Report: Alec Baldwin Must Have Pulled the Trigger in the "Rust" Shooting
I would have noted the report was issued by the FBI but I wanted you to be interested in the story.
The firearm involved in the fatal "Rust" movie set shooting must have had the trigger pulled, an FBI report found, despite the fact that actor Alec Baldwin previously denied pulling the trigger.The local medical examiner then issued his report, stating that the shooting was "an accident." Which... I mean, yeah, we figured that.
Baldwin fatally shot cinematographer Halyna Hutchins and injured director Joel Souza last October while filming "Rust" in New Mexico. During an interview with ABC's George Stephanopoulos later that year, Baldwin denied pulling the trigger on the gun. "Well, the trigger wasn't pulled, I didn't pull the trigger," he said at the time, adding, "No, no, no, no, no, I would never point a gun at anyone and pull the trigger." ... With the hammer quarter- or half-cocked, the Colt "could not be made to fire without a pull of the trigger," officials said.
Even with the hammer fully cocked, the weapon "could not be made to fire without a pull of the trigger while the working internal components were intact and functional," the report observed.
The fatal film-set shooting of a cinematographer by actor Alec Baldwin last year was an accident, according to a determination made by New Mexico's Office of the Medical Investigator following the completion of an autopsy and a review of law enforcement reports. The medical investigator's report was made public Monday by the Santa Fe County Sheriff's Office along with numerous reports from the FBI on the revolver and ammunition that were collected following the shooting. Prosecutors have not yet decided if any charges will be filed in the case, saying they would review the latest reports and were awaiting cell phone data from Baldwin's attorneys. ... While it's too early to say how much weight the medical investigator's report will carry with the district attorney's office, Baldwin's legal team suggested it was further proof that the shooting was "a tragic accident" and that he should not face criminal charges. "This is the third time the New Mexico authorities have found that Alec Baldwin had no authority or knowledge of the allegedly unsafe conditions on the set, that he was told by the person in charge of safety on the set that the gun was 'cold,' and believed the gun was safe," attorney Luke Nikas said in a statement.Well, no, the medical examiner just said it was "an accident." An accident can include something as grave as criminally negligent homicide.
The DA has made no decisions about any charges in the case. Alec Baldwin would never make an angry, impulsive decision or anything. Like if a woman was barking orders at him and questioning his Act-Ting choices, maybe he might have pointed the gun at her and pulled the trigger to make a point.

Sure it seems likely Baldwin did not know, but someone loaded it and left it loaded. There was some story about having used the gun in off hours for target shooting ... still, a competent person empties the gun and checks ... and did Baldwin have any responsibility to check for himself?
But he squeezed the trigger, whether to make a point or just out of raw anger. (Or maybe he conspired cuz' he really wanted to know what it was like to kill someone ... especially to kill a "conservative".) Could happen.

How is there no video of the killing? Everything is recorded on a movie set now, even rehearsals. The cameras are all digital so it costs nothing to film everything. Especially this rehearsal, where they were trying to properly frame and shoot the scene. Are you telling me they didn't record it? I'm 99% sure they were recording when Alex shot her. So where's the video?
Also: didn't the director also get wounded by the shot? How exactly did that happen? I've never heard a satisfactory explanation. I'm 100% sure that what actually happened is nothing like the load of bullshit we are being fed.

I saw someone write somewhere that the report was vague on which Colt had been used in the test. Did they use the actual firearm that was used in the shooting or did they just use the same model to check if it could be made to fire accidentally. Of course, that would only matter if the actual firearm was defective or modified in some way.

Regardless, Halyna Hutchins would still be alive if a) Baldwin followed standard gun-handling instructions ie assume all guns are loaded and b) Baldwin didn't have such a hair-trigger temper.

That determination is beyond the purview of a medical examiner's expertise. It belongs to a court of law's fact-finder, because it involves questions of intent.

And - how does a medical examiner determine "accident"? A medical examiner determines cause of death. It's up to the police and prosecutor to determine if the cause of death constituted an "accident' or a crime.
From looking at the trajectory of the bullet and where the bullet hit the victim and what damage the bullet caused the medical examiner can determine whether the shooting was "accidental" versus "intentional"? Since when? I have a feeling a bullet will cause the exact same damage to a body whether the shooting is accidental or intentional. So, in what way does medical science determine accident versus intent?

