The Morning Report — 6/24/22

adamsgabitch.jpg

Good morning, kids. The weekend is here and a few shining examples of sanity only serve to underscore the madness that's on the verge of swallowing us. While the Senate courtesy of 15 venal, corrupt, contemptuous Republicans passed this odious red flag gun bill, now awaiting passage in the House which is I imagine a fait accompli, Justice Clarence Thomas gave us a much-needed victory with the striking down of New York State's blatantly unconstitutional restrictions on concealed carry. It was a stinging rebuke of the gun-grabbers and for sure stole the thunder to a certain extent of their red flag law victory. There is no doubt in my mind that he is arguably the finest legal mind, along with Antonin Scalia, to have sat on the Supreme Court in 60 years. He's certainly is the court's most brilliant defender of the Constitution, bar none.

Thomas wrote, “the constitutional right to bear arms in public for self-defense is not ‘a second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees.’ McDonald, 561 U. S., at 780 (plurality opinion). The exercise of other constitutional rights does not require individuals to demonstrate to government officers some special need. The Second Amendment right to carry arms in public for self-defense is no different. New York’s proper-cause requirement violates the Fourteenth Amendment by preventing law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms in public". . .

. . . Before the concurrent and dissenting opinions, Thomas issued his coup de grâce on any lingering doubts there could be about the right to bear arms under the Second and 14th Amendments.

“We know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need. That is not how the First Amendment works when it comes to unpopular speech or the free exercise of religion. It is not how the Sixth Amendment works when it comes to a defendant’s right to confront the witnesses against him. And it is not how the Second Amendment works when it comes to public carry for self-defense. New York’s proper-cause requirement violates the Fourteenth Amendment in that it prevents law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms. We therefore reverse the judgment of the Court of Appeals and remand the case for further proceedings consistent with this opinion.”

The gun decision was likely written months ago, but it was released, among many other decisions, on Thomas’s birthday.

I don't have to describe the unbridled hatred every anti-American in this nation has for Donald Trump. But their feelings about Justice Clarence Thomas is at a whole other level. Clarence Thomas to them is the embodiment of nemesis. His life, his mind and his soul (no pun) taken in toto is the absolute negation of their entire belief system and as such poses an existential threat to their power, probably more than any other public figure in or out of government.

As you mull that suitcase-sized truth nuke over, look at the reactions coming from the Left. The hypocrisy and projection are absolutely radiant. I'd say it's akin to Veruca Salt being told "no" except that the consequences are absolutely deadly. You know, it's one thing to be a sore loser, as is the case with the concealed carry ruling. Already the crazed calls to either dissolve the Supreme Court or to pack it are coming, er, "fast and furious," shall we way.

But these fiends are even more out of their minds when they win, legitimately or not, as the case may be. See: 11/3/20—1/6/21. These red flag laws give a green light, so to speak, to the government to abuse you in ways that will go way beyond merely seizing your firearms, which is bad enough. There is nothing they cannot do merely on the pretext of declaring you to be a danger to yourself and society. Can you say "pre-crime." And what is the definition of a crime in mirror-universe-USA? Forget about even being duped into entering the Capitol Building by the Capitol cops. How about raising your voice at a school board meeting to protest critical race theory or transexual perverts in girls bathrooms? Or citing proven scientific research linking the Chinese COVID serum to low testosterone? Or opposing the drive to destroy our fossil fuel industry? Or raising a voice against open borders and the actual replacement of the American citizenry with a latin American serfdom (which we are on track to becoming ourselves)? Or that there is overwhelming circumstantial and physical evidence that the 2020 election was at the very least seriously compromised and as I maintain stolen? And on and on and on.

Psaki-Psircling back to the Justice Thomas' majority opinion as well as the reactions from the junta, already scum like Kathy Hochul and Eric Adams are not only strategizing ways to get around the ruling but openly declaring it null and void.

