Disaster for Democrats As Judge Strikes Down Their Highly Gerrymandered New York District Map

Democrats spent 2021 doing two things: 1, complaining piously about Republican congressional gerrymanders (a "gerrymander" being the redrawing of congressional district boundaries in a census year to favor one party or the other), and 2, drawing the most grotesquely partisan and bizarre gerrymander borders imaginable in the states they controlled, especially in New York State.

The map was so bizarrely gerrymandered it raised eyebrows all over the country.

Democrats had been counting on this masterpiece of non-Euclidean geometry to offset some of the pickups Republicans would see around the country.

Even the New York Times was a bit stunned by the Democrats' brazenness:

New York's new congressional map, redrawn by ruling Democrats, gives the party's candidates a clear leg up in nearly every corner of the state and could knock out as many as five Republican seats.

But when party leaders in Albany introduced the proposed lines on Sunday, many onlookers quickly seized on what seemed to be a singular example of mapmakers' partisan excess: a freshly drawn district now held by Representative Jerrold Nadler, a powerful Manhattan Democrat.

Indeed, with its serpentine shape, Mr. Nadler's reimagined district -- New York's 10th -- is almost comically contorted and overwhelmingly favors Democrats. It stretches 15 miles through 15 different State Assembly districts from Mr. Nadler's home on Manhattan's Upper West Side to Brooklyn, jumping over New York Harbor and making three sharp turns to take in small strips of Carroll Gardens and Boerum Hill, before broadening out to encompass all of Prospect Park, Borough Park and Bensonhurst.

Screenshot (2205).png

By the way, if the current district also looks oddly-shaped -- well, that was also gerrymandered for the Democrats' benefit.

Baffled onlookers and partisans alike quickly dubbed it a "Jerrymander," playing off Mr. Nadler's name and the term long given to the practice of politicians drawing favorable political lines for their party's advantage.

Republicans, known for their own gerrymanders in other states, gleefully shared screen shots of the district to accuse Democrats of hypocrisy.

They were not alone. "This is why people don't trust politicians," wrote Pat Kiernan, a local morning news anchor on NY1, on Twitter. "And the Democrats have given up any high ground they had over Republicans on gerrymandering."

The map was also drawn in this crazy snake-like way to avoid a more natural map which would have the unwanted effect of pitting two long-serving Democrat hacks against each other -- Nadler of the Upper West Side vs. Carolyn Maloney of the Upper East Side.

But a judge threw out the map approved by hack corrupt governor Hochul as too bizarre and partisan to be legal, and substituted its own map.

The new map, drawn up by the court's special master, combines the Upper West Side and Upper East Side into a more geometrically sensible bloc. (Also ethnically uniform -- now it's almost all super-wealthy white ultra-liberal Karens, with some minority-dominated projects and student housing mixed in.)

And so Nadler will be forced to battle Maloney in a primary.

And also puts a lot more New York districts into play for Republicans throughout the state.

Democratic efforts to gerrymander New York's congressional districts in their favor backfired spectacularly on Monday -- forcing the party to eat its own for survival.

Three imperiled Republican seats appear to no longer be in jeopardy and one of two powerful New York Democrats will be out of a job, under new district maps unveiled Monday by a court-appointed expert.

US Rep. Nicole Malliotakis (R-Staten Island, Brooklyn) saw her district redrawn by special master Jonathan Cervas of Carnegie Mellon University to no longer include the heavily Democratic area of Park Slope, former Mayor Bill de Blasio's Brooklyn neighborhood.

Two other districts upstate that were configured by Democrats in what Republicans dubbed Gov. Kathy Hochul's "Hochulmander" were also redrawn by Cervas to remain more GOP-friendly.

And in a stunning move, Cervas redrew two districts represented by entrenched Democrats in a way that now pits House Judiciary Committee Chairman Jerry Nadler (D-Manhattan, Brooklyn) and House Oversight Committee Chairwoman Carolyn Maloney (D-Queens) against each other.

...

Democrats now outnumber Republicans, 19-8, in New York's congressional delegation, which is set to shrink by one due to changes in population nationwide

The gerrymandered districts were expected to boost the Democratic edge to 22-4 but Monday's proposed changes -- combined with widespread expectations of Republican gains in November -- could narrow it to 16-10 or less.

