Federal Judge Vacates Biden's Loan-Cancellation Executive Order, Declaring It Unconstitutional

Dead, for now.


A federal judge in Texas on Thursday struck down the Biden administration's student-debt forgiveness plan, imperiling a key administration priority that would have canceled up to $20,000 in student loans for tens of millions of borrowers.
The Biden administration's plan is an "unconstitutional exercise of Congress's legislative power" that also failed to go through normal regulatory processes, Judge Mark Pittman of the Northern District of Texas wrote in a 26-page opinion.

"No one can plausibly deny that it is either one of the largest delegations of legislative power to the executive branch, or one of the largest exercises of legislative power without congressional authority in the history of the United States," Mr. Pittman, an appointee of former President Donald Trump wrote.
The Biden administration can appeal the verdict. The White House didn't immediately respond to a request for comment.

The lawsuit is one of several brought by Republican officials and conservative groups. Another suit, brought by GOP officials in six states, is currently awaiting a ruling from the Eighth Circuit Court of Appeals, which put a preliminary pause on the program last month as it considered whether the states had legal standing.

The lawless tyrannical Biden Administration has stopped taking applications for their unconstitutional and illegal loan forgiveness bribery program-- almost as if they knew all along that this was unconstitutional and would inevitably be declared to be so, and almost as if it was all just an election-season stunt to Dupe the Progs.

Quite possibly true, but when she throws two out without even granting them a hearing, it doesn't bode well for the chances of this one.

I'd guess that given that the Supremes are all Ivy Leaguers, they've all felt the student loan pain personally when they were young and hungry lawyers, and are thus predisposed in favor of forgiveness.

I'm not even sure I'd count on Thomas, frankly.

But we'll see.

It's not just the stadium itself, it is the practice facilities, tutors, medical insurance,medical coverage and trainers, on and on. The Ohio State Athletic Department is completely separate from the university and operates as a 501c3 non profit. It has actually donated surplus revenue after paying all expenses, including interest on mega loans to build out facilities, to OSU 's general scholarship fund for regular ole students.

And at the end of the day it was R+6. The showing isn't terrible from that perspective, but the amount of wins gotten from it were. What should be viewed as discouraging is that it wasn't due to increased R voting, but decreased D voting.

Rich people create endowments at a university typically to fund their own pet project in perpetuity.

James Click was the GM. I believe that was brewing for a long time and they just kept it together through the end of the season, like parents staying together until the kids graduate. E.g., pitcher touches his hat, or holds his glove some way, adds one to whatever sign the catcher puts down, modulo however many pitches the pitcher has.

I'm as much of a NT hater as the next guy, but this is SOP for women in divorce proceedings. Sucks for her if it is actually necessary, but a request is nothing more than an allegation, which can be completely baseless.

I've seen a person spend over a million dollars through the course of litigation to defend against such baseless attacks, and Steve Schmidt would be my choice for someone having to do that.

Back in my early 30's -- damn, that was (but doesn't seem like) a long time ago -- I joined a senior fastball league in The Bay Area. It was cool, a lot of ex-minor and some ex-major leaguers.

Anyway, because of my speed, they had me batting lead-off. I probably got HBP about 10 times that season, but half the time the umpire refused to award me first base because I made no attempt to get out-of-the-way of the pitch.

It hurts, but how much depends critically on where you get hit. Hit in the back, the shoulder, the butt, or the thigh - hurts, but not so bad. Getting in a joint (wrist, elbow, knee, or ankle) hurts like hell. Perhaps surprisingly, getting hit in the helmet hurts. And, of course, getting hit in the face - which, thank God, I've never been - must be excruciating.

All I can tell you it was obvious he had moved way up on the plate from his previous at bat. He was over the plate, didn't move an inch as the ball closed in. The call was appealed, they looked at the replay and he took the base.

You can count cards all you want, but if it becomes clear you're doing so and you are winning a lot, the casinos will usually notice and ask you to leave. I mean, they're not going to crush your hand with a hammer these days, but you might get tuned up in the parking lot depending on how obvious you are about it.

