Kyle Shideler: For the Rule of Law to Reign, The FBI Must Be Destroyed

markedsafefromfbiraids2.jpg

Hot piece.

Shideler first establishes that -- like so many of us -- he grew up as a huge fan of the FBI, and remained so into his early adulthood.

And then, unfortunately, came bitter wisdom.

The solution to the abuses we now endure is not just to subject the FBI to another fruitless inspector general investigation but to dismantle it completely. The bureau cannot be the focus of yet another congressional hearing. FBI Director Christopher Wray, like his predecessors, is more than happy to sit smirking while a handful of grandstanding congressmen and senators pound the table and yell on C-SPAN. Then he'll jet off for a holiday vacation on a taxpayer-funded private jet while the same congressmen vote to increase his budget. Again.

No, the FBI must be rendered into component parts and distributed to the four winds.

The bureau has always had its problems and its detractors. Since the days of J. Edgar Hoover keeping his own "private" files on elected politicians and famous persons, the FBI has had a political streak. As an agency it has always been savvy about its reputation, bureaucratically out-dueling federal departments that sought to infringe on the bureau's perceived preeminence in the fields of federal law enforcement and counterintelligence. But most of the FBI's politicization had to do with maintaining its own administrative superiority and independence, not serving as muscle for a particular political party.

That's no longer the case.

The FBI's actions over the past six years make perfectly clear that the FBI is more than willing to serve as the enforcement arm of the Democratic Party. It serves as its patron's shield in matters large and small. It exonerated Hillary Clinton for her illicit server. It raided James O'Keefe and Project Veritas when Joe Biden's daughter lost her diary. It eliminated investigation into Black Lives Matter and other black identity extremists because those pursuits annoyed the Democrats' Congressional Black Caucus. It refuses even to utter the word "Antifa" while churches and pregnancy centers are fire-bombed. It continues to cover up for Hunter Biden's corrupt dealings with enemy nations, along with his indulgence in criminal prostitution and drug abuse.

But the FBI has also served as the Democrats' sword as well. It knowingly laundered the Russian collusion hoax, lying in order to secure FISA warrants. It ambushed the president's sitting national security advisor in a nonsense perjury trap. The FBI hunts down January 6 protesters while dodging congressional inquiries about the role of federal agents in provoking the incident. The FBI ginned up a fake kidnapping plot in Michigan to instill fear of right-wing terrorism, manhandled the former president's lawyer, and shackled one of his former high-level aides.

And it has now raided the former president's home under a mere pretext, while the Democrats openly crow on cable news about using a political prosecution to prevent Trump from ever again being able to serve in office.

Other attempts to rein in the FBI short of its abolition have failed. The FBI shows nothing but contempt for those authorized to oversee it. It routinely ignores inspector general investigations. It fails to prosecute or punish those who overtly violate established policies. It refuses to answer legitimate questions from Republican committee members. It doesn't even respond to congressional letters of inquiry. It punishes FBI whistleblowers and seeks to purge from its midst those agents who aren't in lockstep with its new praetorian guard role.

Hit the link to see his plan. It's a more detailed plan of the quick suggestion I made -- break up the component pieces, like the crime lab, and make them independent.

One critical point that has to be kept in mind is that when you do a massive reorganization, there are no federal guarantees about civil servants' jobs, I'm pretty sure, because the old jobs are being eliminated. They can't just claim the "new jobs" are just the "old jobs" in a new form. If the FBI is broken up into pieces and new agencies are created to contain the broken up parts, all of the new positions in those agencies are new.

The former agents of the FBI may apply for those jobs -- but they have no civil service guarantee of them.

What I'm saying is that any bust-up of the FBI presents a golden opportunity for an enormous purge without having to be concerned about the civil service protection racket.

The leftists that now inhabit the FBI may apply for positions in any successor organizations. And they can be turned away, for "just not fitting in" with the new agencies' missions.

...

Admittedly, a GOP-majority Congress may not have the stomach for even the lightest pushback against the bureau.

This, of course, is where everything falls down. The GOP is an authority-worshipping retarded leathergimp (which also requires transfusions of corporate money every two hours).

