Biden's Gestapo: 40 Subpeonaes Issued To Trump Allies In Just One Week, Demanding To Know If They've Ever Endorsed a Political Theory The Regime Deems to be Illegal and Insurrection-y

They're literally demanding any correspondence in which people discussed the legal possibility of Congress rejecting states' slates of electors, and sending them back for a recanvass.

Even if you don't believe this theory, it has never before been the case in America that an erroneous legal or political theory was illegal.

Until now.

And the "anti-authoritarians" of NeverTrump are cheerleading this. There is literally no Gestapo tactic they will not support to "save our democracy."


Biden's war on Trump heats up with 40 subpoenas issued by the DOJ in one week
The Department of Justice has launched two campaigns of legal warfare against the former president. They have seized phones, documents, raided homes, and now have issued some 40 subpoenas in just one week.

The Biden administration is waging a multi-pronged attack against Donald Trump and his supporters, with the goal of making sure neither he nor anyone who supported him, will be able to run for office. The Department of Justice has launched two campaigns of legal warfare against the former president. They have seized phones, documents, raided homes, and now have issued some 40 subpoenas in just one week.

The Justice Department appears to hope that one of these far-reaching investigations will result in an indictment for Trump, as well as for anyone close enough to be caught by their legal shrapnel.

The DOJ is seeking to find information that the people who planned that rally also intended to create a riot at the Capitol Building to obstruct the electoral college's certification of Joe Biden as president. The DOJ also wants any documents about the rally, or the alternate electors, that were submitted to the congressional January 6 Committee, turned over to them.

Those subpoenas, obtained by Tucker Carlson Tonight, seek information on "any claim that the Vice President and/or the President of the Senate had the authority to reject or choose not to count presidential electors." The subpoenas are not looking for official communications, memos, or directives, but are seeking personal communications. Subpoenas went to Trump's attorneys, as well, and in that they are seeking personal communications, they are looking for communications that are covered under attorney-client privilege.

Similarly, the Biden Administration is now subpeonaeing records of a conservative political group in Alabama that helped craft a bill to prohibit doctors from performing transgender surgeries on children.

Deb Heine writes that Biden's Norms-Restoring Department of Justice takes the position that it can presume to "investigate" such normal political activity, demanding all records and communications from a private group engaging in a political effort the Biden Administration opposes.


The Justice Department last month issued a subpoena to the Eagle Forum of Alabama (EFA), demanding all information related to their legislative activities promoting SB184, also known as the Alabama Vulnerable Child Compassion And Protection Act (VCAP).

The DOJ's subpoena requested all documents or information pertaining to the legislation since 2017, including all communications, and "any materials considered by the Eagle Forum of Alabama in preparing" the legislation.

As a 501(c)(4) social welfare advocacy organization, EFA is "legally authorized and expected to fully participate in the legislative processes through education and lobbying efforts," said Margaret S. Clarke, General Counsel of Eagle Forum of Alabama.

The VCAP law prohibits "the performance of a medical procedure upon or to a minor child that is intended to alter the minor child's sex or delay puberty, with certain exceptions."

"At stake here is the ability of all private citizen advocates and non-profit advocacy organizations to engage in the legislative process regardless of their viewpoint,"
Ullman said. "If the DOJ can weaponize a subpoena, any American can be unduly burdened and prevented from engaging in our democratic republic form of government, she added.

"This unprecedented, massive demand by the DOJ for information unrelated to the issues before the court is a blatant attempt to intimidate and silence a non-party organization and crush its Constitutionally-protected rights to educate others, petition the government, and speak freely," said Ullman. "This harassment must be stopped. It's a shot across the bow of people and groups engaged in the legislative process throughout the nation. If the Department of Justice doesn't like your viewpoint it may target you next."

On Monday, Tucker Carlson addressed the descent of America into a Nazi Police State.

Joe Biden's Department of Justice in recent days has subpoenaed "dozens and dozens" of allies and supporters of former President Trump, seeking communications regarding presidential electors in the 2020 election, Fox News host Tucker Carlson revealed during an explosive opening monologue on Tucker Carlson Tonight.

Carlson said "scores" of Joe Biden's political opponents like Amy Kremer--a former Tea Party leader and political activist--are being hounded by federal agents in a "precedent-breaking sweep."

Kremer's organization "Women for America First" hosted the "Stop the Steal" rally in Washington, D.C. on January 6, and even though she didn't personally attend the rally, she and her daughter were subpoenaed by the partisan House Select Committee in September of 2021.

"For the crime of organizing a lawful political event--an election justice rally protested by the Constitution--Amy Kremer is now being terrorized by Merrick Garland's DOJ," Carlson reported Monday night. "On Wednesday morning, FBI agents showed up at her home--at first at the home of her ex-husband carrying a subpoena for her daughter Kylie."

Carlson said the FBI's subpoena demanded all communications from Amy Kremer and Kylie, including her social media posts from October 1, 2020 to the present day.

The host questioned why Joe Biden's FBI would need Amy Kremer's daughter's Instagram posts, and posited that it has nothing to do with the events leading up to January 6.

