Megyn Kelly: I Don't Believe For One Second That Don Lemon Didn't Pay His Accuser to Go Away

Two weeks ago, the man that Don Lemon allegedly assaulted in a grossly sexual way, Dustin Hice, dropped his lawsuit after, supposedly, searching his memory and realizing that he had misremembered everything.


Almost three years after CNN anchor Don Lemon was accused of assaulting a man in a Sag Harbor, NY, bar in 2018, the incendiary lawsuit has ended in a whimper.

"After a lot of inner reflection and a deep dive into my memory, I have come to realize that my recollection of the events that occurred on the night in question when I first met CNN anchor Don Lemon were not what I thought they were when I filed this lawsuit," said Dustin Hice in a full on retreat from his allegations of the assault and subsequent emotional distress against the CNN anchor in court and on conservative media. "As a result, I am dropping the case," the short statement sent out by attorney Robert Barnes for Hice concluded.

Lemon's attorney claims that neither Lemon nor his "representatives" paid him off.

So when I read that my first reaction was: "This is completely bullshit; of course he was paid off, and paid off extra to issue this denial."

But I didn't have proof of that.

Well I still don't have proof of that but Megyn Kelly agrees: This is bullshit. There is no reason to give up the case without some kind of settlement.

There is an unacknowledged payout here. Kelly notes that the lawyer does not deny that Lemon's insurer could have made a payment.

But what would it matter if she were asked about that? She'd lie.

If indeed a plaintiff does change his mind about pursuing a case without getting any payment, he just discontinues the case. No need to offer any excuse. I'm a NYC lawyer myself. Cases are dropped all the time without comment or explanation. The ONLY time the plaintiff ever issues a mea culpa exonerating the defendant, it's because the plaintiff is being paid to do so.

This story involves an accusation of sexual misconduct by a mainstream press talking head, as laundered through another talking head, originating with a lawyer who works for the mainstream press talking head, and potentially involving at least one third party of the type that is notoriously closed-mouthed (insurance).

My guess? Dude wanted a big payout, and didn't get it. So he sued and CNN fought it. Big "talent" at risk, after all. And he certainly knows where CNN's skeletons are.

But now they've been bought. Lemon's gonna go, whether he likes it or not. And the new management wants this scandal gone. I expect they met homeboy's initial demands, and then some. And probably paid Lemon for his silence on this and any number of different peccadillos at the same time.

Just a guess. But if I'm right, I'm glad they're finding out how expensive it'll be to shut down this shitshow in Atlanta.

In this case, audio recordings of him before he was convicted, interspersed with video the events, and interviews with folks who know about what he's talking about.

Starting with about a decade ago, they just upped content creation like crazy because they knew the future was in having an exclusive library. Disney and WB were going to cut them off at some point. That was smart. They were looking ahead a decade to when players like WB and Disney would be able to completely cut them off from their content, and they needed something in the place of that. The content creation was smart.

The heedless way they went about creating content was not.

I bet their decisions on what to cut are determined by an algorithm as much as by executives. I think she's the expensive part, so there's probably an effort to push her out voluntarily, going somewhere else to peddle her garbage.

A problem they're all going to have. Netflix's secret weapon was being first. They got their gigantic catalogue for peanuts and had no competition. But then they got users, so the renewal rates for the content didn't stay peanuts - and others got into the game.

It's a general problem for streaming. To get full coverage, you're paying more than you would for cable. Nobody does that. They have to keep new stuff coming in, but even then they probably can't make *enough* new stuff. The streaming customer is becoming mercenary. Subscribe for 3-6 months, consume what you want 'til you get bored, then drop it and go with someone else for a while. Out of any given three year period, any given service might get six months' worth of subscription fees from the customer. That's where I see it going.

Well, except Disney is weird about its more adult content from Touchstone.

But, still, the three majors (MGM, Paramount, and WB) have been making movies for longer with deeper libraries, so those make sense as well. MGM has been mismanaged for decades, Paramount has no idea what it's doing, but WB seems to have grown through its early day issues to have a pretty settled situation with HBO Max.

Those four could conceivably compete on similar ground for a while.

Couple of days ago I was looking for a movie to watch on amazon Prime... and suddenly there were LOT of Disney movies available in the Bargain Bin ($10 or less to buy). Things that had been reserved for the Disney stream.

I think they've got problems, and are trying to shore up their bottom line to combat a Stockholder revolt.

189 It's a general problem for streaming. To get full coverage, you're paying more than you would for cable. Nobody does that. They have to keep new stuff coming in, but even then they probably can't make *enough* new stuff. The streaming customer is becoming mercenary. Subscribe for 3-6 months, consume what you want 'til you get bored, then drop it and go with someone else for a while. Out of any given three year period, any given service might get six months' worth of subscription fees from the customer. That's where I see it going.

I think we'll eventually see the studios and content creators going back to selling their content through streaming services like NF. There's just too many individual streaming services tied to a specific studio (HBO, Paramount, Disney, etc), plus other like NF and Amazon, for them all to survive. Plus, they're all spending bazillions for mediocre-to-shitty original content. That can't go on forever. I expect it will all go back to the original NF model. But we shall see.