RedState points out that the Democrats were counting on the New York "Jerrymander" or "Hochulmander" for their national ambitions.

A court-ordered map in New York has been adopted, and it's lights out for Democrats heading into November. While the original Democrat map, which was struck down by the state's Supreme Court, had a likely outcome of 22 D-seats to 4-R seats, the new map puts as many as 12 seats in play for the GOP.

Screenshot (2203).png

It seems unlikely the GOP would get many W's in NY, but just blocking the Democrats from picking up the seats they expected from the Jerrymander/Hochulmander is good enough, given the GOP expects a lot of W's elsewhere.

It's not all bad news for Democrats: Red Bill DiBlasio says he's going to run for Congress in the redrawn 10th district.

Also, NY is an expensive place to run ads. Really expensive.

They went from only token resistance to needing to defend, what, 10 seats? In NY?

That's tens of millions of dollars that needs to go right there instead of places like FL, GA, or TX. It's made the wipeout much worse, I think.

While the original Democrat map, which was struck down by the state's Supreme Court, had a likely outcome of 22 D-seats to 4-R seats, the new map puts as many as 12 seats in play for the GOP.

Nice to see some good news on this front. NC's redistricting will see a change from 10-3 R's to 7-6 R's. Paying for our grandfathers mistakes from 60 years ago. *spit

The Republicans refused to show up after the first map got rejected by the state legislature, meaning there was no legal method for a new map to be drawn. The state court took it upon itself to draw a new map since the state constitutional amendment had no provision for what happened in that case.

It isn't effective and results in defeat. Basic game theory proves this out time and time again. When hit, you hit back (tit-for-tat). If two players at a table and one follows the rules and the other cheats and both players discover that about each other (this is the situation we are largely in), if the rule-abiding player continues to play by the rules, he will lose. 100% of the time. The rule-abiding player must either quit the game, or punch the cheating player in the nose until he cuts it out, or he needs to start cheating. Any of those approaches *might* result in parity, but continuing to play by the rules *will* result in defeat. Every time.

And this victory is, in a way, the "quit the game" approach. The Republicans refused to participate in the quorum, which in part led to this being handled in the courts.

94 Democrats blatantly violated the state constitution, hence the courts ruling. Even they couldn't escape the clearly obvious subversion this map represented.

To produce this map Democrats completely ignored a constitutionally mandated process that required a bipartisan commission to redraw districts. That process was created through a statewide ballot issue which the citizens voted on, overwhelmingly approved and amended the state constitution to codify. Democrats simply ignored any input from Republicans and steamrolled the process, hoping one of their hacks posing as a judge would save them. Nope, even they knew that approving this would completely undermine what little credibility they already have.

You always have to make questionable decisions when redistricting. It's the spoils that go to the winning party. For a long time people have realized that 1) the committee has to be selected by a group of laws, 2) the committee has to be able to make its decisions, despite there having been alternatives that might be argued to be optimal (but just argued). And influence will probably distort some of this.

It's just that recently, the Democrats, the remarkable special-pleaders that they are, argued that Republican-led redistricting was especially odious, and they could put their "Certified Racist" stamp on it.

It's just like know how all of a sudden Florida is the only state that refuses textbooks ("censors" them to the illiterate left), because they think that makes a good argument.

If those specific rules were not in place, I'd have little moral issue with NY going haywire with their maps. If the NY GOP wants to cede everything to Democrats for decades because they hate conservatives more than they hate Democrats, then they can reap that reward.

Have to make sure that the Portland crazies have an impact on as many districts as possible.

161 Ask 100 Democrats what is gerrymandering, 95 will say it’s when Republicans draw maps to keep brown and black people from getting fair representation.

But the secret to a successful Republican gerrymander is to carve out as many minority districts as possible, and pack the D's into those districts.

Then make the districts in the rest of the state 55 R/ 45 D.

164 One of the hardest things to do when faced with evil and injustice is to be patient. In time, all such systems and governments collapse, its just rough to live through them while they are active. We are properly called to fight against evil and to oppose injustice, but we should not stoop as low as our foes and lose sight of what we're trying to accomplish.