You mean legally, or how they can detect it? The latter is easy. I was a card counter in grad school, and I can spot another card counter in a minute. Most people play blackjack incredibly stupidly (e.g., splitting 5s, doubling down on 12, which I've seen people actually do). Someone whose bet size and play on a given hand is modulated by the count - which, of course, I was keeping - stands out like a sore thumb. It's obvious on after watching someone for a couple of hands.

A TV shot from behind the catcher looked like his elbow (which was what was hit) might have actually been a bit in the strike zone.

If you don't wash out at that age you are good to go for high school ball. I can't believe how many kids are just not that interested in playing anymore. There's a ton of work goes into being a good pitcher other than physical. The good ones (Christie Mathewson being the first of these) study batters, study tapes, keep notes etc so they know Joe Blow is lousy at hitting the curve ball off the plate and Sid Snow will swing at anything high and fast.

Managers/Pitching coaches used to go over tendencies and what usually gets a dude out before the game with the pitcher. Jim Bouton tells in the 60s how his coach told him to 'pitch around' the first 5 hitters noting "so now we are down 2-0 with the bases loaded...". Traditionally the catcher decides pitch and location but the pitcher can 'shake him off' if he doesn't like it.

I'm sure its more sophisticated now but the manager and coaches do sign plays out to the battery.

The book I read as the basis of my card-counting (began when I was 17), "Blackjack As A Business," says to intentionally make stupid bets and decisions intentionally on occasion -- because not only are you being watched by the pit bosses, but the dealers and eye-in-the-sky are also watching.

I stopped playing when they went from one or two decks to eight -- and they started shuffling before getting halfway through, so you have a diluted, relatively non-accurate count before then (as I'm sure you know).

My buddy and I only got caught once. The pit boss came over in a slightly menacing fashion to give us a hard time (and to ask the usual question: "Thorp or Revere?"). But as we were talking my buddy and I were still keeping the count, and after a while, he was impressed, so he told the dealer to go ahead and let us play as long as we kept our bets low. Since we were broke-ass grad students (making $400/mo), we could hardly do anything else. The dealer was dead impressed: she'd heard about counters, and now actually saw two!

I'm not much on casino gambling but I've spent a fair amount of time in Vegas for various trade shows. Whole lot of cheap hotel rooms in Vegas.

It always depresses me to walk through a casino and see older folks in front of slots pouring endless quarters into them for hours. Seems like the most boring existence possible.

The casino floor is one of the most miserable, depressing places I have ever been in my life, and I used to play piano at retirement homes for the patients back when I was a young student.

Nobody looks like they are having a good time, the cigarette girls looked like they would rather slit their wrists, it had this atmosphere of misery and depression. This was back when you could smoke on the floor.

A lot of people scratch that itch with fake casino gambling games on the iPad or whatever now. There's no money changing hands in either direction, but you still get the dopamine hit of matching up the slot machine reels or whatever. Well for the very first move you can move one of 8 pawns two moved, plus two moves for each knight so that's 20. So can the other side, so that's 400 positions right there. Then it gets worse and you have some 20-40 moves to go and more options per piece in each one until the captures start.

Uh, no. Pitches move laterally as well as longitudinally. The most obvious example is the knee-buckling curve ball, which is thrown right at the batter and - if the latter is lucky - breaks over the plate at the end of its flight. If the batter bails out, he'll never be able to hit. But some of them don't break ... plunk. Even fastballs (esp. two-seam ones) can move laterally by quite a bit. Pitchers are selected on the basis of their pitches moving laterally. Someone who throws straight as a string is easy to hit, even if he throws very hard.

No, it is mostly because it has name recognization and best possibility that it will hold value and be exchangeable for something.
A successful currency has to be recognized as a media of exchange, that will hold its value and be widely accepted.
With a novel currency, unless it shows better tendencies of maintaining value and wide acceptance, no one likes to risk it, which hinders the acceptance.

No market for it, means no faith it will stay around, even if the current currency is tanking.
