Last week, on Friday, a Hawaiian judge in Virginia ruled that Governor Youngkin's executive order to reverse Governor Blackface's executive order and end mask mandates did not actually have the power to make masking optional. The Democrat blackface-wearing governor had the power to impose mask mandates on the schools, but the Republican governor did not have the power to say that mask mandates were optional. The Hawaiian judge ruled that local schools could still impose mandatory masking, which again, is strange, because previously, the Democrat governor's executive order was enough to take local schools' decision-making power away from them as regards masks. I didn't mention this because it was late in the day and I hate bad news late on Friday. I hoped this obviously-lawless order would be reversed. But, better than that -- the Virginia Senate, controlled by the Democrats by a single vote, has decided to explicitly make it the L A W that masking in schools is optional. All but nine Democrats -- who can see which way the wind i blowing -- joined a unanimous bloc of Republicans to pass the law. I would say "I'd like to see a Hawaiian judge now rule that the law cannot trump a liberal school principle's decision," but you well know, they will do that. But hopefully the overrule will come quickly.I'm not sure when this law -- this amendment to a current law, actually -- goes into effect. New laws usually go into effect July 1. However, as this is an amendment to a law already in effect, one Tweeter says it should go into effect immediately upon the governor's signature. (And it will pass the Virginia House, easily -- Republicans control that.) What comes next, the walk-out by teachers? Hopefully. And then, I pray -- the mass firing ordered by Youngkin. Can he do that? I dunno, I'm riffing. He can definitely cut off state funds to any school that refuses to fire striking teachers. It should also be noted that the amendment specifies that students will be offered "in-person" instruction for all their classes. No more "remote learning" bullshit -- by law. There is a mention of some specified exceptions, but I imagine those are limited. And not just "whenever the teachers want to show who runs Bartertown." I work at a public school. We've never ever had a mask mandate and we have been in person since August 2020.
Not a single teacher or student has died although many have had COVID. Especially since the boosters came out. We've had more people sick since the boosters started then we had the whole rest of the pandemic. I can hardly believe what is going on in other states. --- It depends on what the state constitution says. In Michigan, a bill has to have "immediate effect" to come into effect upon being signed. This requires a super-majority. Sometimes this is done by voice vote. It looks like the VA senate provided a big enough majority for immediate effect (assuming that applies). You are right that most laws take effect on 1 July of the year they are enacted. Some laws can be written to take effect on a different date but I do not see any wording in SB739 that states a different date.
It is interesting as many emergency "mandates" were getting lifted already. A few counties decided to push this masking issue even though it is clearly wildly unpopular and the emergency orders were expiring. I believe Chap has kids in Fairfax County schools and he went to Fairfax County schools. When he sent his letter on the 4th, after warning them once and getting a double down, I expect he thought they'd give in. They didn't, so he used the power he had to fix it. That's what you want your reps to do, so even if he's a Dem, I am thankful Fairfax managed to elect a practical one (or one with kids who probably HATED the policy).

This weekend I had to drive down to New Orleans for a business event and stayed over with my daughter so we could explore the French Quarter early on Sunday. ( Local friends explained that the French Quarter is fun to see in the daytime, but a NO GO zone at night...)
New Orleans is under strict mask AND Vaccine Passport rules. Between 25- 40 percent of restaurants are closed for good. The restaurants that actually survived the past two years are now asking for papers. No restaurant was full for Sunday brunch and the few I attempted to enter got a lecture from me about the Constitution, fascism, and the ridiculousness of their demands. Even the Jazz Museum is part of this circus. We drove a few minutes from the French Quarter over the county line to Metairie where they have NO mandates AT ALL. The restaurant owners there are doing so well that they want to thank the mayor of New Orleans for sending all the tourists to their places! I remember when our local Board of Health passed a 'ruling' that not wearing a mask would be subject to fine.
Our local sheriff issued a statement the next day saying they would not enforce any Board of Health violations or fines because they questioned the constitutionality of them. Spending is what holds the disparate parts of the Dem coalition together and spending and promising more spending is the glue that keeps them together. It is the independents that are the worry. FYI -- when laws go into effect.
The state legislature can put it into any bill (one that amends an existing law or one that creates a brand new one) that it goes into effect upon signature of the governor. If that language isn't in there, it goes into effect the date the state law declares it does (i.e., there is already a statute in existence in the VA code that determines what date a law goes into effect after enactment). Guy they had assigned was never showing up but he kept claiming he was there and getting his overtime for it. The town finally figured it out because of the declining revenue from traffic tickets. Cop got to retire and kept his pension. Town did eventually get the $50k back from the state for the time we paid him not to be there. I've no use for any of them. I'm in a state that has no mask mandate and there are still some people who are wearing them. Young and old. I try to stay away from them, mostly because the covidians are quite fragile and I don't know when they'll just completely crack up.