Here's Farrakhan-loving Mayor Nightlife himself:

While nothing changes today, and we want to be clear on that, nothing changes today, we have been preparing for this decision and will continue to do everything possible to work with our federal, state, and local partners to protect our city.

"Nothing changes?" Really? The Supreme Court of the United States of America just struck down your law and declared, no reaffirmed, concealed carry to be legal and constitutional. And nothing changes? How the fuck is that? In theory the declaration of "shall not be infringed" should override everything. In practice, well, that is another story. What this illustrates is just the ugly, naked, will to power that scum like Eric Adams embodies.

Either we are a people united as a nation of just and stable laws, who respect them or we're not. And it will come as no surprise that we are not. We are now officially a mass of people being lorded over against our will by a tyranny that, although a distinct minority of the population, nevertheless control both the instrumentalities of government and the means to impose and enforce its will on us. There is still an illusion of regular order vis a vis SCOTUS rulings, the procedures of government and even elections. But that is fading away every passing day even faster than the price of gasoline is rising. What fucking infuriates me the most about these leftist bastards is their insistence when things go their way that "democracy has prevailed," "our democratic systems have worked," and "the courts have spoken." Jumble it around a bit for the real meaning which is "Democrats have prevailed" and the "Democrat Party has prevailed." Of course, when the opposite happens, it's the greatest catastrophe in history, an abomination that must not stand, etc. ad nauseam.

Let's face the stark reality; America is gone, and we are in some sort of interregnum. To wrap it up, I give you this exchange from yesterday morning's comments (note: do not post responses as you risk an accidental ban-hammer):

Than what is the point? What's the point of even caring about any of this? Why let it bother us? Why even follow political news and blogs? ... Look - I agree we aren't getting what we want any time soon. But, I do believe we can start turning the GOP in that direction. ...

Posted by: Mehive at June 23, 2022 11:40 AM (ky+MF)

++++

And that is where we disagree. I think the GOP cannot be fixed and needs to be destroyed. Beyond that, though, I also do think that the problems are now so vast and so complete that fixing it in general is now impossible. I do think the game is lost. The Republic is dead and is never coming back. The government is enormous, corrupt and unfixable. One of two things will happen over the next decade or so:

The current system metastasizes and we become a fully, top-down, total-control totalitarian dictatorship with no more window dressing. For your vision of the future, see Red China.
The current system fails and the country fractures. The country splits into 4-6 different successor states that have tense relationships.

As to why follow it? Why not? I care about what has been lost, and I care about what's coming.
Posted by: Joe Mannix (Not a cop!) at June 23, 2022 11:46 AM (WWh8n)

And with that we tease a future podcast topic. In any case, it is interesting that even in the midst of all the darkness and insanity that we're all still here, trying to keep it together and preserve our own islands of sanity in the hopes of reestablishing some sort of society that resembles what we had hoped was America.

On that note, being the last Friday of June, here comes the Dobbs decision perhaps a bit later today.

Have a good weekend.

12 Morning, Horde...How goes it?

I started reading C.S. Lewis' The Abolition of Man last night. He absolutely DESTROYS the Leftist mindset through his reasoned argumentation.

Interestingly, he doesn't just rely on Christian ideals, but draws from Eastern philosophy as well. In fact, he calls the source of all morality the Tao. If you reject any part of it (as Leftists do) you have to reject ALL of it. If you accept any part of it, then ALL of it is equally valid.

Great stuff...

America is dead. I happen to think a permanent panopticon tyranny is inevitable. I also think that, as much as the Dems would love to proscribe the GOP, they will allow collaborators like Romney, Collins et al run, while arresting or compromising any MAGA-oriented candidates.

"Elections" will still happen, but will be rendered meaningless ("Red Wave").

And I fully expect Trump to be arrested, jailed and Epsteined. He will not be allowed to die in his own bed.

16 Just as we swiftly passed nation-leading gun reform legislation, I will continue to do everything in my power to keep New Yorkers safe from gun violence.

