Kevin McCarthy Affirms That He Will Strip Eric Swalwell, Adam Schiff, and Ilhan Omar of Their Intelligence/Foreign Affairs Committee Assignments, As Promised

I don't know if this has anything to do with the fact that the Freedom Caucus now has the power to call for a vote to remove McCarthy from the Speakership if he cvcks out, but I'd guess it's not not related to that.

Newly minted House Speaker Kevin McCarthy is making good on his promise to strip Democratic Representatives Ilhan Omar, Adam Schiff and Eric Swalwell of their committee assignments.

"Swalwell can't get a security clearance in the private sector. I'm not going to give him a government security clearance. Schiff has lied to the American public," McCarthy told reporters late Monday night. "We will not allow him to be on the Intel Committee either."

The move is especially damaging for Schiff, who abused his position as House Intelligence Committee Chairman to investigate President Donald Trump over bogus "Russian collusion" during the 2016 presidential election. For years Schiff claimed evidence was "hiding in plain site" that would lead to an indictment of Trump. After years of what Trump called a witch hunt, in addition to Special Counsel Robert Mueller's lengthy and expensive investigation, the politically charged allegations never came true.

Video of Adam Schiff's endless lies -- his "disinformation" -- about having proof of Trump's collusion with Russia at the link.

As if his constant Russian Disinformation, using the authority of his position on the Intelligence Committee to sell his psyops operations to the public, isn't reason enough to ban him permanently from any committee, he also abused his position of power to pressure Twitter into deplatforming the journalist Paul Sperry.

Again, using lies and his position on the Intelligence Committee to do so.

Paul Sperry wrote about Adam Schiff's violation of his oath to defend the Constitution:

Back from holiday vacation, I found an interesting email waiting for me in my inbox from Matt Taibbi, the independent journo Elon Musk tasked with reviewing and releasing internal Twitter documents about decisions to censor content and ban users from the platform.

"Paul," Taibbi wrote, "just found a crazy email on Twitter -- did you know Adam Schiff's staff . . . asked Twitter to have you banned?"

I was gobsmacked. This would explain why Twitter could never give me a reason for suspending my account, even though I had broken none of its rules.

Schiff, the powerful Democratic chairman of the House Permanent Select Committee on Intelligence, made his "request" to ban me through his staff in a November 2020 memo to Twitter. Three months later, in early February 2021, I was kicked off the platform.

Why would a congressional leader sworn to protect the Constitution and First Amendment want to muzzle a veteran journalist? Like authoritarians everywhere, Schiff did not like critical reporting. The man who vowed to "protect our Democracy" from Donald Trump wanted to censor a free press.

In articles for RealClearInvestigations, I outed his anonymous "whistleblower" from the first impeachment of President Trump. It was Eric Ciaramella, a Democrat who had worked in the Trump White House as an Obama holdover. I also exposed Ciaramella's prior relationship with one of Schiff's top staffers on the impeachment committee, Sean Misko.

My reporting cast fresh doubts on Schiff's claims that the 2019 impeachment process happened organically. The New York Times had already busted Schiff lying about prior contacts with the whistleblower. Initially, Schiff publicly stated his office never spoke with the whistleblower before he filed his complaint against President Trump, when in fact a Schiff staffer had huddled with him, something Schiff's spokesman Patrick Boland was forced to admit after the Times broke the story. (The staffer was never identified.) The prior contacts led to suspicions Schiff's office helped the whistleblower craft his complaint as part of a partisan operation.

In the censorship demands Schiff's office sent Twitter, Misko and the "impeachment inquiry" are mentioned. It's not clear if Ciaramella is, too, since some names are blacked out. Schiff demanded Twitter "remove any and all content"' related to them.

Unlike in other cases where Twitter did censor accounts, officials there originally argued that "this isn't feasible."

At the time, Twitter was about the only media outlet where the names of Schiff's impeachment operatives were circulating. The Washington press corps had conspired to protect the so-called whistleblower and cover up his identity. The Washington Post even scolded me for identifying him, claiming I was putting his life in danger. But this was a bluff. I was told by his family, as well as impeachment investigators, that he had received no credible threats.

In his list of demands, Schiff tried to justify banning me by claiming I was promoting "false QAnon conspiracies," which I have never done and I challenge Schiff to produce evidence to back up his defamatory remarks.

Schiff knew better. He knew "QAnon" was a trigger for Twitter censors, who were suppressing QAnon posts. Yet even Twitter's liberal gatekeepers appeared skeptical of Schiff's claims: "If it is related to QAnon it should already be deamplified." (Emphasis in original.)

Schiff knows something about promoting false conspiracies. In 2017, he took to the microphone in a televised House Intelligence Committee hearing and read into the congressional record a screed of wild conspiracy theories about Trump and Russia from the Hillary Clinton campaign-funded dossier.

Sperry details Schiff's history of constant disinformation operations against the American public.

...

