Report: Alec Baldwin Must Have Pulled the Trigger in the "Rust" Shooting

I would have noted the report was issued by the FBI but I wanted you to be interested in the story.

The firearm involved in the fatal "Rust" movie set shooting must have had the trigger pulled, an FBI report found, despite the fact that actor Alec Baldwin previously denied pulling the trigger.


Baldwin fatally shot cinematographer Halyna Hutchins and injured director Joel Souza last October while filming "Rust" in New Mexico. During an interview with ABC's George Stephanopoulos later that year, Baldwin denied pulling the trigger on the gun.

"Well, the trigger wasn't pulled, I didn't pull the trigger," he said at the time, adding, "No, no, no, no, no, I would never point a gun at anyone and pull the trigger."

With the hammer quarter- or half-cocked, the Colt "could not be made to fire without a pull of the trigger," officials said.


Even with the hammer fully cocked, the weapon "could not be made to fire without a pull of the trigger while the working internal components were intact and functional," the report observed.

The local medical examiner then issued his report, stating that the shooting was "an accident."

Which... I mean, yeah, we figured that.

The fatal film-set shooting of a cinematographer by actor Alec Baldwin last year was an accident, according to a determination made by New Mexico's Office of the Medical Investigator following the completion of an autopsy and a review of law enforcement reports.

The medical investigator's report was made public Monday by the Santa Fe County Sheriff's Office along with numerous reports from the FBI on the revolver and ammunition that were collected following the shooting.

Prosecutors have not yet decided if any charges will be filed in the case, saying they would review the latest reports and were awaiting cell phone data from Baldwin's attorneys.

While it's too early to say how much weight the medical investigator's report will carry with the district attorney's office, Baldwin's legal team suggested it was further proof that the shooting was "a tragic accident" and that he should not face criminal charges.

"This is the third time the New Mexico authorities have found that Alec Baldwin had no authority or knowledge of the allegedly unsafe conditions on the set, that he was told by the person in charge of safety on the set that the gun was 'cold,' and believed the gun was safe," attorney Luke Nikas said in a statement.

Well, no, the medical examiner just said it was "an accident." An accident can include something as grave as criminally negligent homicide.


The DA has made no decisions about any charges in the case.

Alec Baldwin would never make an angry, impulsive decision or anything. Like if a woman was barking orders at him and questioning his Act-Ting choices, maybe he might have pointed the gun at her and pulled the trigger to make a point.

Yes, Alec Badlwin has repeatedly demonstrated he has no problems at all with women.

3 Not sure how the medical examiner could determine it's an accident any better than the rest of us. Though it is generally and reasonably held to be an accident, I don't think the corpse would show too much about Baldwin's intent.

Homicide it surely was. Murder, perhaps not. We have lots of laws about that. Murder vs. Manslaughter and degrees of each. Accidentally killing someone still kills someone, and that is usually punished.

How is there no video of the killing? Everything is recorded on a movie set now, even rehearsals. The cameras are all digital so it costs nothing to film everything. Especially this rehearsal, where they were trying to properly frame and shoot the scene. Are you telling me they didn't record it? I'm 99% sure they were recording when Alex shot her. So where's the video?

Also: didn't the director also get wounded by the shot? How exactly did that happen? I've never heard a satisfactory explanation. I'm 100% sure that what actually happened is nothing like the load of bullshit we are being fed.

I saw someone write somewhere that the report was vague on which Colt had been used in the test. Did they use the actual firearm that was used in the shooting or did they just use the same model to check if it could be made to fire accidentally. Of course, that would only matter if the actual firearm was defective or modified in some way.

From looking at the trajectory of the bullet and where the bullet hit the victim and what damage the bullet caused the medical examiner can determine whether the shooting was "accidental" versus "intentional"? Since when? I have a feeling a bullet will cause the exact same damage to a body whether the shooting is accidental or intentional. So, in what way does medical science determine accident versus intent?

I was hovering around a similar thought when I wrote that, the thought being that massive government organizations are merely a pension/perk pool to maintain loyalty to the paymasters (however small a subset of decision-makers that may ultimately be). The job such as criminal labs, money-laundering investigations, etc. are just a public function that provides some nominal utility to justify the massive public expenditures.

I think an actor--in practice--probably relies completely on the weapons prep people and the responsibility lies with that person, not the actor, to have a safe weapon.