— Governor Kathy Hochul

In the NYPD's latest statistical release on crime, it found that the number of overall shooting incidents in the city declined in May 2022 compared to last year. Gun arrests in the city so far in 2022 were up 4.4% compared to 2021, according to the NYPD. However, overall crime in the city was up nearly 28% compared to last year.

Admit it Kathy, you do give a flying fuck about crime!!

He is quiet and attentive. His opinions are well-reasoned. He takes his job seriously. He's independent. He's careful. 74 North Carolina Republicans Can Defend Voter ID Law, Supreme Court Rules

Entirely logical that people who WANT to defend a thing should be allowed to defend it. The lower courts ruled otherwise because they knew the AG would tank the case.

75 48 One of the best parts of the 2A decision was the SCOTUS pimp slapping the appellant courts around the judicial parking lot; "Its one step, Bitches, not two, there is no scrutiny in it". The sound of the 9th court of appeals down on its knees whimpering, is a thing of beauty.

You are free to not own a gun of any type. I will not belittle you nor try to change your mind. I might tease you a bit but that's all in good fun.

In return, you shut the hell up about me and my rights. We both keep our rights, we leave each other alone. Win/Win.

79 There is still an illusion of regular order vis a vis SCOTUS rulings, the procedures of government and even elections. But that is fading away every passing day even faster than the price of gasoline is rising.
++++
Those illusions will be maintained, in some form or fashion, for as long as the system survives. When the system fails, its replacement will also have regular order, be it real or illusory. When it's real, it i's more successful. When it's illusory, the system fails more quickly.

But that regular order, real or fake, is what makes it a system in the first place. Elections won't be canceled. That would be disorderly and have lots of negative consequences. Why cancel an election when you can manage one? Even if election management fails, there's always the Deep State and the congressional cabals to keep things on the right track. Why suspend traditional trials and sentencing when it usually goes the right way anyway? The appearance of propriety is extremely important, and it will be maintained. Only when it is maintained can enough people convince themselves that things are okay.

112 I'm going to figure out how to ask the Supremes for a Declarative Judgement on the obvious truth that amendments to the Constitution modify the text of the document which proceed the amendment. For example: the 1A modifies the "necessary and proper" authorization of congress in the main body of the Constitution such that Congress can't use it to write laws abridging first amendment rights. The 2A's much stronger "shall not be infringed" modifies ALL of the main body's government enabling phrases, such as the interstate commerce clause, the taxation clause, etc so that they can't be used by the government to restrict 2A rights. Indeed to declare exactly HOW all of the Bill of Rights modify the main body of the Constitution restricting the government's actions.

Declarative judgements are very powerful, a judge who ignores them may be sued for doing so.

I'm going to disagree on this one. I would have likely cheered it on, but that would have likely added a constraint to Thomas that would have limited him. Better for him to operate without the duties of the Chief on him.

That being said, I'm sure he would have made a fine CJ.

We will see how the Dobbs case turns out, but if Alito's opinion holds, it will be a clear sign that this is the Thomas / Alito Court.

192 I read Mollie Hemmingway's article yesterday. What really pisses me off about it is the absurd double standard in government.

After Trump was elected, he called upon the government agencies and states to work in a special task force to clean up elections. The agencies ignored him and the states told him to fuck off and didn't cooperate. It went nowhere, and disbanded after a couple of months.

Biden's administration, however, can funnel tax money directly to converting the public-facing government agencies into vote-raising operations for the Party's benefit and not only does nobody bat an eyelash, it is met with enthusiastic cooperation.

Notwithstanding that just gives active shooters and criminals more targets, it will be quickly adjudicated and brought to SCOTUS. The NYSRPA lawyers have said so. It's funny to watch people who have left their constituents to the wolves, where shootings by criminals who ignore their "stringent laws" bark about how legal gun owners are going to cause chaos in the streets. They completely lack not only self awareness, but the intellectual and reasoning capacity to determine that protecting yourself is not only a right granted by the constitution, but something people who live in their states need now more then ever because of their grotesque mismanagement.