In frustration and outrage it is easy to focus on the evil of our enemy and the need to defeat them at the expense of the very principles and ideals we are fighting for.

171 The problem is that there are no objective metrics as to what constitutes a reasonable district. It's all somebody's subjective preference. This won't stop until a computer draws the districts. I hear a company named Dominion can handle it.
Posted by: Archimedes

There are a few objective metrics -- compactness (minimum distance between all parts of voters in district), natural boundaries (rivers, etc.), commonality of interests (i.e., urban v. rural v. suburbs), continuity (all parts of district are connected at some point with rest of district) and preservation of core of prior district.

5 - Repubs go to court and a judge in the Supreme Court (actually the lowest of the three levels) tosses the Dem's map, saying it violates the NYS constitution's requirements for these districts to be reasonably compacted and not draw to give one side a partisan advantage over the other.
6 - Dems appeal to intermediate appeals court, which upholds the lower court ruling 3 to 2 (Dem holler because the 3 were two Repubs and one Dem, the other two judges are Dems)
7 - it's appealed to the top court, which I believe ruled unanimously to uphold the original ruling to throw the map out. I think these judges are all Dems. The top court then gives the job to this guy Cervas, who has apparently done this for states and regions all over the country.

198 btw, what happened in the Florida case this morning *was* in Federal Court; so it's useful to know what that case is about. Federal Circuit Judge Mark Walker had issued an injunction against it, a Federal appeals court has now blocked his injunction. Walker is a far left Obama Judge, and his ruling was very unlikely to stand, since he justified it by writing in his ruling that the Florida Legislature was so obviously racist that no actual proof was needed. (or words to that effect) He also included, in his ruling, a long diatribe about how racist and worthless the current Supreme Court is. (it was a real crank opinion)

The SCOTUS has said political gerrymandering does not violate the Constitution, but racial gerrymandering does. So, leftists have been claiming that all plans that they don't like are RAYCISS!!! But it looks like that old game is falling apart for them.

LOL. The program eliminated the two black state senate districts in central Portland.

But for federal seats, what happens in NY affects people in UE other 56 states as well. Could NY just issue a law that every seat will be Democrat? I means it’s state law right?

Standard SCOTUS answer, which I hope we will start seeing a lot more often - "It does not matter what the political result is, it only matters what is in the Constitution."

And what has happened her is that even NY has to live up to its own constitution. As to the case where a legislature has passed laws granting themselves power in perpetuity, I would argue that California has already done that, and the only answer is for everyone there who objects to leave and move to some other state.

There are four red states (with left leaning State Supreme Courts) that gerrymandered in favor of Democrats by violating the state constitution of each of those states. All four had their supreme court hire a liberal hack professor from Stanford Univ. to come in and realign.

Only the legislature can set voting boundaries....but the supreme courts did it anyway since they are the ones that decide what is constitutional in their state.

One of these states has has consistently elected republican legislatures for decades. But, not this time...and btw, we're talking about Pennsylvania.

Chaos must transition to order as often as order transitions to chaos because of the principle of space/time symmetry. But that equivalence really only occurs at near maximum entropy and heat death.

However, we are in a transient towards maximum entropy. So all the rules don't necessarily apply. And why the transient? And why is it so asymmetric in regards to time and space? Something must have happened that can't be explained within the rules of the system.

301 The best we can hope from a good Republican Congress would be incredible obstruction and the wrangling of the budgetary process to choke off the administrative state completely. No one thinks that is going to happen. Not here in these comments, at least.
Posted by: TheJamesMadison, fighting the system with Kobayashi at May 20, 2022 01:01 PM (LvTSG)

Voting GOP representatives in is a *Defensive* measure, not an offensive one. The reason I hope John Fetterman (for example) loses is because he will work very hard to make post-birth abortion available an make Democrat controlled mail in balloting mandatory for *all* elections. Someone who just does nothing is FAR preferable to that.

So yes, I strongly support the move to put in power those who will do little with it, because the alternative is those who are going to a whole lot of BAD stuff with it. Bad stuff aimed at YOU.

I do not want a new Congress to do much of anything, other than to obstruct everything Biden wants to do while the Fed Government slips into chaos.