It's just a different deal. People point guns at other people on set and stage and pull the trigger all the time, every day.

Over on Youtube the channel "Legal Vices" has gone through the police interviews with the major players in excruciating detail. Each episode which is basically the police interviews with a different player is a couple of hours. Can't believe I've spent that much time watching but my takeaway is the armorer was completely unqualified for the job. No idea where or how dummy ammo was being stored when not in use or even how it was getting to set. Also the guy that supplied the dummy rounds seems to have had the hots for the props manager and comes across as trying just a bit too hard throwing the armorer under the bus. To the extent I care about Baldwin at all I think he's a pretty crappy human.
I still think this one falls on a gray area. Actors do a lot of things on set with guns that break all the gun safety rules. Know your target and what's beyond it? Impossible when filming at least half the time I bet. Can't know what's behind the set wall etc.
I think an actor--in practice--probably relies completely on the weapons prep people and the responsibility lies with that person, not the actor, to have a safe weapon.
It's just a different deal. People point guns at other people on set and stage and pull the trigger all the time, every day.

So when was it last in the gun lock up. If it was taken out for target shooting, by whom? Alec? And he hadn't turned it in to be cleared. Why would she tell him it was cold? Did she check it? Or was he just dicking around with it and shot them. And then later come up with, she told me it was cold. Maybe she checked it and missed it. I think its easier to believe he was the fcuk up. I have run a range before. I get gun safety. I also think in an environment where every single gun safety rule is out the window and where actors are part of a system that is supposed to provide safety that individual responsibility on the actor becomes murky.

It was a single action, but I don't recall whether it was of the old style where there are half cock positions, or whether it was a more modern one with no half cock positions.

Why half cock? Because in the older single actions, you had a spur on the hammer that was used to strike the primer, the cylinder would not rotate until you put the hammer in half cocked position, which you would need to rotate to unload and load the cylinder.

At the end of your fun, reload the chamber with the rounds you are pretty sure are dummy rounds. Don't double check before handing the weapon to the actor, because you are the only one to have handled it, and you are sure it is fine.

He was shot to death with a blank. Why? Because they use dummy bullet tips in revolvers so the chambers don't look empty. Turns out if you're close enough and hit in the right spot, you can be killed by one of those plastic tips.

Agreed. I don't know why you'd allow any gun to be used on set to be taken to a range and live fired at any time during production. Its just another chance for cross contamination of rounds. Seems like all prop weapons would also be secured only for use on-set until completion of production.

Because all the other gun safety rules simply can't apply. They're pointing guns at each other, on purpose, and pulling the trigger. The ONLY prevention in this case is ammunition control.

The use of the weapon on set including his decision not to check the weapon, admittedly he knew how to, is on him. The fact that live rounds were left in the weapon is on the armorer. The fact that the weapon was allowed to be removed from the set and used for recreational live fire not associated with the film, is on the producer, who is also Baldwin.

There is enough culpability on Baldwin for involuntary manslaughter easily, voluntary manslaughter if they want to push his admitted knowledge of the weapon, and him not checking it.

I mostly agree. The prop master needs to be excessively diligent at making sure only fake ammo is on set. On top of that, the actor should be checking.

I keep asking that, and various people keep saying they should, but I haven't seen anybody who seems in the know verify if they do or don't.

I'd really like to know, in practice, how this works. Because, again, let's say Al Pacino is supposed to kill Robert DeNiro at the end of Heat. I'd think both DeNiro and Pacino would want to check that damn prop gun. I'd think everybody on set would like to know - because Pacino's aim may not be so good and the lighting and sound guy ain't that far away.

But in reality, I somehow doubt everybody that COULD be accidentally killed get a chance to verify this. And putting it all on the actor, just because the actor in this case is Asshole Alec Baldwin, seems more than a little self serving.

Again - I'm surprised it doesn't happen more. If I'm on the jury, I don't convict just because of "this is how you handle guns".

Well for one thing, guns are a lot more familiar than swords, or swordplay. I mean there are experts and cosplayers and all that but they don't even come close to how many have been around gunfire or shot a gun.

But I mean, there's a level of "more real than reality" where people expect something or find it more proper than what the real life effect would be. People have been trained to expect that SHhhhhinnNNGNG sound when someone draws a sword (like they expect arrows to whistle, somehow).

Cowboy movies are about the old west, they don't dig up Bat Masterson to play himself with his original weapons.