I don't see that at as a question, I believe that is a fact. Look what happened when Gore was denied the steal. The Left has gone way beyond loud disagreement, they literally murder people and burn down cities as a prelude to the widespread terrorism that would erupt and go unchallenged (if not assisted by the DHS, FBI, DEA, BATFE, the Party Military, et al) if they did not succeed in their key plans.

The early-dawn SWAT raids and the Stalinist political prisoners (J6) are not just threats and warnings but promises to run over anything that gets in their way.

But, once they go down the "Ultra Federalism/Lawless Road" that door opens for all sorts of things.

312 252 Further support for JJ's supposition that we are post-American republic- I don't remember any previous DOJ publicly announcing anything other than full support for a SCOTUS decision.
Posted by: Farmer Bob at June 24, 2022 08:46 AM (r2JRj)

I love JJ but "post-republic" woefully understates the case. We are a totalitarian police state now. The police state apparatus, and the DOJ is a particularly nasty and despicable component, is the law. Congress has deferred totally to this reality and is theatre.

I agree with Joe Mannix. This ends in a full-throated, Soviet-style dictatorship or in dissolution. Obviously the latter, if peaceful, would be the more desirable. I don't know about how peaceful it will be, but that is the most likely outcome. A state soon will refuse to recognize federal authority or "law" (a Red one, Blue ones already do so), and it begins.

The Senate Republicans who supported the gun control legislation recently were just acknowledging they are powerless puppets and doing what the police state apparatus expects. We kid ourselves each time we vote. Dictatorship is here, far worse than Putin.

313 What effect, if any, comes from wishy-washy concurrences to SCOTUS opinions?
____________

Concurring opinions are not binding precedent, as majority opinions are. If you're citing a concurring opinion in your argument, you have to indicate that in the citation. Concurring opinions can be cited as persuasive precedent, and in cases where there is no binding precedent on an issue, lawyers will sometimes use concurring opinions to try and convince a judge that this is the way they should go.

Even Obama claimed that collecting taxes was a way to punish, hurt and manipulate achievers, that the fe'ral government can just print whatever they want and tax via inflation and debt.

Income taxes are a vector of the government to hustle for campaign contributions, manipulate and control businesses and people and to be a constant reminder that you are chattel and can be arrested, thrown in prison and made bankrupt at any time. That is why the tax code is deliberately obfuscated.

Thank you for that Joe Mannix (and to J.J. Sefton for promoting his comment).

This is where I have been since December 11, 2020. When the SCOTUS rejected the Texas lawsuit. Up until that point, I was foolishly holding out hope that those Twitter lawyers with all their "release the Kraken" bullshit, as well as the claims for a reversal of the election results by state congress votes, would prove to be feasible. When the lawsuit was rejected without even addressing the massive amount of proof of rigging and fraud, I gave up all hope for this country.

In my eyes, in retrospect, I see the country was killed in March of 2020 with the execution of the Plandemic. It was then buried in November of 2020 with the steal of the election. January 6th was simply the tyrants in control dancing on the grave of the nation.

But yeah, I still keep up with the descent of the nation into further tyranny so I can be informed and aware of the coming horrors. And try to warn friends and family with this knowledge, if they bother to listen to me at all. Most do not and just think I am a conspiracy idiot.

This is certainly true at the company I work for. We were looking to add 4 FT positions (we only have 25 employees now so that's a lot at once) and that's all quietly been dropped. Latest word is that "we are not looking to hire at this time." Just 3 months ago the president of the company personally told me we were hiring 4.

I don't disagree with any of that. It isn't Congress doing this, it's the Cabinet. Congress, however - and especially Republicans in that (snort) august body - doesn't need to be providing cover and support and "bi-partisanship" to them.

