Jury Returns Guilty Verdicts In Government's Do-Over of Fednapping Case


The FBI gets its frame in the 2020 fednapping hoax.

A jury on Tuesday convicted two men of conspiring to kidnap Michigan Gov. Gretchen Whitmer in 2020, in a plot prosecutors described as a rallying cry for a U.S. civil war by anti-government extremists.

The jury also found Adam Fox and Barry Croft Jr. guilty of conspiring to obtain a weapon of mass destruction, namely a bomb to blow up a bridge and stymie police if the kidnapping could be pulled off at Whitmer's vacation home.

Croft, 46, a trucker from Bear, Delaware, was also convicted of another explosives charge.

It was the second trial for the pair after a jury in April couldn't reach a unanimous verdict. Two other men were acquitted and two more pleaded guilty and testified for prosecutors.

The result was a victory for the government following the shocking mixed outcome last spring.

The federal prosecutors begged the judge to give the jury different instructions regarding what entrapment was from the instructions given in the first trial.

The judge also limited how long defense attorneys could question government witnesses, bizarrely ruling that they could only question them for as long as the government questioned them. Even though it takes far, far longer to impeach a witness's story than to merely elicit the story he wants to tell and has been coached to tell.


Julie Kelly wrote about the Detroit FBI office and its motto a couple of weeks ago.


"We have a saying in my office. Don't let the facts get in the way of a good story."

So said FBI supervisory agent Henrik Impola to one of the FBI informants working the FBI-inspired, organized, and executed scheme to "kidnap" and "assassinate" Michigan Governor Gretchen Whitmer ahead of the 2020 presidential election.

That comment, made in December 2020, just a few months after several men were arrested for their alleged role in the plot, was repeated by a defense attorney during opening statements Wednesday morning in the retrial of two remaining defendants in the federal case.

Impola's warning should be the FBI's new motto; he also could be the poster boy for the modern-day FBI. Not only did he handle the main informant in the Whitmer operation, Impola worked out of the Detroit FBI field office when a man named Steven D'Antuono was in charge. The purpose of the caper, one with D'Antuono's fingerprints all over it, was to produce negative news coverage for Trump while millions of Americans were voting for president in 2020; the president was accused of inspiring "white supremacist right-wing militias" to take out one of his most loathed political adversaries.

One week after the arrests in the Whitmer plot were announced on October 8, 2020, FBI Director Christopher Wray invited D'Antuono to take over a plum assignment--head of the FBI field office in Washington, D.C. The promotion gave D'Antuono control of the most powerful FBI office in the country several weeks before the events of January 6.

D'Antuono currently handles the criminal investigation into the Capitol protest, which so far has resulted in the arrest of more than 850 Americans on mostly nonviolent offenses. D'Antuono's agents also participated in the raid on Mar-a-Lago on Monday evening.

Impola, for his part, was removed as a government witness in the Whitmer fednapping trial amid accusations he committed perjury in a separate trial.

Impola, Wray, and D'Antuono are just a few of the actors responsible for the agency's "good story" related to Donald Trump. For six years and running, the bureau has portrayed Donald Trump as a public menace who must be destroyed at all costs. Trump and those around him are the villains in the FBI's "good story" while any number of FBI officials and assets--James Comey, Andrew McCabe, Peter Strzok, Lisa Page, Christopher Steele, Michael Sussmann to name a few--are victims and martyrs.

Unless the defense agreed to that before the trial started, and I seriously doubt they did, it is blatantly illegal and automatic grounds for an appeal.

I've never seen or heard about arbitrary time limitations on cross-examinations. As a veteran cross-examiner myself, the judge will let you go for as long as you want, so long as you aren't going around in circles. I've never been arbitrarily limited to certain time lengths. As for the jury instructions for entrapment, there should be a standard jury instruction mandated by federal law. Almost all jury charges are now standardized.

However (and this is where I flaunt my ignorance about all the details in the case)... If you are ever in a room with someone who is talking about something like kidnapping, blowing up bridges, etc... you need to walk away. I'm no lawyer but I am aware of many cases that have been appealed and overturned a previous conviction. Have things changed in the last few months?

I was on the jury for a case where a woman claimed she was fired from a state agency because of discrimination. It was a pretty straightforward case but the defense lawyer kept asking basically the same questions in slightly different ways and the case lasted an entire week. It could have been over in a matter of hours. We reached our not guilty verdict in a matter of minutes but the bailiff told us he had already ordered lunch so chill to after lunch.

Afterward, the judge invited the jury to his chamber to thank us and he spent about 15 minutes goofing on the defense lawyer but he let him ask as many questions as he wanted.

I've never seen or heard about arbitrary time limitations on cross-examinations. As a veteran cross-examiner myself, the judge will let you go for as long as you want, so long as you aren't going around in circles. I've never been arbitrarily limited to certain time lengths. Anyone looking at the way that judge acted should be appalled, he's basically running the trial exactly like a conspiracy theorist would assume, by hamstringing the defense and letting the prosecutors get away with whatever they want. And I brought up The Bedford Incident here one time, a while back. Not a movie guy, but seems like a sleeper of a very good Cold War classic, and some great performances by Widmark and the German guy. One nice element is that we never see/hear the Soviet sub or its crew. The prey remains unseen and sort of mysterious.