Nevertheless, Shideler is firm:

To save the rule of law, the bureau must be destroyed.

This must happen.

If you are allowed to launch coup after coup against the duly elected President that the people of the United States fairly and freely elected, then it's not a coup.

It's now just Part of How the System Works.

Meanwhile: The FBI delivers more subpoenas to more congressmen, demanding their records.

UPDATE: This post has been updated with a statement from U.S. Rep. Scott Perry in which Perry said his lawyers have been told he is not a target of an investigation that resulted in an FBI seizure of his cell phone earlier this week.

Federal investigators delivered subpoenas or paid visits to several House and Senate Republican offices in the Pennsylvania Capitol on Tuesday and Wednesday, according to multiple sources.

At least some of the individuals receiving subpoenas were told they were not targets of an investigation, according to at least six sources reached by PennLive, but that they may have information of interest to the FBI. All of the sources had been briefed on the investigative moves in some way, but demanded anonymity in order to discuss them.

And if you told the FBI to deliver subpoenas on Nancy Pelosi and her husband and son -- more on that later today -- they'd refuse, saying that would be "unprecedented" and "destabilizing."

Below, Missouri's AG Eric Schmidtt -- soon to be Missouri's based Senator, no thanks to Trump -- tells the FBI to go search itself.

49 Sadly, the malfeasance of the FBI has overshadowed the malfeasance of everyone else. The FBI needs to be dismantled and replaced without question, but that is merely a "good start." The entire federal LE and Intelligence complex needs to be dismantled and replaced. Every single cop and spy in the federal government - FBI, Marshal, Secret Service, Department of Agriculture, IRS, HUD, CIA, DIA, NSA, CISA - absolutely every single law enforcement or intelligence agent in every single agency needs to go. It is rotten to the very core and must be destroyed. Replace all of it with new agencies and forbid any other agency from engaging in *any* LE or intelligence function for any reason under any name.

I worked with the FBI after September 11th and found out that most of the the agents I worked with also had UCMJ or NJP problems resulting in being passed over.

In short, they all had something that could be held over them, and yet the FBI hired them. It deserves further inquiry.

108 I've been arguing for a while now that the part of the FBI that targets federal office holders should be moved to an organization controlled by and answerable

It makes no sense that you put a federal organization in charge of...investigating the rest of the federal organizations.

Create a new org with leadership voted on by the 50 governors and with a permanent ban on anyone that has worked for FedGov (outside of the armed forces).

Want to be the "State Investigative Chief"? Better show at least 26 governors that you can find and successively prosecute corrupt FedGov members.

109 I stand by my assessment that the most accurate portrayal of the attitude and operational mode of the FBI in popular culture was on TV, in "X-Files." In that show, they were portrayed as lawless, reckless, power-hungry monsters with no accountability who constantly broke the rules. The storylines were not realistic, but the portrayal of the FBI was.

150 For the most part, unless you are taking illegal pictures or recording yourself and keeping that only in memory, the Feebs can get virtually all of the information via other means.

My guess is that the Feebs use the whole cellphone ruse in order not to disclose where they actually are getting the data wholesale via NSA intercept capabilities. It is simply laundering the source of the data so it can be used in court.

Look up Stinger technology for example, letter subpoenas to telcom providers, and so on. Essentially, the Federales are literally Hoovering up all information including using data brokers of any digital data spread globally on the net.

They are doing so for fun, power, and profit (insider trading most likely or resale). Same as the KGB did back in its heyday.

Just swipe your finger on it or point the camera at you.

Per my understanding, though a Horde Lawyer will hopefully tell me if this is wrong, the approach is to think of it like a safe. If you have a safe with a key, the state can compel you to produce the keys. If you have a safe with a combination, the state cannot compel you to reveal the combination because the Fifth Amendment is still technically a thing.

Biometrics are like a lock with a key. They can compel you to produce the key. Passwords are like a lock with a combination, and they cannot compel you tell them the combination because that would be self-incriminating. If you refuse to reveal the password or combination, the state can hire a safecracker to force open the safe (or subject your device to cryptoanalysis or other measures).

