THE MORNING RANT: Bravo to the GOP Rebels If They Can Break The Congressional Seniority System; (plus a crazy alternative idea – “Reverse Seniority” )

The intra-party battle among Republicans over Kevin McCarthy’s divine, pre-ordained right to be Speaker of the House has not been something I’ve paid much attention to. I have no expectation that the GOP leadership will pursue an agenda that I care about - issues such as border security, fiscal restraint, accountability and consequences for rogue government officials, eliminating “omnibus” bills, requiring that bills actually be read, etc.

That said, my sympathies are with the 20 Republican rebels that Dan Crenshaw so charmingly slandered as “terrorists” because they choose to prioritize their constituents over the DC establishment.

Then I read this tweet from Ben Domenech, and now I do care. If the 20 Republican rebels can shake up the Congressional seniority system before coronating McCarthy or an equivalent “surrender caucus” Republican as Speaker, then something significant will have been accomplished.

By the way, this post is not about beating up on Ben Domenech. His “protect the establishment from newly elected activists” tweet just reminded me of something I have periodically meant to write about, specifically, how destructive the Congressional seniority system is, and how it undermines the constitutional intent of Representatives being equal in Congress.

By the way, I am well aware that Article 1 Section 5 of the Constitution states that “Each house [of Congress] may determine the Rules of its Proceedings.”

Fine. Does that mean it would be OK if Congress made a rule that when voting on bills, each Congressman’s vote is weighted based on his tenure, such that a first-term Congressman’s vote has only one-tenth the weight of a 10-term Congressman’s vote?

Or, if the House can make its own rules, can it completely deny to newly elected members of Congress the right to vote on bills? Can the House make a rule that only when a member is on, say, his 3rd term does he accrue the right to cast a representative vote on behalf of his constituents?

That would be unthinkable, right? Well, why then is it accepted that only long-tenured Congressmen may be appointed to Committee chairmanships, where they have elevated powers to determine how bills will be written and which bills will be voted on?

One of the primary arguments for Term Limits is that it would push out of Congress those who have risen to powerful positions, allowing turnover in both that specific seat, and in the positions of power the termed-out Congressman held.

I enthusiastically support Term Limits in Congress – preferably no more than 12 years in either house of Congress. Of course, it would take a Constitutional Amendment to bring it about, which requires 38 states to ratify the amendment, so it’s not easy. But with 50 statehouses full of legislators who look in the mirror and see a future Congressman, wouldn’t they be doing themselves a favor if they passed such an amendment, since that would guarantee that every seat in Congress would have to come open within 12 years?

But a Term Limit amendment will probably never be passed. So here’s a completely outrageous idea that has no chance of ever happening, but if it did, it would certainly incentivize senior members of Congress to retire…

Reverse Seniority: The more time a Representative spends in Congress, the less power he has.

Since the House can set its own rules, how about if it establishes these rules based on Congressional tenure:

• No Committee Chairmanships after 10 years (5 terms) in Congress.
• No Sub-Committee Chairmanships after 12 years (6 terms).
• Barred from all committee membership after 14 years (7 terms).

Once a Congressman started his 8th term he would be a powerless back bencher until he finally relinquished his seat. As a powerless backbencher he’d be under considerable pressure to relinquish his seat.

Preposterous? Maybe. But it’s no more ridiculous than our current system which punishes the electorate if they dare to replace existing Congressional fossils with new blood.

It isn't about seniority as much as it is about how much money they raise for other members' campaigns. Limit that and you limit the hyper-partisan leadership that emerges.

The entire corrupt system is predicated on a few gaining positional superiority over a majority and the main way of doing that is via seniority and control of committee assignments, offices (literal offices) etc. If you give one person that kind of power, it is much easier to corrupt that person. These 20 odd some people are doing the right thing. The system is utterly corrupt and if it does not self correct through some similar mechanism, it will be corrected by outside efforts. That is what has been happening, is slowly escalating ways since the Tea Party. That is why they are hammering Jan 6th. They know it is coming and want to stop it.

They'd have to impose it on themselves and that will never happen. I like the idea to a point (i'd prefer mandatory retirement or transfer to a chain gang), but it has the same hurdles as any other form of control to try to keep the corruption at bay.

It was worded in such a way that many of us voted the opposite of what we wanted, which was to limit their service to age 70. Because it makes sense and would have a positive impact on the country as a whole they would never allow it to come to pass.

74 I've recently come to believe the seniority narrative is another fig leaf. It is a thing that happens. It does effect outcomes.

But even taking that into account, it doesn't explain Pelosi or Mitch. They are preposterous figures.

When I just look with my eyes at the two of them and not the narrative I have been taught, they are ridiculous and impossible.

