Texas Federal Judge Blocks Enforcement of Wrong-Way Brandon's Mandate for Federal Employees
Previously his OSHA mandate was struck down by the Supreme Court.
His mandate on federal contractors has been enjoined by an appeals court since December 7th. That will be reviewed by the Sixth Circuit, I think, and ultimately by the Supreme Court. He did prevail, at least for now, as far as mandating that nurses and other workers in facilities taking money from Medicare and Medicaid must be vaccinated. Now a Texas district federal court judge enjoins enforcement on his declaration that all federal employees -- not contractors, but actual government workers -- must be vaccinated.Judge Jeffrey Brown, who was appointed by former President Trump, wrote that the order exceeded the president's authority. The case is about "whether the President can, with the stroke of a pen and without the input of Congress, require millions of federal employees to undergo a medical procedure as a condition of their employment," Brown wrote.Yes, but your employer does not have the right of Medical Prima Nochtae over you, which leftwing professors would grasp if a conservative president mandated, say, that all female government workers not get abortions or whatever. And the president's power to order about the bureaucracy is limited by the powers actually given to him by Congress. And Congress has not given him this power. I saw a commentator, I forget who, maybe Brit Hume, maybe Jonathan Turley, note that Presidents and their attorneys are usually mindful not just about the personal price of losing on their claims of presidential power, but about the historic price of losing on claims of presidential power for all future presidents. And so that most presidents do not roll the dice and say "YOLO" on very dubious, weak claims of power, knowing that in all likelihood the courts will say "No" and put up a firm limit on presidential power. Brandon doesn't roll that way, obviously. His presidency is not just disastrous for the nation's current citizenry, but for all future occupants of the White House. This small, nasty, weak little man is enfeebling the office of the presidency for all future presidents out of pique and senility-caused anger. I mean, this, for example, is just stupid:

Maybe...this is a good thing?
The presidency is FAR too powerful now. The imperial presidency is a concept not by accident.
I was kind of hoping that part of the establishment hating Trump would be a curtailing of the administrative powers of the executive branch, but pretty much everyone below the president was on the same side as the establishment. The fight became to hobble Trump, not his administration. I wanted Congress to reassert its power to exclusively make law, but they never did.
Maybe this is another form of what I wanted.

The SCOTUS opinion on the medical employees mandate is a mess. They couldn't find an express grant of authority for Congress for this either, but instead pointed to the multitude of other rules passed by CMS (what the dissent referred to as a "hodgepodge") to infer that CMS would have the authority to require vaccinations as well.

The deadlines have passed, but no decisions on exemptions have been made. Paperwork aplenty, but I haven't heard of a fedgov employee being denied or issued an exemption or losing their job. So it is not too late. Late, but not too late for at least some.

That's the thing people have to keep in mind on some of this stuff. Just because the injunction wasn't granted, that doesn't mean it will ultimately be upheld and in some ways, that will be worse for the administration since when the case *is* adjudicated, even more data will be out showing how screwed up the whole process was.

So, this will probably turn on whether fed employment every previously required vaccinations. Sorry, soldiers/sailors and probably VA hospital staff(?) and I don't know for sure about run-o-the-mill bureaucrats, but I'd guess they'll be ok since they don't usually check vaccination status for office jobs.

I think that the Constitutional Republic is pretty well dead, what we see right now is some faint twitchings in the form of there being a vague set of roles and offices that through custom shadow some of the concepts laid out in the Constitution.
In short, there won't be a formal Presidency much longer. Obama proved that you don't even have to be a natural born citizen, Biden proved that you don't even have to be elected. Trump proved that no one in the Regulatory Branch (now a Real Thing) has to follow any executive order with fear of consequences. Even the military can ignore the Commander in Chief and interact more openly with our Enemies' leadership.
The State Department proved that foreign policy is really held by the sinecures and career bureaucrats. So there really is no functioning role. The President is more like UK's Royalty now.

I'm considering buying a 25 volume set of Zane Grey novels. And I have a library full to overflowing with books already, half of which are in a 'to be read' state.
Do I buy the books because they'd be awesome to have and read someday?
Or do I face reality and get to work on the books I already have to read?
Obviously this does not apply to the stack of 25 John D. MacDonald novels I'm also buying.