He had a couple that were ok. I think he relies on subordinates to vet people for him instead of going off deep person knowledge himself. This can be a weakness, depending on your subordinates. This would be borne out both by people in his admin as well as people he has endorsed himself.

Plus, he has a blind spot when it comes to his family.

This is not necessarily a deal breaker, as if you learn from your mistakes, a leader can still be quite effective (especially once he has people with a better people sense and also share his vision.) On the other hand, we are kind of in the 'no tolerance for missteps' phase, so your mileage may vary.

307 Every state in the union should react like that AG, without exception. It doesn't matter if they are left or right, whether they agree with the FBI's abuse of power or not. it's abuse of power, it's unconstitutional, and it's running roughshod over their state's rights and sovereignty guaranteed in the constitution.

3) It makes US better, in short.

316 As a point of order, be careful using terms like "rules" or "policies".

It's absolutely black letter law, in the USC title 18 blah blah, with penalties proscribed usually involving huge fines, prison sentences, even the death penalty.

The Democrats are not shy about using the full force of phony baloney "investigations" and star courts to punish their political opponents for something they didn't do, how is it that the Republicans can't be bothered to go after the people who are abusing their positions, violating their oath of office, and derelict in their duty?

This is not complicated. It might not be easy, but that's their job. They wanted the job, and they tell everyone that will listen they are just that sort of indispensable uniquely qualified individual to do it.

Nobody on earth could have suspected Jeff Sessions was a double-agent, Mattis was a saboteur, Kelly was spy, etc.

Trump faced a panopticon of traitors and saboteurs all stabbing and pricking at him on an hourly basis.

He was able to get things done that no other President could, facing what he faced on sheer will power alone.

388 Yet another AOSHQ wishcast fantasy that reflects lack of familiarity with reality - Trump didn't - and won't if he has a second chance - have a pool from which to pick "good" appointees, in many areas. The "swamp" encompasses about 90% of the people with any background in many areas. And there's just the general degradation of the civic culture, part of which means that even the least unsuitable candidates are *still* not nearly as disruptive and fresh-start in their outlook as a true outsider like Trump.

And there was (and will still be) the GOP chokehold on the pipeline, via Senate confirmation. Which didn't only present a barrier, in some cases, to better choices, but also enabled many of the most damaging attacks and entanglements, like having the ridiculous situation of an AG who had (ridiculously) recused himself from a "matter" that was entirely fictitious and was used as a club to weaken a president for years on end. But firing him would have only given ammo to the GOP/Dem/Beltway adversaries.

Then, there is the intrusive security clearance forms you have to fill out about almost every embarrassing action you may have done over the years (which were conveniently leaked to China btw in the past to give plausible deniability for the Kalorama crowd to keep them.

General Flynn is that no one worthwhile can hope to work if the Stasi are constantly attacking them. Remove the threat hanging overhead- permanently- and then we can see some real work.

Don't get me wrong, Eric Schimdtt is a good cat, but he's not going to get anything major done as a Senator. That's why the modern Senate exists, and the Derp State would rather blow up Capitol Hill than lose control of it. If he wanted to show he was serious, use his power of state law to have the FBI agents breaking Missouri law investigated, if not arrested.

He's not going to do it, but that reinforces the point. Loca authorities think Congress can save them. Congress thinks power resides in the local authority. Without co-operation don't expect much. And that's before the Romney/ Murkowski axis.

530 It's been "evolving" for years and O&Joe's administration was a huge part of that evolution. For example, When the Bureau of Land Management seized the Bundy family’s cattle following a trespassing dispute and unpaid grazing fees. (The Intercept did a great follow-up, The Bizarre Story behind the FBI's Fake Documentary about the Bundy Family, May 2017)

It 'works' with the broad authority of many Congressional statutes, "serving" not only Federal agencies but also state agencies and the private sector, as may be appropriate.

As per FBI gov: The FBI is a national security organization that works closely with many partners around the country and across the globe to address the most serious security threats facing the nation. We are one of many federal agencies with law enforcement responsibilities.

Congress has enacted the laws, including the scope of operations, for the FBI and funds same. Congress also has auditing resources, hearings, etc. to know what is or isn't working within the executive branch.