So I'm of two minds about this. In the Depp vs Heard defamation case there was a time limit and the judge did enforce it. But it was a total overall time limit for each side. So I'm thinking that its either A: exactly like what the article wrote and its a bullshit illegal action by the judge. Or it's also possibly B: that there was an overall time limit for each side and its a case of dumb journalist not understanding what they're writing about.

But even in a civil prosecution, limiting the time spent on a single witnesses barring a medical emergency so long as the line of questioning is germane to the case has not to my knowledge been done anywhere else.

194 As a legal concept, "entrapment" was always controversial, especially for the police and prosecution. They of course always wanted leeway for informants and undercovers to push people to commit crimes so that they can then arrest and prosecute them. Lots of ink was spilled on what crosses the line into entrapment. If I recall, there were a number of cases involving undercover prostitutes. Policewomen would pose as prostitutes at hotel bars and similar venues, and push and pressure male patrons into sex even after they would resist. But men are dumb, especially when drunk, and the pressure would often pay off. Were they entrapped?

Jury instructions that depart from the federal std are one of the criteria for overruling lower courts because it is specifically a legal error committed by the judge and an error in this directly involves the jury's understanding of the law for deliberations. The days of free wheeling jury instructions in most jurisdictions is gone.

Then, there is the limitation on the constitutional 6th Amendment right to confront witnesses. I have never heard of a specific time limit on cross examination outside of a mock trial competition. There is a limit on recrosses but it is not a time limit but rather the recross questions are required to be limited to the redirect questions and answers by the witnesses.

The judge instructions alone might be problematic on appeal as the judge involved would have to explain why these departed from the original trial. Jury instructions are one of the leading reasons for appellate reversal and remanding for a retrial btw. The right to confront denial by time limit is serious if applied to all govt witnesses.

If you ever read the detailed accounts of the ridiculous "Court" "proceedings" in the early Soviet period from Volume 1 of the unabridged Archipelago (much of it is cut out in the abridged version), our federal courts make a lot more sense. It's in the last third of the book, and all of it will sound hauntingly familiar to you.

It was before they got to the point of simply dispensing with Courts altogether in political cases, for the sake of efficiency. It was when they were still pretending at a juridical system.

This current federal judiciary is just a step on a well-worn path. And it's a pretty quick step, in historical terms.

Go read that, and then look back at us, say, in ten years. It will look like two parallel lines.

Entrapment reverses the burden of proof as the defendant admits to committing the crime but argues that they would have not committed the crime had not the government agent made them do it. Intoxication, because it is voluntary, goes to mitigation of sentence but not the offense itself. To prove a government agent made them do it is difficult to pull off because you have to indicate either extreme coercion like putting a gun to your head to get you to go through or lethal threats against family or friends, or a repeated harassment to complete the crime above and beyond mere pestering. Most defendants never carry that one off to a jury.

Nope. Drinking those drinks themselves constitutes voluntary action by the defendant. Now, if the government agent put Rohypnol in the drink that the guy did not know about, then you have an argument.

Proving coercion that would compel a defendant to commit an illegal act is a difficult task for a defendant as I mention above. Proving that the government agent's campaign to get the defendant to commit the crime was so persistent and annoying over time that the defendant finally gives in to commit the crime is even more difficult.

Most changes in the law on evidence come from a judge dealing with a novel issue or a judge making a ruling challenging old precedents, like Jed Rakove did years ago, that the use of fingerprinting is not a generally accepted science (it was grandfathered in btw) compliant with Dow Chemical precedent.

FWIW, most comparative research indicates that political engagement goes up when things start going wrong. In a representative state, people being disengaged is not necessarily a bad thing because ideally the minders act with good faith on behalf of their constituents. It is when the voter engagement becomes extreme (other than ballot stuffing of course) that people perceive something is seriously wrong. Ideally, the government changes direction because otherwise it usually means a path toward civil war.

Entrapment is a very tricky area of the law right up there with insanity pleas. Theoretically, if you could demonstrate the agent plied the guy with drinks until witnesses in court could obviously tell that the guy was extremely intoxicated before committing the crime, you might demonstrate that the government agent effectively created the agreement to commit a crime in the defendant. That still does not excuse the defendant if the defendant does an overt act toward fulfilling the crime (whatever it was).

On the first jury, someone(s) thought as you did Chuck Martel and hung the jury. The redrawing of the judge's instructions and the time limit thing though probably led to less evidence being presented here for the jury to make that decision.

Now, its pretty clear looking at what those same people were saying at the time that this is NOT true.

But the left will on the one hand say it is true in the 60s/70s, but that anyone that claims that is happening now is a NAZI conspiracy theorist.