No amount of institutional deference can explain how a drunken furious mentally and emotionally incompetent 80+yr old Harridan can bully her way around ferociously ambitious 50 yr olds. She's feeble.

Institutional deference can't explain it. It just can't. It has to be something else.

How does that woman inspire the fear she does? It isn't because other pols just shrug and say "them's the rules".

My biggest suspicion in all of this is that there are only 20 members of congress who are confident that the deep state dossiers on them won't make for compelling reasing.

I actually don't much care about who is Speaker. It shouldn't be McCarthy - he needs to be punished for what he did in 2022 - but beyond that it isn't hugely relevant. What this battle is doing is showing the petulance and arrogance of a bunch of worthless dickheads in a way that cannot be ignored. For those of us who don't do math in our heads, that was 29 years ago. 29 actual years, not Horde years, although it seems much longer.

I support both term and age limits. I also support installing a trap door into the DC sewer system underneath each desk in Congress, which may be activated by a simple majority vote of the critter's constituents.

And nothing will happen for two years anyway. If they get the deal they want, maybe they can at least keep the Ukraine grift from continuing and get a couple of reforms through. Unlikely, but at least distantly possible.

Investigations are irrelevant. Congressional investigations are pointless. Everyone lies, Congress has no authority and nothing comes of it or will ever come of it. They can "refer" whatever they want to the DoJ and the DoJ will ignore it. The only point of a congressional investigation is to grab headlines, but the press will just make fun of them and call them racists and oppressors.

If it was just a power outlet, it's harder to do unless they sent the message over the air to disable charging within your device (even creepier, more unsettling and a greater overreach).

I disagree. Excise taxes in particular were expressly conceived at the Convention as indirect taxes. It is just that people west of the Appalachians in PA did not want to pay the duly passed taxes. For the most part, those taxes were to pay down state Revolutionary War debts that were assumed by the national government and those incurred by the national government itself.

Read Hylton v. US (1796) which also deals with excise taxes btw for how taxes were to be assessed under the Constitution. More of the Framers were in that Supreme Court or in the Congress that passed those taxes than at any time since then.

What's *really* funny about the CO plastic ban ban is that the charge for paper bags is is a handout to the stores and retailers the bill has pissed off by making the customers pissed off. From HB20-1163:
A store or retail food establishment, on or after July 1, 2021, may furnish recyclable carryout bags to customers at a charge of at least 10 cents per customer, which amount the store or establishment may retain in full, unless a local government's ordinance or resolution prohibits the store or establishment from retaining the full charge.

So make plastic bags illegal, mandate charging for paper bags, let the business keep those dimes extracted from the customer as a payoff, and provide a revenue reservoir for local governments to seize in the future once the initial rage is gone.

Easier way to do it is simply expand the number of House members which can be done by simple legislation. According to population growth, about a twelve hundred or so would approximately represent public opinion and each representative would roughly have 200-300k per district.

Shay's rebellion is a very complicated situation sort of like the Whiskey rebellion where both good and ill can be found on both sides.

Economically, whiskey was the cheapest way to transport grain surplus to the more populated east rather than grain itself. Plus, the excise tax had to be paid before the booze was sold so it fell on the sellers to get recompense from the buyers upon sale leading to black market whiskey having a benefit.

Shay's Rebellion dealt in part with a division in the state between Boston and rural West Mass where speculators in Boston bought up property liens for unpaid taxes. The US itself went into a Depression after the war ended and there was a surplus in agri goods suddenly depressing prices to the point where farmers were going broke and could not pay their property tax levies.

The current economics of Greece are an example. Think about 40-50 percent of the economy occurs under the table there to avoid taxes and the entire society does it so any mandates even from the German bankers for increased taxes and austerity is simply sidestepped.

Some of that was inertia and inevitable, but often it was a way for the entrenched coastal areas to maintain political power and thus oppressive.

In the run up to the ACW Virginia hadn't redistricted in some thirty years, so that West VA and inland counties had 2/3 of white male population while tidewater had 2/3 or more of the elected representatives. This was no small part of allowing VA to secede at all, and the major reason why far West VA decided to break away for good.

Yes redistricting was a sore point in the original colonies and up until late in the Articles Congress, there was a conception that the States would simply create their own colonies in the West by some. The two things that the Articles Congress did accomplish was ratifying the Peace Treaty of Paris recognizing US independence and the Northwest Ordinances that allowed new states to enter the Union on the basis of equality to the old.

He didn't split it, the legitimate government of Virginia did. The one formed by the majority of white males in the far west in 1861 in Wheeling. Lincoln would have been fine with that remaining the government for the entire state, but the locals did. If you are going by the Southern view that secession is a thing, then you can't argue of a loyal government being set up being illegal. If you go by the Northern view of it being not a thing, then if all the members go into rebellion nothing wrong with reforming the state government to execute the laws.