The Federal workforce as a whole is quickly evolving. Again, it's Congress working in conjunction with the administration. The deep state just gets deeper.

531 If someone worked as even so much as a janitor for the FBI then they need to be banned from all future federal employment.

That is the only way to make sure the worst, and most conniving offenders don't infect the new organization.

I have said for a while now that my vote goes to whoever promises to dismantle the FBI. We have seen enough. I don't want any investigations. I don't want any half measures. I want them all fired, and the buildings where their agency once stood turned into social justice homeless shelters so the ruling class can have the joy of the crime they ignored while persecuting their political enemies.

532 CLAIM: The federal judge who authorized the raid on Mar-a-Lago was appointed by then-President Donald Trump.

VERDICT: FALSE. Magistrate judges are not appointed by the president; they are appointed by other federal judges.

Maybe they'll be laxer but the Senate was perfectly content to let most appointments remain empty and block any recess appointments. The highest ranking member of the permanent bureaucracy just runs the department instead.

536 New hires could be direct hires (currently IRS and Labor).

Federal Jobs dot Net, David Scholl, 1/14/22. In part, "Under a DHA, an agency must demonstrate a severe shortage of candidates or critical hiring need. If one of these conditions applies, the agency is free to hire any qualified applicants into a competitive service position without regard to:

the normal rating and ranking process,
the application of veterans’ preference, or
the “rule of three” selection requirement, under which managers may only select from among the three highest-scoring applicants.

Although OPM may independently authorize a DHA for certain positions/locations, it is more common for individual agencies to submit a request based on their own unique sets of circumstances."

Believe it or not, things can improve or get worse. It tends to be cyclical.

537 Keilar asked, “How close do you think that person in Trump’s orbit would have had to be to know these details about where the documents were?”

Mulvaney said, “Really close. I didn’t even know there was a safe at Mar-a-Lago, and I was the chief of staff for 15 months. This would be someone who was handling things on day to day, who knew where documents were, so it would be somebody very close to the president. My guess is there is probably six or eight people who had that kind of information. I don’t know the people on the inside circle these days, so I can’t give any names of folks who come to mind, but your instinct, I think, is a good one. If you know where the safe is, and you know the documents are in 10 boxes in the basement, you’re pretty close to the president.”

538 Arthur Andersen the prominent accounting firm in Chicago was shut down by the Fed's and all employees lost their jobs regardless of position or pension status. Civil Servant jobs should not get special status or privileges. The Fed's set the precedent. Dismantle the FBI.

539 Yeah, who and whose Party? There is less chance of the FBI being abolished or reformed by the Marxist Democrats or Useless Republicans than Obamacare repeal.

And even on the off chance it was, guess who the Democrats have teed up to take it's place. Yeah, the IRS, which already has the power to do a lot of things the FBI can't.

I think the timing of the Trump FBI Panty raid was a red herring. If we had an opposition party it would already be running ads to try and stop the IRS from being expanded. But the FBI raid has diverted attention, and the real threat, the IRS, will be doubled in size. An Army of Louis Lerners.

But if you get enough Eric Schmitts in there things become possible. The Dems played that game for decades until they had a solid voting bloc.

Oh good. As long as conservatives can avoid the coming gulags over the next 60 years maybe the GOP will be in position to defund the FBI.

546 IMO this was an overreach by a rogue DOJ/FBI that functions like the former KGB and the Stasi.

The DOJ/FBI have violated the fundamental principles equal justice and application of justice. WTH about Hillary and Hunter Biden? This is a selective application of the law based on political affiliation that ignores the national security implications - China, Russia, Ukraine, and Iran.

FYI in my 35 year law enforcement career I wrote probably in excess of 1000 search warrant affidavits and served the search warrants.

If I had lied or lied by omission in an sw affidavit my ass would have been thrown out the door.

The FBI knowingly lied and lied by omission in the affidavits 4 times re FISA warrants to surveil two people re an espionage investigation. In fact these warrants were retargeted knowing the warrants were tsinted to spy on Trump then a candidate for President. There are other flagrant actions.

So far there has been no accountability. The American People should be very concerned and demand accountability now! Lest we descend further into third-world banana republic.