Carlson's monologue below the fold.

But while Biden's Gestapo can demand all personal records of its political enemies, American citizens may not request records from Biden's Gestapo, writes Byron York.

A conservative group used FOIA to seek information about how Biden sought to execute his executive order 14019 -- which would supposedly "protect voting rights."

How? In what way? By what authority?

These are the sorts of questions citizens are permitted answers to, right?

Not any longer:

On July 30, 2021, a conservative but nonpartisan think tank called the Foundation for Government Accountability sent a Freedom of Information Act request to the Justice Department asking for documents showing how the department is complying with Biden's order. The foundation was particularly interested in the specific plan the department came up with -- what was the DOJ actually going to do to implement the president's wishes? "Please provide your agency's strategic plan developed pursuant to President Biden Executive Order 14019 ... outlining ways you identified for your agency to promote voter registration and voter participation," the request said.

The Justice Department's answer was...nothing. A year passed, and the Justice Department did not turn over a single document. So the foundation went to court, and as a result, a federal judge ordered the Justice Department to turn over the material. The judge set a deadline of Sept. 8, 2022. The Justice Department waited until the last day and turned over...next to nothing. It sent a batch of emails and a few documents that turned out mostly to be staffers corresponding with each other over who would be present at which meeting.

Most importantly, the Justice Department refused to turn over its strategic plan. None of it. This is what the chief of the Freedom of Information branch of the Civil Rights Division told the foundation:


After review of the Civil Rights Division documents responsive to your request, the Division has identified (15) pages of material representing the STRATEGIC PLAN for the Implementation of Executive Order 14019, Promoting Access to Voting. I have determined that these materials are to be withheld in full pursuant to Exemption 5 of the Freedom of Information Act, 551(b)(5), which pertains to certain inter- and intra-agency records protected by civil discovery privileges, in this instance the deliberative process and presidential communications privileges.

To withhold the plan, the Justice Department relied on what has long been called the most abused exemption -- Exemption 5, also known as (b)(5) -- of the Freedom of Information Act. "This incredibly large cutout is often called the 'withhold it because you want to' exemption," wrote journalist and FOIA advocate Nate Jones in 2014. "According to stats compiled by the Associated Press, (b)(5) use is at an all-time high." Even though later reform reduced its use a little, Exemption 5 is still an indispensable tool for administrations seeking to hide what they are doing.

So the strategic plan, the document that would give the world some information on what the administration is doing to enact Biden's order, remains a secret. But that's not all. The Justice Department is withholding lots of other information, as well.

In theory, the target can file a motion to quash the subpoena. If I had any faith in the judiciary at this point I would think that would be a sufficient safeguard against overreach and abuse.

But I don't have that faith anymore.

Yes by going to court to quash the subpoenas. A slapdown here and there is likely by courts particularly in the Alabama case if pursued. Bunch of old McCarthy era and Civil Rights era precedents involving First Amendment rights. The DOJ has gone YOLO now and is trying to declare the executive branch above the courts.

For a pardon to be made, you have to specify who it applies to--you cannot wave a magic wand and pardon everybody. The closest is Carter's pardon of Vietnam draft evaders. That was a specific group that could be named and a specific offense. The Ford pardon of Nixon was where the person was named and the pardon was for whatever crimes that Nixon committed in the White House. Once again limited as to person and set of crimes.

In the case of J 6, Trump had neither a definite set of people nor a definite list of crimes that might have been committed. During the remaining 13 days or so, it would have been literally impossible to locate and find the people, let alone determine all the offenses.

I don't have an answer. If the elections are honest, and a majority of us (well, not us) vote for that crap, then I guess we suffer and decline.

NO, it isn't. It is based on a flawed comparison of the US v. Weimar Germany. If anything, it would have to be more something like the Khmer Rouge tried or the Chinese during the cultural Revolution. But, we don't have the yute bulge as in the cultural Revolution and the left does not have hardened guerilla fighters honed over decade of Civil War and armed by opponents either.

If anything, bad times would resemble the Spanish Civil War or Yugoslavia depending on whether opportunistic foreign countries play or not. It could end up like the end of the Hapsburg or USSR empires. Germany is not the only example of a country becoming authoritarian as there are loads of examples in S. Europe or Latin America if not the Middle East.

Arresting the former POTUS and soon to be Republican nominee in 2024 is a bit different that subpoenaing records and cell phones from his supporters. You still have to at least have a plausible charge and Trump hasn't broken any laws.

Unless they are planning to go full martial law I don't see arresting Trump working any better for them than the boneheaded raid which has not worked in their favor. The 1876 election comes the closest but it was more or less one state, not multiples. The 1824 election was sent to the House for resolution. In a sense, you could say that the 1860 election might be the closest. Lincoln did not receive a single electoral vote in the South and some of the Southern states had already left the Union before the electoral college met and their representatives/Senators leaving to join the Confederacy well before Lincoln was inaugurated in March of 1861 to a smaller Union of States.
