The very design of red flag laws is to remove due process protections. You forgot to mention that Randy's order was done one-sided in a court process to which he isn't privy, standards of evidence vary, 1/3 of orders are wrongly issued, and Randy foots the bill.

Noted Moronette Alexthechick wrote about just that problem a few days ago.

Like many people, Alexthechick plays a lawyer on Twitter.

Like far fewer people, Alexthechick also plays a lawyer in her day job as a lawyer.

That last part is the tricky part that the Twitter Lawyers usually don't bother with.

Sorta Twitter Law School - let's talk Red Flag Laws and ex parte orders and due process and how anyone who tells you don't worry, the process won't be abused and there are robust due process protections is, at best, wildly naïve and, more likely, is lying to your face.

Your legal vocabulary term for the day is ex parte - this means without party in Lawyer Latin. An ex parte order is one issued without both parties being present. There are valid reasons for this. In matters where time is of the essence, courts need the ability to issue orders.

This is to protect the person, property, or rights of another. To move it out of interpersonal matters, in civil litigation an temporary restraining order may be issued for documents or items to be preserved because the other side might dispose of them before suit can be filed.

Ex parte orders are needed due to human nature. Sometimes things need to be done quickly and courts are not designed for speed. Make no mistake, though. The due process protections for the party against whom the order is issued come into effect after the issuance of the order.

To show the potential issues with Red Flag laws, I shall discuss what happened to a client with the issuance of a protection order against him. He had an ex-wife who was bipolar and who refused to take her meds. She continued to harass him years after their divorce.

She showed up to court with a black eye and said he punched her in the face. She sought a protective order against him, which the judge issued. She also filed a criminal complaint for assault against a woman. The protective order statute requires gun confiscation until hearing.

Client leaned about this when the police showed up to serve him with the order and summons for court appearance. He was stunned by this not only because he didn't hit her but because he was out of the state on the date this supposedly happened. The told the police this.

The police shrugged and said we're just here to serve you and get your guns. That is true. The cops do not adjudicate, they only do what the court says. So he turned over his guns and then got in touch with us later that day. Boss [I assume this means alexthechick's boss at the law firm] and he were long time friends.

Boss told him to get together every bit of documentation about him being out of town, hotel receipts, meal receipts, any video of him at the gathering he was attending, all of it. Boss also got in touch with the DA and said he was out of state, he couldn't have done this.

DA said I'm not dropping this but move to dismiss and we'll hear both motions at the 10 day hearing on the protective order. So we filed the motion to dismiss and motion to consolidate and then Boss went to the hearing. The crazy ex didn't show up to the hearing at all.

Boss presented everything to the judge. Judge told the DA withdraw the charges or I'm dismissing. The DA said fine, I'll withdraw. Now, it's better for the stats on the DAs side to withdraw then to have the case dismissed. Judge also refused to extend the protective order.

Client asked where do I pick up my guns. Judge said you have to go through the paperwork to do that. We'd anticipated that so we had the forms ready and the judge signed the forms. Client said where do I pick them up and judge said this has to be processed, it'll take three weeks

Client also asked the DA when the hearing would be for the ex's perjury charges. The DA said what perjury charges? Client got very upset because it was obviously perjury, he wasn't even in the state, she provably lied, that's perjury. DA said no we don't charge in these cases.

Three weeks go by and client starts calling the sheriff's office to get his guns back. He keeps getting the run around. Boss had to threaten to go back to court to get an order compelling compliance. When client picked up the guns, his Mossberg shotgun was gone.

The sheriff's office initially denied that he even had one, luckily he'd kept a copy of the inventory. It took seven months for him to get reimbursement for the Mossberg. The sheriff's office never did say what happened to it other than there must have been a mix up.

While all of that is going on, client was looking for work. He had two interviews that went well and he was told that he would be offered the job once the background check was done. Both jobs retracted offers after the background check came back.

So we had to get copies of the background checks from the background check services. Sure enough, due to how the database on the state side was maintained, the data scrape pulled the protection order and the charge but the dismissal wasn't showing up yet.

