We all know how trustworthy the assertions they made in their FISA warrant application were. This will be redacted, to make it even more one-sided, if that's possible. The Deep State bullshit, via the Deep State stenographers at the NYT:-The Justice Department asked to search President Donald J. Trump's Florida residence after retrieving an initial batch of highly classified national security documents, out of concern that their disclosure could compromise "clandestine human sources" used in intelligence gathering, according to a redacted version of the affidavit used to obtain the warrant.So their evidence for the warrant was based on... the documents Trump gave them voluntarily. That's what necessitated a raid on a President's home. Couldn't just say "37 pages long." Had to say "more than three dozen pages," to make it sound as damning and dramatic as possible. .. describes the government's monthslong push to recover highly classified materials taken from the White House by a former president who viewed state documents as his private property.Most if not all of them are his private property. The affidavit lays out a timeline starting with a Feb. 9, 2022, criminal referral by the National Archives after it had retrieved 15 boxes from Mar-a-Lago. The affidavit quotes the referral as indicating that the boxes contained "newspapers, magazines, printed news articles, photos, miscellaneous print-outs, notes, presidential correspondence, personal and post-presidential records, and 'a lot of classified records.' Of most significant concern was that highly classified records were unfoldered, intermixed with other records, and otherwise unproperly [sic] identified."Weird that I don't see anything about NUCLEAR CODES in there. And the full user of those phrases will probably be "we don't believe Mr. Trump retained any Top Secret or Nuclear passport work." The only thing that should be redacted would be an informants name, anything else and we know it's all bs, and they'll end up leaking more lies that can't be verified because it's all blacked out. Just learned this morning that one of my oldest friends died of throat cancer on Wednesday.
Sadly, his son is Gabriel Sterling, who helped steal the election from Trump in GA. I remember meeting Gabe when he was an idealistic Young Republican in college. But, court cases have limited that and it does not include for example taking everything and returning it at some future date. Search and seizure arrest warrant case involving cops dealt with a cop writing down serial numbers of stereo and tv equipment to find out if they were stolen. The search results were thrown out because while the arrest for a unrelated crime allowed the police to enter to serve the warrant, even though the equipment was in plain sight, it was not related to the object of the search and the subsequent serial number search was not a plain sight evidence of law breaking. The search results were thrown out because while the arrest for a unrelated crime allowed the police to enter to serve the warrant, even though the equipment was in plain sight, it was not related to the object of the search and the subsequent serial number search was not a plain sight evidence of law breaking. That would require a separate search warrant.

Read the affidavit and basically, it is a fishing expedition and arguably overly broad. In addition, given that the trucks arrived at Mar A Lago, before Jan 20th, any alleged crime will have to be pursued in the SD of Florida over illegal retention of classified information.
Trump's lawyer's letter included in the affidavit fairly states the statutes and caselaw involving officers of the US. Ironically, a lot of that was also dealt with in the emoluments cases brought against Trump because that clause does not apply to the president. Seth Tillman did exemplary work in highlighting the origins of the definition of emoluments in the clause and his work indicates clearly that those terms do not refer to the President. Remember the name of Brian Auten and also the NARA OIG referral to the FBI in February. The NARA names are going to be revealed by FOIA regardless of whether the FBI redacted it. This is affidavit is mess, legally. It seems to claim that unsubstantiated press reports over 18 months before precipitated the required emergency search actions of the FBI (CBS truck thing) when no suggested illegality was involved and it strains to suggest that the warrant should cover everything available, either in plain site or not, because...shrug...the FBI doesn't know "exactly" where things they claim they need to seize are...this negates the search as targeted and as required.
I think it's time to stop using Magistrates, which are essentially legal hired help for a district court and not judges, as able to issue warrants - it's not in the Constitution and it makes the warrant process easily scammed. This is a recent development actually, criminal warrants were issued by judges until the late 60's early 70's and no one seems to have challenged the Constitutionality of that...but maybe we'll see that now.