Of course, that would only matter if the actual firearm was defective or modified in some way.

I was hovering around a similar thought when I wrote that, the thought being that massive government organizations are merely a pension/perk pool to maintain loyalty to the paymasters (however small a subset of decision-makers that may ultimately be). I still think this one falls on a gray area. Actors do a lot of things on set with guns that break all the gun safety rules. Know your target and what's beyond it? Impossible when filming at least half the time I bet. Can't know what's behind the set wall etc.
I think an actor--in practice--probably relies completely on the weapons prep people and the responsibility lies with that person, not the actor, to have a safe weapon.
It's just a different deal. People point guns at other people on set and stage and pull the trigger all the time, every day.

Over on Youtube the channel "Legal Vices" has gone through the police interviews with the major players in excruciating detail. Each episode which is basically the police interviews with a different player is a couple of hours. Can't believe I've spent that much time watching but my takeaway is the armorer was completely unqualified for the job. No idea where or how dummy ammo was being stored when not in use or even how it was getting to set. Also the guy that supplied the dummy rounds seems to have had the hots for the props manager and comes across as trying just a bit too hard throwing the armorer under the bus. I recall that Jon-Erik Hexum was killed by a blank. It wasn't a case of a gun that was supposed to be empty having live ammo. The idiot actually put a gun with a blank right to his head and pulled the trigger. He didn't realize than even with blanks there is some discharge. I have run a range before. I get gun safety. I also think in an environment where every single gun safety rule is out the window and where actors are part of a system that is supposed to provide safety that individual responsibility on the actor becomes murky.
If it were a system of support cables that failed we would look at the cable rigging guy not the actor for not independently verifying the safety of the rig.
I just see some nuance in what happened.

In the interviews I mention in my #170 Baldwin explains in great detail that he knows exactly how to tell the difference between a blank, a dummy, and a live round. He may rely on someone else while on set, but as part of his entitled idiot persona (without a lawyer present) he told the police in a recorded interview he knows exactly how to check the rounds himself.

It was a single action, but I don't recall whether it was of the old style where there are half cock positions, or whether it was a more modern one with no half cock positions.
Why half cock? Because in the older single actions, you had a spur on the hammer that was used to strike the primer, the cylinder would not rotate until you put the hammer in half cocked position, which you would need to rotate to unload and load the cylinder.

Film captured it better. Digital capture loads funky at that speed and flashes are often incomplete, so they usually get adjusted in post-production.

Agreed. I don't know why you'd allow any gun to be used on set to be taken to a range and live fired at any time during production. Its just another chance for cross contamination of rounds. Seems like all prop weapons would also be secured only for use on-set until completion of production.
Because all the other gun safety rules simply can't apply. They're pointing guns at each other, on purpose, and pulling the trigger. The ONLY prevention in this case is ammunition control.

In response, he changed which episode he was going to remake (going from the Alien Main Street episode to the kick the can episode which was, essentially, Spielberg on auto-pilot), filmed it in six days, and just walked away except for the minimum amount he had to do as producer.
The end result is weirdly incomplete and can't be spoken about without bringing out the tragedy to explain it. The reason to really watch it is the two episodes directed by Joe Dante (the kid with the active imagination) and George Miller (Terror at 30,000 feet).

The use of the weapon on set including his decision not to check the weapon, admittedly he knew how to, is on him. The fact that live rounds were left in the weapon is on the armorer. The fact that the weapon was allowed to be removed from the set and used for recreational live fire not associated with the film, is on the producer, who is also Baldwin.
There is enough culpability on Baldwin for involuntary manslaughter easily, voluntary manslaughter if they want to push his admitted knowledge of the weapon, and him not checking it.

Even pointing a firearm (even a fake one) at someone is brandishing or assault depending on the jurisdiction. That is to cause a reasonable person apprehension that they are subject to being harmed by a lethal weapon.
What Baldwin is arguing is that he had no intent to kill or injure anyone and that the others were not in apprehension that they were being threatened because of a movie shoot situation (similar to Binger sweeping the jury with an AR15). Well, the shoots should be really separate, but there are scenes where people fire real bullets (at background stuff usually, or a bucket, that kind of thing). Its not only cheaper but gives better results than using squibs.