383 If we go to war with Russia we'll lose at least 10X that...and in weeks not in decades. And that assumes it does not go nuclear.

That is so last century thinking. Foreign entities are now in control of our electrical grid, they also do almost all of our shipping, we are very dependent on foreign sources for food and energy. (eg. Go ask a produce manager at a grocery store where their food comes from - almost all of it is imported from somewhere where their crops are in season)

The new war in America has been going on for decades. Your politicians hate you and are total puppets of foreign enemies. The Colonial pipeline was just a shark bump, if the Feds could do it, so can the much more sophisticated Russians when it comes to cybersecurity.

Russia doesn't need to kill 10x soldiers "over there", they can just shut down the grid Right Now and kill tens of millions. But they don't have to, they have domestic politicians doing it for them already leaving no fingerprints to the crime.

The riots in the summer of 2020 prove this. They were state-sponsored terrorism against the populace reminiscent of the first Great Terror in the immediate aftermath of the Bolshevik Revolution.

Garland can do anything he wants with impunity. The House might impeach him, but the Senate will not convict because "that's now who we are." The truth is they either are blackmailed or onboard or both. The GOPe simply has bowed to the reality that all power is vested in the national security state and members of Congress, senators and the president are just window dressing.

The upside is the United States is dissolving. The downside is it will be hell.

Because we theoretically are going to transition away from gasoline.” But the problem is, there was a “misjudgment as to how long of a transition it was going to be and what we needed to do to make the transition work.”

Rattner stated that “refining capacity has gone down” due to refineries shutting down since the pandemic, but “the rest of the ones that are left are running at full capacity.” And “As much as can be refined is being refined.”

Where in CA? According to a quick web search, the average residential electricity rate in CA is $0.1534 per kwh, vs. $0.1135 in AZ. So assuming averages, your AZ price is about 26% lower than it would have been in CA. That will pay for a lot of air conditioning. Mine is right around a dime.

469 there was a “misjudgment as to how long of a transition it was going to be and what we needed to do to make the transition work.”
______________

These dipshits just decided that since they don't like fossil fuels, they'd just "transition" the country out of them by shutting down/hampering production of fossil fuels.

But we don't have the infrastructure set up that can meet our energy needs with electric or wind or solar or unicorn farts or any of the other wet dreams the left has.

So their "transition" isn't working, because there isn't any ready alternative energy to "transition" to. Meanwhile, these f*cking assholes have caused all energy prices to skyrocket, and they're bankrupting lower-income people and destroying our economy.

Top Men! The adults are back in charge! Restoring competency to our government!

I've said before and I'll say again - this is by far the better site for content than HA. But, at HA there were more single-subject posts and because the comment system let you reply directly (i.e., your reply would show up under the other person's comment and you'd get a notice if someone responded to you). And you could keep commenting on "old" posts - it allowed for deeper and longer conversations on specific subjects.

Whereas here it's scattershot - you have to search to see if anyone responds to your comment and then a new post goes up and the conversation is over.

Again, before everyone hates me - I admit the content here is far better and the commenters are great - but the comment system sucks - doesn't allow for very fluid conversations.

I don't think it was the move to FB - it was the movement further and further left will still calling themselves a "conservative blog".

Half the fun in commenting there was constantly pointing out how far left they had moved and providing examples (of course, the writers at HA never engaged in comments - they were far too afraid to do so). I think they went to a membership system to try and fight that - believing that those who point out that they are all leftists now wouldn't pay and that the commenters who would pay would be sheep who still believe they are conservative.

The reason McConnell and the GOPe went along with putting conservatives on the court and keeping Garland off the court is that it was an easy gift to give conservatives that did nothing to really stop their true agenda.

The Courts don't stop the left's agenda in congress very much. A hiccup now and again - like this latest 2A decision - but overall the Courts don't do anything about illegal immigration, globalization, etc. that the Uni-party wants.