Client now had to decide if he wanted to disclose to a potential employer that, hey, I have a crazy ex who claims false things about me, here's a copy of the dismissal paperwork or if he wanted to wait the five weeks it would take for the dismissals to propagate through the dbase

Also the dismissal paperwork on the criminal charges was marked dismissed due to failure of complaining witness to appear. That said nothing about she lied about this entire thing. Boss had to explain the situation to an employer who, thankfully, listened.

Because they were friends, Boss handled this at a very low rate. It still cost the guy $2,500. If it had been at Boss's standard rate? Well over $10,000. All for something that was an actual lie. But but but alex! Due process! It worked! Sure. In theory, it did.

The protection order was not renewed. The criminal charges were dropped. He got all but one of his guns back. He got a job, eventually. It all worked. Sure it did. All it cost him was $2,500, months of his life, humiliation during interviews, and immense stress. For a lie.

She was never charged with perjury. There was no point in suing her since she didn't have any money. If you think that this won't happen with Red Flag laws, you are suffering from disordered thinking and, hey, isn't that a red flag? /fin

One thing that Matthew McConnauhey mentioned in that overly-praised speech at the White House about red flag laws -- which the media has not seen fit to repeat -- was that we needed prosecution for "abuse of red flag laws," in order to keep the red flag law credible and not just a tool of harassment and abuse.

He mentioned red flag laws and prosecutions for abuse of red flag laws as a package deal. You can't have one without the other.

No one seems to want to have any interest in charging those who perjure themselves to deprive others of their civil rights, though.

So: Pass.

Senate conservatives, which apparently do exist, are pushing back against slender-shouldered gentry liberal John Cornyn and the Democrat Wing of the Republican Caucus, reports Axios:

Frustration inside the Senate GOP conference is boiling among conservatives at the way Sen. John Cornyn (R-Texas) is handling the bipartisan gun reform negotiations -- putting the man who aspires to succeed Mitch McConnell as Republican leader in a political jam.


Why it matters: Some senators are viewing these negotiations as a test case for how Cornyn would fare as lead negotiator for the party should he replace McConnell one day.

Driving the news: Multiple sources with direct knowledge say the GOP senators who are uneasy about the negotiations include Mike Lee (R-Utah), Rick Scott (R-Fla.), Ted Cruz (R-Texas), Josh Hawley (R-Mo.), Tom Cotton (R-Ark.), Rand Paul (R-Ky.), and Mike Crapo (R-Idaho), among others.

Between the lines: Several senators feel they've been shut out of the negotiating process and kept in the dark about crucial details, and will be asked to take a politically tough vote without enough time to digest the bill.

One GOP senator, speaking to Axios on the condition of anonymity to be candid about his concerns, branded Cornyn's approach: "Shut up, and vote."

"There's considerable unhappiness in the conference that we seem to be approaching a bill that will unite all the Democrats and divide the Republicans," said another senior Republican with direct knowledge of the internal talks.

The senior Republican mentioned that Sen. John Kennedy (R-La.) asked Cornyn during one lunch, "Are we focusing on gang violence and inner-city murders? And the response was, 'No, we're not focusing on that' ... And more than a few of us wondered why the hell not?"

"It would be prudent, and I think Sen. Cornyn knows this ... it would be prudent to give senators plenty of time to read the bill and research the issues," Kennedy told Axios.

Schumer -- and Cornyn -- want to rush the vote as quickly as possible, allowing for no research, debate, or consideration.

And, as you all know, anyone who rushes you into a decision with long-term irreversible consequences while emotionally bullying you and telling you not to research the facts or examine the legal language is, of course, someone with your very best interests at heart.

The "DECIDE NOW WITHOUT ANY FACTS!" cancel campaigns on Twitter should have taught us that much.

I understood your sarcasm. I just responded with my genuine wish that the red wave does appear and makes changes at the state level.

The Fed GOP is a wasteland and will do nothing positive. It may prevent negative things from happen, but that's the most we can hope for.

