Waiting For the Affidavit
The affidavit is set to be released at noon. It was already a one-sided affair containing no evidence, just assertions by FBI agents. We all know how trustworthy the assertions they made in their FISA warrant application were.
This will be redacted, to make it even more one-sided, if that's possible. If they don't release this within 10 or 20 minutes, I'll put up a different post. The Deep State bullshit, via the Deep State stenographers at the NYT:-The Justice Department asked to search President Donald J. Trump's Florida residence after retrieving an initial batch of highly classified national security documents, out of concern that their disclosure could compromise "clandestine human sources" used in intelligence gathering, according to a redacted version of the affidavit used to obtain the warrant.So their evidence for the warrant was based on... the documents Trump gave them voluntarily. That's what necessitated a raid on a President's home.
Couldn't just say "37 pages long." Had to say "more than three dozen pages," to make it sound as damning and dramatic as possible.
The affidavit -- including more than three dozen pages of evidence and legal arguments presented by the Justice Department's national security division plus supporting documents --
.. describes the government's monthslong push to recover highly classified materials taken from the White House by a former president who viewed state documents as his private property.Most if not all of them are his private property.
The affidavit lays out a timeline starting with a Feb. 9, 2022, criminal referral by the National Archives after it had retrieved 15 boxes from Mar-a-Lago. The affidavit quotes the referral as indicating that the boxes contained "newspapers, magazines, printed news articles, photos, miscellaneous print-outs, notes, presidential correspondence, personal and post-presidential records, and 'a lot of classified records.' Of most significant concern was that highly classified records were unfoldered, intermixed with other records, and otherwise unproperly [sic] identified."Weird that I don't see anything about NUCLEAR CODES in there. Oh, I know why -- because that was another Deep State lie, fed to a propaganda press whose main stock-in-trade is lies.

The only thing that should be redacted would be an informants name, anything else and we know it's all bs, and they'll end up leaking more lies that can't be verified because it's all blacked out.

It could also involve a clerk and/or justice leaking to the WH who then leaked it to the media.
That is what institutions and the media do is smother stories with a pillow until they stop moving. If it was a conservative justice or clerk for one, we would have probably gotten a perp walk given this administration.

Wrong way to look at it, the Dems and oligarchs ARE the ancien' regime and it is them that fear a French revolution. What they did was institute a coup, not a popular revolution and as a result are steadily hollowing out their institutions so they don't function correctly. What you are seeing is not a cohesive regime but different oligarchs pulling different ways with their puppets in office with some foreign actors mixed in. Consolidating a coup is a difficult thing to do if the government is not popular because it becomes tempting for the weak to defect (Iike Zuck throwing the FBI under the bus yesterday or the CDC giving up on Covid and Monkeypox, and so on.)

What the FBI is trying to invoke is the plain sight doctrine where they claim that they had to go through everything in the house to find the documents that were under lock and seal apparently. But, court cases have limited that and it does not include for example taking everything and returning it at some future date. Search and seizure arrest warrant case involving cops dealt with a cop writing down serial numbers of stereo and tv equipment to find out if they were stolen. The search results were thrown out because while the arrest for a unrelated crime allowed the police to enter to serve the warrant, even though the equipment was in plain sight, it was not related to the object of the search and the subsequent serial number search was not a plain sight evidence of law breaking. That would require a separate search warrant.

RCP was originally a decent measure until polling companies on the behest of Dems began to report vastly incorrect polling numbers to skew results. That being said, Biden is probably up a couple of points due to student loan issue, the green giveaway, and the Trump raid. Some of Biden's approval depression was on the left as they did not get Orange man in jail, the student loan forgiveness, and their green utopia save the world giveaways.

I'm guessing all the back and forth with the DoJ was over who would sort through the documents. The DoJ was probably insisting their people do it, thus they'd be able to read everything Trump had in his office, including private communications with lawyers.
When Trump's people didn't budge, they figured they'd find a new way to break the law, on order to further break the law.

Personally, I think President's Biden's average is much higher. The polls are always slanted to the right, and if it wasn't for his dynamic declarations on cleaning up our precious environment by stopping drilling, people ought to be enthusiastic about his help for suffering Ukrainians. The latest thing that shows President's concern for the middle class is cancelling the debt of struggling college students who just want to make the world a better place.

I wouldn't bet on it. The college loan bailout only helps a small minority of people in the country and puts the burden on the rest of us, like 85%. I'm not happy with the loan bailout and neither is almost everyone here. And we vote.
Same with the green energy bullshit and the raid. Every poll I have seen says more are against than in favor and the soaring energy bills aren't helping. If the left didn't own the media we would hear a much more balanced report of the actual mood of the country.

I'm guessing all the back and forth with the DoJ was over who would sort through the documents. The DoJ was probably insisting their people do it, thus they'd be able to read everything Trump had in his office, including private communications with lawyers.

Trump's lawyer's letter included in the affidavit fairly states the statutes and caselaw involving officers of the US. Ironically, a lot of that was also dealt with in the emoluments cases brought against Trump because that clause does not apply to the president. Seth Tillman did exemplary work in highlighting the origins of the definition of emoluments in the clause and his work indicates clearly that those terms do not refer to the President.
Remember the name of Brian Auten and also the NARA OIG referral to the FBI in February. The NARA names are going to be revealed by FOIA regardless of whether the FBI redacted it.

He's out of the news. So everyone forgets how bad he is.
Don't worry - the student loan forgiveness thing put him right back in it - and all the bad economic news is getting ready to dump all over him - hours worked per week are dropping, cars are being repossessed, cell phone companies are warning of late bill payments, utility companies are showing high bill defaults, real estate is coming off their highs, the FED isn't done raising rates, food prices are still going up - and layoffs are gathering steam.
Just in time for back to school.

Southern District of Florida District Court judges. These are appointed by the president, confirmed by the Senate and serve for life until resignation, retirement, or death (or impeachment in rare cases).

I think it's time to stop using Magistrates, which are essentially legal hired help for a district court and not judges, as able to issue warrants - it's not in the Constitution and it makes the warrant process easily scammed. This is a recent development actually, criminal warrants were issued by judges until the late 60's early 70's and no one seems to have challenged the Constitutionality of that...but maybe we'll see that now.

I've submitted a draft of another art on the Raid on Mar-a-Lago. My conclusions are born out in this affidavit - pretextual, overly broad search warrant, and omissions in the affidavit that are so blatant it should be squashed y a competent higher court and not some highly biased Magistrate judge.
