2nd Amendment Grammar...It Isn't Complicated...At All

Whenever I get bored of organizing my dryer lint collection I will look in on the lunatic left and their fellow travelers, the ignorant and stupid soft left. One of their favorite Straw Man arguments against the 2nd Amendment is the laughably incorrect grammatical analysis they prefer; that the independent clause clearly stating the right that is being codified and defended is somehow modified by the first part of the sentence: "A well regulated Militia, being necessary to the security of a free State."And of course it gets even dumber, because they don't understand what "well regulated" meant in the 18th century.

How's this?

A well-schooled electorate, being necessary to the security of a free State, the right of the people to keep and read Books, shall not be infringed.

Would that make it clearer to the little gun-grabbing suburban liberals who think guns are icky?

Probably not, but it's fun to poke them anyway.

What is particularly galling is that the definition of "militia" Has been a matter of law for a long time.

This is from UNITED STATES v. MILLER et al. Decided May 15, 1939!

The signification attributed to the term Militia appears from the debates in the Convention, the history and legislation of Colonies and States, and the writings of approved commentators. These show plainly enough that the Militia comprised all males physically capable of acting in concert for the common defense. 'A body of citizens enrolled for military discipline.' And further, that ordinarily when called for service these men were expected to appear bearing arms supplied by themselves and of the kind in common use at the time.

Wow...plain language...what a concept!

The 2nd Amendment has been at the forefront for me for several months, because the People's Republic of New Jersey has been busy trying to eviscerate the clear, unambiguous Supreme Court holding in New York State Rifle & Pistol Association v. Bruen that negated the clearly unconstitutional restrictions on the right of the people of New Jersey to keep and bear arms. Tomorrow the legislature will vote on a collection of vomit-inducing restrictions on the right to bear arms, including making it illegal to carry in one's own car! They are copying the hysterical reaction of the New York state legislature after the Supreme Court smacked down NY's ridiculous anti-gun laws. And like NY, NJ will get a prompt beating from the federal courts.

But the damage will be done. Until the new laws wend their way through the court system the legality of public carry in most of New Jersey will be confused. The state police are enthusiastic in their attacks on legal gun possession, and I very much doubt that a murky and confusing set of laws will prevent them from arresting and jailing law-abiding citizens on the flimsiest of pretexts.

Never mind that the gun crime rate among legal carry permit holders in America is lower than the gun crime rate among cops.

Never mind that there are millions of defensive gun uses each year!

Just how many defensive gun uses are there each year?

Trying to understand the mushy thinking of the gun grabbers is an exercise in confusion. But the goal is more important than their reasoning. They want to disarm the people so that the only power in America is the government.

Why is that?

Just ask the people of Venezuela...the people of Cuba...the people of the Soviet Union...the people of communist China...the people of North Korea...and on and on and on.

20 Selling or transferring a gun in Oregon becomes illegal on December 8th, as the Measure 114 gun law goes into effect.

That is because the cops have to issue a permit to you (after interviewing you and testing you at the range), and there is no permit system in place, and no funding for a permit system.

This is deliberate on the part of the people behind the law. (Thanks, Mike Bloomberg!)

The assumption is that a judge will issue a temporary restraining order to suspend the law until the legal appeals are heard - but if the case goes to an Obama or Clinton judge, that may not happen.

The court analyzed "militia" but decided to just ignore their own lyin' eyes in order to say that a short-barreled shotgun was not a weapon that would be used by one. Well, they didn't actually say that. They twisted words like a Rubik's cube to say that "it was not in judicial notice... blah blah blah." Meaning that the defense didn't introduce evidence that a trench gun was a real thing. Just two decades after WWI! Because there was no defense. Because Miller was dead and his council decided there was no reason they should show up. It's a freaking travesty that no Court since has had the stones to admit the obvious and strike down NFA '34.

It will get reversed eventually, but the hope of the gun-grabbers is that the firearms industry in Oregon will be destroyed before the law gets reversed.

Oh, and magazines over ten rounds are banned. Existing magazines that you own are grandfathered in, but it's up to **you** to prove that you owned the magazine before the law went into effect. The default assumption is that the larger magazine is illegal.

Reversing centuries of English common law - you have to prove your innocence - the government doesn't have to prove your guilt.

Not just Supreme Court jurisprudence, either. It's a matter of black letter Federal law, 10USC246, which DEFINES the U.S militia as all able bodied male citizens seventeen and older, and less than forty five. Again, that's the definition, not enlistment eligibility. Seventeen is roughly high school juniors. Teachers and administrators that do not prepare their students to exercise the rights and responsibilities of militia service by the time they graduate from high school have FAILED or SABOTAGED their students and their communities, and should be replaced. School districts that do not do this should have their federal funding cut off, down to the last penny.

Ban the use of SWAT teams for anything other than an active shooter or hostage situation. None of this blowing up toddlers to serve a fraudulent warrant for weed on the wrong house shit anymore.

The American revolution began when the British army was trying to confiscate arms from the militia. This statement provides a reason for the right, but not necessarily the only reason. If this statement was left out one might assume that the 2nd only applied to arms for individual self defense, since self defense is obviously a right in itself. But the Founders were well aware that the right should also apply to the militia for political purposes, since they recently experienced the Brits violating that right. And, note that they were also aware it was an issue that came up in the 1687 Glorious Revolution, and the English Bill of Rights also has a right to bear arms for the same reason.