So, the GOP figures it'll give us conservative justices and keep conservatives voting GOP. It doesn't hurt their agenda and costs them almost nothing politically. That's their one sop to us. And we eat it and think it means something. When it's really just p****ing in the wind for the most part.

But the GOPe entirely supports using the FBI and DOJ against MAGA and conservatives to keep us in line.

And a follow-up to that - don't expect the Courts to save us from the DOJ and FBI - it will take years for cases stemming from this stuff to wind their way up to SCOTUS. Even if, for instance, ultimately SCOTUS finds that it was unconstitutional to arrest Clark yesterday and he wins a civil case and gets awarded $$$ - it'll be years from now and the damage will already have been done. It won't reverse anything.

Looking to the Court to protect the Constitution means almost nothing when Congress and all the agencies completely ignore the constitution.

You'll never get Rubio out with just Democratic turnout in Florida we need Republican moms to turn on him for voting against the gun safety bill.

530 The gun bill was passed by the entire GOP Senate, make no mistake.

McConnell gave Cornyn the green light to go ahead with the sell out. This is not the first time McConnell has lied and stabbed the voter base in the back.

The entire GOP senate caucus keeps electing McConnell to leadership, and Cornyn wants his job. If the rest of the GOP senators were serious, they would call for a vote of no confidence in McConnell and elect someone else.

They won't, so the conclusion is, the every GOP senator is fine with this.

No; I really think that whatever her liberal views were, RBG would not support the threatening of the lives of Supreme Court Justices or bombings of churches and right to life centers. Not everybody who is a violent lunatic.

533 Zeroing out the agencies budgets. What exactly does that mean? Shutting them down and sending everyone home? I think their appropriations are directed to a degree the money is already in the pipeline for this year. The appropriations are approved by different committees. The time it would take to shut them down or even get them throttled back would be years, I think.

535 I'm assuming it's zero based budgeting. You justify your annual expenses, not get X amount and go on a spending spree so that you don't "lose" money next year.

Account for every pencil, desk, chair, and employee every year.

I think McConnell blocked Garland so he could give Hillary the gift of replacing Ginsburg with a female justice.

He also thought Trump would lose.

Not every liberal will voice support for such things - but the lack of the dem establishment, media, etc. being "outraged" by the BLM riots, the Antifa antics, and now this - and the fact that the left voters don't hold anyone on the left responsible for allowing these things to continue (and in fact encouraging and condoning these things) - tell us that most leftists tacitly support violence for political purposes even if they themselves won't engage in the violence.

Sure, there are a few who will vociferously say this is wrong - but that is the very small minority of the left. The same way there are only a very few who will defend free speech.

the left has completely turned. they are no longer in favor of anything remotely American.

That is possible - it was a "win" for McConnell either way blocking Garland - gives him cred with conservatives, and if Hillary wins - he can give her that gift.

but I'm talking about the overall effort by McConnell to appoint conservative justices.

I doubt very much that McConnell gives a whit about conservative judges. If he cared so much about the Constitution - he wouldn't have OK'd this gun control deal. Or many other things he OKs.

He sees appointing conservative judges as an easy gift to conservatives that costs him little politically and doesn't hamper his true agenda (i.e., uni-party globalism).

And, conservatives eat it up. I don't know how many arguments I have with other conservatives about McConnell and they always back him and say "look at what he's done for the Courts" - they don't see the bigger picture. They believe he is actually doing something that matters.

The Courts barely matter anymore. Do you really believe NY state is going to start issuing concealed carry permits just b/c the Court told them to? And, quite frankly, any good result at SCOTUS will be easily overturned once there are 5 liberal Justices (which will likely happen sooner than we think considering the violence of the left). And while Roe will be a great victory, it does nothing to save our republic.

And even if NY follows the decision - it's a pretty small victory considering everything else congress does to destroy the country vis a vis illegal immigration, border security, sending money overseas, hampering energy production, etc.