I mostly agree. The prop master needs to be excessively diligent at making sure only fake ammo is on set. On top of that, the actor should be checking.
I think this is normally how it works, but the prop master was new, Baldwin had some jackass Covid protocols that meant the prop master was told to leave guns on a cart outside of her control, and Baldwin has emotional issues that would wear any normal person down.
Eventually, most normal people would stop reminding him of the safety protocols because of the storm of abuse Baldwin regularly unleashes on people.

Yeah the recoil looks bad. Even if you PERFECTLY mimic how much recoil a gun gives with your wrist action, that ripple of shock through your arms and clothing still isn't right and you can tell the difference.

I don't believe that he intended to shoot her and her assistant. That level of intent is irrelevant in a negligent homicide case, which is what he should be charged with. He appears to have disregarded a basic standard of care in firearms handling, and it is for a court to determine whether he met or failed to meet that standard.

I keep asking that, and various people keep saying they should, but I haven't seen anybody who seems in the know verify if they do or don't.
I'd really like to know, in practice, how this works. Because, again, let's say Al Pacino is supposed to kill Robert DeNiro at the end of Heat. I'd think both DeNiro and Pacino would want to check that damn prop gun. I'd think everybody on set would like to know - because Pacino's aim may not be so good and the lighting and sound guy ain't that far away.
But in reality, I somehow doubt everybody that COULD be accidentally killed get a chance to verify this. And putting it all on the actor, just because the actor in this case is Asshole Alec Baldwin, seems more than a little self serving.
Again - I'm surprised it doesn't happen more. If I'm on the jury, I don't convict just because of "this is how you handle guns".

There was a Hays Code directive that a gun firing and someone getting shot couldn't happen in the same shot. This held for a long time, even after the Hays Code fell out of use.
I think it was Where Eagles Dare that did it first in a major American production, and Eastwood and team had no idea that it was a problem until they submitted it.

Well for one thing, guns are a lot more familiar than swords, or swordplay. I mean there are experts and cosplayers and all that but they don't even come close to how many have been around gunfire or shot a gun.
But I mean, there's a level of "more real than reality" where people expect something or find it more proper than what the real life effect would be. People have been trained to expect that SHhhhhinnNNGNG sound when someone draws a sword (like they expect arrows to whistle, somehow).

This was single action revolver probably set to about 2lbs.
It's won't matter much though. Because he had to cock it to full first. Even the pissant trigger pull on the peacemaker won't allow him to defend himself from. "He fully cocked the weapon, he then pointed it at the director, he then put his finger on the trigger"
Making a decision to depend on the amount of trigger pressure to protect you against an accidental operation of the weapon and still addressing the trigger is gross negligence.

Braenyard is right. If you have a strong stomach, you can look up what a contact wound looks like as extremely hot gases at high velocity char and displace the flesh. Nasty.
The effect diminishes over distance but there is a reason that Uncle Sam requires blank adaptors as well as to help the weapon function. The Swedes used wooden bullets and had a splitter attachment to make them less harmful out of the bore.

Nice lie there Alex. If the ONLY question was who put the live bullet in, then you must have pulled the trigger. Even if some nefarious enemy had put in the bullets, that doesn't control the gun going off. A live gun handled with care does not go off and hit anyone, as it is not pointed at them.

But as producer, he's responsible for hiring a possibly inexperienced gun-wrangler to manage this and THEN restrict her access and control of the guns that were her responsibility. She was not allowed in the room where the shooting took place to manage the use of the guns.

From what I've gathered online, Baldwin's Pietta six-shooter was visually and mechanically identical to the old 1873 Colt Single Action Army -- that is, no transfer bar. However, Baldwin didn't drop the piece and, as with the other Pietta style, the hammer would not have fallen and struck the primer with fatal effect unless he pulled the trigger.
The firing pin on the transfer-bar Pietta s not located on the hammer, so it would seem anachronistic if you got a good look at it in any film set in the Old West.

Cowboy movies are about the old west, they don't dig up Bat Masterson to play himself with his original weapons. How many cowboy movies set in the 1870s or 1880s has the guys shooting Winchester Model 1894 rifles?
