Biden, Without Congressional Authority, Announces He's Forgiving Student Loans For His Voters -- And Claiming That the "Emergency" Powers He Has Due to Covid Allow Him to Act As a Tyrant, Apparently Forever
Note that Biden already declared an end to the covid emergency when he canceled Trump's Remain in Mexico policy, and his CDC just announced that we're effectively back to normal.
But Biden won't formally say the "emergency" is over -- so he can continue acting as tyrant when he finds it politically useful to do so.
The Biden administration is canceling up to $20,000 in student debt for Pell Grant recipients and up to $10,000 for individual borrowers who make under $125,000 per year, and it's extending the pause on repayments by four months, the White House announced on Wednesday. Why it matters: The decision -- which comes days before the Aug. 31 deadline when loan repayments were set to resume after a series of pandemic pauses -- is expected to alleviate some of the debt burdens of 43 million Americans while also fulfilling a key campaign promise. Driving the news: Approximately 20 million Americans could have their debt completely canceled under Biden's announcement. The debt forgiveness for Pell recipients is in addition to the cancellation of up to $10,000 in student debt for other borrowers. Critically, the Biden administration is taking steps to make the student loan system more manageable for future borrowers. It will cap monthly payments at 5% of a borrower's monthly income and forgive loan balances after 10 years of payments for borrowers with loan balances of $12,000 or less, among other measures.Borrow as much as you want, your payments are hard-capped at 5% of your income and end after 10 years, no matter how much of your debt is left outstanding.
The $10,000 in debt relief also applies to households that earn $250,000 a year or less.

Here are some facts: Only 37% of Americans have a 4-yr college degree, only 13% have graduate degrees, and a full 56% of student loan debt is held by people who went to grad school. Biden's plan to cancel it would be like taking money from a plumber to pay the debt of a lawyer.
Say yeah -- didn't this Republic used to require Congress to pass laws? Didn't NeverTrump used to caution about the "authoritarian" Trump assuming the powers of a tyrant? And yet... they're all supportive of this, or silent about it.

I'm sorry, but this begs for some math. Assume the borrower has $20k in student debt (above median, but not unreasonable). Assume the borrower earns an average of $45k in years 0-5 and an average of $55k in years 6-10.
It doesn't say whether it's gross or net, but gross would be typical. So that 5% cap would be $188/month for the first 60 months, for a total of $11,280. The cap would be $229/month for the second 60 months, for a total of $13,740. The grand total payment under the scheme would be $25,020. Assuming a 7.5% interest rate and a 15-year term, the total cost of the loan (assuming no penalties) is $33,372.44 (over 15 years, not ten). The monthly payment would be $185 if it was a normal loan. The 5% cap is more than the monthly minimum in this scenario.
This will affect a small number of people with modest debt load and shockingly low income. High debt will be over the $12k limit and higher income will pay it off. This is not as good it looks for student debtors.

I don't - my kids don't - get much of that at all. because we make too much. for the LOAN. it's an entitlement! the loans are given based on need.
so we could (we don't but if need be) get private loans still. much higher rate. those are not being forgiven.
this will go to people in grad school mainly, plus kids who got major loans for college which means, they were pretty high need but for some reason didn't get large scholarships.
anyway this giveaway will no doubt increase tuitions, especially for grad schools. people like us with multiple kids going to college who sacrificed to make sure they had plenty in their 529s are just fooked
I can't even imagine how ROTC kids are feeling.

I worked for my father at sub minimum wage for tuition, and worked nights and weekends to cover rent, food, books, etc. He was always to gracious about how much tuition was saying "I got it covered."

Obama destroyed student loans 2009-2011. Borrowers got the GM creditor treatment. After a decade of criminal misbehavior from servicers the .gov hired for the nationalized loans, none of those people realistically owe anything to anybody from an ethical standpoint. And thats not even counting the feds welching on PSLF and similar programs.
One servicer tacked 45k onto mine in one go with a paperwork fuckup prior to transferring it to another outfit... 4 years and zero legal headway in fixing it.

No, this is for loans to students, not parents. You"re confusing either parent PLUS loans, or the parental income info they collect for eligibility on subsidized loans. In the latter case, the student owes the money amd they're the ones gettinf writeoffs

Please clarify. Have you seen the EO or the IRs interpretation of it? I haven't, so I have no idea what they are suggesting gets waived or forgiven. But here is the bottom line, nearly 100% of loans signed for in high-end colleges are signed via the FAFSA. You can have the student sign for it, or you as the parent can sign for it. You get student loans that the FAFSA signer must pauy. And you can get Parent loans - that you know you as a parent will pay. But letting the kid sign for it means you cannot include them as a dependent, ever while the loan is outstanding or it comes to you - or you have committed fraud. Those aren't my words - read the agreement.
Don't give advise unless you understand the legal ramifications.

The banks already got paid off when Barky nationalized the loans.
Vis-a-vis tax consequences, even without the explicit exemption here, loan forgiveness is not taxable if the borrower is insolvent, which many of these people are.
Vis-a-vis moral hazards, it will be interesting to see how many of the "loans must be paid no matter what" folks remain pure when their FHA/VA loans are massively underwater, say, a year from now.
