Surprise! The Supreme Court "Investigation" That Was Designed to Fail to Identify the Dobbs Leaker Has Successfully Failed to Identify the Dobbs Leaker

Failure Theater, Supreme Court Edition:

The Supreme Court said Thursday it cannot identify who [leaked] the draft opinion of Dobbs v. Jackson Women's Health Org., the landmark case that overturned the constitutional right to an abortion.

The Supreme Court marshal investigating the leak "has to date been unable to identify a person responsible by a preponderance of the evidence," the court said.

...

"After examining the Court's computer devices, networks, printers, and available call and text logs, investigators have found no forensic evidence indicating who disclosed the draft opinion," the marshal's office wrote in a report on the probe.

Investigators interviewed 97 employees, all of whom denied sending the draft opinion to Politico, also according to the marshal's office.

All of the interviewed employees signed an affidavit under the penalty of perjury stating that they did not share the draft opinion, officials said. If investigators later find they lied, then the personnel would be subject to prosecution.

The report found that the COVID-19 pandemic, which allowed more work from home, along with gaps in security policies, increased the risk of inappropriate disclosures of court information.

"While investigators and the Court's IT experts cannot absolutely rule out a hack, the evidence to date reveals no suggestion of improper outside access. Investigators also cannot eliminate the possibility that the draft opinion was inadvertently or negligently disclosed -- for example, by being left in a public space either inside or outside the building," the report stated.

Bullshit.

Roberts decided to leave the investigation to the Marshall of the Supreme Court, a position responsible for mere security over the physical premises of the court. It's not a law enforcement position.

He chose to give this job to a non-investigator instead of bringing in the FBI.

He also apparently agreed to make this "investigation" as non-intrusive as possible -- not securing warrants to look at people's personal call logs, for example.

This leads to certain questions.

Like: Who is it who is most invested in not finding the guilty party?

Well, the guilty party himself, would be one answer.

It's an interesting answer. I'm not saying it's correct. But there is a logic to it. If Roberts is the leaker, obviously he would want the least intrusive, least serious investigation possible.

Which is exactly what Roberts actually dialed up here.

We're always discussing the leftwing justices as having a motive to leak the decision -- well, Roberts is a left-ish justice, and he too was very opposed to overturning Roe.

We also know that he's previously played games with his court decisions to "preserve the appearance of political independence of the Court." He flipped his vote from striking down Obamacare to upholding Obamacare -- contriving a bizarre argument that no one, including Barack Obama's lawyers, argued, that "it's a tax" -- in order to "maintain the standing of the Supreme Court in the eyes of the [liberal] public," all because the leftwing media spent a month and a half battering him personally with messaging that they wouldn't like him or his court any more if he struck down Obamacare.

So keeping the Court's "authority" intact among the liberal professional class has been of paramount concern to Roberts. Nothing threatens that authority more than the Court's overturning of Roe.

And Roberts was no longer in a position to stop the decision just by flipping his vote. No, something more than that was needed. He might have to work outside of the court to direct pressure within it...

Did that happen? I don't know, but I do find it very, very interesting that Roberts delivered up an "investigation" that was widely predicted to be ineffectual and, true to that prediction, proved ineffectual.

Almost as if that was what the guilty party always had in mind from the start.

40 Seems to me like this is the one sin that even being a progressive with noble intentions can't excuse. You've got clerks who've worked for years to get this billet so they can graduate to top law firms or judgeships. But if you're known to be the leaker, you'll get a lot of backslapping and, "Well, I hope things work out for you" and very few job offers. So the Court, rather than destroy one of their own, chose to turn a blind eye.

I’m kind of with Ace on this. Roberts voted to uphold the unaffordable care act because he decided he wanted to uphold the unaffordable care act. I doubt he needed much more than being on the outs with the in crowd to do that. It’s even likely that if he was ever a vote against the UCA it was because he didn’t think he could maintain the useful fiction of being conservative, not out of any principle.