I think that their search quality is shit because of the manipulation. In non-manipulated areas - purely technical searching, for example, which I do a lot of - it is still top dog in my experience. In everything else, it's increasingly shit because they're playing games with results - false amplification, false suppression, etc. It's increasingly poor at non-technical searches and is worse than useless for anything involving contemporary affairs.

Qwant (a Euroland search engine) does a far better job for general-purpose search, as does Bing and as do several others. Google's censorship and manipulation has ruined its search engine.

Their idea was "content". It was their driving force. Just get stuff on the service, and people will stick around to check it out.

But when everything is the same kind of dreck (minus a couple of small exceptions every once in a long while), it just becomes noise. Sure, Netflix can spend big guy money on a Will Smith vehicle like Bright, but when it sucks and no one watches it after the first week, the financials get...squiffy.

Apple's streaming service is apparently just a giant money hole (they're producing both Ridley Scott's Napoleon epic and Martin Scorsese's next expensive film amongst many other things), and they're fine with it because they want that library.

I would like to say brave search is better but it's often not. My primary use case for search is looking up all the things people say here that I've never heard of or trying to solve technical problems. It often fails in both the cultural stuff and the technical stuff. I really hope they can get better. They're newcomers so maybe it just takes time.

But NF doesn't carry the 4K versions of the discs. That's becoming a problem, because most of the new "regular" blu-ray discs don't have an atmos track. I have a 9.1.4 home theater, so I want the atmos track. The fuckers are making you buy the 4K version to get the atmos. That is pissing me off and reducing the value of NF to me.

Didn't they stop giving the smallpox vaccine as a required shot some time ago? We would now have a generation or two of people who aren't vaccinated. I remember in Gulf War Redux, husband had to get smallpox vaccine again, along with a bunch of other stuff, but it was only for people in theater. I don't think my kids have had the smallpox vaccine because it was "eradicated" in the 60's.

The quality of the atmos mixes varies, but on a well mixed track the sound envelope is amazing. It's literally like you're right there in the movie. And with 9.1.4 there's so many speakers you don't hear the sound coming from this or that speaker, like you do with 5.1. The sound seems to be coming from everywhere -- just like you were actually there. Once you experience that, it's hard to give it up, although the receiver does a good job of taking non-atmos tracks and extrapolating the height speakers.

Active bias is when you pay your employees to promote certain things and hide other things directly in your results. The passive comes in when one side writes most of the words and does so in a coordinated repetitive manner.

A search engine will always trend towards an association of terms with those ideas that are most commonly presented under the belief that commonality correlates with consensus. The only solution to this is to actively look for opposing views and track their click-throughs. But it is tough.

And with 9.1.4 there's so many speakers you don't hear the sound coming from this or that speaker, like you do with 5.1. The sound seems to be coming from everywhere -- just like you were actually there. Once you experience that, it's hard to give it up, although the receiver does a good job of taking non-atmos tracks and extrapolating the height speakers.

I barely notice my own little 5.1 system, to be honest. Hell, most of what I watch is in mono anyway, but when I do do surround, my attention ends up so forward focused that the surround barely gets noticed.

I just like to poke fun at Atmos lovers. I have nothing against it. It's just a bit of fun.

Yep, that's when my husband had his smallpox, cholera, yellow fever, etc. We had to get cholera and yellow fever before going overseas when I first joined up, but I don't know that that's the case now. Both made me sick, but not nearly as sick as the stupid shingles vaccine.

Atmos is the latest surround-sound format by Dolby. DTS has DTS:X or something similar. They are both object-oriented formats, meaning that they can handle almost any speaker configuration and any amount of speakers. They also both added support for "height" speakers. Those are speakers mounted on your ceiling. Or, if you can't or won't do that, there are speakers that fire at the ceiling and reflect the sound back down. The "9.1.4" I mentioned means I have 14 speakers in total: 9 surrounding me at ear-level, a sub, and 4 mounted on the ceiling.

4k is nice if you a good enough and big enough set to take advantage of it. I do now - I got it about a year ago - and it does kick ass. Most of I watch is still plain old HD, though. On the plus side, upscaling from 1080p to 4k is pretty easy (one of the reasons why 4k became the standard rather than 2k - it's a clean double in each dimension, which is easy to do) and both my streaming box and my Blu-Ray player have very solid upconversion.

Live Baby Live by INXS has an Atmos track. I'm not sure it's better than the 5.1 track, just different. The music is still forward, mostly, with the height filled by crowd noise.

I suspect the market remains fractured and customers drift between the options, making the total addressable market smaller unless one of them has a mega-hit like Netflix got with Tiger King and Disney+ got with the Mandalorian, that will convince people to add it to their streaming portfolio for a while.

Agreed, although I wonder how many of these supposed big hits are actually big hits. Very few if any of the companies clearly disclose the number of viewers for their shows. You only hear -- and usually through paid promoters or influencers -- how this or that show is such a big huge hit. But without an actual box office or accurate viewership numbers, it's impossible to verify and that makes me skeptical. And none of these leftwing companies would ever lie about the popularity of their content, would they?

If one was to subscribe to all the major services, the cost becomes stupidly expensive. There is either going to be a consolidation of services, a few more CNN+ outcomes, or a collapse in subscription fees. Roku is most interesting because they have the largest user count on their platform and are rapidly building up their media content. Their Roku channel could be that agnostic place for a low cost consolidation. One thing for sure is cable is toast.