Well the participants in the exercise wouldn't be the villains( hypothetically) here, it'd be the guys who designed the exercise and ran it to see how the participants (representing the decision-making of major countries) would react.

It'd be like getting a group of pilots together and asking them how'd they'd handle various terrorist attack scenarios. Potentially not nefarious, but would be nefarious if the person who organized it was planning to launch such an attack.

The exercise itself doesn't look all that abnormal.

On the one hand, he's stupid enough to think this means he needs to move further left.
OTOH, he'll move further left, and easier to remove.

I don't know. I don't think they're getting a lot of state support. I could see the homeless moving in during colder seasons but it's getting hotter now and everyone is starting their yearly complaints about humidity. There are huge camps around ATL and smaller ones in Savannah. I don't know the cause.

366 It'd be like getting a group of pilots together and asking them how'd they'd handle various terrorist attack scenarios. Potentially not nefarious, but would be nefarious if the person who organized it was planning to launch such an attack.

The exercise itself doesn't look all that abnormal.

Concur. These kinds of exercises are relatively normal. I used to support similar things at the War College from time to time as a way to train senior level players in National Security positions.
If anything, I think the timeline is off.

I would normally 100% agree if one certain worldwide thing didn't recently happen.

368 164 One of the hardest things to do when faced with evil and injustice is to be patient.

372 340 Internal wave counts of the price action on the SPX now indicate an A wave target price somewhere around 3560, possibly as low as 3450.

If it comes quickly it will look and feel like capitulation, which would be a nice precursor to a face ripping B wave rally.

The S&P 500 has been grinding out a bear market correction since last September. Often markets end bearish phases with something a bit more scary, and this is often called capitulation.

Capitulation is when CNBC says the blood is LITERALLY flowing in the streets.

well i guess depends on "always" or "wins".

I mean like at some point, you were incipent -- a wad of goo hurled blindly into a steamy void, until a lucky meeting with a ready egg, organized sufficiently over time to get to the point of you -- thinking that thought and typing it down.

Not to mention the biosphere of earth has maintained a remarkably narrow index of biological order for millions of years, without much help from the supposed premier organizers on earth.

381 "Those who go about slaying monsters should take care to not become monsters themselves." War is ugly and they are at war with us. Until recently many of us are still in denial.

In the 60s left had an argument between it's two main factions. Between the communists who wanted masculine war and domination and the feminine minded socialists who believed they would lose an armed conflict because they lacked the numbers and institutional power. So instead their plan was to embrace cultural subversion, demographic change, welfare dependence, courts and Brainwashing children through media amd education Etc. It would take decades but their gains would be deep and permanent. Their hegemon of control would have synergy between government, corporations, and media.

Still there is alot of room for Geneva convention type options between redcoats lined up for gentlemanly slaughter and Sherman's march to the sea. Gerymandering is legal and inevitable. Reality is If progressives ever start taking hits they change the rules. Just look at free speech. We need to approach them with a realist mindset or we will continue to repeat failures of the past.

383 For years my assumption about Congress is this:

If dems win enough, we will lose our guns. Every Government protest from either side could be another tianamen square.

If GOP gains enough, abortion will be returned to the states.

Regardless DC will continue growing in it's control over our lives and resources. I believe I have been proven accurate thus far.

Posted by: Shiggz (cool ranch MAGA) at May 20, 2022 02:20 PM (0SrVS)

384 I should clarify. If Democrats come for guns, all but some deep red states will capitulate. DC will weaponize every penny of tax dollars they take from the people and give back to states with strings attached. Eventually either war or voluntary/involuntary secession.

Ideally under next GOP president, red states will seceed and reform their own constitutional federation. If you do it under dem president they will Sherman's march our asses before we can prepare to Ukraine their asses.

Posted by: Shiggz (cool ranch MAGA) at May 20, 2022 02:27 PM (0SrVS)

385 Well, now long under-represented NY Republicans have to turn out in Sweet Revenge Level numbers and they will earn a bit of power back in the state.

386 Remember that the reason these districts can be drawn to include certain streets, down to a few houses, is because the democrats and their leftist enablers... especially big tech...know who votes how down to apartment buildings and houses.

The same technology they use to finesse the steal and manipulation of votes.

Targeted fraud.
