But Biden won't formally say the "emergency" is over -- so he can continue acting as tyrant when he finds it politically useful to do so.![]() The Biden administration is canceling up to $20,000 in student debt for Pell Grant recipients and up to $10,000 for individual borrowers who make under $125,000 per year, and it's extending the pause on repayments by four months, the White House announced on Wednesday. Why it matters: The decision -- which comes days before the Aug. 31 deadline when loan repayments were set to resume after a series of pandemic pauses -- is expected to alleviate some of the debt burdens of 43 million Americans while also fulfilling a key campaign promise. Driving the news: Approximately 20 million Americans could have their debt completely canceled under Biden's announcement. The debt forgiveness for Pell recipients is in addition to the cancellation of up to $10,000 in student debt for other borrowers. Critically, the Biden administration is taking steps to make the student loan system more manageable for future borrowers. It will cap monthly payments at 5% of a borrower's monthly income and forgive loan balances after 10 years of payments for borrowers with loan balances of $12,000 or less, among other measures.Borrow as much as you want, your payments are hard-capped at 5% of your income and end after 10 years, no matter how much of your debt is left outstanding. The $10,000 in debt relief also applies to households that earn $250,000 a year or less.

For the past year and a half, the Office of General Counsel ("OGC"), in consultation with our colleagues at the Department of Justice Office of Legal Counsel, has conducted a review of the Secretary's legal authority to cancel student debt on a categorical basis. This review has included assessing the analysis outlined in a publicly disseminated January 2021 memorandum signed by a former Principal Deputy General Counsel. As detailed below, we have determined that the Higher Education Relief Opportunities for Students ("HEROES") Act of 2003 grants theOh well as long as Biden's handpicked political lawyers said it's okay... I had Pell grants, helped me keep my student loan debt to a low amount that I was able to pay off in a few years. Doesn't really compute that you already got grants but are also getting more of your debt turned into a grant.

The grand total payment under the scheme would be $25,020. Assuming a 7.5% interest rate and a 15-year term, the total cost of the loan (assuming no penalties) is $33,372.44 (over 15 years, not ten). The monthly payment would be $185 if it was a normal loan. The 5% cap is more than the monthly minimum in this scenario. This will affect a small number of people with modest debt load and shockingly low income. High debt will be over the $12k limit and higher income will pay it off. A Business Insider FAQ states: "The American Rescue Plan made student loan forgiveness tax-free through 2025, meaning borrowers eligible for cancelation won't face a larger federal tax bill come April." I'm not sure whether that means any debt canceled before 2026 is not taxable or that payment of the relevant taxes is simply deferred until then. Out of state tuition at my law school was $19k a year when I enrolled -- just over the $18,500 cap requiring a private loan. They had the brochures for Access Group ready to go for those private loans -- turns out law schools were getting bonuses for signing students up for them.

Obama destroyed student loans 2009-2011. Borrowers got the GM creditor treatment. After a decade of criminal misbehavior from servicers the .gov hired for the nationalized loans, none of those people realistically owe anything to anybody from an ethical standpoint. And you can get Parent loans - that you know you as a parent will pay. But letting the kid sign for it means you cannot include them as a dependent, ever while the loan is outstanding or it comes to you - or you have committed fraud. The banks already got paid off when Barky nationalized the loans. Vis-a-vis tax consequences, even without the explicit exemption here, loan forgiveness is not taxable if the borrower is insolvent, which many of these people are.