I think that courts should be careful about this.
If this were ebola or some ghastly thing with a huge death rate, and if there were an actual VACCINE that granted virtual immunity to the disease; okay I can buy requiring people to get a shot in certain areas directly controlled by the federal government.
The problem is that the state cannot demonstrate a great enough need and an effective enough treatment. There's neither the emergency required, nor the solution valid enough to require it.

THat is a good question. I did buy a lot of Louis L'Amour books for just that reason (Also because they're vivid, even if the endings are sorta random). I've only read a few Zane Grey novels though, so this would maybe be a way to really get immersed in his stuff.

I think the key to their thinking is in the word "own". As in who owns you? Clearly the Establishment sees castes of chattel - such as employees - and castes of free people (illegal aliens).
The question quite frankly comes down to: Does your employer enjoy the "right" to jam anything they want into your body, as much as they want, for as long as they want and not be responsible for any consequences? What specifically are those conditions where an employee is considered chattel?
Is this in any way compatible with We The People and Consent of the Governed?

I'm going through 80s movies and while people at the time were saying it wasn't as good as Old Hollywood, you had so much on-screen emerging talent back then.
Oddly, they're still leading men even though they're getting decrepit. How old is Mel Gibson? All the young heartthrobs are now collecting Social Security.
No one replaced them, so yeah, Tom Hanks and the rest of the Boomer crew are really going to relate to the new generation.

It is in my #1 spot of all time. I know there are better made movies out there. More artistic. yadda yadda. It is hands down my favorite though. It was a creature of its time and I don't think it can connect as well with people that didn't have their teens in the 80s. But I think most will still agree that it's pretty good.

Launch of a Wooden Satellite Still Pending
The satellite's development team, comprised of Kyoto University and Sumitomo Forestry Company, said it's aiming to harness the environmental friendliness and the economy of wood in spacecraft development. They say a satellite with a wooden exterior would burn up upon re-entering Earth's atmosphere at the end of its mission, lessening its burden on the environment. The wooden framework also will permit the satellite's antennas to be inside the spacecraft. A plan is under way to use an experimental apparatus on the International Space Station to hold wooden sheets of varying hardness, taken from several tree species, attached. These would remain exposed to the space environment for about 9 months to determine their deterioration.

Usually granting a portion of a challenged executive order to proceed until the case is heard means that the executive order will succeed. But now that a Texas federal Judge has come out and definitively said that federal workers (and by default - those who receive federal tax dollars) aren't required to comply - this ruling hamstrings idiots like Kavanaugh immensely. He has to say how a lower Federal court got it wrong, specifically on the merits. I don't think he has the brain power and just punts.

It's french, dubbed. But it is another light-hearted comedy action thriller and I enjoyed it. I think the main spy and Jack Burton would have gotten together pretty well.

The real-world effectiveness of all available Covid-19 vaccines combined was as low as minus-47% in the 60-69 age group, and as high as +66% in the under 18 age group between August 16th and September 12th 2021. The only other age groups that the vaccine was showing to have positive effect at this point were 18-29, 30-39, and 80+. But as you can clearly see none of the age groups were showing a vaccine effectiveness anywhere near 95%.

That was my problem with it. I knew too many kids like the ones in that movie. Felt like 'laughing at' and not 'laughing with'. Killer dance movies at the end though, props for that.

Well, studies have shown that children born to unwed mothers have bad effects for the babies, the mothers, and society, so perhaps when girls hit puberty they should be put on Norplant until they're married. For everyone's safety. It's very easy to track too.
Bonus: This has actually been tried, and vigorously opposed by reproductive rights groups because it infringes on bodily freedom or whatever.

They say that William Hurt was one of the few cast/crew members of Midnight Rider to make it all the way off the bridge before the train barreled into their impromptu movie set. I bet he showed a range of emotion when he heard that train whistle!

Isaac Kappy claimed he had evidence against hanks, and then decided to throw himself off of a freeway overpass, and doing something funky like putting his belt on backwards before doing it.
Hanks has this weird penchant for photographing children's shoes, socks and gloves out in remote locations, often with cryptic writing nearby. A day or two before Kappy killed himself, Hanks took a picture of a medical glove at or near the very overpass Kappy launched himself off of on route 66, with a pretty creepy and prescient text. He's never bothered to remove it.
