The dissent cites statistics on children and adolescents killed by guns, but what does this have to do with the question whether an adult who is licensed to possess a handgun may be prohibited from carrying it outside the home? Our decision, as noted, does not expand the categories of people who may lawfully possess a gun, and federal law generally forbids the possession of a handgun by a person who is under the age of 18, 18 U. S. C. s.s.922(x)(2)--(5), and bars the sale of a handgun to anyone under the age of 21, ss.922(b)(1), (c)(1).1

Do we just have "negative rights", ie, what the government is forbidden from doing, or do we have "implied" positive rights? There are close to half a billion guns in private hands in the US, and guns don't just expire like milk. There are plenty of examples of abused 150 year old guns that still fire, and they were inferior in metallurgy and construction to modern guns when they were made. See my point 2 for starters. A 5-4 can easily be overturned with a switch in one vote. A 6-3 needs at least two. That makes it better.
Finally, were Roberts to sign onto it, it would sort of be an acknowledgment by Roberts that he has no control over the Court. It would be the Thomas / Alito court.

The leading clause makes perfect sense when you account for the fact that we were NOT supposed to have a standing army.
We can argue over whether or not we needed one / were going to need one.
But. That clause is there for a specific reason. Once we had a standing Army, the clause was obfuscated on the Federal Level.

The 14th amendment made it clear that Congress could make laws to protect the rights of citizens as it saw fit.
So, from the 14th on, it can intercede in state affairs.
I don't know how this was ever taken up by the courts, but the courts are not the same type of reversible body that Congress is. And that's probably the reason the progressives chose to overrule the people through the courts.

Interestingly, I've seen a LOT of lefties argue that this or that gun law is not an infringement. It took me a while to realize they didn't know what the word "infringe" meant.
Most of them seem to think it means something like "completely removed." As in, as long as you allow people to have some sort of gun, no matter how small, impractical, ineffectual, etc, your right hasn't been completely removed.

Not precisely a correct understanding of it. The Courts can intervene in state affairs(such as the current SCOTUS ruling), but the 14th doesn't actually provide any provision for congress to do so.

I think one of the Article 1 sections say that states must have a democratic form of government. This would mean that the Federals could intervene if fraud and the like made that arguably not the case. Like we have now.

See, we have three branches, judicial, legislative, and executive. When congress passes a law, it grants power to the executive to enforce it and to the judiciary to determine when and what enforcement is appropriate. The 14th amendment is a law, giving the judiciary the ability to determine when and where it is appropriate for the executive to intervene and uphold it. The legislature did not expand its power there, as written.

Yeah, I'm going from my understanding of how the 14th amendment became the "Incorporation principle". And it seems that the 14th gave Congress the power to intervene, but perhaps it was thought that Congress should only intervene when given the judgment of a review in the courts.
That might actually have been a valid restraint, although, now it just takes a handful of judges to "overrule a state", and not a majoritarian process that would test how motivated is the entire government in righting this wrong.

In all fairness, we probably could have told them the same thing when Trump was president and some of them thought about blowing up the Whitehouse and being the next John Wilkes Booth, and holding up severed heads of the enemy.
Because they were all ready to stop complaining about every little thing they didn't like about a president who had yet to be able to do anything yet.

It's written like other parts of the Constitution in an almost boilerplate fashion but being in an amendment could potentially even be taken to overwrite the amendment process in narrow circumstances. I can see why it was written like that and why it has been misused.

If there is ever five ultra-Progressive Justices on SCOTUS, I would not be surprised if they started using the 14th Amendment to declare almost all the rest of the Constitution un-Constitutional. All they'd need is cases they can take. Those would soon be coming. The five Prog Justices would become a Constitution re-write committee.