Months after Schiff lobbied Twitter to ban me and remove all the impeachment-related content from its platform, his communications director and chief of staff -- Patrick Boland -- tried to intimidate my editors at RCI into retracting the impeachment stories I broke a year earlier.

In his emails, Boland invoked "the events of January 6," warning our stories could "result in actual violence" if they remained online. Over time, Boland's demands became more and more strident. But my editors refused to give in to the bullying.

It wasn't about "safety." It was about wanting to avoid any scrutiny for their actions.

After joining Twitter in June 2016, I tweeted more than 20,100 tweets and I amassed more than 340,000 followers -- all without any problems, without any suspensions. Until Schiff exercised his vendetta against me.

Sperry points out that it's wrong to call it "social media" -- it is now just "the media." People view "social media" far more than the legacy media.

Adam Schiff and his Deep State criminal cronies seek nothing less than the complete control over the speech and thoughts of the American public.

And for that, he should not just be banned from any congressional committees, but prosecuted for a criminal conspiracy to deprive citizens of their civil rights.

As to Eric Swalwell and Ilhan Omar: Fartwell f***ed a Chinese spy and continues lying about -- he remains compromised and blackmailable -- and Ilhan Omar defrauded the United States' immigration system by marrying her gay brother to get him a visa. And she speaks on behalf of literal terrorists every other month.

It's a zero-cost option. Both people are wildly unpopular with the country at large and a lot of people recognize both of them as dangerous. The Dems don't love them, either (well, they don't love Omar. They do love Schiff, but he also failed, and so is probably on the shit list).

It's a way for McCarthy to pretend to be something he's not (an honest man who keeps his word) in a way that doesn't piss off the strong wing of the Uniparty, plus it throws some red meat to the rubes and that is useful to do on occasion.

It had nothing to do with the "Freedom Caucus", and idiots like Gaetz, who I suspect will now take credit for everything good because "they're holding his feet to the fire" or something. Jim Traficant was the most honest politician of my lifetime. Sure, he was insane and corrupt.

But his toupee was a good metaphor for his corruption, because it wasn't well-hidden. He just stapled a carpet remnant to his bald pate and went about his business.

But, at the end of day, he was an American. More than I can say for the rest of this gang of crooks.

No. Actually the entire Republican caucus came up with those agenda priorities. There were some specifics added here and there, but honestly that could have been done in the floor via amendments (which they planned to do anyway). What the Freedom Caucus mostly gained were rule changes. Which I am fine with, as I am with the idea they will ensure the promised agenda is executed. But the idea this agenda os entirely theirs is pure fiction.

-------------
Problem is, no one trusted McCarthy and other GOP leaders in Congress to actually do the right thing. Hence the requirement to actually vote, getting rid of omnibus rules and instituting cutgo, and so forth. And most important, restoring the vacate the chair motion as a privileged motion that makes the speaker accountable at any time for failures to keep their word. Any member can also issue a non-privileged motion to vacate the chair and that goes to the rules committee I believe. The privileged motion must be voted upon on the floor--yea or nay. That motion had existed since the beginning of Congress until Nanzi killed it during the 4 yrs of Dem control of the House.

What that means is that the rest of GOPe in Congress cannot hide behind the GOP leadership's failure theater and must have a recorded vote to support the Speaker staying in place or not. That is why McCarthy was fighting so hard against it.

257 Re Ed Buck,
According to a 2019 indictment, Buck “engaged in a pattern of soliciting men to consume drugs that Buck provided and perform sexual acts at Buck’s apartment” – a practice described in the document as “party and play.”
The victims were solicited on social media, including a gay dating website, and Buck used a recruiter to scout and proposition men, prosecutors said.

Prosecutors said in a news release Tuesday that Buck typically targeted people who were destitute, homeless or struggling with drug addiction.

“He exploited the wealth and power balance between them by offering his victims money to use drugs and to let Buck inject them with narcotics,” prosecutors said..."

323 253 If you are in fear for your life, that's all you need to say. Posted by: Marcus T
---------
No, the whole fear for your life is simply one requirement. Essentially for self defense, in most states, the burden flips on the defendant to have to affirmatively prove that their use of force was reasonable. A few states allow that to be established in a pretrial hearing, but others make you do the full monty. In most cases, you have to testify as a defendant on the stand in order for the jury to understand what you were thinking at the time. You must show your use of force was reasonable, commensurate with the objective degree of threat you faced.

So evidence like whether the robber was leaving, the fact that the robber's back was turned when he was shot (albeit at bad breath distance), the number of shots, the direction that the robber's 'gun' was pointing, and whatever the guy said to the others during the robbery, are simply a few issues. Leaving the scene is also not prudent because it indicates potential fear of wrongdoing absent any present threat from others.

Law doesn't work that way. It is designed to keep the peace which can render excessive actions by someone shooting in self defense at the beginning into murder. Read up on the pharmacist in Oklahoma, Jerome Ersland, now serving a long sentence for a coup de grace on a felon that was already shot by him.

The number of shots fired plus whether the person still presented an objective threat is a matter for the jury to decide.