That said, assuming that the in crowd and its hangers-on are doing something that needs covering up is probably always the best bet.

Scotus secrecy applies to giving out drafts of opinions to the WH. A few justices have done it in the past but always to opprobrium by their fellow justices. One justice leaked Dred Scott opinion to incoming Prezzie Buchanan who basically said all is well on the slavery question front in his inaugural address. Fortas was notorious for leaking Scotus discussions to LBJ and that was part of the reason that he had little institutional support from the other justices when he got caught taking money which foundered his nomination as Chief Justice.

From what I recall and I could be dead wrong, roberts was willing to put some Federal *limits* on abortion but did not want the conservative justices ruling to over turn roe vs. Wade. He sought a compromise ruling exactly like he did with obamacare. I still think he or his clerks leaked the document to put pressure on the conservative judges.

Scotus appointments are more like a long time marriage between these justices (indeed lasting longer than marriages for several of them like Douglas). Given the formatting of the leak, it was done fairly late in the process from my viewpoint. I spent awhile on the Justices' papers at the Library of Congress and the early drafts are just that--full of pencil marks, etc. partial cite additions, and so on. What we saw leaked was very very close to the final opinion in formatting as well as text.

At that point, something like that draft would be circulating primarily by the justices themselves rather than among their law clerks. Take that for what you will.

FWIW, I think you are correct from what I have read about the case and ensuing leak. Roberts wanted to preserve the shell of Roe instead of sending it back to the states. Essentially, the abortion ruling has removed it from the national conversation which upsets both parties--GOPe which liked to fund raise off of it while doing nothing and the Dems who fundraised off of it and sought to increase it by any means to the last second before birth occurred. For some maybe most Dems, even that was not enough.

Now it is a much more muted state by state debate as it probably should have been in the first place.

Not necessarily. NY did surprisingly well for Republicans this last election cycle, even though Lee Zeldin lost. One theory behind this is that Hochul spent a lot of effort getting out the pro-abortion youth vote in places like hipster Brooklyn, running up her totals while leaving the upstate vote untouched. NY is a dodgy state, but that legitimate strategy could have worked also.

Federalizing everything risks a civil war far more than allowing the states to decide. In essence, Dred Scott made the Civil War inevitable as slave owners sought to take their slaves everywhere including a pending case involving NYC.

Kennedy did so on a few subjects near and dear to him.

Essentially, Roberts lets the political arena dictate his rulings and then writes the opinions to justify that. Rehnquist, Thomas, and Alito, espoused consistent theories and then applied them to their cases. The last principled leftist judge was probably Thurgood Marshall actually and before him Hugo Black.

For the most part, the states were our originators of liberty, not the federal government as it taught. The sad thing is that most lawyers have no idea how to employ their state constitutions for liberty and neither do the judges in these states because for the last century or so, national constitutional law is what is taught.

Not exactly, it allowed a public redevelopment corporation created by New London to use eminent domain in order to convey the property to Pfizer. Prior caselaw allowed individual properties to be condemned for 'blight' in order to redevelop. But, Kelo's property was not 'blighted' so New London used Midkiff v. Hawaii as its justification. Hawaii had a few really large landowners who never sold the land but only leased it for homebuilders. Hawaii sought to condemn this land and sell it to the homeowners citing a public purpose in conveying this land from one private owner to another. A decision authored by O'Conner allowed it under a public purpose justification.

That is why New London is who is being sued.

Nope, that is an early 1900's decision. Jacobson v. Massachusetts in 1905. Jacobson already had smallpox and so tried to avoid the mandate for a smallpox vaccination. The Court said nay as it was a justified police power of the state and Jacobson was just fined for refusal to be vaxxed.

Curiously though, in Jacobson, the Court used federalism to declare there that the vaccine was a justified use of the state's (not federal) police powers and should be a state case instead of federal.
