom set but you will pay dearly for them. About 10 to 15k for a no bill at grand jury and at least 50k and up to the moon if you go to trial.

Prosecutors do this shit and have done this shit for forever which is why the Brady rule was instituted and that the trial courts have refused to apply much in fact except to attorneys they dislike. One of the key problems for the defense is that unless the defendant is able to pay for their own experts and investigators to aid their attorney, they are left with either arguing someone else did it or the other dude did it. Soddi or Toddi are the terms.

There has been a continuous stream of DOJ lawyers lying in court, failing to disclose evidence favorable to the defense, not reporting misconduct such as spying on defendant lawyer communications and so forth.

Prosecutors do not view their role, by and large as doing justice--but instead the goal is to win so as to rise in the system.

The rule is that the prosecution has to turn over exculpatory evidence. That is evidence that shows innocence. Since the video shows he is there, the argument they will make is that it was inculpatory, it proved his guilt. As such, it was not required to be disclosed. This kind of shit goes on all the time. Look at Gen'l Flynn's pleadings relating to withdrawing guilty plea -- it details the governments systemic abusive tactics very nicely. The Feds suck and they have sucked for a Very Long Time.

I think they feared disclosure or leaks. The narrative at the time - and still, but it was fever-pitch then - was that this guy (and the rest of them, but him especially) was a violent monster who was terrorizing the Sacred Institutions of Our Honorable Republic.

Releasing the footage would risk disclosure. If it went to trial, it would require disclosure. People following it would see it. The response of "huh? *This* is what they're so worked up about? This wet fart?" was too big a possibility.

There was a much wider narrative to be maintained.

Well, "assholes" aside, it is a fact when you make a plea they ask you to admit your guilt. Which you do, to avoid trial. You can argue coercion and probably the supreme court would agree -- if the case gets to them. It might not because it is hard to attack a guilty plea because they put your through a process when you say under oath that you aren't being coerced among other things, and that you are freely and volutarily chosing to plea rather than asserting your right to trial.

338 I don't know the actual standards and basis for charges, but being in the Capitol when Congress is in session is the normal situation about 99% of the time. In fact I'm not sure when I've ever heard of the building being closed to the public during session (you can see, at least at night, whether they're in session by a little light being on waay up at the top of the dome, visible from the Mall and all around).

I thought the charge was disrupting a government function. This could take many forms. The small numbers of idiots who bum-rushed onto the Senate floor clearly could be charged with disruption, but buffalo-horn guy was not among them, I don't think (not just the newly released video, but lots of prior private video and still imagery showed him talking with Cap Police, calmly, in the hallways).

As I've said from the outset, all kinds of very different things happened that day. Which we know from abundant private imagery and first-hand accounts. What has still AFAIK never been addressed concretely is the colossal incompetence of the Cap Police. The building is easy to secure and I've seen no instance where the breach couldn't have easily been stopped.

As I understand, the makers of the film wanted to pay the Zulu actors a lot, but South African law (where it was filmed) greatly restricted pay, so they got creative, and did things like give actors props (the cattle), which were very valuable and appreciated, but skirted the law.

You're very welcome. The guest speaker actually led a group of about 60 of us through the exercise. It's not as easy/hard as one would think depending on the step. I found the most difficult phases for me were (1) Wait: Be quiet in God's presence and (2) Listen: Ask the Lord to speak to you & be willing to listen.

My mind continues to wander here and there during quiet times... practice, practice, practice as our guest speaker said. He said he has been doing this for over ten years and still has difficulty maintaining focus from time to time.

If they are right we have been in the events of Revelation for the last almost 2000 years. In fact about 6 years short of the end of that 2000 years. I get that no one will know the day or the hour but I think there are compelling points to this view.

There's pretty strong scriptural support for this position, and it does not require a huge system of scriptural interpretation to support it.

But then, that's true about postmillenialism as well. And preterism. The final truth I think is none of the above, but some of each has truth. I think its like trying to predict what the Messiah was going to be like using only the Old Testament: the info is there, but it is only clear in retrospect.

There was a report that the way Tucker's crew found the video that they showed was by searching for "digital bookmarks" in the files. Which would indicate that someone had not only watched that video previously, but had marked it for rewatching or showing to others. Doesn't necessarily mean it was DoJ, but they certainly had reason to have viewed that footage.