360 "Posted by: whig at January 10, 2023 02:03 PM (bDjBG)"

I agree it depends on the state and those are all factors. But if a defendant is consistent in saying; 1) They feared for their life 2) Perp demonstrated a clear threat 3) They feared he would kill people before exiting, the rest is rather academic.

That be shot the perp in the back shows nothing but a positive opportunity to end the threat. You will rarely se a case where the guns are drawn face to face. Everyone looks for an angle or opportunity to end the threat. He saw it. He took it. Now I've also seen people continue to shoot a downed perp- and often for good reason. Because I've seen people with shots in them return fire or continue to be a threat. There is also the adrenaline factor and being in that situation will lead some into that type of situation. It's why you see many LEO shootings with clips emptied. You stop stop shooting when the perp changes shape or lights on fire.

Read up on the pharmacist in Oklahoma, Jerome Ersland, now serving a long sentence for a coup de grace on a felon that was already shot by him.

The number of shots fired plus whether the person still presented an objective threat is a matter for the jury to decide.

I think what did Ersland in was that he went back in the store where the first perp was lying on the ground with a bullet in the head. Unconscious but not dead. Ersland then walks in the back, RELOADS, walks back out to the front, and then fires like five shots into the unconscious perp.

406 373- I agree, personally, but he should (the shooter). Shooting a corpse may be some minor offense in Texas- so the cap shot may be a nothingburger, but intentionally killing a human being without a valid defense is problematic. So, if the prosecution can prove alive at capshot (killing of a human being is an element, can't kill a corpse, and a corpse isn't a human being, so 2 required proofs, there) then he may be in deep shit since justification arguably passed.

407 Posted by: Marcus T
--------
Marcus, Self defense is a difficult area of the law and requires you to mount an affirmative case and meet a standard of proof. Essentially, you have to admit killing someone in order to claim self defense and then have to prove to a jury that your actions objectively were proportional to the threat presented, the threat was objective and not subjective via providing facts of the circumstances, and that your total actions were reasonable. To that end, you have to secure witnesses, evidence, often use of force expert witnesses, etc. so even to get no-billed by a grand jury often takes about 10k or so in legal fees. Fleeing the scene and not being around to justify your actions is also treated in most jurisdictions as abandoning the mantle of righteousness.

The shots in the back might or might not be considered reasonable when all facts are considered--a critical thing will be whether the robber gave indications that he was leaving and something like stay here for ten minutes while I am leaving etc. If the robber did, then matters become much more complex--generally speaking you are not allowed to shoot someone to retrieve mere money or goods.

One of the biggest 'mistakes' we ever made was allowing the commies to exist in the public square and not going all the way and purging them as antithetical to a free society. It allowed them to subsist off and thrive inside the society that tolerated them and slowly ate away at it's heart until only now do they have the ability to do to us what we probably should have done to them.

The commies are not going to make that mistake if they can help it.

I don't necessarily disagree, and I believe every situation has its own set of facts and circumstances. My point is only that his fear for life is a compelling factor across all circumstances. I would argue the shots in the back (compelled by his fear for life) was an opportunity to save his own life and that of others. I would further argue, including the use of expert testimony, the number and manner of shots was not unusual for the circumstances. That most shooting of this type include, on average, the number and manner of shots. Even the final shot to the melon (which I think could be problematic) was compelled by adrenaline and circumstance, and was furthermore immaterial because the perp was already dead. Excessive l, yes and in retrospect I am sorry for that, but nit was a difficult situation in which fear clouded judgement. I think combined with the perps record of violence a fair and reasonable jury would call this a good shoot.

I agree with this. He had his back to the defender at the time of the first shot, but the perp was actively threatening multiple people with lethal force by pointing the gun around. The coup de grace shot, however, is a big deal. The law doesn't allow that in any state in the Union. A jury may allow it, but our law doesn't.

440 What is excessive actions?
Posted by: Lost in Space

---------
You are allowed to use force more or less that is proportional to the threat that the perpetrator presents ( a jury decides what is and is not reasonable as to the threat and your use of force btw). When the threat objectively ends, then you are no longer able to use force. That means if the robber is fleeing, you cannot shoot at them for example as the current threat to life and limb has passed. If a robber is down from being shot by you, you go to cover after ordering them to disarm and don't continue shooting them without some indication that they are a current threat.

A coup de grace is not considered reasonable under any circumstances btw as it indicates that your motive at the time of the coup de grace was revenge, not ending the current threat.

That is not a legal excuse of adrenalin for a coup de grace shot (that is in fact an argument for manslaughter with that shot) and the shooter in this case cannot be said to have the medical expertise to know whether someone was dead or not.

Similar to the old law school hypothetical about shooting someone as they pass your window on the 32 floor while jumping off a 48 story building.
You shoot him while cleaning a gun with an accidental discharge, you might conceivably be charged with manslaughter or released via accident. You shoot them intentionally, it will be treated as murder whether or not they would die shortly anyway.

New Mexico is particularly problematic on what the courts demand versus the statutory law in self defense.