Positive action can only come, at this point, from the state level. If we're going to have a red wave, I want it to have positive effects.

46 AtC's thread needs to be provided for comment for every proponent of red flag laws. What recourse does somebody who is falsely accused have to restore their name, be made whole (in terms of time and money spent in their defense), and to punish/deter false accusations?

If they cannot provide concrete steps to rectify these problems, then to hell with them. And no, "Well, that's a rare occurrence" is not an acceptable response.

Further, the return of weapons need to be as quick as the seizing of the weapons. If a weapon is lost or takes longer than is allowable, then the police chief needs to be held personally liable for compensation, and is barred from being reimbursed by the department.

Gun waiting laws do the same thing. Woman has crazy ex, she tries to get a gun, must (in Kali) pass tests, get certificate, then wait before she can take posession of gun she bought. Nothing bad EVER happens in that scenario.

I know of a case in Kali where a restraining order (total BS) was used to kick a guy out, but before that happened, the sheriff came, and gave the guns to his son WITHOUT verifying he was even allowed to have firearms or not, and NOT making sure they were secured in his car trunk correctly (they were not; ammo still in magazines in the weapons). Kinda reminds me of the episode of the Simpsons where Homer and Barney were coming back from the Duff Beer factory, and Homer was arrested for drunk driving, so the town drunk Barney drives off in Homer's car, allowed to by the police.

My sense of it is the GOPe is playing the Dems to enhance their electoral chances in November. The issue kills tons of Dems in competitive races for the benefit of GOPe and Trumper candidates by encouraging the Dems to reveal themselves in order to motivate their voters. The GOPe knows they control the Supreme Court and knows that Red Flag Laws are not Constitutional. That Schumer and other Dems are now on record encouraging assassination of Judges the GOPe knows that even squish Roberts will squash this law, toot sweet. So its just a rope the dope gambit to them. Legally, the judge *must* approve the petition, unless there are some glaring holes in the reason provided. The defendant has no opportunity to defend him or herself, so there's no reason provided for the judge to disbelieve the accuser. Ergo, all the evidence available to the judge aligns with the accuser's claims. So the judge is forced to rule based strictly on that evidence.

This is basically NJ gun law. Everything is written to make gun ownership perilous. E.g., it's an open question whether stopping for gas and snacks on the way to the range with my kids is violating the statutes prohibiting transport of weapons except for a narrowly prescribed set of reasons.

I stop for gas and snacks. But I am waiting for the day some cop pulls in behind me and sees the rifle cases through the back window of the van.

This is bullshit. My son's black friend in HS dropped his 9mm pistol he was packing in his baggy pants on the gym floor during a basketball game. He never got punished for it. Zero Tolerance of Guns on school grounds is a myth. Today the faculty is all about making such infractions go away so the deserving yout can attend college. BTW, my son's black friend murdered his cousin over an argument on who was going to wear the new basketball sneakers. He's now in jail. His rap sheet has over 90 entries in it and he's 20. There are a lot more than two Americas when it comes to the law.

There will never be anything more than lip service to safeguards for red flag laws. They can promise to prosecute false reports, it will never happen. They don't prosecute perjury and very rarely prosecute people that make false reports of crimes.

The most unbelievable element of villain behavior in "Atlas Shrugged" was that only one person - Floyd Farris - recommended the wholesale slaughter of people and he was excoriated for proposing it. 368 Ace, your website is exhibiting a disturbing behavior. I mentioned it the last time it happened, which lasted (for me) about 48 hours.

When I go to your website on my PC (any browser, using Windows 10) it's activating my webcam. Unlike last time, the behavior does not stop when I exit the browser - it requires a full restart.

371 Anyway, the optics (lol) are that recent murders are due to some failure of Republicans to do something (we're never specifically told what and why, just insinuations and propaganda) and now finally Democrats have pressured the Republicans into doing something™.
Stupid, isn't it? But by cooperating Republicans are lending credibility to this story.
I guess they really like such optics (lol).
