Um, Roberts was already supposedly willing to vote with the majority as far as the Mississippi ruling itself, possibly in a strategic ploy to split off someone from the majority to overturn Roe. He did not join that majority.

The cvcks' message of the day is that Conservative, Inc. is to be credited for this, because the Federalist Society passed names to Trump. And so they should get credit, rather than Trump.

I realized fairly soon that I was completely wrong as Trump proved himself to be far more worthy of trust than pretty much anyone in Washington DC. I went to Halifax for a friend’s wedding a few years ago. The wedding was on Saturday but iI was there for the Thursday and Friday festivities too. Ao I got to meet a lot of his friends and family. Nice people and teated me great. But, to a person they all asked me why Americans allow people to die on the steps of hospitals. They genuinely believe that millions of people are suffering with horrible diseases and dying because it costs $1M for an operation and shit. And if I tried explaining it is all lies and propaganda and 1/2 of medical care is already provided by tax dollars already, they would have none of it. It was a truly bizarre experience.

That was the entire problem with the way the entire issue was handled back with Roe v Wade; rather than let the Legislature(s) hash this out and be poltically responsible for the outcome, the SCOTUS of the time decided to force everyone to obey their rule with no accountability at all. I must have stood in that booth for 10 minutes after voting all the down tickets, still not sure for the top ticket. I still vividly remember the feeling coming over me just before I filled in that vote for Trump. Can't really explain it, but it was the first time since Reagan that I knew, without doubt, it was the right decision. Not sure about '24, but yesterday and today makes me believe the Good Lord had a hand in helping me make that decision in '16.

The "substantive due process" cases are still out there, the ones that gave rise to Roe and Casey. So if a liberal-majority court decides to overrule Dobbs, we're essentially right back where we started. Besides, if Case B overrules Case A, and Case C overrules Case B, does Case A then get resurrected? Maybe.

But I think liberals will take this fight to the legislatures, including specifically at the federal level, and sadly I expect them to find some success . . . .

There's nothing wrong with stare decisis when used as a guideline, not a hard rule. It's purpose is to make sure that the same types of decisions don't have to keep being made over and over again. BUT when a bad decision is in place, then it is the duty of any honest court to overturn that decision.

I would point out that almost all of the memorable SCOTUS decisions in our history ignored Stare Decisis, cases like Brown vs Board of Education.

A major difference is that even Dems freely admitted that Roe was poorly reasoned and tortured the law beyond recognition. They just refused to ever concede any ground because that is their nature.

I wouldn't put it past a future liberal court to try and overturn this, but they would look like absolute clowns trying to overturn a soundly reasoned decision, which will make them hesitate at least.

This decision by the SCOTUS has already ruled those options out. This is now a State Law matter, not a Federal matter.

All the decision decided is that there is no CONSTITUTIONAL right to abortion and overruled existing precedent to that effect. The decision says nothing on whether any government -- state or federal -- can decide to legislatively (or administratively?) provide for abortion rights. If Congress passed a federal law tomorrow saying that women can have abortions on demand, as I read Dobbs it would not prevent that. Now, the law may be invalid for other reasons, but not because of Dobbs.

If I'm not mistaken, if a point of law has already been settled by SCOTUS, and judges contradict that ruling, SCOTUS can actually discipline said judge.

So the idea that new cases will flood in and work their way back up seems a bit overdone.

Frankly, I think even the liberal justices are glad to have this out of their hair.

I agree. The left has a very hard time convincing people of their crazy radicalism, which is why they keep trying to impose it from the top down, even misusing courts to do so.

There is, if you believe polling, a slim majority that approves of abortion in the first couple months when it doesn't look like a baby in the "its okay to eat tuna but sad if a dolphin dies in the process" approach.

But after that, the margins drop rapidly, where people simply do not like the idea of later term abortion.

I agree. Because the 14th amendment says that Congress can make laws to protect "rights" that states do not.

This could be passed as a "Reproductive Rights Bill".

But that's my problem with the "Incorporation Clause" is that all it means is that a dishonest enough faction can pass any requirement over the states by inventing "X rights".

Taney's ruling stated as fact that the founders felt that Negroes had no rights that whites were bound to respect. That was never true even for enslaved blacks - there were slave codes that barred types of harsh treatment for example. Even at the time many, even slave holders, thought that part of the ruling was wrong. But the zeal to 'settle' the issue by making the Republican party illegal did nothing but inflame the situation and destroy Northern Democrats' position of limiting slavery vs Republican's Free Soil non extension into territories.
